This thesis reviews the process in which the regulation systems against ownership concentration of newspapers established with the opportunity of legislation of the periodical act in 1987 was reinforced as they were all amended to the newspaper act in 2005 and as they were again amended in 2009 it came to confront crisis in the aspect of press law legislation history. The regulation systems against ownership concentration of newspapers established based on the principle of legality of newspaper function in the Clause 3, the Article 21 of Constitution was reinforced as the newspaper act in 2005 and in 2006 they began to shrink following the Constitution Court decision against newspaper act. As newspaper act and broadcast act are revised in 2009, regulation against combining the management of newspapers with broadcast and regulation against owning multiple number of newspapers came not to exist. Because in this process, the opposition party also allowed limited cross-ownership of newspaper and broadcast, it can be said that the system of newspaper ownership regulation confronted the crisis of dissolution. The instruction of regulation alleviation in a short period of time in spite of the fact that regulation alleviation which allows cross-ownership of newspaper and broadcast is the matter of policy that should be decided after long-term review of the change of media environment and the progress of the power of domination of public opinion is dangerous. Newspapers are strong media with terrestrial broadcast in formation of public opinion on politics. It's because it is difficult to ignore the worry that the power of domination of public opinion of the newspapers which are in oligopoly of newspaper public opinion market can be spreaded to the territory of report broadcast. From the point of view that there is probability for democracy to be ultimately threatened due to the shrink of political Darwinism caused by concentration of media ownership, the alleviation of ownership concentration of newspapers should have premise of long-term social discussion.
Currently, patrol officers dispatched are required to work in pairs, and are assigned individual duties. However, despite these rules, there are still inappropriate combat education centered around dangerous weapons and arresting technique training being taught in the police system. The human rights problems resulting from excessive responses, the damages done to the patrol officers due to insufficient responses, and the judicial issues that many officers who have justly arrested face, reveal the ultimate problem of the decrease in reliability of the police. Considering this problem, there is a need for change in the current training system. Specifically, in the current dispatch rule, assignment of individual duties, and training methods, realistic improvements must be made. Having understood the arrest technique training problem and reviewed case studies of the police training in South Korea and other countries, I plan to analyze the effects of implementing a realistic and professional training system, and propose a systemic solution according to the results. By effectively discussing the various issues of the proposed training and police education, I intend to propose a realistic teamwork training for paired patrol officers, enabling them to work well together in practice and theory, hence increasing the effectiveness in crime situation.
This study, based on understanding the play features of the participants, explores early children's peer-relation strategies of maintaining and altering play frame and understanding the meaning of the strategies. Free play of 5-year-old children's was observed. The child-care center was visited 1 or 2 days a week, from March to October, 2012. The data collected were based from field notes, interviews with participants, their workbooks and more. The participants used strategies such as 'refusing', 'incapacitating', 'interpreting in a way to sympathize', and 'changing the rules of play' to maintain the play, whilst 'tell-on', 'being on the same side', 'accepting 3rd party' features were used to alter play frame. Participants using these various play-frame strategies experienced life implications of 'dialectic of exclusion and selection' and 'quiver of boundary'. This study, specifying efforts of the children to maintain and alter the play frame, will provide an understanding of perception of "social exclusion" to children, which has been viewed negatively in the past. It will also benefit on-site teachers in helping them understand peer-relationship within children and provide a more in-depth intervention for peer-relationship issues.
To determine which are the culturally specific factors of Korean bereavement, this chapter focuses on the view of death and the traditional mourning process which reflect Korean values and norms. The formation of the Korean view and understanding of death has been strongly influenced by three of its major traditional religions: Shamanism, Buddhism, and Confucianism (Park:1994: Hao:1999) and Christianity more recently. Each religion has a different view of death and the appropriate expression of mourning. Korea accommodates funeral customs and rules strictly as a cultural system and has retained these traditions over a long period; hence, some of the traditional funeral rituals still remain in modern Korean life, although some of the rites have been simplified. We have looked at the various ways in which grief and mourning is displayed and shared in a collective manner over a long period of time. This fits in well within the other Eastern cultures that are collectively organized, and contrary to the Eurocentric models do not hastily seek to detach the living from the dead and recognize that grief is a long process, and different individuals may take different amounts of time to recover from the grief. The view of death and bereavement in Korea has sprung from the roots of three Korean religions, together with the recent addition of Christianity, although they mainly result from the three earlier religions. The beliefs of these religions are still closely linked together in the rituals of Korean bereavement on both conscious and unconscious levels. The influence of these religions is evident in practice through the bereaved family's mourning reactions, funeral rites and customs and its views about death. Korea used to have a period of mourning for three years, following traditional mourning rites; then the chief mourner and the bereaved families could return to their normal life. In spite of this long mourning process for the bereaved family, once the funeral ceremony is finished, people expect the bereaved family not to express their grief in public; even the bereaved family does not like to talk about death. The process for bereaved people is related to mourning processes in terms of detachment from the deceased in order to start a new life. Relatives and the community recommend the performance of the kut ceremony for relieving the grief of the bereaved. When one family member dies in an unlucky way, the bereaved family may have some fear or other psychological reactions of grief such as pain, depression, insomnia and nightmares, hallucinations or other physical reactions. Unlucky deaths give the bereaved a very painful time and these types of reactions are often more serious than reactions to natural death. But through the kut ceremony, the bereaved family can start to make a new relationship with the deceased. The taboo of this type of death and death generally remains a crucial aspect of the isolation that bereaved people might face and the collective nature of mourning(even where it is still present) is unable to address this aspect of the privatization of grief.
