Introduction and Prospects of UNCITRAL Expedited Arbitration (UNCITRAL 신속 중재의 도입과 전망)

  • The modern arbitration practice recognises the need for a faster and simplified procedural framework for international disputes with fairly low amounts at stake. This has driven several institutions to expand their offer of procedural guidelines with a simplified set of rules that would fit this purpose. Expedited arbitration is increasingly used by parties and is growing in popularity. The basic idea behind establishing expedited arbitration rules is to create the possibility for the parties to a dispute to agree on a simplified and streamlined procedure and to have an arbitration award issued within a short period. The associated cost savings for the parties is another benefit. The importance of developing rules for expedited dispute resolution has recently also been considered by the UNCITRAL Working Group II, in light of the "increasing demand to resolve simple, low-value cases by arbitration" and "the lack of international mechanisms cope with such disputes." As a result, the UNCITRAL 2021 Expedited Arbitration Rules (UNCITRAL EAR) took effect on September 19, 2021. The EAR was adopted by the Commission on 21 July 2021 and, next to UNCITRAL's well-known instruments like the Arbitration Rules (UAR) and the Model Law, represent another chapter in the Commission's impactful work in the field of international arbitration. Overall, the UNCITRAL EAR has great potential to meet the need for more flexible and efficient arbitration proceedings, primarily because they provide the tribunal with strong managerial powers while still leaving room for consultation with the parties. However, parties must remember that not all disputes may be suitable for expedited arbitration, and disputes that are complex or have the possibility of being joint or consolidated may not benefit from simplified procedures and tight deadlines. This article will outline the core features and characteristics of the UNCITRAL EAR.

Association Between Insomnia and Constipation: A Multicenter Three-year Cross-sectional Study Using Shift Workers' Health Check-up Data

  • Background: Although insomnia and constipation are highly prevalent worldwide, studies examining a possible association between them are lacking. We examined the relationship between insomnia and constipation in shift workers who have a high prevalence of insomnia and other diseases. Methods: This study had a multicenter cross-sectional design and conducted using health examination data including self-reported questionnaires. In total, 12,879 and 4,650 shift workers were enrolled in Severance Hospital and Wonju Severance Hospital, respectively, during 2015-2017. Multivariate logistic regression models and subgroup analysis were performed in each center with the same protocol, using a common data model. Results: The mean age of the total population was 44.35 (standard deviation = 8.75); the proportion of males was 56.9%. Female sex, being underweight and non-smoker were strongly associated with an increased risk of constipation symptom (p < 0.001). Pooled odds ratios (ORs) were calculated using ORs of both centers with weights; there was a significant dose-response relationship (sub-threshold 1.76 [95% confidence interval [CI] 1.62-1.91]; moderate 2.28 [95% CI 2.01-2.60]; severe 4.15 [95% CI 3.18-5.41] in the final model, p for trend < 0.001). Subgroup analysis performed by stratifying sex and pooled ORs showed a similar trend to that of the entire group. Conclusion: We observed a strong correlation between insomnia and constipation in this population. Our findings may help in formulating guidelines and policies to improve quality of life in shift workers through the management of sleep quality and proper bowel function. This study is the first to report this relationship among people working in shifts.

Documentation Strategy of Missing Archives in BUMA Democratic Uprising : Focusing on MASAN Uprising (부마민주항쟁 결락기록의 도큐멘테이션 전략 마산항쟁을 중심으로)

  • This study reviewed the archival collecting methodology so that the documentation method such as collecting about missing archives in BUMA Democratic uprising is prepared for and it progressed the pre-analysis by applying to working models of 'documentation strategy' that Larry Hackman and Joan Warnow-Blewett suggested. First of all, I generally examined BUMA Democratic Uprising and narrowed the scope into MASAN Uprising in order to deduce the effective documentation method, performing the pre-analysis centering on MASAN Uprising. In succession, by analyzing the type and activity of an action group of MASAN Uprising, I organized the area of MASAN Uprising documentation. Finally, by selecting some action groups of MASAN Uprising, I investigated archives in person. Based on this, I suggested the investigation and analysis of the present-condition of missing archives, the preparation for collecting policies, active collecting, the establishment of management policy of collecting archives and the detailed management strategy about integrated management.

