요양종결 이후 산재근로자의 취업기간 분석 (An Analysis on the Employment Duration of the Workers Injured in Industrial Accidents)

  • 1998~2000년에 신규로 장해등급이 판정된 남성 산재근로자를 대상으로하여 산재보상 수급자 데이터베이스와 고용보험 피보험자 데이터베이스를 결합함으로써 취업력(labor history)을 재구성하였다. 이 자료에 기초한 분석 결과에 따르면, 먼저 원직장복귀가 산재근로자의 주요한 직장복귀 경로이며 고용유지에도 유효하였던 반면, 요양종결 이후의 취업자들은 상대적으로 높은 이직률을 보였다. 그리고 직장복귀자의 약 6할은 이직을 경험하는 것으로 나타났으며, 이직자 가운데 77%는 이전 직장의 취업기간이 1년 미만이었다. 한편 다중위험모형을 이용한 취업기간 분석에서 사업장 규모가 작을수록 그리고 비자발적 이직의 경우에는 직업탐색기간이 길수록 산재근로자의 취업기간이 짧아진다는 사실을 확인하였다. 뿐만 아니라 요양종결 이후의 첫 직장에서 일자리를 유지하는 기간이 길수록 이후의 취업과 고용유지에도 긍정적인 효과를 보였다.

강풍 피해에 따른 피해비용의 효율적인 산정을 위한 분류체계 개발 (Development of Categorization System for Efficient Calculation of Damage Cost according to Strong Wind)

  • In this study, the plan to construct a disaster information categorization system that can be objectively and efficiently performed was suggested in order to perform disaster management task systematically. Recently, the damage of natural disasters is gradually growing larger and faster, increasing the economic loss. Especially, as for the domestic storm damage, the damage from strong wind was found to be greater than the damage from torrential rain. Also, strong wind was found to be inflicting a great damage on human life, property and agricultural crops, so the necessity to study damage restoration from strong wind is increasing. Nevertheless, the damage items categorized in the domestic disaster year book are often comprehensive or unclear in criteria, and thus fail to reflect items or matters due to actual disaster damage. It is difficult to aggregate damage accurately such that it does not correspond to the national compensation scope or the damage amount is calculated according to subjective judgment of the investigator in charge. As such, if the disaster information management is inadequate by not applying accurate categorization criteria from damage amount calculation, there can be an issue with fairness when paying the damage support aid. Therefore, this study suggested a categorization plan for objective and efficient execution of disaster information management task in order to resolve such issues. It is expected that quick and efficient execution would be possible in disaster information management and task procedure domestically by constructing systematic categorization system related to disaster information.

  • 건설사업은 목적물의 특성, 사업규모, 계약방식 등에 따라 다양한 사업주체가 참여하고 그로인해 복잡한 의사소통 구조를 가지고 있기 때문에 이해관계의 대립으로 인한 클레임 및 분쟁이 지속적으로 발생하고 있다. 그런데 분쟁의 사례를 살펴보면 상당수가 시공사와 발주자 사이에서 발생하고, 발주자의 우월적 지위에 따른 불공정 관행이 원인이 되어 분쟁이 제기되고 있다. 이에 본 연구는 상대적으로 계약적 약자인 시공사를 정보 활용 주체로 설정하고 대한상사중재원의 중재판정 사례를 바탕으로 분쟁 발생 유형 및 원인별 분석뿐만 아니라 보상비용 등에 관한 분석을 수행하여 시공사의 분쟁에 따른 시간적, 경제적 손실을 최소화하고자 하였다. 이를 통해 공사 수행 중 발생 가능한 분쟁 대응전략을 수립하는데 도움을 줌으로 써 원활한 합의 유도 및 공사의 완성도를 높이는데 기여할 수 있을 것으로 기대한다.

  • 본 논문에서는 1982년, 1985년, 1990년, 1995년, 1998년이라는 5개 시점을 택하여 관민(官民)간 평균적 보수격차와 보수불평등도를 측정하고, 공공부문과 민간부문의 순(純)근로소득 격차를 시계열적으로 추정하였다. 추정 결과 우리 나라 공무원의 평균 근로소득은 민간부문보다 높았으며, 공무원은 학력 경력 직종 등을 통제한 후에도 높은 순(純)임금프리미엄을 누려 온 것으로 나타났다. 또한 공무원의 소득불평등도에 있어서는 민간에 비해 극도로 소득평준화가 이루어지는 특징을 갖고 있었다. 그럼에도 불구하고 우리 나라 공무원의 보수가 낮다는 인식에 대해 본 논문에서는 그 이유를 공무원 사회의 임금평준화 경향 때문으로 보고, 상위직과 하위직 간의 급여격차 확대 및 하위직 고용유연성 제고를 통한 해결방안을 제시하고 있다.

