해양사고심판에서 자유심증주의의 한계에 관한 연구 (A Study on the Principle of Free Evaluation of Evidence in the Judgement of Korean Maritime Safety Tribunal)

  • 해양안전 심판은 원인규명에서 나타난 교훈을 통하여 유사사고의 재발을 방지하는 목적을 달성하고자 하며 또한 해양사고 관련자의 과실에 대하여 정계재결 혹은 시정권고 재결 등을 하게 된다. 그러나 해양안전심판원의 재결은 이른바 전문가집단의 견해로서 연정을 받으며 형사소송이나 민사소송에도 그 영향을 끼치는 것은 물론이거니와 또한 보험사 혹은 선박소유자간의 손해배상관계에 있어 합의, 협상의 근거로 사용되고 있다. 그러나 이 같은 영향력 때문에 한편으로는 재결 취소소송이 이어지고 있다. 그러므로 해양안전심판원의 재결은 이러한 사정을 감안하여 심판원이 지닌 권위의 유지를 위하여 신중하게 이루어져야 할 것이다. 자유심증주의는 법정증거주의에 대하여 인간의 이성에 대한 신뢰를 기초로 하여 천차만별인 증거의 증명력을 합리적으로 자유판단하여 실체적 진실을 발견하려는 것이다. 이는 증거의 신빙성과 협의의 증명력을 법률에 의한 규제보다 법관의 합리적 과학적 심증에 맡기는 것이므로 법관의 자의를 허용하거나 순수한 재량에 맡기는 것은 아니고 증거의 평가는 어디까지나 경험상의 법칙과 논리법칙에 따라야 한다.

  • Concrete is to be important quality in placement point and exact test method needed about early judgement method concrete on placement point. But early judgement method of concrete proposed various kind of method because the problems of accuracy and the time required of test exists, it is used within the limits. This study is to propose of early strength judgement by using microwave for accurate estimating early strength of concrete and to develop test machine. Through out this study we find that belows. 1) Strength development of concrete specimen according to the time heated by microwave showed the height strength development in 9 minutes regardless of slump and w/c. 2) As cooling time is long, strength of concrete specimen according to the time heated by microwave showed high strength development and this tendency is like regardless of heating time, w/c and slump. 3) As w/c is high, accelerating strength development according to w/c showed lower strength development and this tendency is like regardless of slump, heating time and cooling time. 4) As slump is big, compressive strength of specimen in standard curing showed lower value and as w/c is big, strength development showed lower

  • 본 연구에서는 22.9[kV] 애자의 표면오염에 의한 자외선 영상과 거동을 통해 자외선 이미지 형태 판단법을 정의하였다. 코로나 방전에 의해 나타나는 자외선 영상은 아메바, 젤리피쉬, 썬플라워 형태 등 3가지로 나누어지며, 세부적으로는 8개의 진행 메커니즘으로 구분하였다. 전력설비가 설치된 현장에서는 즉각적으로 이 판단 방법으로 전력 설비의 열화된 부분을 찾을 수 있다. 이는 신뢰성 있는 데이터를 통해 전력설비의 열화를 판단하는 기준에 활용이 가능하다. 향후 현장진단에 적합한 기술로서의 연구가 활용될 것이다.

  • The rapid impact assessment matrix (RIAM) might be a new tool for performance of an environmental impact assessment (EIA), comparing with many traditional methods of EIA, which have produced large reports setting out the subjective judgement reached by the assessors. The main criticisms of E1A are in part a natural result of the traditional method used. RIAM uses a structured matrix to allow for such judgement, both subjective and those based on quantitative data, to be made on a like-by-like basis, and provided a transparent and permanent record of the judgement made. Also, the computerized RIAM system using software program allows for the matrix to be shown in graphical form, which greatly enhances the clarity of the results produced by this method. RIAM provides a system by which development options and scenarios can be rapidly evaluated. To illustrate the use of RIAM, an example from an EIA study using application of scoping by assessment criteria in Environmental Impact Regulation of Korea was given. The criteria that might be used to evaluation EIA methods, and how RIAM measures up against these criteria, are discussed.

