창의적인 아이디어를 등록할 수 있는 블록체인 기반의 저작권 관리시스템 (Blockchain-based Copyright Management System Capable of Registering Creative Ideas)

  • 최근 웹툰이나 웹소설처럼 저작물로 보호되어야 할 디지털 콘텐츠들이 손쉽게 복제되어 유포되면서 불법 복제가 사회적인 이슈로 떠오르고 있다. 이와 관련하여 본 논문에서는 블록체인을 적용하여 저작물 위변조 방지, 보안성 향상, 거래 속도 향상, 비용 절감, 가시성을 향상시킬 수 있는 저작권 관리시스템을 제안하였다. 시스템은 기존과 같이 공식적으로 저작권을 등록할 수 있고 더불어 단순한 아이디어 수준의 저작물도 시스템에 등록할 수도 있다. 후자의 경우는 창작 아이디어가 떠오르면 언제든지 시스템에 등록하여 추후에 자신의 독자적인 저작물이라는 것을 증명할 수 있는 수단으로 활용할 수 있다. 시스템은 특히, 용량이 큰 콘텐츠의 경우, 트랜잭션에 콘텐츠의 해시 결과 값만을 포함시키고 원본 콘텐츠는 별도로 관리하여, 네트워크 참여 노드들이 처리해야 할 데이터의 양을 줄이고 스토리지 용량을 대폭 감소시킨다.

  • 졸업 연구작품 제작에 참여한 학생들과 참여하지 않은 학생들에게서 인식되는 창의적 능력, 창의적 성격, 창의적 리더십 및 융합적 사고와 관련된 역량을 파악하였다. 창의적 능력에서는 참여 학과 학생들에게서 다양한 전공 분야의 이해를 통한 아이디어 창출에 대한 부분의 교육에 더 많은 교육과정과 비교과 활동의 운영이 필요하나 전체적으로는 비참여 학생보다는 높은 긍정적 결과를 얻었다. 창의적 리더십 및 융합적 사고에서는 종합설계와 졸업작품을 진행한 학생이 더 긍정적인 면을 보여주었으며 미참여 학과 학생들은 고등사고, 복잡한 현상의 논리적 분석 및 전체적 파악 등에서 창의적 역량이 부족함을 나타내었다.

현대패션에 나타난 아트모드에 관한 연구 (A Study of the Art Mode in Modern Fashion)

  • This study was aimed to make clear fashion is an expression art displaying not only functional or commercial aspects, but creative functions as an artistic work by analyzing Art Mode and its values, and to help develop more creative design by combining fashion with art. In terms of method, relevant documents, precedent studies, and the works announced in domestic and foreign fashion collections, such as Vogue, Fashion News, Gap, and Collections from 2000 to 2009. According to the findings, artistic works were used by the Art Mode in modern fashion. The respect of artists was expressed using historic famous painting works or current works in various fields, designers' individuality was shown by directly applying work messages to clothes, and fashion design was converted into a tool to communicate the messages like artistic works. Second, the various styles, using the formative character of modern art styles from animalism to modern abstractism, showed the creativity of design, transformed art into the art that enables to see the image of modern art, and presented the possibility of developing into a newer creative design through the application of numerous art styles and the transformation of ideas. Third, the collaboration with artists was used. Fashion designers or fashion brands tried to change the images of works or brands in partnership with artists or to increase differentiated images. The future direction of fashion is a pursuit of new form and content to express fashion, not simply to use artistic works. It is expected that such pursuit will lead to more creative and artistic fashion design.

패션 디자인과 생성형 AI: 창작물의 범주와 윤리적 과제 (Fashion Design and Generative AI: Categories of Creative Works and Ethical Challenges)

