Regulatory Compliance for the Working Environment Measurement System in Korea (작업환경측정제도 규제 순응 실태)

  • The regulatory recognition, regulatory approval, and observance for employer, inspector, and worker groups were investigated for the Korean measurement system in working environments. The employer, worker, and inspector showed an agreement of 90~97 % for the measurement of working environments. This survey showed that the measurement system of working environments has been settled in Korea. However, this survey showed an agreement of 81~87 % for reporting the results of working environment, involvement of worker representative, improvement of working environment, and holding presentations for working environment measurement. The employer recognized well for the measurement of working environments, involvement of worker representative, improvement of working environment, and holding presentations for working environment measurement, but the employee did not recognize well them as much as the employer did. Thus, the improvements for the recognition for involvement of worker representative, improvement of working environment, and holding presentations for working environment measurement by the employee are needed.

The Moderating Effects of Employer Trust on the Effect of Organizational Reputation (기업평판이 회사몰입과 이직의도에 미치는 영향에 관한 연구)

  • The purpose of this study is to examine the the effect of organizational reputation on company commitment, turnover intention and the moderating effect of employer trust. Despite the progress of organizational reputation studies, There is a shortage of employee-perspective studies. This study considered the limitation of previous study and the help to the company. This study built a exploratory model that there is causal relationship of organizational reputatio to company commitment, turnover intention and the moderating effect of employer trust on the effect of company commitment, and turnover intention. To test hypotheses empirically, the data was collected from 239 iron and steel company's workers in Po-hang. The study showed following results. First organizational reputation had the effect on the company commitment and turnover intention significantly. a positve reputation in an organization is associate with commitment and negative reputation in an organization is associate with turnover. Second perceived employer trust played the role as the moderating variable in relation with the effect of reputation on the company commitment. The implication of these results to the union and the company, the limitation and the direction of future study were suggested.

  • The purpose of this study is to understand principals' difficulties in opening procedure of employer-supported childcare center. Participants of this study were 5 principals of employer-supported childcare center. This study was carried out as a qualitative study with several in-depth interviews in group and individually. The results of this study were as follows: Principals of employer-supported childcare center have hard time 1) due to the lack of understanding of the person in charge about the distinctive nature of childcare center 2) in the relationship with consignee 3) due to collective demands of parents 4) because of the complex administration system 5) because of operation applied to the characteristics of the consigner.

  • Korean won overseas construction projects worth 71.6 billion US Dollars in 2010, which exceeded that of 2009 by 45.6%. An overseas construction project is a transaction of large scale, long term project, many parties participating, deferred payment, and of high-technology. It contributes to foreign currency earning, and also leads the nation's export restructuring work towards high value-added one. There are various kinds of risks towards the relevant parties respectively, which are key elements in successfully performing the overseas construction project. There are completion risk, financing risk, operating risk, revenue risk etc, in an employer's place. A contractor may be confronted with payment risk, issuance risk of performance bond, financing risk, performance risk of sub-contractors, and exchange rate risk. In lenders place there are repayment risk, completion risk, and political risk in the host country. In order to mitigate risks, the parties shall take relevant measures or require relevant securities. A contractor needs to evaluate the credibility of an employer in respect of payment risk, and can also request export insurance cover by the Korea Trade Insurance Corporation(the former 'Korea Export Insurance Corporation"). An employer can require a contractor to provide performance bond in respect of completion risk, and employ a well-known first class bank as a mandated arranger to arrange financing with regard to completion risk. Lenders needs to evaluate the credibility of an employer and accomplish feasibility study of the project. Lenders can request insurance cover from export credit agency. Once the parties assess the respective risks and obtain relevant securities, the project will be successfully completed. The success of the project will be sure to bring the parties involved enormous profits and another opportunity to participate in overseas construction project afterwards.