  • This article is focused on the review of the judgement standard for compliance of the documents in international standard banking practice. Since the establishment of Uniform Customs and Practice for Documentary Credits, The practices of the Credit transactions has been formed and developed with the rapidly changing progress of the international trade environment. but though the international standard banking practice have meaning to suggest a new examination standard, in practice, there are some problems on the judgement of the compliance of the documents. Therefore, for the useful judgement standard for compliance of the documents, the range of the standard should become concrete and simple so that all the related parties can forecast. and the opinions and interpretations published by ICC Banking Committee are recommended to be used, systematized and activated. and also with the change of the trade environment, the changed standard practice could be published annually for the useful use. and it will be necessary to consider to publish the publications in the form of the "White Book" Last, it is necessary to accept the changes by the needs of the times as the international standard banking practice promptly and analysis accurately its problems for the times of the electronic commerce, so that Credit systems should be settled and developed continuously as the useful means of the settlement of the proceeds conquering of the characteristics originated from the international transactions between the parties concerned.

When Work is Related to Disease, What Establishes Evidence for a Causal Relation?

  • Establishing a causal relationship between factors at work and disease is difficult for occupational physicians and researchers. This paper seeks to provide arguments for the judgement of evidence of causality in observational studies that relate work factors to disease. I derived criteria for the judgement of evidence of causality from the following sources: the criteria list of Hill, the approach by Rothman, the methods used by International Agency for Research on Cancer (IARC), and methods used by epidemiologists. The criteria are applied to two cases of putative occupational diseases; breast cancer caused by shift work and aerotoxic syndrome. Only three of the Hill criteria can be applied to an actual study. Rothman stresses the importance of confounding and alternative explanations than the putative cause. IARC closely follows Hill, but they also incorporate other than epidemiological evidence. Applied to shift work and breast cancer, these results have found moderate evidence for a causal relationship, but applied to the aerotoxic syndrome, there is an absence of evidence of causality. There are no ready to use algorithms for judgement of evidence of causality. Criteria from different sources lead to similar results and can make a conclusion of causality more or less likely.

한국의 수학교육 평가 유형에 관한 연구동향

  • This study was to analyze the research trend related to mathematics education evaluation in the analysis of the articles on , . The study explores the future direction of mathematics education assessment research by investigating whether such evaluation was suitable for the expectation about the assessment required in the current mathematics curriculum. This study was to classify the evaluation-related researches based on Korea educational curriculum revision from 1991-2010 to examine the research trend on the mathematics education evaluation in each season in Korea, analyze the articles by 'monitoring of student's progress', 'judgement on instruction', 'giving the value on mathematics achievement of students', 'value judgement of the program' that were the purpose of evaluation presented in 1995 NCTM(National Council of Teachers of Mathematics). As a result, looking at the research trend classified by the time of the educational curriculum revision, the 7th educational curriculum had the most number of the papers announced from 1997-2006. Despite 2007 educational curriculum revision was the short period from announced 2007-2008 before the next educational curriculum was placed, 11 papers(34.4%) were published. According to the category by the purpose of the assessment prescribed in NCTM, it showed that researches of 'monitoring of student's progress(46.9%)' were the most, those of 'value judgement of the program' and 'giving the value on mathematics achievement of students had a similar percentage.

시뮬레이션 교육에서 성찰질문과 글쓰기를 이용한 디브리핑의 효과 - 복부수술 후 환자 간호에서 (The Effect of Debriefing using Reflective Questions and Writing in Simulation Training - Post Operative Care of Abdominal Surgery)

  • Purpose: The purposes of study was to evaluate the effect of debriefing using reflection questions and writing on the critical thinking disposition, self-efficacy, and clinical judgement ability in simulation of post-operative care of abdominal surgery. Methods: The research method was a nonequivalent control group no-synchronized design. The study period was from August 22 to 30, 2016. The subjects were comprised of 34 people in the experimental group and 36 in the control group. In a simulation session for post-operative care of abdominal surgery, the treatment of the experimental group was to debrief for 30 minutes using Lasater's reflection questions and writing. For the control group, a typical debriefing was conducted in the same environment. Results: Critical thinking disposition, self-efficacy, and clinical judgement were significantly higher in the experimental group than the control group. Conclusion: To enhance the critical thinking disposition, self-efficacy, and clinical judgement of nursing students in simulation, it is recommended to debrief using reflection questions and writing.