  • This study investigates the intersection of generative AI and fashion design, with emphasis on the recognition of artificial-intelligence (AI)-generated works as creative outputs and the associated ethical and legal challenges. Generative AI technologies, such as GANs and diffusion models, have revolutionized the fashion industry by enabling the rapid creation of innovative designs. Despite these advancements, significant issues persist regarding the attribution of authorship and copyright protection. Current intellectual property frameworks in the U.S., the EU, and South Korea predominantly recognize human creators, which implies that AI-generated works are not copyright protected unless significant human creative input is demonstrated. This study reviews the relevant policies and guidelines from major organizations such as WIPO and the U.S. Copyright Office and examines various case studies to illustrate these points. Additionally, the ethical implications of AI in fashion design, particularly concerning data bias and transparency, are critically analyzed. The findings underscore the necessity for transparent and fair data usage, clear documentation of the creative process, and human-AI collaboration. This collaboration should enhance creativity without overshadowing the unique artistic contributions of human designers. The study concludes by recommending the development of robust legal and ethical guidelines to ensure responsible and innovative use of AI in fashion design. These guidelines aim to protect the rights of human designers while fostering a collaborative environment in which AI serves as an enabler of creativity and innovation.

  • The purpose of this study is to find out the creative visual expression in fashion illustration through the previous general theories on creativity. The creative visual expression, in fashion illustration works, can be summarized eight categories as follows. There are 'maximization & minimization'to emphasize the illustrators'emotions and contemporary trends, proposed specially in body expression, 'inversion' seen as the forms of contra-perspective, upside-down, rearrangement of parts, diverted process, etc, 'Unusual uses'to add the effect of caricature, parody, and humor to the fashion illustration works, 'extraordinary connection'seen as the shapes of various combination between animals, plants, stuff, and man, 'concealment & elimination'used frequently in creative visual expression includes a deformed human body, an abstracted human body, an extreme value contrast, simple colors, and dress in silhouette, 'association'seen in various methods; comparing the similar shapes, describing a certain situation or details for analogizing the whole, ‘illusion’ expressed in surreal, mysterious, and fairy depictions and 'substitution'to imitate the composition and colors of masterpieces, copy the parts.

저작권법의 시각에서 본 연극연출의 창작성과 법적 지위에 관한 연구 (The Study on the Creativity and Legal Status of Directing from Copyright Law Point of View)

  • This thesis purposes to suggest that creative stage directors have copyright ownership and we make them create high-quality of theatre direction. Stage directors are sincere creator of the theatre stage today. We have little judicial precedents about stage directors, no artistic examination related directing. Stage directors are performers who have neighboring rights, there is a problem that they won't have the exclusive right of making derivative works in this country. Others will make creation (such as cinemas, animations, novels) based on stage expression without permission, because stage directors don't have exclusive right of making derivative works. Copyright law can't protect the concept of stage directors and building blocks of them which are drama text, actors and theatre space, because copyright law don't protect idea according to idea/expression dichotomy. The expression of stage direction is belong to five fundamentals which are composition, picturization, movement, rhythm, pantomimic dramatization that are come from Dean & Carra's work. Directors' work is to make theatrical works based on literary works. Therefore, theatrical works are derivative works which based on drama texts. Also, theatrical works are able to be joint works. In the case of that stage directors write drama text and create expression on the stage, they have to own authorship of both works. Merger doctrine should not apply theatre directors' works strictly like any other functional works because stage directors usually create noble expression which have been not before. We need shift of the definition of theatrical works which are derivative works or joint works to protect theatre directors' creativity. Hereafter, the special legal section for dramatic(theatrical) works including the flexible legal definition for performing arts should be established, and 'contract form' for stage directors should be made. Acting edition(literary works) should be published to grant creative directors compensation. I emphasize to grant ownership of copyright to creative stage directors, to encourage directors' works. Therefore, copyright law will be the support for development of cultural arts institutionally.

A Creative Apparel Up-cycling Design Development Using Creative Thinking Methodology

  • Fashion is the second most polluting industry. We must strive to transition to a form of industry that does not cause environmental pollution. These efforts drive may fashion brands to produce and sell products with redesigned methods that delight the inventory flow. Accordingly, it is necessary to develop creative apparel up-cycling design using the creative thinking method. This study aims to produce clothing redesign works by introducing design idea types for systematic redesign creation. In this research, we conducted a literature review on the concept of up-cycling design and employed heterotopa spacial concept reflected fashion design creation methodology types. The RE;CODE, a leading domestic up-cycling design brand, was used in case analysis. According to the command of shape transformation, it is spreading, stacking, dropping, inverting and crossing, from the creative thinking method reflecting heterotopia spacial concepts, showing designers a concrete way to transform form into new apparel. Seven works of apparel up-cycling design were developed by conducting process of RE;CODE. Also, to establish an apparel up-cycling design creation process for creating works. In this study, we proposed a systematic method for apparel up-cycling design, including a method for reorganizing two or more different materials to create something new and ultimately reversing the structure. The value and significance of this study is that it proposes a systematic method for apparel up-cycling design to make it new.

