의사의 설명의무는 의사가 환자에게 이미 시행한 의료행위, 시행 중인 의료행위 및 장래에 시행할 의료행위와 환자의 요양상 수칙에 관하여 적극적 체계적으로 진술함으로써 환자가 그 내용을 인식하게 할 법적 의무를 총칭한다. 이 의무는 환자의 알 권리에 대응하는 보고성 설명의무, 환자의 동의권 거절권에 대응하는 기여성 설명의무, 요양지도성 설명의무로 나뉜다. 설명의무를 분류하는 것은 각각의 기능과 법적 성질이 다르고, 법적 성질이 다름에 따라 그 위반 시의 효과, 특히 손해배상책임의 대상과 범위가 달라지기 때문이다. 이 주제에 관하여 우리나라에서는 지난 40년 가까운 기간 동안 많은 이론의 발전이 있었고, 그를 토대로 대법원 판결의 논리도 상당히 정치하게 전개되어 왔다. 그러나 여전히 학계와 실무계 일각에서는 용어와 개념의 혼동, 학설과 판례 논리에 대한 이해 부족을 목격하게 되고, 심지어 대법원 판결문 내의 전후 문맥에서 그리고 관련 있는 복수의 판례 사이에서 논리와 이론의 불일치를 발견하게 되는 것이 사실이다(이것은 합리적 근거와 설득력을 지닌 견해의 분립을 지적하는 것이 아니다). 위와 같은 견해와 문제의식을 기초로 해서, 의사가 부담하는 설명의무의 기능별 분류와 법적 성질 및 그 위반 시의 효과를 우리나라 학설과 판례를 중심으로 분석 정리한다.

In this paper, novel analog duty cycle corrector (DCC) with a digital duty error detector is proposed. The digital duty error detector measures the duty error of the clock and converts it into a digital code. This digital code is then used to accurately correct the duty ratio by adaptively steering the charge-pump current. The proposed duty cycle corrector was implemented using an 80nm DRAM process with 1.8V supply voltage. The simulation result shows that the proposed duty cycle corrector improves the settling time up to $70{\sim}80%$ at 500MHz clock frequency for the same duty correction accuracy as the conventional analog DCC.

무선 센서 네트워크의 센서 노드는 내부 전원을 사용함으로 인해 수명이 제한적이다. 기존의 여러 MAC 프로토콜은 무선 센서 네트워크에서 에너지 절약을 위해 sleep/listen cycle을 스케쥴링한다. 또한, MAC프로토콜의 duty-cycle은 사용자의 조정에 의해 낮은 duty cycle로 변화할 수 있으며, 이는 프레임에서 sleep 시간을 결정하게 된다. 이러한 duty cycle의 크기는 MAC 프로토콜의 성능에 직접적인 영향을 미친다. 본 논문에서는 NS-2 환경에서 서로 다른 duty cycle을 갖는 TEEM과 SMAC을 시뮬레이션하고 두 개의 프로토콜의 에너지 소비와 성능 측면에서 duty cycle을 분석한다.

본 논문에서는 duty cycle-corrected analog synchronous mirror delay(DCC-ASMD)라고 불리는 새로운 구조의 내부 클럭 생성기를 제안한다. 제안된 회로는 임의의 duty ratio를 가진 외부 클럭에 대하여 duty ratio가 $50\%$로 보정된 내부 클럭을 2클럭 주기 만에 생성할 수 있다. 그러므로, 본 내부 클럭 생성기는 double data-rate (DDR) synchronous DRAM (SDRAM)과 같은 듀얼 에지 동기형 시스템(dual edge-triggered system)에 효율적으로 이용될 수 있다. 제안된 기술의 타당성을 평가하기 위하여, $0.35\mu$m CMOS 공정기술을 이용하여 제안된 내부 클럭 생성기를 구현하여 모사실험을 실행하였다. 실험 결과, 제안된 내부 클럭 생성기는, $40\~60$의 duty ratio를 갖는 외부 클럭 신호에 대하여, 50$\%$ duty ratio를 갖는 내부 클럭 신호를 2 클럭 주기 만에 발생시킬 수 있음을 확인하였다.

