A Study on the Set-off Defenses Issued in Arbitration (중재 관련 상계항변에 관한 고찰)

  • In investigating how set-off defenses matter in arbitration, one should take into account that it is not permitted against the parties' will for arbitrators to rule on the disputes that are not the subject of an arbitration agreement, unless otherwise agreed upon by the parties involved, because it is considered that the parties intend to solve only the disputes which are the subject of the agreement by arbitration. Also, one should keep in mind that the parties must settle the disputes that are the subject of an arbitration agreement by arbitration when they conclude the agreement, and it is not allowed against the parties' will to resolve the disputes in other ways. The parties may agree whether the respondent can request for arbitration on the counterclaim, which is his/her claim against the claimant, and whether the respondent can raise a plea for a set-off that his/her claim against the claimant is a counter obligation. Failing on such agreement, the respondent may submit a counterclaim when his/her claim and the claimant's claim are the subject of the same arbitration agreement. The arbitral tribunal may rule on the counter obligation when the arbitration agreement, which becomes the basis for the claimant' claim, has an effect on the counter obligation. Where the claimant fails to raise an objection even after he/she becomes aware that the respondent has requested for arbitration or has raised a plea for set-off by providing his/her claim which is not the subject of the arbitration agreement as a counterclaim or a counter obligation, the arbitral tribunal may rule on the respondent's claim against the claimant. On these occasions, the arbitral tribunal has to guarantee the parties an opportunity to defend themselves by pointing out those situations. It will meet the purposes of arbitration systems to rule out the jurisdiction of the courts when the plaintiff alleges the existence of the arbitration agreement, in case the respondent raises a plea for set-off based on his/her claim which is not the subject of the arbitration agreement in the litigation procedures. However, where the plaintiff fails to allege the existence and conducts pleading in the court with regard to the counter obligation, the court must not reject the respondent's set-off defense because of the existence of the agreement.

  • BIM technology, which is widely used in the construction industry, has been introduced in various fields for the purpose of saving construction cost and reducing construction schedule. However, in the case of BIM-based cost estimate, there are various trials and errors in applying BIM technology which can be applied for calculating quantity and cost estimate. BIM-based cost estimate can improve the quantity accuracy and allow to easy modifications that were not expected in 2D-based construction process. However, for this purpose, it is necessary to take into consideration that interoperability between BIM data and cost information should be planed in advance. Besides, the definition of a BIM data specification is also required for the seamless data exchange and integrity in each phase of the construction process. Therefore, in this study, we propose a BIM - based cost estimation method and technology in each type of work applicable to the current domestic construction industry.

Kinematical Analysis of Men's Pole Vault Event (장대높이뛰기 경기의 운동학적 분석)

  • This study was conducted to investigate the performance times, CM position and CM speed, pole chord length and pole chord angle, whole body angular momentum(X axis), and grip width in pole vault event according to the event and phase; touch down, pole plant, take-off, maximum pole bending pole straight, pole release, peak height, and foot contact, pole contact, free flight. The pole vaulting of four male elite vaulters including six trial were filmed using two video digital cameras at 60 Hz at 56th national athletic match, and data were collected through the DLT method of three dimensional cinematography. In general the better jumper is, the longer the performance time is. And the greater CM speed is, and the better his transformation ability of CM horizontal speed into vertical speed is. As he uses a longer pole, his grip is higher, and it is a enough for him to rock back his body, so that he pulls and pushes the pole well keeping his hips close to. An greater maximum angular momentum and early positioning of the hips parallel to the bar makes his body far side of the bar and his bar clearance easier. Specially our national jumper needs to have more powerful braking force during foot contact phase, and take his body on the pole after maximum pole bending, and pull and push the pole strongly keeping his hips close to. Also he needs to have stronger muscular strength in order to control the longer pole and use the pole of proper tension more efficiently.

Microstructural Changes during Activation Process of Isotopic Carbon Fibers using CO2 Gas(I)-XRD Study (이산화탄소를 이용한 등방성 탄소섬유의 활성화과정 중 발생하는 구조변화(I)-XRD를 이용한 분석)

  • The structural parameters such as Lc, La and d of $CO_2$activated isotropic carbon fibers(ACFs) were obtained from XRD in order to understand a development mechanism of micropores. And the structural parameters were compared with specific surface area(SSA) data. The $d_{002}$, Lc, and La of the original fiber were measured to be 4.04$\AA$, 6.2$\AA$, and 23.6$\AA$, respectively. Carbonization of outer-parts and oxidization of inner-parts of the original fibers were far from completeness. It was observed that the structural changes of the ACFs during activation take place severely, therefore the carbonization and the oxidization of the fibers take place simultaneous with pore developments. The $d_{002}$ of the ACFs was increased to be 2.80$\AA$, and the La of the ACFs was decreased to be 17.0$\AA$ by activation. It was shown that the pores are developed continuously from the outer-parts to the inner-parts of the fibers, therefore the SSA increases as a result of the development of pores fully to the inner-parts of the fiber when the burn-off degree was over :39%. It seems that the (002) planes of crystallites contribute to the micropore wall related to the super high SSA.SSA.

  • Recently, studies have been carried out to develop unmanned Micro Air Vehicles(MAVs) that can search and monitor inside buildings during urban warfare or rescue operations in hazardous environments. However, existing fixed-wing and rotary-wing MAVs cannot travel at extremely low or high speeds, hover in place, or change directions instantly. This has lead researches to search for other flight methods that could overcome those drawbacks. Insect flight principles and its applications to MAVs are being studied as an alternative flight method. To take flight, insects flap and rotate their wings. These wing motions allow for high maneuverability flight such as hovering, vertical take off and landing, and quick acceleration and deceleration. This paper proposes a method for designing a mechanism that reproduces hovering insect flight, the basis for all other forms of insect flight. The design of a mechanism that can reproduce the motion that causes maximum lift is proposed, the required specifications are calculated, and a method for reproducing hovering insect flight with a single motor is presented. Also, feasibility of the design was confirmed by simulation.

