Interpretation of the ROK-U.S. Alliance and PSI (한미동맹과 대량무기 확산방지구상에 대한 해석)

  • The policy of the United States is a Korean Peninsula free of all nuclear weapons. The United States government was considering the possibility of military action to eliminate the North Korean nuclear threat. Talk of military action peaked from mid-1993 through mid-1994. Such an attack might have led directly to a Korean war. At that time the nuclear crisis solutioned by North Korea-United States negotiation and ROK-United States alliance. PSI's purpose is to prevent or at least inhibit the spread of weapons of mass destruction, their delivery systems, and related materials to and from states and non-state actors whose possession would be a serious threat to global or regional security. The most controversial activity of PSI is interdiction. North Korea has expressed grave concern over the initiative, stating that it has a sovereign right to develop, deploy, and export weapons, and that it would view any interdiction of its ships as a declaration of war. If South Korea is to execute interdiction North Korean ships expect tensions to increase dramatically on the peninsula with North Korea doing something quite provacative in response. South Korea cannot help approaching PSI with great caution, since it has to consider the ROK-United States alliance, and inter-Korean relations.

  • It's about time we had to think an alternative to recover out insufficient fishery market caused by IMF locally as well as the fishery agreement on Japan and China. The Ministry of Maritime Affairs & Fisheries have planning the advancing fishery information integrated system for the fishing present condition, marine resource administration and applicability consideration. The fishery information communication system is build up to the raw data & process-network-content. The communication system must be small size, low cost and adapted SSB transceiver, that is using fishery shipping. In this paper We present digital data communication network to exchange information for fishery and safety between fishing ship and coast station in cheeper communication fee using SSB(single Side Band) in HF(High Frequency) band.

Dynamics of Democratic Labor Union Movement since 1987 in South Korea (1987년 이후 민주노조운동의 동학)

  • This paper reviews the dynamics of growth and decline of Democratic Labor Union(Minju-nojo) Movement from the perspective of the conflicts among the industrial relations actors on the institutional incorporation of KCTU, a transformation of industrial relations institutes, and labor flexecurity in the change of political opportunity. The negotiations for the institutional incorporation of KCTU concluded in the 1997-98 labor laws. Since 1998, the conflicts and the compromises on the change of 1997-98 labor laws has continued. It was a kind of games for the transformation of the institutions of industrial relations and labor flexcurity. But the 1997-98 labor laws has shown the path-dependency. Since 2008, a cycle of the movement has entered a decline stage. The decline of Democratic Labor Union Movement came from the institutionalization of the movement, the change of political opportunity, and a generational change of 1987 cohorts group which has been the center of the movement.

Influencing Factors on the Duration of Offset Agreement (절충교역 계약 소요기간 영향요인)

  • Republic of Korea has been applying offset to defense acquisition program for some benefits such as modernization of defense industry and enhancement of R&D capabilities since 1983. But in point of implementation, there is the possibility of delay of offset agreements based on the value of proposed technologies. As it often happens that the delay of offset agreement negatively affects the time schedule of main defense deal, it is necessary to prepare for this issue. The purpose of this study is to extract some factors affecting the duration of offset agreement by statistical analysis. Reviewing existing papers and contract process, nationality of enterprise, the number of project participants, properties of project, the number of technologies in the first proposal, level of domestic defense technology in each weapons system, the amount of main contract were used as independent variable and duration of agreement as dependent variable. To hypothesis testing, correlation and multiple regression analysis were conducted using the previous 25 contract cases. As a result of correlation analysis, the amount of main contract, the number of technologies in the first proposal and properties of project have positive relationships with dependent variable. In multiple regression, the amount of main contract and the number of project participants have significant effect on the duration of offset agreement.

  • Korea's overseas construction industry has been rather depressed by the weakened profitability as well as the sharp decrease of the market shares due to the lack of international competitiveness and the declined international market. There exist a lot of various risks in performing the overseas construction, and especially EPC projects, which entail complicated process from different parts, also require a sophisticated procurement and management skill. Subsequently, to survive in the competitive international market, we need to establish strategies to select potentially profitable projects at the initial stage of bidding process and to mitigate the high degree of risk exposure through contract negotiation and its adjustment. This research discusses the trend of environment in international construction markets. Then, it identifies the key factors that affect the profitability significantly through the structured surveys from 59 actual overseas projects, and it analyzes the key factors by using statistical methods. This research provides the profitability evaluation bases, with which overseas construction participants can forecast and analyze the risk more systematically, by eliciting profit-influencing factors using the result of statistical analysis, literature review and structuring their cause-and-effect relationships. The profitability casual hierarchy structure describes the profitability factors' hierarchy in details and their interrelationships. It also enables us to find out critical factors directly related to profitability aggravation through a qualitative and quantitative analysis. Ultimately, with this hierarchy structure as the base, the research will suggest how to develop the quantitative profitability forecasting model.

