우리나라 군용항공기 제작사의 책임제한 해결방안에 관한 고찰 (The Limitation of the Military Aviation Manufacturer's Liability)

  • 국회는 2017년 3월 30일 제조물책임법 일부개정법률안을 국회본회의에서 통과시켰다. 본 개정안에는 무엇보다 피해자인 소비자의 입증책임을 완화시키며 제조물책임의 배상책임을 3배까지 증액하는 신설조항이 있어서, 제조물책임관련 소송이 증대될 것이며, 제조물책임보험 가입이 증가할 것이다. 군용항공기 제작사는 군용항공기의 제작목적이 기동성 위주이며, 군의 작전성을 위주로 운용되기 때문에 현실적으로 군용항공기 제조사들이 군용항공기 제조물책임보험을 들 수 없는 현실 상황하에 군용항공기제작사는 제조물책임법과 하자담보책임, 채무불이행책임의 손해배상 위험에 직면하여 있다. 제조물책임법의 시원지인 미국은 1970년대 제조물책임법이 시행되게 되자, 군용항공기제작사의 책임한도에 대하여 학계, 법조계, 보험업계에서 큰 논란이 있었으며, 군용항공기 제작사의 책임문제를 해결하기 위하여, Government Contractor Defense (GCD, 정부계약자항변) 라는 법리를 판례로 만들어 냈다. 한국과 미국정부가 맺고 실제 적용하고 있는 Foreign Military Sales(FMS) 계약서에는 군용항공기제작사에 대한 면책조항이 있다. 군용항공기 제작사가 높은 제조물책임보험을 들 수 없고, 방산원가에도 제조물책임보험료를 반영시키지 않는 현실에서 외국의 수출을 확대하고 있는 군용항공기제작사는 위기 그 자체에 직면하고 있음을 정확히 알고, 시급히 이러한 위기를 해결할 수 있는 입법개정, 정책수립을 하여야만 한다.

해양사고에 있어서 책임귀속의 제한 필요성에 관한 연구 (A Study on the Necessity of Limitation for Legal Liability in Marine Accidents)

  • 해양사고는 민사법상의 손해배상, 형법상의 책임의 귀속 및 행정상의 제재와 같은 여러 가지 법적 책임 문제를 야기한다. 어떠한 행위에 의하여 결과가 발생하였다고 하여 바로 책임귀속이 되는 것은 아니다. 이러한 책임의 전제로서 해양사고를 야기한 행위와 그 결과 발생사이에 인과관계가 문제된다. 해양사고에 있어서 그 원인 규명은 해양이라는 사고 발생 장소, 증거확보의 어려움, 사고 발생시와 조사 시점과의 시간차 등으로 어려움이 많다. 그러나 정확한 원인 규명은 유사 사고 방지와 책임 소재를 가리는데 매우 중요한 요소이다. 인과관계를 논리학적으로 보면 무한히 확산 가능한 개념이지만 책임귀속에 있어서는 이를 제한할 필요성이 있다. 따라서 이 논문에서는 인과관계 이론을 바탕으로 해양사고에서의 인과관계를 검토하여 책임귀속의 합리적인 판단 기준을 논증한 것이다.

  • In this article the present writers have surveyed recent cases on Warsaw Convention especially on the cases emerged in the years between 1986 to 1993. The cases before 1986 were discussed already in the book titled "Liability of International Air Carrier," written by Professor Choi, published in Seoul 1986. In this article the writers have reviewed most of the American cases and some cases from the courts of Germany, France and England. Main subjects which were discussed herein were as follows: Liability of air carriers in Warsaw Convention carriage 1. Exclusivity of the Warsaw Convention as a remedy 2. Warsaw Jurisdiction 3. The scope of the Warsaw Convention's definition of "Accident" under Article 17 of the Warsaw Convention (1) Mental anguish (2) Unusual or unexpected events 4. Adequacy of notice of the limitation of liability to passengers for injuries and death 5. Damages recoverable, punitive damages and burden of proof 6. The wilful misconduct exception; definition of wilful misconduct 7. Cargo and passenger baggage 8. Time limitation of actions After examining articles published world-wide, this article compiles and analyses recent cases involving the Warsaw Convention system. As Warsaw System is based on international convention, maintaining uniformity in interpretation is of utmost importance. Therefore, this type of study is essential for resolving air-transportation disputes in Korea. This article examines the current state and recommends the desired course for the Warsaw Convention. The writers hope that this article is helpful to the Korean courts and those in the air-transportation industry in interpreting the Warsaw Convention.