Sustainability Criteria Identified in the Global Sourcing Practices of Global Fashion Retailers (글로벌 패션 기업의 해외 소싱 프로세스에서 나타난 지속 가능성 기준)

  • This study sought to examine the sustainability criteria found in the global sourcing practices of global fashion retailers. Sustainable supply chain management, with a particular focus on the sustainability criteria of global sourcing, was analyzed. This qualitative study was based on a focus group interview and corporate social responsibility (CSR) annual reports. Eight master categories, 18 middle categories, and 37 bottom categories were extracted. The key categories and their middle categories were as follows: (1) Social compliance (working conditions, employment, safety); (2) Environment concerns (environmental pollution management, eco-friendly production, supply chain environment); (3) Energy efficiency (energy saving program, store environment); (4) Consumer protection (restricted substances management, consumer product safety improvement); (5) Management system (code of conduct, triangle audit system); (6) Community social activities (local community service, voluntary activities, charitable activities); (7) External stakeholder engagement (media & non-governmental organization management, maintenance of relationship with local authority); (8) Brand protection (respect for companies' intellectual property). The findings of this study offer academically significant insights into the sustainability criteria that can be encountered by companies under diverse global sourcing scenarios, revealing that global sourcing by fashion retailers is not merely a means of reducing costs, but a way of generating new jobs and making a social contribution to developing countries. The study's findings also have practical significance, offering guidelines for general CSR activities in the global sourcing process.

Assessment of MJO Simulation with Global Coupled Model 2 and 3.1 (Global Coupled 모델 2와 3.1의 MJO 모의성능 평가)

  • A large number of MJO skill metrics and process-oriented MJO simulation metrics have been developed by previous studies including the MJO Working Group and Task Force. To assess models' successes and shortcomings in the MJO simulation, a standardized set of diagnostics with the additional set of dynamics-oriented diagnostics are applied. The Global Coupled (GC) model developed for the operation of the climate prediction system is used with the comparison between the GC2 and GC3.1. Two GC models successfully capture three-dimensional dynamic and thermodynamic structure as well as coherent eastward propagation from the reference regions of the Indian Ocean and the western Pacific. The low-level moisture convergence (LLMC) ahead of the MJO deep convection, the low-level westerly and easterly associated with the coupled Rossby-Kelvin wave and the upper-level divergence are simulated successfully. The GC3.1 model simulates a better three-dimensional structure of MJO and thus reproduces more realistic eastward propagation. In GC2, the MJO convection following the LLMC near and east of the Maritime Continent is much weaker than observation and has an asymmetric distribution of both low and upper-level circulation anomalies. The common shortcomings of GC2 and GC3.1 are revealed in the shorter MJO periods and relatively weak LLMC as well as convective activity over the western Indian Ocean.

  • To identify the influence of senior sports instructor's positive psychological capital on organizational performance, job engagement, and innovative behavior, this study conducted a research on 227 senior sports instructors at 5 sports centers and senior sports centers in Seoul, Gyeonggi-do, and Incheon regions. The research results were as follows. First, positive psychological capital of senior sports instructors had a significant influence on all sub-factors of organizational performance. Secondly, positive psychological capital of senior sports instructors had a significant influence on all sub-factors of job engagement. Third, positive psychological capital of senior sports instructors had a significant influence on innovative behavior. Thus, this study verified that positive psychological capital is an important variable for enhancing organization performance, job engagement, and innovative behavior of group members. In addition, this study holds a great significance in proving positive psychological capital's positive influence on working environment of senior sports instructors.

Survey on Analysis and Improvement of the Stress Status of Customer-facing Workers in the Corporation (공단 고객 응대 근로자의 스트레스 현황과 개선을 위한 인식도 조사)

