A Study on Interim Measures of Arbitration - the Korea domestic perspective - (중재에서의 임시적처분에 대한 연구 - 국내 중재를 중심으로 -)

  • If the interim disposition of the Arbitration Tribunal is not immediately enforceable, it will only give pressure to the other party concerned and the arbitration could work against him if the other party fails to implement it. If enforcement is impossible, the disposition will have no practical effect or practical benefit. In addition, if a system is contrary to its unique characteristics or nature, it will not function as a system or it will become an unnecessary decoration. There is no room for argument that the above provisions are wrong or misinterpreted if the temporary disposition in arbitration cannot be characterized by its characteristics, such as its provisionality, urgency, incidentality, or invasibility. As attracting international arbitration cases can create enormous added value for the national economy, countries are scrambling to create a mediating-friendly legal environment in their countries, and Korea has been more active in arbitration than in the past. Despite various efforts, however, attracting international arbitration cases is still a long way off. Therefore, Korea should create a mediating-friendly, legal environment to attract arbitration cases. There are many reasons why arbitration is activated internationally, but the most important of them is that it is easier to approve and execute. The use of the approval and execution of heavy court is, in turn, the most important requirement of a mediating-friendly environment. It is natural that temporary dispositions made in arbitration should be as easy to approve and enforce as in the case of arbitration. In addition, it is natural for the parties to consider the use of approval and execution when deciding where to mediate or when applying for arbitration; thus, the degree of ease of execution, along with the procedural use of arbitration or provisional disposition, will be a measure of the likelihood of hosting international arbitration cases, as well as the activation of arbitration.

Investigating Foreign Direct Investment Attractive Factors of Korean Direct Investment into Vietnam

  • This paper aims to investigate FDI attractive factors, which are important to formulate policies to attract Korean direct investment into Vietnam. Based on the literature review and the results of interview with 27 Korean investors in Vietnam, we determined the model of variables attracting Korea's FDI into Vietnam. It is used to assess the impact of attractive factors belonging to three groups of variables to support investment decision; they are macroeconomics variables (including market size factor, labor cost factor, and market openness factor), policies variables (including monetary policy factor and tax rate gap factor), and microeconomics variables (geographic advantage factor representative by location). This research also utilized a relatively new quantitative research method based on the Autoregressive Distributed Lag model (ARDL) with the time data chain from 1995 to 2017 of Korean FDI into Vietnam. It analyzes long-term relationships between dependent variables and independent variables. The result of this study indicates that there are three positive factors (low wages, trade openness and government policy) explaining the FDI flows in the long term. The result also shows that incentive tax policy has had a positive impact on Korean FDI, which has satisfied the aim of seeking efficiency of Korean investors.

  • The construction industry has been behind in informatization compared to other industries such as banking, manufacturing, medical, etc. since it is not conscious of informatization and it also has difficulties in attracting investments and attracting IT experts. Furthermore, there has been lack of survey and research on that specifically what areas and how much degree they are behind in informatization. This paper presents a framework and strategy for assessment of informatization based on end users' viewpoints. The authors has already performed the assessment of informatization of general contractors based on IT experts' viewpoints. However, this paper tries to assess informatizaton of construction based on end users' aspects. The result of this research is expected to provide various aspects such as assessment, identification of needs, and problems regarding information systems. These could be effectively used as a guideline and a direction for information system development.

  • SMEs in Korea are suffering from severe manpower shortage due to poor incentive system and employees' frequent change of jobs. So far, the government has made continuous efforts to solve these problems, but SMEs still have the same problem. It is critical for SMEs to maintain core employees for long term who can directly contribute to the business performance. However, Korean manpower policies for SMEs has mainly focused on hiring new recruits and attracting experienced high caliber employees to SMEs. Relatively, policies for attracting in-house employees to work for longer term were insufficient. This paper focuses on providing strategic policy options to make core employees stay in the company for longer term. For this, it identifies the concept and features of core employees and reviews the necessity of introducing the Mutual Aid Project. Also, it suggests the way to enhance the effectiveness of policy by analyzing current Mutual Aid Fund programs in Korea.

  • The competition for attracting outstanding HRST (human resource for science and technology) who can lead technological innovation is heating up all over the world. The various concepts, which are brain drain, brain gain, brain overflow, brain migration, brain circulation, are used to explain the international mobility of HRST. But the concept of brain scout is the more adequate for explaining in the case of outstanding HRST as the main cause of excessive competition for scouting. This study analyzed the critical factors of the determinants of Korean students in the USA who have intentions of returning to Korea in view of brain scout. As the first step in this study, potential factors and hypothesis are established by the interviews. As the second step, the major factors are examined by surveys and hypothesis testing. Also, a new model for decision-making is proposed which describes intentions of returning to Korea by logistic regression analysis and contributions of each factor derived from this study were compared. Finally, policy implications for attracting outstanding HRST and the limit of this study are discussed.