항공기에 의하여 발생된 제3자 손해배상에 관한 로마협약 개정안에 대한 고찰 - 불법방해배상협약안과 일반위험협약안을 중심으로 - (A Study on the Revised Draft of Rome Convention on Compensation for Damage Caused by Aircraft to Third Parties - With Respect to the Draft Unlawful Interference Compensation Convention and the Draft General Risks Convention -)

  • The cumulative result of the work by the ICAO Secretariat, the Secretariat Study Group and the Council Special Group on the Modernization of the Rome Convention of 1952 are two draft Conventions, namely: "Draft Convention on Compensation for Damage Caused by Aircraft to Third Parties, in case of Unlawful Interference", and "Draft Convention on Compensation for Damage Caused by Aircraft to Third Parties" The core provisions of the former draft Convention are as follows: The liability of the operator is strict, that is, without the necessity of proof of fault. It would be liable for damage sustained by third parties on condition only that the damage was caused by an aircraft in flight(Article 3). However, such liability is caped based on the weight of the aircraft(Article 4). It is envisaged to create an independent organization called the Supplementary Compensation Mechanism, with the principle purpose to pay compensation to persons suffering damage in the territory of a State Party, and to provide financial support(Article 8). Compensation shall be paid by the SCM to the extent that the total amount of damages exceeds the Article 4 limits(Article 19). The main issues on the farmer draft Convention are relating to breaking away from Montreal Convention 1999, no limits on individual claims but a global limitation on air carrier liability, insurance coverage, cap of operators' strict liability, and Supplementary Compensation Mechanism. The core provisions of the latter draft Convention are as follows: the liability of the operator is strict, up to a certain threshold tentatively set at 250,000 to 500,000 SDRs. Beyond that, the operator is liable for all damages unless it proves that such damage were not due to its negligence or that the damages were solely due to the negligence of another person(Article 3). The provisions relating to the SCM and compensation thereunder do not operate under this Convention, as the operator is potentially for the full amount of damages caused. The main issues on the latter draft Convention are relating to liability limit of operator, and definition of general risks. In conclusion, we urge ICAO to move forward expeditiously on the draft Convention to establish a third party liability and compensation system that can stand ready to protect both third party victims and the aviation industry before another 9/11-scale event occurs.

우리나라 의료판례 변화에 대한 비판적 고찰 - 판결양식과 손해배상액을 중심으로 - (Critical Overview on Changes of Judicial Precedents in the Medical Cases of Korea - In Relation with Forms of Judgments and Damages -)

  • Compared with medical cases and health care law from other countries there has been a lot of progress on medical law, especially on medical precedents in Korea. However, in recent years, medical precedents tend to reflect a realistic position of health care providers, rather than normative position of the victim. The burden of proof to prove strict liability is given to patients in civil law suits by courts, patients generally has the burden of proof. The rate of claims to prove the negligence of medical malpractice is falling significantly. Even if the error is acknowledged, it is not enough to get right to be relief for patients by increasing limitations of liability or ratio of patient's own negligence. Compensation fee is included in medical fees and risk of medical malpractice actions contributes ultimately to a health care consumer. In conclusion, author represents a major the new upgrade of above mentioned problem. By advising that court should assess actively for the perspective of victim for medical negligence we will be able to exercise remedies of patients' rights and to prevent recurring medical accidents and also contribute to medical advances.

PEST-SWOT-AHP 분석을 이용한 중소제조기업의 제조물책임 대응전략 수립 (Developing Product Liability Response Strategies of SMEs using PEST-SWOT-AHP analysis)

  • Product liability (PL), which began enforcement in 2002, refers to the legal responsibility of the manufacturers or sellers (wholesales or retailers) for the property damage or bodily harm caused by their product. With a strong enforcement of the Product Liability (PL) Act, companies are required to structure and operate a response system to defend or prevent product accidents efficiently, but small and medium enterprises (SMEs) are unable to respond more aggressively due to limitation of management resources. In this manner, it is important to develop response strategies for SMEs to efficiently cope with the PL Act. In this paper, the PEST (Political, Economic, Social, and Technological) analysis is performed to reveal the impact of the PL Act on SMEs in macro-economic point of view. To formulate SME's PL response strategy, SWOT analysis is performed to categorize each factors from PEST analysis and AHP is applied to identify the intensities of SWOT factors. The prioritized SWOT factor, results of PEST-SWOT-AHP analysis, are used to formulate SME's PL response strategies. The study results are briefly summarized as follows. To reduce product defects, it is necessary for SMEs to formulate PL response strategies for each phase of the product life cycle by continuously collecting and analyzing PL cases in the same industry or for similar products. In addition, SMEs should invest more technological effort to ensure product safety. Further, SMEs should spread PL awareness to all staff members by training internal PL experts. Moreover, a SME should enroll in PL insurance and spread this information to its customers so that they become aware that the company is proactively conforming to the PL law.