Needs for the employer-supported day care service of the married man and women workers (기혼취업남녀의 직장보육시설에 대한 요구)

  • The purposes of this study were to identify the needs for the employer-supported day care service and to analyze the factors related to the needs for the day care service of the married employees. KLFI(1995)'s National data were used and three Logistic models and one Catmod model were employed to analyse the effects of the independent variables on the needs for the day care service. The results of this study were as follows: First, half of employed workers needed the employer-supported child care service. Second, they preferred the day care center near their residential area than in their work site. Third, according to their age, type of occupation, and their difficulties for the childcare and household work, employed men and women needs on site day care differently. Finally, their needs for the expenditure of duty care service differed by their age, sex, and occupation, and their levels of difficulties for the childcare and household work. These findings suggest that duty care service for the employed man and woman are supported diversely according to their needs and preferences.

  • This study is designed to evaluate the effectiveness of TDM as a peak-period trip reduction strategy. This effort uses as a case study, the implementation of Regulation XV (REGXV) in Southern California, the most ambitious and far reaching employer-based ridesharing program implemented to date. This study explores the program effectiveness in terms of three aspects ; employee travel behavior changes after implementating Regulation XV, TDM programs offered by employers subjects to Regulation XV, and causal relationship between employee travel behavior changes and employer-based TDM programs. The study finds that Regualtion XV has a small, but statistically significant positive impact on AVR change. Popular incentives used by employers are less costly and easy to implement rather than to be effective. The increase in AVR is associated with increases of carpools promoted by strong incentives such as monetary subsides. A large number of indirect incentive programs are not effective. The study concludes that employers need to invest heavily on strong incentives, rather than on proposing diverse incentives, to comply with REGXV.

  • Currently, in Korea, an accident that takes place during a worker's commuting is generally not considered as work-related accident. However, there are several exceptions such as an accident that occurs in commuting while using transportation provided by an employer, an accident that happens during commuting time that can be regarded as part of a business activity (e.g. tending to work instructed by an employer on the way to or from work), and an accident that is caused by insufficient facility management by an employer. It is even more so as the workers' commuting distance increases with expanding scale of a city, and traffic accident occurs more frequent. Social risk of commuting-time accident is on the rise. Under this circumstance, it is an important social issue to explore how to protect workers from commuting-time accident.

  • The article analyzes the theoretical aspects of the relationship between the right to medical secrecy and the employer's right to receive information on the employee's state of health, resulting in a more complete description of the implementation of the right to medical secrecy and the employer's right to information on the employee's health state and the possibilities of protecting violated rights. The limits of permissible restrictions on the right to secrecy of health in terms of ensuring the person's performance of their job function have been clarified.

  • This study aims to look into factors which exert an important effect on the formation of cooperative employer-employee management systems of enterprises and finally to suggest an alternative for establishing the future's union-management relations. To accomplish the purpose, this research find each of important factors of the formation of cooperative employer-employee management systems through a theoretical consideration of those factors. The importance and priority order of the factors were systematized by the AHP analysis. The analysis showed the following two things. First of all, the management expecting the employees should be strengthened. Then, the establishment of transparent management and union-management systems sharing the enterprise's vision and values play important roles in the formation cooperative employer-employee management systems. In conclusion, this study provided alternative for establishing the future's union-management relations, based on the analysis results.

  • Since the early 1990s, the Korean courts have tilted in the direction of giving greater freedom to employers by relaxing the restrictions on dismissal for economic reasons. During the Korean economic crisis of 1998, the Korean Labor Standard Act was also revised for the purpose of relieving the limitation of employer's discretion in employment adjustment. From the Coasian perspective, this article analyze how implied contracts for the employee's reliance and employer's compliance might be influenced after the formal law is revised. We demonstrate that, if the legal change results in excessive intervention, it might cause the employers to over-breach, the employees to under-rely, and the accompanying efficiency to decrease. We scrutinize the total population of unjust dismissal cases since 1987 in order to investigate how the legal changes in Korea have affected the implied contracts. Our empirical analysis raises a possibility that Korean legal changes made in 1990s might have increased the employer's opportunism and decreased the employer's reliance effort.