Under the UN Security Council Resolution 1540/1810 in 2004 to restrict the proliferation of WMD (weapons of mass destruction) and their means of delivery, many countries have taken great efforts to, control the export of strategic items, thereby preventing the transfer of ABCM (atomic, biological, chemical weapons, missiles) and technologies and goods related to conventional weapons or dual-use items, Compliance Program (CP) in Korea or Internal Compliance Program(ICP) in Japan refers to a company's internal system or rules to comply with the export control laws and regulations, and is to prevent the unintentional illegal export of strategic items. This paper analyzes the Compliance Program (CP) of strategic export control system between Korea and Japan. Both countries have very similar legal frameworks under the guiding principles of multilateral export control regimes. However, there are some differences in actual procedures, classification service, supporting system, export license, sanctions for illegal exporters, etc. Korea should take more active and customer-oriented measures to promote the Compliance Program (CP) into Korean export companies for better awareness and positive attitude, practical information and education, smoothy government-firm communication, closer cooperation between Korea and Japan, etc.
Having ahead the Korea-US FfA come into effect by beginning of the 2012, the interest to U.S. trade law has been highly increased. The abuse of U.S. antidumping measures, especially, have been alleged by many developed countries, that's why it need to be studied. For initiating antidumping investigation, the scope of "subject merchandise" has to be determinated. But there is no regulation about the term "subject merchandise(or product under consideration)" on WTO Antidumping Agreement as well as U.S. Antidumping Law. U.S. antidumping law defines domestic like product as "a product that is like, or in the absence of like, most similar in characteristics and uses with, the article subject to an investigation under this title". Thus, the reference point from which the like product analysis begins is "the article subject to an investigation". The Department of Commerce should interpret the subject merchandise in accordance with customary rules, beginning with its ordinary meaning. The note of caution is that the DOC generally exercises 'broad discretion to define and clarify the scope of an antidumping investigation in a manner which reflects the intent of the petition. This paper investigates the survey scope of product in U.S. antidumping law through related regulations and cases. In addition, it was carefully examined because the scope of subject merchandise has effect on antidumping duty order.
Recently, as most companies are getting globalized, global sourcing of raw materials are also provided actively. Since each country has different, strict and complex rules-of-origins, importance of COO(country-of-origin) is increasing more and more. This study was surveyed with 127 manufacturing companies in South Korea. The purpose of this study is to verify the effect relationship how brand equity and COO capacity impact on the COO performance. The research hypothesis and model was derived from the basis of existing theory and empirical research, and obtained the following results. Firstly, brand equity of the COO showed positive (+) effect on the COO information capacity and product brand equity showed positive (+) effect on the COO management capacity. Secondly, the COO information capacity showed positive (+) effect on the COO management capacity. Lastly, product brand equity and the COO information capacity showed positive (+) effect on the COO performance. This study is differentiated from previous research information by empirically evaluating the relationship between the brand equity and the COO. This study contributed to academic by examining the research on the COO management in South Korea and also practically suggested the direction how manufacturing company in South Korea is to take the advantage of the brand equity and the COO capacity.
The purpose of this article is making investigation of the principal composition of the twin-pagodas in Buddhist temple through ornaments of a case preserving relics of Buddha in the east and west pagodas of Gameunsa temple. This research has an important meaning in clarifying that the concept of placement two Buddhas together with lotus sutra, which was only applied to Bulkuksa temple, has been extended to Gameunsa temple. And this observation gave us a clear explanation for the principal composition at the twin-pagodas in Buddhist temple plans. The author obtained the following conclusion from this article : The cases preserving relics of the Buddha for the west and east pagodas are globally in similar form as the type of a royal palace. But the different points between eastern and western can be seen on the existence of Buddhist statues on the base floor, set-up of the gate at railings, and 4 lion statues at a coner of the base floor. In the western pagoda, there are Buddha statues above the base-floor of the cases preserving relics. These Buddha statues are composed of a boy monks and angels with playing music for the praise of the Sakyamuni Buddha lecturing the Lotus sutra at YoungChui Mountain. On the other hand, in the eastern pagoda, Buddha statues on the cases preserving relics are composed of a the Four Devas and monks as a defending God of the nation of Buddha. In the eastern pagoda, one can see something that does not exist in the western pagoda, which is a gate located in railing of a case preserving the relics. This gate described the scene of the Sakyamuni Buddha entering into the pagoda of 7 treasures. In a corner of the case preserving relics in the eastern pagoda, there is another thing which does not exist in the western pagoda. This is a sculpture of a lion which symbols the seat of Lion supporting the Buddha in the Dabotap(the pagoda of 7 treasures). When we observe the form and structure, the descriptions at the railings, the gate, the shrine, the statue of a lion, and the accessories in jewelries, at the cases preserving the relics in the eastern pagoda, one can realize that they have the same combination structures between the ones at Dabotaps in Bulguksa temple and those in China as well as in Japan, all of which represent the Gyun-Bo-Tap-Pum of Lotus Sutra. Among the distribution rules in the twin-pagodas in Buddhist temple, the application of the ideal of lotus was known to be effected only to Bulguksa temple. But from the result of the present article, it is more clearly proved by applying the Gameunsa temple that the distribution theory in the twin-pagodas in Buddhist temple was in fact based on the ideal of lotus.