본 연구는 NCS '문헌정보관리' 직무 구성요소인 능력단위 및 능력단위요소의 중요도 및 활용도를 평가하고 분석함으로써, NCS '문헌정보관리' 직무를 도서관 실무에 적용했을 때 현장 사서들이 실질적으로 중요하게 생각하고 우선적으로 요구하는 구성요소들을 도출하고자 수행되었다. 첫째, NCS '문헌정보관리' 직무의 구성요소(능력단위)에 대한 중요도 및 활용도를 평가한 결과, '이용자 정보서비스', '독서문화 프로그램 운영' 능력단위는 중요도와 활용도가 동시에 높게 나타났고, '문헌정보 실무 연구수행', '문헌정보 큐레이션', '문헌정보시스템 운영' 능력단위는 중요도와 활용도가 낮게 나타났다. 둘째, 직무 구성요소(능력단위)에 대한 Borich 요구도 분석 결과, '독서문화 프로그램 운영', '이용자 정보서비스', '문헌정보수집' 순으로 높게 나타났고, '문헌정보 큐레이션', '문헌정보시스템 운영', '문헌정보 실무 연구수행' 구성요소는 바람직한 수준과 현재 수준이 공통적으로 낮게 나타나고 있어 요구도가 낮은 것으로 파악되었다. 셋째, The Locus for Focus 모델을 활용한 직무 구성요소(능력단위)의 우선순위 분석결과, '독서문화 프로그램 운영', '이용자 정보서비스', '문헌정보수집', '문헌정보 서비스 마케팅', '문헌정보 보존', '문헌정보 이용분석'의 6개 능력단위가 최우선순위 구성요소로 도출되었다.

The purpose of this article is (1) to measure the attitudes of health care consumers towards medical service, the physicians' duty to provide information and patient self-determination options, (2) to discover the their related variables. The attitude of health care consumers towards medical service reveals statistically significant corelation with age and education. Among the statistically significant independent variables it is significantly related with age in the multiple regression analysis. The attitude of health care consumers towards the physicians' duty to provide information reveals statistically significant corelation with age, education and the attitude of health care consumers towards medical service. Among these independent variables it is significantly related with the attitude of health care consumers towards medical service in the multiple regression analysis. The attitude of health care consumers towards patients' self-determination options reveals statistically significant corelation with age, the attitude of health care consumers towards medical service and the attitude of health care consumers towards the physicians' duty to provide information. Among these independent variables it is significantly related with the attitude of health care consumers towards the physicians' duty to provide information in the multiple regression analysis.

Wireless sensor networks for forest monitoring are typically deployed in fields in which manual intervention cannot be easily accessed. An interesting approach to extending the lifetime of sensor nodes is the use of energy harvested from the environment. Design constraints are application-dependent and based on the monitored environment in which the energy harvesting takes place. To reduce energy consumption, we designed a power management scheme that combines dynamic duty cycle scheduling at the network layer to plan node duty time. The dynamic duty cycle scheduling is realized based on a tier structure in which the network is concentrically organized around the sink node. In addition, the multi-paths preserved in the tier structure can be used to deliver residual packets when a path failure occurs. Experimental results show that the proposed method has a better performance.

This paper presents a fast-lock dual-loop successive approximation register-controlled duty-cycle corrector (SARDCC) circuit using a mixed (binary+sequential) search algorithm. A wider duty-cycle correction range, higher operating frequency, and higher duty-cycle correction accuracy have been achieved by utilizing the dual-loop architecture and the binary search SAR that achieves the fast duty-cycle correcting property. By transforming the binary search SAR into a sequential search counter after the first DCC lock-in, the proposed dual-loop SARDCC keeps the closed-loop characteristic and tracks variations in process, voltage, and temperature (PVT). The measured duty cycle error is less than ${\pm}0.86%$ for a wide input duty-cycle range of 15-85 % over a wide frequency range of 0.5-2.0 GHz. The proposed dual-loop SARDCC is fabricated in a 0.18-${\mu}m$, 1.8-V CMOS process and occupies an active area of $0.075mm^2$.

This study primarily concerns the various franchisor's duties provided under the Draft Common Frame of Reference (here-in-after DCFR) in comparison with those under Korean law. It particularly focuses on the followings. First, it scrutinizes the rules on the scope of application in a comparative way, focusing on the following questions; what is the definition of a franchise contract and what are the essential elements of such contract. Second, it investigates in a comparative way the provisons as to the franchisor's contractual duties as follows; 1) a duty to collaborate actively and loyally and coordinate their respective efforts, 2) a duty to provide the franchisee with adequate and timely information before the contract is concluded, 3) a duty to grant the franchisee a right to use the intellectual property rights, 4) a duty to provide the franchisee with the know-how, 5) a duty to render the franchisee with assistance, 6) a duty to ensure the products ordered by the franchisee are supplied, 7) a duty to provide information during the performance, 8) a duty to warn the franchisee decreased supply capacity, 9) a duty to make reasonable efforts to promote and maintain the reputation of the franchise network. Its emphasis is particularly put on the rationals, the contents and the nature of such duties. Third, this study provides legal and practical advice to the contracting parties when they intend to insert either the DCFR or Korean law in their contract as a governing law.