제품디자인에 있어서 창의성에 관한 연구 (A Study on Creativity for Product Design)

  • The ability of 'creative thinking' is one of the most important fact for designers to complete their design process. It is not only the overall concept of the process but also all details related to each steps of the process such as planning product strategies, research, finding ways to solve problems image development, broadening ideas, etc. It is, however, not easy to creative as designers by natural learning through experiences unless they have geniuses for creative designing. Many experienced designers in the field are even in dilemmas being not be able to differentiate from copying other designs. This study is focused on the researches on the works of famous designers, architects and artists who have shown great creativities throw their works or processes. It is aimed to define their ways of thinking which could be fundamental motives for the creativeness, various behavioral methods to solve problems in creative ways, technical approaches to improve creativities, and overall intuition in the design working processes.

20세기초 유럽 디자이너들의 작품에 나타난 표현주의적 특성 (Characteristic of Expressionism on the European Designer's Works in the early 20th Century)

  • The purpose of this study is to observe artistic of Expressionism reflected to works of European costume designers by analizing works of seven major representative costume designers in the twentieth century. They are Mariano Fortuny, Paul poiret, Madelene Vionnet, Jean Patou, Jeanne Lanvin, Gabriel Chanel and Elsa Schiaparelli. These designers deployed individual and various creative costume design work with peculiar expresive techniques, which is based on the Expressionism. Although each creative work was made in extremely unique sense, there was comon expressive spirituality I their creative activity. The findings are as follows : 1. Based on the "Medieval-directed characteristic" which arose over all fields of art of those days, a modern and reformative clothing beauty was created by reanalyzing traditional motive. 2 Characteristic of Cubistic Expressionism were described in overall silhouette of clothing and fine decorative element. 3. Fantastic Expressionism, which pursued basic worth from the primitive and ethnic customs, effected costume style of early 20th century and draw such designers as Mariano Fortuny, Leon Bakst, Paul Poiet, Elsa Schiaqarelli to adopt intensive and primary color. And it also gave an impact against traditional concepts by accepting fantastic oriental Exoticism.Exoticism.

대중가요의 창작성 요소에 관한 고찰 (A Study on the Creative Elements of Popular Music)

  • 1850년 프랑스에서 시작된 음악 저작권은 건축이나 미술 등의 분야처럼 시각적으로 고정이 되어있는 저작물에 대한 권리와는 다르게 곡 시간의 흐름에 의한 저작물이다. 음악 저작물의 보호되어지는 범위는 다른 분야의 저작물과 같이 전체 음악이기 보다 음악저작물 안의 각각의 요소와 구조를 분석하여 법적으로 권리를 주장할 수 있는 창작적 표현이라 판단되는 부분을 보호의 범위로 보는 것이 타당할 것이다. 우리나라 대중가요에서 표절에 관한 이슈 중 창작성 판단은 원고의 저작물에 대한 보호에 해당 되는지 여부를 가리는 측면에서 매우 중요한 부분을 차지하는 것으로 보인다. 저작물로 인정되는 곡안의 아이디어나 창작요소의 판단은 중요한 논점이다. 창작성을 판단하기에 앞서 해당 표현이 창작의 표현에 해당하는 음악적 요소에 대한 문제는 법원의 판단이 아닌 산업과 학계에서 검토되어 공감대를 형성해야 할 문제라 판단된다. 또한 오늘날 대중가요는 저작권을 보호받는 저작물 중 창작적 표현의 논의가 없었던 것으로 보인다. 본 논문을 통해서 대중가요의 창작적 요소와 비창작적 요소를 구분하고, 창작적 표현 요소에 대한 음악 창작자들의 공감대를 마련하는 시론이 되고자 한다.