Understanding the Left Right Judgement Test: A Literature Review

  • Background: The body schema, which is constantly updated using somatosensory information, enables accurate movement. Since pain is reported as a possible source to alter the body schema, the left right judgement test (LRJT) has been widely used in the pain rehabilitation. However, there was a lack of consistency in the effect of the pain on the LRJT results, and for the effect of the LRJT as a part of intervention programs for pain patients. The deeper understand of the LRJT is necessary for better reproducibility, and to expand the therapeutic applications of the LRJT in the pain and musculoskeletal rehabilitation. Objects: This literature review aimed to understand the LRJT and to study the potential of the LRJT for therapeutic applications. Methods: The PubMed database was searched for studies relevant to LRJT. To establish the query set, the term was regarded from various perspectives. Results: The selected studies were classified into three categories: LRJT development, factors influencing LRJT, and therapeutic applications. Conclusion: Left right judgement test is the evaluation tool for the integrity of body schema as well as a tool for implicit motor imagery. Pain, proprioception, and other factors influence the performance of the LRJT.

전문심폐소생술 교육에 Lasater의 임상판단 루브릭을 적용한 디브리핑의 효과 (Effects of the Lasater's Clinical Rubric of Debriefing in Advanced Cardiovascular Life Support Training)

  • 본 연구의 목적은 시뮬레이션 수업 후 Lasater의 임상판단 루브릭을 이용한 디브리핑이 간호학생의 비판적 사고성향, 문제해결능력과 임상판단력에 미치는 효과를 검증하는 것이다. 비동등성 대조군 전후 시차설계를 이용한 실험연구이며, 연구대상은 12그룹 60명으로 무작위로 실험군 (n=30)과 대조군 (n=30)을 배정하고, 실험군에게는 시뮬레이션 교육과 Lasater의 임상판단 루브릭을 적용한 디브리핑을 실시하고, 대조군에게는 구조화된 도구를 사용하는 것이 아니라 질문과 피드백으로 이루어진 일반적 디브리핑을 실시하였다. 자료수집은 2015년 6월 15일부터 6월 22일까지 이루어졌으며 비판적 사고성향과 문제해결능력은 자가보고형 설문지를 이용하여 측정하였고 임상판단력은 Lasater의 임상판단 루브릭으로 측정하였다. 연구결과 비판적 사고성향은 실험군은 실험 전 $3.5{\pm}1.4$점에서 실험 후 $3.6{\pm}1.3$점, 대조군은 실험 전 $3.5{\pm}1.4$점에서 실험 후 $3.4{\pm}1.2$점(t=1.86, p= .022), 문제해결능력은 실험군은 실험 전 $3.4{\pm}1.6$점에서 실험 후 $4.0{\pm}1.8$점, 대조군은 실험 전 $3.5{\pm}1.5$점에서 실험 후 $3.6{\pm}1.6$점(t=3.21, p=< .011) 및 임상판단력은 실험 후 실험군은 $11.5{\pm}1.7$, 대조군은 $9.3{\pm}2.3$(t=4.14, p=< .001)으로 실험 후 비판적 사고성향, 문제해결능력, 임상판단력 모두 실험군이 대조군보다 통계적으로 유의하게 높게 나타났다. 이를 통해 Lasater의 임상판단 루브릭을 이용한 디브리핑은 임상판단력을 향상시키는데 유익하므로 시뮬레이션교육에서 Lasater의 임상판단 루브릭을 사용하는 디브리핑이 필요하다고 사료된다.
