A Study on Improvements of Regulation for the Preventing Commercial Disputes Related to Adjustment of Subcontract Price (하도급대금 조정 관련 분쟁의 예방을 위한 법규 개선방안에 관한 연구)

  • The purpose of this study is to examine the problems of the regulations regarding the modification of subcontact price. It also suggests several measures to improve the regulations related to the subcontact price adjustment which help to reduce unnecessary claims and commercial disputes. The literature research, structure and context analysis on the subcontract regulation and survey are adopted as basic research methods. The primary findings of this study are summarized as the following: (1) A provision outlining necessary procedures that an owner and a contractor should notify a subcontract or the adjustment of contact price needs to be made. (2) A provision allowing procedures that subcontactor could make the alteration of subcontract agreement and adjustment of subcontact price needs to be made. (3) The terminology like a unit cost and the rate of contact price needs to be clearly defined in order to improve the criterions of the subcontact price adjustment. (4) The criterions and additional expenses that the contractors ate responsible far need to be defined.

  • Asbestos have been used around the world because of reliable and cost-effective physicochemical characteristics. After incubation period about 15-40 years asbestos can cause various cancers, including malignant mesothelioma when inhaled into the air. These properties turned out, asbestos have been banned from using in developed countries. Also in Korea also, the use of asbestos was banned across the board by revision of Industry Safety and Health Act in February 2009. Therefore, the problem of asbestos is not when using. It is about dismantling, maintenance, and the final processing of asbestos waste. Asbestos Cement slates which is Widely distributed throughout the country as roofing materials has much scattering potential compare with inside materials. Also Ministry of Environment is planning to introduce legislation 'Asbestos Safety Management Act' through Environment Announcement and The same Act. 24 show as follows. Minister of Environment or governor should do survey on the actual condition targeting rural buildings with slates and partly or fully fund to dissolve, remove asbestos slate which was used in each buildings. Therefore, to solve these problems, database-building and necessity of management strategies have been continually arisen. So this study was performed. Its application value is very high in terms of its political, economic. Asbestos Cement Slates database could build to collect national registered building data and then using GIS, asbestos cement Slates distribution map were constructed in each province's cities and counties of the country. And this map by Application, construction was to visualize by application, construction of year. Through these results, information of Asbestos Cement Slates could visually inform to policy makers, asbestos dismantling and management contractor, and civilian and it would alleviate the gap of knowledge information. This is expected to be utilized by medium and long-term and effective plan for demolition and dismantling of asbestos cement Slates.

Survey on CAD Softwares Used in Small Contractors and Improvement to College CAD Education (중소규모 건설회사 CAD 활용현황과 대학교육 방안)

  • A survey of small-size contractors in Jeju was conducted to investigate college graduate's CAD (computer aided design) competence. Most of small-size contractors use CAD softwares to review and update drawings submitted from an architect. This research analyzed the curriculum of the architectural engineering in several national universities. The CAD classes have 4 or 6 hours per week and use AutoCAD primarily. This research proposes that a CAD class needs at least 6 hours per week, 2D drawing is the main theme in the curriculum, and exercises to make 3D models are also included in the CAD class. The improved methods, Internet cafe and real time feedbacks using a smartphone, to evaluate the reports and exercise results are necessary.

  • EPC contractors have made continuous efforts to develop integrated project execution methods to improve the performance of industrial plant project. In particular, the concept of Advanced Work Packaging (AWP) has been recently presented by readjusting the existing "Work Packaging" concept as part of the integrated project execution method from the project life-cycle perspective. However, Korean EPC contractors are still unfamiliar with the AWP implementation. Thus, this study aims to identify the organizational competency factor for effective implementation of AWP. For this purpose, first, this study identified the expected risks in AWP project and the 29 organizational competency factors to manage risks. Second, five experts verified the suitability of factors and supplemented the factors. Finally, 37 factors were identified as organizational competency factors for implementing AWP.

  • The efficient communication process is essential to guarantee the completeness of design and secure the quality to meet the contractor's needs. However, using the existing communication methods based on the design and documents, it is difficult to effectively understand the drawings and specifications that are very complicated, and sufficient technical experiences would be required. Ineffective and inefficient communication among users, designers and project participants during the design process would raise the possibility of functional interferences of the object, induce conflicts, cause a design change, and accordingly incur losses of the project in terms of cost and time. The purpose of this study is to suggest improvement direction of communication in accordance with the requirements, by investigating the present state and the project participants' understanding of design communication. And also, it presents the application model of QFD that the project participants could share and define, and feedback the requirements as well as conducting analysis of improvement factors based on the survey.