이사책임감면규정 도입이 기업의 원가형태에 미치는 영향 (A Study on the Liability Limitation Provision and Firms' Cost Behavior)

  • 본 연구는 이사책임감면규정 도입이 기업의 원가행태에 미치는 영향을 분석하였다. 우리나라의 이사책임감면규정은 경영자의 기업경영관련 의사결정 실패에 따른 위험을 완화하여 경영효율성을 향상시킬 목적으로 2011년 4월에 도입되었다. 그러나 이러한 이사책임감면규정의 도입이 경영자의 도덕적 해이를 부추길 수 있다는 우려의 견해도 존재하므로, 이사책임감면규정의 도입 효과를 검증하기 위한 실증연구의 필요성이 강조되고 있으나 아직 미비한 상황이다. 이에 본 연구에서는 경영자의 의사결정이 반영되는 기업의 원가행태를 중심으로 이사책임감면규정 도입 효과를 실증적으로 분석하였다. 연구결과, 이사책임감면규정을 도입한 기업은 미도입기업보다 판매관리비의 하방경직적인 원가행태가 강화되었음이 관찰되었다. 이는 이사책임감면규정 도입기업의 경영자는 매출성과 감소 시 향후 매출성과가 회복되었을 경우를 대비하고자 보다 적극적으로 조정비용을 고려하는 것으로 해석된다. 본 연구는 이사책임감면규정 도입의 정책적 타당성을 입증할 수 있는 실증증거를 제시하였다는데 자본시장과 학계에 공헌할 수 있을 것으로 기대된다.

국제안전관리규약(國際安全管理規約)(ISM Code)과 해상운송인(海上運送人)의 주의의무(注意義務) (International Safety Management(ISM) Code and Duty of Due Diligence of Ocean Carrier)

  • "International Safety Management(ISM) Code" means the International Management Code for the Safe Operation of Ships and for Pollution Prevention as adopted by the Assembly, as may be amended by the International Maritime Organization. This Code have brought into force internationally since 1th July, 1998 by incorporated to the new Chapter Ⅸ in the SOLAS Convention. Accordingly those States which give effect to the SOLAS Convention will have to ensure that rules giving effect to the Code are introduced into their domestic legislation. The purpose of this Code is to provide an international standard for the safe management and operation of ships and for pollution prevention, by this to reduce the maritime casualty which could caused by neglect of person. To achieve this purpose the ISM Code specifies a number of broad 'safety management objectives' for owning or operation companies, and it requires that such companies should establish, implementing and maintain a written Safety Management System(SMS) covering a whole range of safety environmental and related matters. These requirements of the Code could effect on the carrier in some points such as duty of due diligence to care for cargo, due diligence to make the vessel seaworthy and burden of proof etc. In this respect, We should know that the ISM Code could effect on the carrier advantageously or disadvantageously subject to whether the carrier observed the requirement of the ISM Code. Although it does not add cause of liability or increase limitation of liability imposed to the carrier.

우주잔해 손해에 대한 국제책임 (International Liability for Damage Caused by Space Debris)

  • 우주잔해는 제도상에서 운용되고 있는 인공위성 및 우주선 등에 빈번히 손해를 야기하고 있으며 때로는 지구상으로 떨어지기도 한다. 이러한 잔해는 점점 증가하고 있으며 그에 따라 타국의 우주물체 및 지상 손해가 발생할 가능성도 높아지고 있다. 그러나 현 국제법 체계에서는 미확인 우주잔해로 인한 손해뿐 아니라 확인이 가능한 우주잔해로 인한 손해에 대해서도 구제 받는 것이 쉽지 않다. 이것은 우주잔해로 인한 손해에 대해서 명확히 규정하고 있는 법규가 없기 때문이다. 이러한 한계를 극복하기 위해서는 책임협약의 일부 내용을 수정하거나 새로운 법체계를 세우는 것이 바람직한 것으로 보인다. 예컨대 우주물체를 새롭게 정의하면서 우주잔해를 포함해야 하고, '발사' 개념을 좀 더 명확히 하여 발사의 범위를 특정해야 한다. 또한 우주잔해 손해의 책임 주체를 등록 전과 등록 후로 나누어서 등록 전에는 발사국들이 공동으로 또는 개별적으로 책임을 지고 등록 후에는 등록국 내지는 소유국이 책임을 지도록 해야 한다. 타국의 우주물체에 대한 손해배상체계도 현재의 과실책임에서 '절대책임'으로 변경하는 것이 필요하다. 특히 우주잔해에 의한 손해에 대해서는 그 과실이 있다고 해도 그 입증이 쉽지 않고 또한 그 잔해가 과실이 아닌 정상적인 우주활동의 부산물로 발생되는 경우가 많기 때문에 현 책임협약상의 과실책임을 부과하기가 어려우므로 지상 제3자 손해에 대한 책임과 마찬가지로 '절대책임'으로 변경하는 것이 바람직하다. '미확인' 잔해에 의한 손해를 입는 경우에 대한 구제방안으로서 보험, 우주배상기금의 조성, 시장점유율책임이론의 도입 등을 제시했는데 책임협약의 개정 또는 별도의 국제조약 등을 통해 규정되어야 할 것이다. 우리나라도 앞으로 천문학적인 가격의 인공위성을 다량 보유하게 될 것인데, 점점 증가하는 우주잔해로부터 자유로울 수 없다. 만약 우주잔해로부터 우리의 인공위성이 피해를 입게 된다면 위성 자체의 손해 뿐 아니라 운용상의 장애 및 기능 불능으로 인한 경제적인 손실이 막대하다 할 것이다. 결국 손해배상을 받지 못하면 우리는 막대한 경제적 손실을 떠안을 수밖에 없고 그것은 국민의 세금과도 연결되어 있다. 그러한 측면에서도 우주잔해에 의한 손해를 구제할 수 있는 방안에 대해 하루 속히 국제적으로 합의가 되어야 할 것이다.