Legal Review of Product Liability of a Defective Aircraft (군용항공기와 결합방지를 위한 개선방안 및 법적 책임관계 연구)

  • When a military aircraft suffers damages due to the defects in its design, manufacturing or notification, all of which are generally understood as products liability defects, the obvious compensation is sought as it would in other consumer good case. However, there exist clear yet unappreciated difference between general consumer goods and military aircraft, as far as products liability law is concerned - some sort of recovery should be obtained even when there exist only defects, not damages, to the aircraft because of the implication of defective parts is much grave than what can be expected in a consumer goods case. While certain anticipatory measures do exist in manual or at negotiation stages for the safety of military aircraft, such measures are ineffective, if not ambiguous, in recovery effort in the post-accident stage In another word, the standardized military procurement contract manuals and boilerplate forms do not appreciate the unique and dangerous military nature of military aircraft. There are many unique legal issues which can arise when trying to prevent defective aircraft or parts, or to recover compensations for accident due to such defects. At two-level, the government should establish legal system (or countermeasures if you'd like) for purchasing safer military aircraft. First, one should be able to work with legal ground and policy that allows selecting and purchasing safer goods - the purpose of such contract is not litigious, but rather in acquiring what are most reliable. Second, in case the defects do arise and lead to damages, solid legal principles and instructions should be established for effectively pursuing appropriate company, (usually a aerospace industry giant with much experience) for products liability - the purpose of such pursuit is inevitable for a public official, since he or she is no private business man with much flexibilities, even to the point of waiving such compensatory right for future business purposes. This article tries to identify problems in methods of procuring military aircraft or parts - after reviewing on how the military can improve on legal and policy grounds for procuring what will be the focus of future military strength, it will offer some of the ways to effectively handling and resolving a liability issues.

The Fourth Industrial Revolution and Labor Relations : Labor-management Conflict Issues and Union Strategies in Western Advanced Countries (4차 산업혁명과 노사관계 : 노사갈등 이슈와 서구 노조들의 대응전략을 중심으로)

  • The $4^{th}$ Industrial Revolution, symbolizing the explosive innovation of digital technologies, is expected to have a great impact on labor relations and produce a lot of contested issues. The labor-management issues, created by the $4^{th}$ Industrial Revolution, are as follows: (1) employment restructuring, job re-allocation, and skill-reformation, driven by the technological displacement, resetting of worker-machine relationship, and negotiation on labor intensity and autonomy, (2) the legislation of institutional protection for the digital dependent self-employed, derived from the proliferation of platform-mediated labor, and the statutory recognition of their 'workerness', (3) unemployment safety net, income guarantee, and skill formation assistance for precarious workeforce, (4) the protection of worker privacy from workplace surveillance, (5) protecting labor rights of the digital dependent self-employed and prcarious workers and guaranteeing their unionization and collective bargaining. In comparing how labor unions in Western countries have responded to the $4^{th}$ Industrial Revolution, German unions have showed a strategic approach of policy formation toward digital technological innovations by effectively building and utilizing diverse channel of social dialogue and collective bargaining, while those in the US and UK have adopted the traditional approach of organizing and protesting in attempting to protect the interest of platform-mediated workers (i.e. Uber drivers). In light of the best practice demonstrated by German unions, it is necessary to build the process of productive policy consultation among three parties- the government, employers, and labor unions - at multi levels (i.e. workplace, sectoral and national levels), in order to prevent the destructive damage as well as labor-management confrotation, caused by digital technological innovations. In such policy consultation procesess, moreover, the inclusive and integrated approach is required to tackle with diverse problems, derived from the $4^{th}$ Industrial Revolution, in a holistic manner.

Impacts of Immigrant Workers on Regional Economy in S. Korea (이주노동자의 유입이 지역경제에 미치는 영향)

  • Recently international movements of labour as well as those of goods and other production elements such as capitals and technology have been increased rapidly under the process of glocalization. The huge amount of immigrant workers' in-flows makes increasing influences on regional economy in South Korea. This paper examines such impacts of immigrant workers on local labor markets, productivity. and industrial composition and innovation on the basis of analysis of empirical data and review of existing literature on the subject. Despite a problem of simplification, some reasoning can be listed as follows: First of all, the inflow of immigrant workers has an effect of job displacement among domestic simple workers, with duel effects on the status of native workers; secondly, Immigrant workers give a positive effect on local productivity, but only with low level of wage and of purchasing power; thirdly, the in-flow of immigrant workers seems to prevent existing industries from transformation towards new ones and/or from automation and innovation of production facilities, while there seems no clear relationship with foreign direct investments of local firms.

  • Our nation have several procedures and law for national airspace management, however those procedures and law not enough to manage airspace. Therefore, I have studied this paper for improving flight safety and for providing economics flight of civcil aircraft and military aircraft, also, for increasing efficiency of airspace through systematic airspace management, additionally, for improving nation defense ability and for preventation our nation damage when occuring airspace problem. Nowaday. in using airspace. two theory which freely use theory and use theory under jurisdiction is opposed by every nation in worldwide. Consequently. we can realize every nation endeavour to increase their jurisdiction airspace. However. our nation is not still prepared to cope with other nation when occuring airspace trouble. because airspace definition is not prescribed on our aviation law. Therefore. several problems which are improved in our airspace management are presented on this paper. The presented matters are as follows. First, The airspace definition is not prescribed on aviation law and responsibility limit of airspace management is ambugious. Second. problem on structure of approach control area and special airspace, Third. problem on airway system. Fourth. civil agency and military agency apply respectively different regulation in establishment of aircraft flight route, To grasp these problems, considered the airspace conception, airspace classfication. legal character of airspace. our nation airspace state and management together with other nation airspace state and management. also compared our nation airspace management with other nation airspace management. And. improvement methods to solve problems which was appeared by comparing and analysis are presented on this paper.

  • Agreements such as the Uruguay Round and the New Round have dramatically changed international construction markets. The globalization of the construction industry provides tremendous opportunities for construction industry, while it generates the complex skeins of risks to contractors wllo would like to expand into new foreign markets. According to ENR, recently about $13.9\%$ of contractors that entered international construction markets have experienced loss in projects and furthermore, their average profits have also declined continuously. Accordingly, contractors need a strategic risk management system for assessing various risks and improving Profitability for overseas construction projects. This paper discusses the long-term trend of profitability performed by Korean contractors in international construction markets during the last 35 years. Then, it identifies the key factors that affect the profitability significantly through the structured surveys from 59 actual overseas projects. These factors can be used for developing a risk management system for international construction project.
