Toxic tort cases have increased dramatically since the 1970s, as large technological systems, such as nuclear power plants and chemical factories, or mass-produced, high-tech products, had exposed citizens and consumers to dangerous substances. It was, however, difficult to establish causal connection between exposure and the alleged harms in many of the environmental, pollution, and product liability cases under the framework of tort law conception of causation and responsibility. Science and law was called upon to resolve such 'late modern' legal cases where true causes are hard to find, where no single explanatory factor is sufficient for explaining diseases like cancer. This article examines how plaintiffs in the Korean tobacco litigation mobilized such late modern tools in science and law, such as epidemiology and the allocation of the burden of proof, in the context of the global circulation of science and law. It further shows how a set of the scientific theories and legal arguments developed in order to cope with late modern risk played a central role in establishing a causation between smoking and cancer in 2011. This article suggests that STS scholars can fruitfully examine the interaction between science and law as a way to understand and engage with social and legal issues engendered by late modern risk.

The trademark dilution of famous marks as a kind of unfair competition practice is defined and regulated in Article 2 (1) (c) of the Unfair Competition Prevention and Trade Secret Protection Act (hereinafter referred to as the Unfair Competition Prevention Act), which was newly established according to the amendment of the Act on February 3, 2001. Famous trademarks are universally protected in all around the world, which are likewise protected in the Republic of Korea by the Unfair Competition Prevention Actin line with such international trends. In order to establish the trademark dilution of famous marks, it is necessary to have the following characteristics: (1) high reputation of the original mark, (2) use of identical or similar markscompared to the original mark, (3) occurrence of blurring of discrimination or tarnishment of reputation; in particular, with respect to the degree of proof of 'blurring of discrimination or tarnishment of reputation', which is a constituent requirement of the trademark dilution of famous marks, it is reasonable to interpret the trademark dilution as concrete endangerment offense, neither harm-based offense nor abstract endangerment offense, and thus it should be considered that the crime is established if a specific realistic risk of blurring of discrimination or tarnishment of reputation occurs. Furthermore, in relation to the specific criteria of 'blurring of discrimination or tarnishment of reputation', it is necessary to comprehensively judge the degree of individual behavior in specific matters as a normative factor as well as the psychosocial viewpoint of the general public.
The study sought to reveal the impact of focusing attitudes and cognitive emotion regulation on post-traumatic growth for adolescent athletes with trauma experiences. A preliminary survey was conducted on 215 middle and high school athletes in the S city and K provinces. The impact of focusing attitudes and cognitive emotion regulation on post-traumatic growth was verified using validated questionnaires. The results for the purpose and method of study are as follows. Focusing attitudes and cognitive emotion regulation of adolescent athletes affect post-traumatic growth. Positive reappraisal was the most influential factor affecting post-traumatic growth, followed by the factors influencing the aware, acceptance, accept, reflect and positive refocusing. In order to experience post-traumatic growth through the results of this study, it is important to understand the overall understanding and tactics of focusing attitudes and cognitive emotion regulation. Therefore, effective psychological training methods will be needed to positively control the level of focusing attitudes and cognitive emotion regulation among adolescent athletes.

In order to excavate underground tunnel most safely such as Han river, the slurry shield TBM method is applied to cope with face of high water pressure for many metro projects. In downtown subway project most of excavated soil is discharged externally whereas in road construction excavated soil is used as filling materials so it becomes important factor for success of the project. After excavated soil, weathered rock and soft rock are discharged with bentonite through discharge pipe to slurry treatment plant then those soils are separated in separation plant according to those size. Fine grained soil has been discarded together with filter cake but it is not toxic and can be mixed with coarse aggregate in proper ratio so this study is performed to find use of qualified filling material to meet quality standard. Therefore, in this study, legal standards and quality standards for the utilization of excavated soil of the slurry shield TBM method were examined and test was conducted to derive recycling way for filter cake and aggregate. And a plan for using it as a filling material for road construction was derived. Because bentonite is a clay composed of montmorillonite, and the excavated soil in the tunnel is also non-toxic, disposal of this material can waste social cost so it is expected to be helpful in the underground space development project that carries out the TBM project by recycling it as a valuable resource.
Along with the changing times, organizational culture is also rapidly changing, and such organizational culture enables companies to secure discriminatory competitive advantage in the mid-to long-term perspective. This study aims to examine the impact of organizational culture on improving competitive advantage of enterprises by dividing organizational culture into three dimensions: development culture, rational culture, and consensus culture. To this end, a survey was conducted on small and medium-sized companies. As a whole, the rational culture, which is task-oriented and puts competition as a motivating factor, was more strongly prevalent than other organizational cultures, and in order of development culture, rational culture, and consensus culture, it affects the improvement of competitive advantage. This means that development culture and rational culture, which emphasize high-tech and productivity, are more important to improve the competitive advantage of small and medium-sized companies. In addition, the analysis of differences according to the size of employees showed that rational culture was important when the size of employees was small, but the larger the size of employees, the more important the development culture was to improve the competitive advantage of companies. Through this study, we were able to understand what organizational culture should be emphasized according to the size of small and medium enterprises.