The Chevron saga including Chevron/TexPet v. Ecuador, PCA Case No. 34877(hereinafter referred to as "Chevron I") and Chevron/TexPet v. Ecuador, PCA Case No. 2009-23(hereinafter referred to as "Chevron II") started out of domestic litigations between TexPet and Ecuador in the early 1990s. In Chevron I, the Tribunal decided that Article 2(7) of the U.S.-Ecuador BIT on effective means of provision was breached because of undue delays in the seven legal proceedings TexPet had brought against Ecuador in respect to contractual obligations. In Chevron II, it was contended that through the actions and inactions of the judiciary and the executive, Ecuador breached her several obligations under the BIT. Ecuador objected to the jurisdiction of the Tribunal because TexPet's investment was terminated in 1992, and because Chevron is not a party to the 1995 Settlement Agreement and 1998 Final Release. In its Interim Award on Jurisdiction and Admissibility, the Tribunal applied a prima facie standard to the facts alleged by the Claimants but denied by the Respondent, and decided that questions in respect of the Respondent's jurisdictional objections should be joined to the merits under Article 21(4) of the UNCITRAL Arbitration Rules. In the merits phase of Chevron II, the Tribunal divided the merits of the Parties' dispute into two parts, entitled "Track 1" and "Track 2". In its Partial Award on Track 1, the Tribunal decided that Chevron is a "Releasee" under the 1995 Settlement Agreement. In a decision on "Track 1B", the Tribunal decided that the Lago Agrio complaint cannot be read as pleading "exclusively" or "only" diffuse claims, and that, to this extent, the Claimants' reliance on the 1995 Settlement Agreement as a complete bar to the Lago Agrio complaint must fail, as a matter of Ecuadorian law. The Tribunal maintained the position that the Parties' disputes on both merit and jurisdiction should be reserved for Track 2. It remains to be seen how the Tribunal addresses the Claimants' allegations of multiple denials of justice under international law against the judgments of the Respondent's Courts, together with the Respondent's jurisdictional objections in Track 2 of the arbitration.

Background: Radon contributing about 42% of annual average dose, mainly comes from soil. In this paper, standard measurement procedures for soil radon exhalation rate are suggested and their measurement uncertainties are analyzed. Materials and Methods: We used accumulation method for estimating surface exhalation rate. The closed-loop measurement system was made up with a RAD7 detector and a surface chamber. Radon activity concentrations in the system were observed as a function of time, with data collection of 5 and 15-minute and the measurement time of 4 hours. Linear and exponential fittings were used to obtain radon exhalation rates from observed data. Standard deviations of measurement uncertainties for two approaches were estimated using usual propagation rules. Results and Discussion: The exhalation rates (E) from linear approach, with 30 minutes measurement time were $44.8-48.6mBq{\cdot}m^{-2} {\cdot}s^{-1}$ or $2.14-2.32atom{\cdot}cm^{-2}{\cdot}s^{-1}$ with relative measurement uncertainty of about 10%. The contributions of fitting parameter A, volume (V) and surface (S) to the estimated measurement uncertainty of E were 59.8%, 30.1% and 10.1%, in average respectively. In exponential fitting, at 3-hour measurement we had E ranged of $51.6-69.2mBq{\cdot}m^{-2} {\cdot}s^{-1}$ or $2.46-3.30atom{\cdot}cm^{-2}{\cdot}s^{-1}$ with about 15% relative uncertainty. Fitting with 4-hour measurement resulted E about $51.3-68.2mBq{\cdot}m^{-2} {\cdot}s^{-1}$ or $2.45-3.25atom{\cdot}cm^{-2}{\cdot}s^{-1}$ with 10% relative uncertainty. The uncertainty contributions in exponential approach were 75.1%, 13.4%, 8.7%, and 2.9% for total decay constant k, fitting parameter B, V, and S, respectively. Conclusion: In obtaining exhalation rates, the linear approach is easy to apply, but by saturation feature of radon concentrations, the slope tends to decrease away from the expected slope for extended measurement time. For linear approach, measurement time of 1-hour or less was suggested. For exponential approach, the obtained exhalation rates showed similar values for any measurement time, but measurement time of 3-hour or more was suggested for about 10% relative uncertainty.