Mechanisms for the Initiation of Sperm Motility (정자운동 개시 기구)

  • Initiation and activation of sperm motility are prerequisite processes for the contact and fusion of male and female gametes at fertilization. The phenomena are under the regulation of CAMP and $Ca^{2+}$ in vertebrates and invertebrates. Mammalian sperm requires $Ca^{2+}$and cyclic AMP for the activation of sperm motility. Cell signaling for the initiation and activation of sperm motility has been well studied in the ascidians, Ciona intestinalis and C. savignyi and salmonid fishes. In Ciona, whose cell signaling for activation of sperm motility has been established, the sperm-activating and -attracting factor released from unfertilized egg requires extracellular $Ca^{2+}$ for activating sperm motility and eliciting chemotactic behavior of the activated sperm toward the egg. On the other hand, the cyclic AMP-dependent phosphorylation of protein is essential for the initiation of sperm motility in salmonid fishes. A decrease in the environmental Ti concentration surrounding the spawned sperm causes a li efflux and $Ca^{2+}$ influx through the specific $K^{+}$ channel and dihydropyridine-sensitive L-/T- type $Ca^{2+}$ channel, respectively, thereby leading to the membrane hyperpolarization and $Ca^{2+}$ influx. The membrane hyperpolarization synthesizes cyclic AMP, which triggers the luther Process of cell signaling, i.e., cyclic AMP-dependent protein phosphorylation, to initiate sperm motility in salmond fishes.almond fishes.

Examination of the effect on the surrounding marine environment by disposing of a squid by-product (오징어 가공 부산물의 해양투기에 따르는 주변해양환경의 영향에 대한 검토)

  • Squid by-product like viscera has just been recognized as one of the serious pollutants on the surrounding marine environment in Ulleung island of Korea. The effect as a marine pollutant, however, has not been examined and evaluated properly. It was carried out the comprehensive examination of the marine pollution by disposing squid by-products. The sediments and water qualities were investigated in several positions, including the dumping position around Ulleung island. It is also estimated a spreading of by-product in terms of estimating the sinking speed and evaluating the attracting characteristics as a feed. As a result, There were no significant pollutions of the sediment and water quality. The spreading of by-product by the local current was 2-2.5 times of the depth, and it will become longer in spring tide. It was confirmed that the squid by-product has attracting ability for local fish by acoustical survey. Furthermore, it can be useful for the local fish species as feeds.

An Analysis on the Motivations in the Elementary Mathematics Lessons (초등수학 수업의 동기 유발 방법 분석)

  • This study was to analyze motivations in the mathematics lessons from the perspectives of preservice elementary school teachers. The participants were three groups of 62 preservice elementary teachers who were sophomore or junior students in Seoul city in Korea. Two groups of the students were enrolled at teaching and learning mathematics courses, whereas one group of students were at mathematics problem solving course. They were randomly assigned to elementary schools for their student teaching. They were required to observe mathematics lessons focusing on motivations during their participating at the two-week student teaching period. The preservice teachers were asked to observe and submit the reports of the observation in the mathematics lesson. The researcher suggested a guideline of observation and analyzed the reports according to the categories those were suggested in the guideline. The results of the analysis on the reports are summarized as follows. First, the preservice elementary school teachers considered the purpose of motivations as attracting students' interest. Second, the major ratio of motivations were attracting students' attention in the mathematics lessons. Third, the duration average time was 5 minutes 50 seconds and only limited materials for the motivations. At last, most mathematics lessons need to stimulate students' curiosity that fits to the objectives of the lessons. The researcher suggests that we need to develop various motivations in mathematics lessons with which teachers should subtlely connected to the objectives of the lessons.

  • Purpose of this study is to define competitiveness and attribution factors of Busan port on attracting high value added business such as transshipment cargo. Research finds condition to become optimal transshipment port comprises both internal and external circumstances. As for the internal circumstance, scale and location of the distripark as well as port facilities and the rates, for the external circumstance, international network and information technology on logistics managements are providing positive effects. Optimal plans to attract transshipment cargo should include, first, development of total logistics management system from port entry to unloading, transportation, processing, loading to departure. Second, assign port as free trade zone under customs law to attract foreign investment and goods traffic through tax exemption. Third, unless it is illegal, government needs to grant substantial freedom to shift capital for the foreign investors which will lead increase in cargo traffic and foreign investment.

Time delay estimation between two receivers using basis pursuit denoising (Basis pursuit denoising을 사용한 두 수신기 간 시간 지연 추정 알고리즘)

  • Many methods have been studied to estimate the time delay between incoming signals to two receivers. In the case of the method based on the channel estimation technique, the relative delay between the input signals of the two receivers is estimated as an impulse response of the channel between the two signals. In this case, the characteristic of the channel has sparsity. Most of the existing methods do not take advantage of the channel sparseness. In this paper, we propose a time delay estimation method using BPD (Basis Pursuit Denoising) optimization technique, which is one of the sparse signal optimization methods, in order to utilize the channel sparseness. Compared with the existing GCC (Generalized Cross Correlation) method, adaptive eigen decomposition method and RZA-LMS (Reweighted Zero-Attracting Least Mean Square), the proposed method shows that it can mitigate the threshold phenomenon even under a white Gaussian source, a colored signal source and oceanic mammal sound source.