Issues of Residential Area Management in Korean Natinal Parks (국립공원 취락지구 관리 개선방안 연구)

  • More than 130,000 residents are dwelling in 550 villages or residential areas covering 100K$m^2$ in the twenty national parks of Korea. Building new houses, additions, reconstruction, and certain kinds of land uses are prohibited in the residential areas of the national parks. Residents and park officials were interviewed and surveyed to discover problems and to suggest new management policies. Two of the mountain region national parks were studied, and the results are : First, it is recommended to amend the National Parks Act in order to list explicitly those facilities allowed in residential areas. Also the Act should enalble residential area management planning. The Residential area survey period should be shortened to 5 years instead local governments and the National Parks Authority offices. It is recommended that the NPA offices take over this responsibility completely. Thirds, some residential areas are better off to be excluded from the parks and the Boundaries of many residential areas are inappropriate and need to be adjusted. Fourth, as the number of visitors increase rapidly, the residential areas serve as tourist centers. The "Ecotourism" concept is to be introduced so that the residents can take part in ecotourism promotion. Fifth, the residents should be and well informed of residential area management policies and regulations.gulations.

  • The present study aims to monitor three of the community empowerment projects implemented as part of the community central revitalization projects in Yeongwol. We used an established indicator (i.e., quantitative evaluation) as well as an interview (i.e., qualitative evaluation) throughout the monitoring process. The PM (project manager) committee members, consisting of six interdisciplinary experts, carried out the monitoring from $24^{th}$ of October until the $26^{th}$ of November 2018. We categorized the results of the monitoring into the aspects of needs, software, and hardware, and analyzed them as follows: First, although the locals were willing to take part in programs, they were in overall not well informed about the ongoing programs and the program that suits their needs the most. The service organization should therefore actively publicize the program and provide sufficient information about it .Second, instead of a one-off program, the locals should be empowered to take over the program eventually and develop it as a local business model. Last, the locals from the center as well as the outskirts of Yeongwol should organize a learning net, collaboratively develop a further program, and assess its effectiveness by employing a thorough monitoring system.

  • This text discusses trends in the construction of religions since the Meiji Era, using Konkokyo and Restoration Shintoism as examples. The construction of religions is applied here as the process of a deliberate acceptace of religious images as a discourse of "Civilization" endowed with "kyougi" or "Doctrine" and "kyousoku" or "Rules of Instruction." Winding through a meandering path, these constructed religions do not take precedence over "Jikyou" or "State Religion." Yet, "Jikyou" for a while was fixed in its own fragemented self-imagery. As for Shinto, in 1900, the Office of Shinto Shrines became independent from the Office of Shrines and Temples in the Department of Domestic Affairs, and clearly Shinto and Shinto Shrines were part of secular state ideology. In the Bakumatsu and Meiji Periods, it ultimately was cut off from Restoration Shinto, thereby achieving this development on its own. This tells of the formation of an entirely new and modern Shinto within a secular "Jikyou." Konkokyo, moreover, as a religion establishes "kyousoku" and "kyougi." As a Shinto sect, it takes steps on the path toward recognizing a self-identity, namely as religious Shinto. As a result, dogmatization and systemization progress, and "Byoukinaoshi" or "illness-recovery" from the Tokugawa Period weathers. Also, as for progress in the Shinto religious order, from its foundation, the characteristics of a unified state and religion emerge, and thus there is an acceptance of significant restrictions. This dillema continues to persist as a problem in postwar Japan. Shedding light on Tokugawa Era practice also sheds light on where we can now take religious concepts.

Design of DNG-type Substrate-Integrated-Waveguide Resonators to Replace the Conventional Metallic Waveguide for the Military Satellite Transceiver (군위성 송수신기용 기존 금속 도파관을 대체하는 DNG형 기판적층 도파관 공진기의 설계)

  • A new and significantly small guided and resonant structure is suggested to take over bulky metallic hollow waveguides used in military satellite transceivers. Below Ku-band, the conventional waveguides resulting in quite heavy transceivers will be replaced by the low profile SIW(substrate integrated waveguide) structures that are distinguished from the others in that the suggested ones have much lower cut-off frequencies by the circuital configuration of DNG(dobule negative) constitutive parameters and become even smaller than the other SIWs. The design scheme is validated by the circuit and full-wave simulations from the guided, resonant, and coupled structures. Besides, a bandpass filter as the suggested coupled structure is fabricated with a cheap substrate in a low-budget fabrication process and its frequency response is measured as verification of the purpose of the design.

A Hybrid Type Shaping Scheme in ATM Networks (ATM 망에서 혼합형 셀 간격 제어 기법)

  • Congestion may take place in the ATM network because of high-speed cell transmission features, and cell delay and loss also can be caused by unexpected traffic variation. Thus. traffic control mechanisms are needed. One of them to decrease congestion is the cell shaping. This paper proposes a hybrid type cell shaper composed of a Leaky Bucket with token pool, EWMA with time window, and a spacing control buffer. The simulator BONeS with the ON/OFF traffic source model evaluates the performance of the proposed cell shaping method. Simulation results show that the cell shaping concerning the respective source traffics is adapted to and then controlled on the mean bit rate.