  • Today's customer service providers, who have the greatest impact on customer satisfaction, are experiencing severe stress and job burnout due to various causes. Unlike general companies, the corporation has a relatively high level of dissatisfaction with customer service since there is a large conflict between the provision of kindness and the reasonable handling of civil complaints according to laws and regulations. In order to analyze the environment of the NPS' customer service providers, 5.583 branch employees working at the National Pension Service and 407 call center employees were surveyed online using the questionnaire function of the Enterprise resource planning system. The contents of the survey consisted of a survey on customer-facing employees, the level of awareness of customer-facing workers protection measures, and opinions on improvement and supplementation related to customer-facing workers protection measures. As a result of the survey, 72.8% of the total respondents experienced grievance complaints, and the proportion of call center employees was even higher at 89.0%. In addition, both the branch and the call center had the largest share of complaints about obstruction of business, unreasonable demands, abusive language, and verbal abuse. More than 40% of call center employees in their 20s and 30s experienced the highest frequency of complaints 13 or more times a year. The most difficult thing in the process of responding to complaints was that both branch offices and call centers had insufficient psychological recovery time, lack of space, and lack of help from colleagues and superiors. Based on the survey analysis, it is suggested to establish a countermeasure through case analysis rather than the right to suspend work for civil complaints that cannot be handled, such as customized manuals and action strategies for the age group with high grievance complaints.

The Awareness and Demand of Teacher-Librarian for the Composition of E-book Collection: Based on Analysis of the E-books Provided by Busan Digital Library System (전자책 장서 구성에 대한 사서교사의 인식과 요구 - 부산 독서교육종합시스템 전자책 분석을 중심으로 -)

  • The purpose of this study is to identify the problems of the e-book composition provided by the Comprehensive Reading Education Support System and to propose a service improvement plan related to the establishment of e-books in school libraries as educational resources based on practical issues and perceptions experienced by teacher-librarians. As a research method, the composition of the collection of 3,002 e-books supported by the Busan Comprehensive Reading Education Support System as a reading education platform of the school library was analyzed based on the Korean Decimal Classification. Based on this, two focus group interviews (FGI) were conducted with 4 elementary teacher-librarians and 5 secondary teacher-librarians working in Busan. The result of this study can be used as basic data to support students' reading activities using e-books as educational resources and to form an efficient e-book collection in school library.

A Critical Review of 'Reconsideration about Nomenclature of Herbs Listed in the Korean Pharmacopoeia' ('대한민국약전에 수재된 식물성 한약재의 학명에 대한 재고' 의 논평)

  • Objectives : 'Reconsideration about Nomenclature of Herbs Listed in the Korean Pharmacopoeia' was published by Doh and Lee with absolute misconception of nomenclature. A critical review of Doh and Lee's paper is given, to correct the confused the concept of nomenclature and to provide proper scientific name for taxa which are discussed. Methods : This paper discusses the proper usage, as mandated by the International Code of Nomenclature. Adherence to the rules described in this paper should reduce the present confusion in the nomenclature of scientific names listed in the Korean Pharmacopoeia. Results : Although Doh and Lee proposed four categories to correct the scientific names of the Korean Pharmacopoeia using available botanical databases, they failed to show how nomenclatural concepts are applicable due to misconception of legitimacy and the confusion about synonym. From a nomenclatural perspective, 'accepted name' or 'recommended name' is a subjective term which used to be employed for convenience in a certain databases or working group without nomenclatural meaning. Doh and Lee also pointed out the standardization of author citation. However, they missed the importance of author citation error such as basionym or validating authors. Conclusions : Doh and Lee were not able to solve nomenclatural problems of the Korea Pharmacopoeia due to lack of clarity on the nomenclature code. We strongly recommend that KFDA has to commence extensive nomenclatural review for the next revision of Korea Pharmacopoeia.

Barriers to the practice of fall prevention by nurses and nurse assistants at geriatric hospitals (요양병원 간호사 및 간호조무사의 낙상예방활동 실천의 방해요인)

  • Older adults are at a high risk of falling, causing severe injuries and increased hospital stays and treatment costs. This can be a burden not only on the family but also on the national economy. Thus, fall prevention is very important in nurses' and nursing assistants' work. This study intended to grasp the real situation faced by nurses and nursing-assistants working at geriatric hospitals in J province, Korea. The researcher interviewed thirty-six nurses and nursing-assistants in four geriatric hospitals and performed four focus group interviews. Data were analyzed through an inductive content analysis based on Elo & Kyngäs's approach. Three categories and five subcategories were identified. Categories were patients, environmental, and personal factors. Patient factors included patients' impaired cognitive function. Environmental factors included lack of personnel support and assignment of inpatients without regard to fall risk. Personal factors included hopelessness regarding improvement and fear of being blamed. Promotion of fall prevention practice needs a gradual increase in nursing staff at geriatric hospitals, a system for assigning hospital room according to fall risk, and education and support system to reduce nursing burden.