  • A Conceptual cost estimate, which is computed in the preliminary step of a project, is important for decision-making by a contractor in terms of the project budget, economic feasibility and validity analysis, and alternative comparisons. Therefore, a high error rate of a prediction model for a conceptual cost estimate can lead to various problems including excessive project expenditures and a delayed break-even point. this study proposed optimal impact factors by configuring quantitative impact factors computable in a preliminary step in various cases(combinations of impact factors). subsequently, the accuracy of different cases was comparatively analyzed by using the cases as input values of a prediction model using regression analysis. when the optimal combination of impact factors proposed in this study and other combination of impact factors were applied to the prediction model, the regression analysis-based prediction model exhibited 0.2-4.7% improvements in accuracy, respectively. the optimal combination of impact factors proposed in this study improved the accuracy of the prediction model of a conceptual cost estimate by removing unnecessary impact factor.

  • Integrated Project Delivery (IPD) as a delivery method fully capitalizes on an integrated project team that takes advantage of the knowledge of all team members to maximize project outcomes. IPD is currently the highest form of collaboration available because all three core project stakeholders, owner, designer and contractor, are aligned to the same purpose. Compared with traditional project delivery approaches such as Design-Bid-Build (DBB), Design-Build (DB), and CM at-Risk, IPD is distinguished in that it eliminates the adversarial nature of the business by encouraging transparency, open communication, honesty and collaboration among all project stakeholders. The team appropriately shares the project risk and reward. Sharing reward is easy, while it is hard to fairly share a failure. So the compensation structure and the contingency in IPD are very different from those in traditional delivery methods and they are expected to encourage motivation, inspiration and creativity of all project stakeholders to achieve project success. This paper investigates the compensation structure in IPD and provides a method to determine the proper level of contingency allocation to reduce the risk of cost overrun. It also proposes a method in which contingency could be used as a functional monetary incentive when established to produce the desired level of collaboration in IPD. Based on the compensation structure scenario discovered, a probabilistic contingency calculation model was created by evaluating the random nature of changes and various risk drivers. The model can be used by the IPD team to forecast the probability of the cost overrun and equip the IPD team with confidence to really enjoy the benefits of collaborative team work.

  • Construction projects have unique characteristics that these may be carried out by contractors thus, cost should be estimated before execution. The importance of cost estimation and cost check has become increasingly emphasized in all phases of construction project that would be performed numerously. It is needed that owner have to estimate reasonable budget, and contractor should predict the bid price. However, there are lack of standard cost estimation method before quantity takeoff, cost analysis method, and cost database thus, the method of area cost, such as square foot method, is as used as ever in Korea. Therefore, this research suggested standard cost database structure CUBE, and analysis method of item quantity per one household categorized by area type. Whereafter, database of all item quantity of finish work has been built with 90 building cost data, and validated it's availability. In this respect, the suggested method and the findings from this research are expected to help enhancing the efficiency and productivity of cost estimation in Korea.

Application of Accrual Basis for Calculation of Prolongation Cost in Construction Projects (공기연장 추가간접비 산정기준의 발생주의방식 적용 연구)

  • Recently, Domestic public construction projects are experiencing a great deal of disputes because of the growing uncertainty about the criteria for calculating the prolongation cost. In addition, researchers have been studying various systems and proper cost estimates in an effort to reduce the uncertainty of these systems and the occurrence of disputes. However, there is no standard yet for social consensus. Meanwhile, The study on the classification system according to the recognition standard of accounting has been systematically studied. As a result, the concepts of accrual and cash basis are defined separately. The purpose of this study is to verify the possibility of applying the concept of 'accrual basis' to the Standard for calculation of prolongation cost. Therefore, As a result of analyzing the occurrence pattern of Job-site overhead cost, it is confirmed that actual costs can not be calculated by the cash-basis method. In particular, the implications of the necessity of the accrual-basis method should be more strictly indicated in the case of items such as indirect labor costs and welfare benefits. In addition, the contractor 's claim report and the appraisal report were examined. As a result, it was confirmed that the calculation situations of prolongation costs are biased to the cash-basis method. In this way, it is suggested that necessary to supplement the calculation standard of the actual costs from the point of view of accrual basis.

  • This study intends to explore the factors influencing the progress of housing construction projects by regional housing associations. In order to develop the importance weight of factors classified into 11 factors with 4 categories, AHP and Fuzzy methodologies are implemented based on survey analysis by field experts and project participants. Research findings indicate that the four categories of land, business, legal entity, and copartner, and the factors of professionalism, location, transparency, purchasing cost, administrative supervision, landlord participation, liability for damages, etc are in order of importance. It is noteworthy that the contractor, financial institution, developer, legal expert, and association consider professionalism, location, purchasing cost, and transparency as the most important factors respectively. This study aims to help provide the implication for factors Influencing the progress of housing construction project to project participants.