Measuring the compressive strength of concrete is a very important factor in the safety review of concrete structures. Concrete compressive strength measurement methods include destructive and non-destructive methods. The destructive method includes the uniaxial compression failure method, and the non-destructive method includes the rebound hardness method and the elastic wave measurement method. In this study, the type of measurement method and the effect of reinforcing bars inside the concrete were tested to examine the relationship between them. Regardless of the type of specimen, the average compressive strength by the elastic wave measurement method among the three experimental methods was greater than the average compressive strength by the other methods. When the specimen type is the same, the standard deviation of the measured values of the elastic wave measurement method is smaller than that of the other measurement methods, so it can be seen that the elastic wave measurement method does not show large variance in the measured values compared to the other two measurement methods. When the average compressive strength according to the test method for each specimen was compared with the average compressive strength of the compressive failure test method, the average compressive strength was measured to be high in the order of the elastic wave measurement method, the compression failure test, and the rebound hardness method. Since the measured values of the compressive strength of concrete are different depending on the method of measuring the compressive strength of concrete and the presence or absence of reinforcing bars inside the concrete, further research is required considering the effect of various concrete covers.

UAV(Unmanned Aerial Vehicle) is widely used in space information construction, agriculture, fisheries, weather observation, communication, and entertainment fields because they are cheaper and easier to operate than manned aircraft. In particular, UAV have attracted much attention due to the speed and cost of data acquisition in the field of spatial information construction. However, ortho image images produced using UAVs are distorted in buildings and forests. It is necessary to solve these problems in order to utilize the geospatial information field. In this study, fixed wing, rotary wing, vertical take off and landing type UAV were used to detect distortions of ortho image of UAV under various conditions, and various object areas such as construction site, urban area, and forest area were captured and analysed. Through the research, it was found that the redundancy of the unmanned aerial vehicle image is the biggest factor of the distortion phenomenon, and the higher the flight altitude, the less the distortion phenomenon. We also proposed a method to reduce distortion of orthoimage by lowering the resolution of original image using DTM (Digital Terrain Model) to improve distortion. Future high-quality unmanned aerial vehicles without distortions will contribute greatly to the application of UAV in the field of precision surveying.
Background: Accurate mediastinal lymph node staging is vital for the optimal therapy and prognostication of patients with lung cancer. This study aimed to determine the preoperative risk factors for pN2 disease, as well as its incidence and long-term outcomes, in patients with clinical N0-1 non-small cell lung cancer. Methods: We retrospectively analyzed patients who were treated surgically for primary non-small cell lung cancer from November 2005 to December 2014. Patients staged as clinical N0-1 via chest computed tomography (CT) and positron emission tomography (PET)-CT were divided into two groups (pN0-1 and pN2) and compared. Results: In a univariate analysis, the significant preoperative risk factors for pN2 included a large tumor size (p=0.083), high maximum standard uptake value on PET (p<0.001), and central location of the tumor (p<0.001). In a multivariate analysis, central location of the tumor (p<0.001) remained a significant preoperative risk factor for pN2 status. The 5-year overall survival rates were 75% and 22.9% in the pN0-1 and pN2 groups, respectively, and 50% and 78.2% in the patients with centrally located and peripherally located tumors, respectively. In a Cox proportional hazard model, central location of the tumor increased the risk of death by 3.4-fold (p<0.001). Conclusion: More invasive procedures should be considered when preoperative risk factors are identified in order to improve the efficacy of diagnostic and therapeutic plans and, consequently, the patient's prognosis.

The government is actively implementing a start-up infrastructure and start-up support policy for successful start-up companies. However, the actual success rate of start-up companies is not high. In order to improve the performance of a start-up company, it is necessary to have a strategy that has the right entrepreneurship and efficiently utilizes its resources. In particular, opportunity exploration, resource acquisition and resource reorganization are dynamic capabilities that are very necessary for the growth of a start-up company. Therefore, the purpose of this study is to verify the effects and relationships of entrepreneurship and dynamic competence of business startups on management performance. For this study, a survey was conducted on CEOs of start-up companies less than seven years old, and 361 final samples were used to analyze data. The results of this study are as follows. The innovation, risk-taking and initiative of entrepreneurship were found to have a positive effect on dynamic capabilities. Second, the innovation and risk-taking of entrepreneurship had a significant positive effect on management performance, but initiative was found to have no significant effect. Third, it was found that dynamic capabilities had a significant positive effect on management performance. Lastly, the verification of the mediated effect of dynamic capabilities showed that there was a mediated effect between initiative and management performance. In other words, this study found a significant research result that effective management of the resources of a start-up company had an effect on management performance and growth when forwardness did not directly affect management performance. This suggests that dynamic capabilities are an important factor in the management performance of start-up companies.
Objectives: The purpose of the study was to investigate factors affecting the assessment of objective and subjective masticatory ability in the elderly, and to evaluate masticatory ability assessment more accurately. Methods: A total of 112 participants were recruited after oral examination in senior citizen welfare facilities. The participants' masticatory ability was evaluated objectively (Mixing ability index; MAI), and subjectively (Key food intake ability; KFIA). Participants' general characteristics and oral health-related variables were also recorded. Based on masticatory ability assessment, participants were classified as either high or low. IBM SPSS Statistics Ver.23.0 was used for all analyses, including descriptive statistics, Chi-square test, Mann-Whitney U test, Spearman rank correlation, and Logistic regression analysis. Results: Higher masticatory ability was positively correlated with higher scores on MAI and KFIA. Additionally, there was a significant positive correlation between MAI and KFIA. When analyzing factors affecting objective and subjective masticatory ability assessments, Functional tooth units (FTUs) were revealed as a related factor. In subjective masticatory ability assessment, oral moisture, difficulty in chewing, and the Geriatric Oral Health Assessment Index (GOHAI) were also influential factors. Conclusions: In order to accurately assess masticatory ability, it is necessary to use both objective and subjective measures. Additionally, to improve the masticatory ability in the elderly, treatment should be provided to improve overall oral health and satisfaction.