국제항공(國際航空)테러리즘으로 인한 여객손해(旅客損害)에 대한 운송인(運送人)의 책임(責任) ("Liability of Air Carriers for Injuries Resulting from International Aviation Terrorism")

  • The Fundamental purpose of the Warsaw Convention was to establish uniform rules applicable to international air transportation. The emphasis on the benefits of uniformity was considered important in the beginning and continues to be important to the present. If the desire for uniformity is indeed the mortar which holds the Warsaw system together then it should be possible to agree on a worldwide liability limit. This liability limit would not be so unreasonable, that it would be impossible for nations to adhere to it. It would preclude any national supplemental compensation plan or Montreal Agreement type of requirement in any jurisdiction. The differentiation of liability limits by national requirement seems to be what is occurring. There is a plethora of mandated limits and Montreal Agreement type 'voluntary' limits. It is becoming difficult to find more than a few major States where an unmodified Warsaw Convention or Hague Protocol limitation is still in effect. If this is the real world in the 1980's, then let the treaty so reflect it. Upon reviewing the Warsaw Convention, its history and the several attempts to amend it, strengths become apparent. Hijackings of international flights have given rise to a number of lawsuits by passengers to recover damages for injuries suffered. This comment is concerned with the liability of an airline for injuries to its passengers resulting from aviation terrorism. In addition, analysis is focused on current airline security measures, particularly the pre-boarding screening system, and the duty of air carriers to prevent weapons from penetrating that system. An airline has a duty to exercise a high degree of care to protect its passengers from the threat of aviation terrorism. This duty would seemingly require the airline to exercise a high degree of care to prevent any passenger from smuggling a weapon or explosive device aboard its aircraft. In the case an unarmed hijacker who boards having no instrument in his possession with which to promote the hoax, a plaintiff-passenger would be hard-pressed to show that the airline was negligent in screening the hijacker prior to boarding. In light of the airline's duty to exercise a high degree of care to provide for the safety of all the passengers on board, an acquiescene to a hijacker's demands on the part of the air carrier could constitute a breach of duty only when it is clearly shown that the carrier's employees knew or plainly should have known that the hijacker was unarmed. A finding of willful misconduct on the part of an air carrier, which is a prerequisite to imposing unlimited liability, remains a question to be determined by a jury using the definition or standard of willful misconduct prevailing in the jurisdiction of the forum court. Through the willful misconduct provision of the Warsaw Convention, air carrier face the possibility of unlimited liability for failure to implement proper preventive precautions against terrorist. Courts, therefore, should broadly construe the willful misconduct provision of the Warsaw Convention in order to find unlimited liability for passenger injuries whenever air carrier security precautions are lacking. In this way, the courts can help ensure air carrier safety and prevention against terrorist attack. Air carriers, therefore, would have an incentive to increase, impose and maintain security precautions designed to thwart such potential terrorist attacks as in the case of Korean Air Lines Flight No.858 incident having a tremendous impact on the civil aviation community. The crash of a commercial airliner, with the attending tragic loss of life and massive destruction of property, always gives rise to shock and indignation. The general opinion is that the legal system could be sufficient, provided that the political will is there to use and apply it effectively. All agreed that the main responsibility for security has to be borne by the governments. I would like to remind all passengers that every discovery of the human spirit may be used for opposite ends; thus, aircraft can be used for air travel but also as targets of terrorism. A state that supports aviation terrorism is responsible for violation of International Aviation Law. Generally speaking, terrorism is a violation of international law. It violates the soverign rights of the states, and the human rights of the individuals. I think that aviation terrorism as becoming an ever more serious issue, has to be solved by internationally agreed and closely co-ordinated measures. We have to contribute more to the creation of a general consensus amongst all states about the need to combat the threat of aviation terrorism.