토양오염지역의 책임에 관한 우리 나라, 미국, 영국, 독일, 네덜란드, 덴마크 법과 제도의 비교 분석 및 우리 나라 정책개선방향 (Problem Findings Regarding the Legal Liability of Soil Contaminated Sites in Korea, and it's Policy Suggestion from a Comparison Study to U. S., U K., Germany, Netherlands, and Denmark's Policies)

  • Attempts were made to compare and analyze the policies of the United States, the United Kingdom, the Netherlands, Germany and Denmark concerning Korea's major problems associated with legal liability of the contaminated sites. These countries were chosen from a feasible preliminary analysis of 18 countries of the EU and the U. S. The major problems were revealed based on the analysis of Korean legacy and legislation, which are summarized as follows i) lack of clear detailed technical and legal guidance to determine the responsible party or parties of contaminated sites, ii) no distinction between the strict and non strict legal liability of innocent land owners, iii) no clearly set limit on retroactive legal liability. Comparison of the policies of countries chosen suggested improvements regarding these major problems as follows: i) activating national and international research on soil contamination prevention policy, ii) arranging distinct legal regulation between strict and non strict liability criteria, iii) establishing the limits on innocent and non strict liability, iv) establishing methodology and process of legal liability distribution and compensation, and v) establishing a legal process to redeem any benefit derived from remediation of contaminated sites with the public budget. Our policy suggestions above are not yet conclusive due to a lack of policy implementation simulation. Additional research is needed on aspects of social, economic and long term effects of the proposed policy directions. Nevertheless, application of the policy suggestions of this research would increase the efficacy of Korean policy regarding the survey and remediation of the potentially contaminated sites.

  • It is a well recognised rule in international law that the property of aliens cannot be taken. The question of whether indirect expropriation and government regulatory measures require compensation is an important issue in international investment law. Bilateral investment treaties and other investment agreements contain brief and general indirect expropriation provisions. These focus on the effect of government action and do not address the distinction between compensable and non-compensable regulatory actions. It is generally accepted that a state is not responsible for loss of property or for other economic disadvantages resulting from bona fide general taxation accepted as within the police power of states, provided it is not discriminatory. Yukos Oil Company is a Russian oil and gas company engaged in exploration, refining, and marketing activities. It is one of the largest oil and gas companies in the world. Yukos Oil Company has its production operations in Russia and markets its products in Europe. An international tribunal ordered the Russian government to compensate a group of Spanish investors for the losses they suffered when Russia seized the Yukos Oil Company on July 26, 2012. This has been the subject of several judicial proceedings and academic publications. This paper explores which circumstances do not lead to taxation amounting to expropriation. The author suggests that under the following circumstances, taxation would not amount to expropriation. First, taxation should be non-discriminatory. Also a lawful exercise of the taxation powers of governments would not amount to expropriation.

Thin Film Transistor Backplanes on Flexible Foils

  • Several laboratories worldwide have demonstrated the feasibility of producing amorphous silicon thin film transistor (TFT) arrays at temperatures that are sufficiently low to be compatible with flexible foils such as stainless steel or high temperature polyester. These arrays can be used to fabricate flexible high information content display prototypes using a variety of different display technologies. However, several questions must be addressed before this technology can be used for the economic commercial production of displays. These include process optimization and scale-up to address intrinsic electrical instabilities exhibited by these kinds of transistor device, and the development of appropriate techniques for the handling of flexible substrate materials with large coefficients of thermal expansion. The Flexible Display Center at Arizona State University was established in 2004 as a collaboration among industry, a number of Universities, and US Government research laboratories to focus on these issues. The goal of the FDC is to investigate the manufacturing of flexible TFT technology in order to accelerate the commercialization of flexible displays. This presentation will give a brief outline of the FDC's organization and capabilities, and review the status of efforts to fabricate amorphous silicon TFT arrays on flexible foils using a low temperature process. Together with industrial partners, these arrays are being integrated with cholesteric liquid crystal panels, electrophoretic inks, or organic electroluminescent devices to make flexible display prototypes. In addition to an overview of device stability issues, the presentation will include a discussion of challenges peculiar to the use of flexible substrates. A technique has been developed for temporarily bonding flexible substrates to rigid carrier plates so that they may be processed using conventional flat panel display manufacturing equipment. In addition, custom photolithographic equipment has been developed which permits the dynamic compensation of substrate distortions which accumulate at various process steps.

미역양식업의 생산조정과 가격지지 (A Study on the Production Adjustment and Price Support Program of Sea Mustard Aquaculture)

  • The market conditions of sea mustard is changing by overproduction, decreasing price, Import of blanched and salted sea mustard from China into Korea domestic market and increasing market share of sea mustard of China in Japan. In addition, the price support program in sea mustard aquaculture must be modified due to the restriction of domestic support by international organization such as WTO. There are two ways to solve those problems. First is that finding a way to solve the overproduction of sea mustard. One of possible ways is the production adjustment by Marketing Order. Second is that finding an alternative way to replace price support program. The possible way is Direct Payment instead of purchase stockpile system. To introduce marketing Order, outlook center, organization of self-management, production adjustment through output control measure, improvement of market structure, and education/publicity arc necessary. Also, to implement marketing order, setting a model business by government is required. There are two steps for implementation of marketing order. First step is to construct Order Committee including organization of producer, people related marketing. However, this committee must run by government for certain short-term. Second step is to improve quality of product and acceleration of demand. At visual point that enforcement of the first step is completed, government has process that government transfers Order Committees self-correcting. It is desirable that government only conduct the support acts such as quality improvement and acceleration of demand. Also, at early stage it is necessary to have aid system for marketing order For example, we can expect that income increase by production adjustment in long run. However, in short run the income of producer may decrease so, it is required to compensate his economic lose. For compensation, The useful means that can be utilized is direct payment. Direct payment is not continued policy. Also, when production adjustment policy such as Marketing Order has effective results, Direct Payment as an assistant measure must be reduced or abolished. Therefore, when production adjustment acts as an effective tool to control overproduction, Direct Payment system.

서울 지역 주부들의 건강과 관련된 식생활 의식구조 (Health-related Dietary Attitudes and Behaviours among Mealmanagers in Seoul Area)

  • In this survey, we investigated the way of thinking about meal management of housewives including the sincerity to meal preparation, the eating practices and cronic degenerative diseases related dietary behaviors, and studied the effects of above factors on the real food intakes. We also investigated the trends of health-foods and nutrient supplements usage. The results obtained from 506 housewives in Seoul were summarized as follows. Although our subjects prepared their meals habitually without special concern, they did not prefer the use of convenient foods. The food prefrence of housewivess who had more child and refered higher life status was similar with other family members. The dietary attitudes were good in large family, the higher income and the more child group. The highly educated group skipped breakfast more frequently. The mealmanagers with better education career and good living status considered for the restriction of salty foods, sweet foods, animal fats and pungent foods, and for the nutritionally balanced diet. The high income group showed great concerns about weight gain at meal times. The nutritional qualities expressed by the frequency of food group intakes were high in the better educated and living status groups, and their eating frequencies of animal protein foods and calcium sources were significantly high. Mealmanagers who had no job intaked vegetable oils through frying foods frequently. The use of health-foods and nutrient supplements was influenced by age, educational and economic level and self-estimated living status, but the trends in prevalence of both were not consistent. Health-foods were prefered by the groups of high educational career, affluent income and advanced living status, and low educational career, low income and low living status groups favored the nutrient supplements. The restrictive intake of animal fat and the use of health-food were positively correlated, which seemed that the subjects used health-foods as supplements in compensation for nutritional unbalance caused by the avoidance of animal protein foods.

사할린 영주귀국 동포의 주거생활사 - 안산시 고향마을 거주 강제이주 동포를 중심으로 - (Housing History of Sakhalin Returnees in Ansan Gohyangmaeul)

  • The purpose of this research was to find out the housing history of Sakhalin returnees in Ansan Gohyangmaeul since leaving hometown under the Japanese ruling period, who experienced two international migration for one's life. Face to face interview had been done with 20 returnees in the community center of Ansan Gohyangmaeul during October to December, 2008. The semi-structured questionnaire about housing the respondents lived in major life changes used to guide the individual interview. The results showed that personal life as well as housing histories were differed by the reason to move into Sakhalin, which still influenced the returnee' life up to now. The housing they had lived changed from barracks like a training camp, to Japanese small wooden cottage/row house, and then Russian brick house/ apartment. Housing alteration and addition and rebuilding were common to renew the old existing house. The boundary of residing area was mostly limited to the first residing location under soviet governing system throughout one's life without a long distance move. Housing satisfaction was very high in Gohyangmaeul because of the improvement of housing facilities and residence itself as well as the convenience of housing management, compared to former residence in Sakhalin. Economic and emotional aspects of life satisfaction were also high during about 8 years of living in the apartment. Forced movers still require the compensation on hand to either Korean or Japanese government no matter the amount. Social integration to the Korean community would be one of the main issues to new returnees as well as the already returned. In-depth interviews of case study need to reveal the unique housing experience of the forced mover according to the type of leaving hometown by oneself or by parents, and to returned region and time to motherland.
