This study examines the Buyer's Remedies in respect of Defects in Title under SGA. As SGA divides contractual terms into a condition and a warranty, its effects regarding a breach of a condition or a warranty are different. Where a stipulation in a contract of sale is a condition, its breach may give rise to a right to treat the contract as repudiated and to claim damages. Where there is a breach of a warranty in a contract of sale, the aggrieved party may have a right to claim damages. Regarding a breach of a condition under SGA s 12(1), although the buyer may have his right to terminate the contract, he may lose that right when he accept or is deemed to have accept the goods by intimating his acceptance to the seller, acting inconsistently with the ownership of the seller, or retaining the goods beyond a reasonable time without rejecting them. Furthermore, the buyer may claim the estimated loss directly and naturally resulting from seller's breach. SGA contains the principle of full compensation and so the suffered loss and the loss of profit are compensable. As to specific performance under SGA, the court has been empowered to make an order of specific performance to deliver the goods in conformity with the terms of the contract and so it is not a buyer's right. This order should be made only where the goods to be delivered are specific or ascertained goods and the court must think fit to grant the order. However, among these remedies, the buyer cannot have the right to terminate the contract where there is a breach of warranty by the seller under SGA s 12(2).
Clearly there are many legal arguments and criticisms surrounding the proposals for change in the Warsaw Convention and the need for a radical review. 최근 잔여지 매수 관련 고충민원이 증가하고 있는 상황에서 '잔여지 매수규정'을 보다 구체화 해야 한다는 필요성이 제기되고 있다. 잔여지는 공익사업에 편입되고 남은 토지로 '잔여지 매수청구'에 의해 사업시행자가 손실보상을 하고 있다. 본 논문은 지방자치단체에서 수용재결한 잔여지 사례를 중심으로 시사점을 제시하는 한편, 피 수용자에게 정당한 손실보상으로 권익 보호와 효율적인 보상행정을 하기 위함이다.
Purpose: This study was constructed in order to examine factors that influence work-related musculoskeletal disease (WMSD) approvals and current status according to the company size. Method: This is a descriptive study that utilized Industrial Accident Compensation Claim Data. Workplaces with over 35,811 workers derived from the 2012 claim data, which comprised approximately 91.5%, were selected for this study. Then workplaces were divided into three groups according to the number of workers: less than 5, 5~299, and 300 and over. Results: Since 2008, the number of small sized workplaces has increased. The 2012 data showed that 32.5% of workers at small sized workplace had WMSD. However, workplaces with 5~299 workers showed WMSD approval rate of 60%. Of note most WMSD approved workers were employed by manufacturing and construction companies, regardless of the workplace size. Most of them were engaged in elementary tasks. The days of medical treatment at OPD and IPD were most prevalent among workers at the largest workplaces. Conclusions: It is certain from this study that WMSD has been polarized by the company size. More policy attention should be paid to the WMSD status of workers at small sized workplaces which usually do not have their own health office.
This article is focused on the review of price reduction and measuring damages under the CISG together with the law relating to sale of goods in main countries when the goods delivered did not conform with the contract. And also reviewed on the election of remedies for the aggrieved party, that is, which one between the two remedies would provide more compensation for the non-conformity. This article can be summarized as below. 1. Price reduction has its principal significance when the buyer accepts non-conforming goods and plays important role only when the seller is not liable for the non-conformity because the same price reduction formula applies for all circumstances. Of course, the buyer must bear any further damages, such as shutdown expenses and other consequential damages. 2. If the seller is liable for the damages and the price level rises, the buyer normally will claim damages since this approach is much more favorable result than price reduction. 3. In case the seller is liable for the damages and the buyer suffers no consequential damages, if the price level falls, price reduction would provide more compensation for the non-conformity than would damages and if there is no change in the market level, the allowance for defects in the goods will be normally the same under the price reduction and damages. By the way, In case the seller is liable for the damages and the buyer suffers consequential damages, it is desired that the buyer firstly elect the price reduction and later seeks to claim for consequential losses when the price level falls and unchanged.
본 논문에서는 2020년 3월 12일 제시된 EU사법재판소의 A and Others v. Finnair Oyj 판결을 검토해 보았다. 본 판결은 대체항공편에서의 운항지연의 경우에도 금전보상청구를 인정하였다는 점에서 중요한 의미가 있는 판결이다. 이에 본 논문에서는 아직 아직 국내에 소개되지 않은 본 판결을 분석하여, 향후 항공여객의 권리보호 논의 내지는 EC 261/2004 규칙의 해석론적 검토와 관련한 비교법적 참고자료의 역할을 하고자 하였다. 본 논문에서는 먼저 A & Others 판결의 사실관계를 정리하고 EU사법재판소의 판시사항을 개관해 보았다. 몇 가지의 논점들과 EU사법재판소의 판단 법리를 정리한 후, 논문의 구성적 논점을 크게 ① 대체항공편의 운항지연과 그와 관련한 여객의 보상원칙 및 ② 운송인 면책사유로서의 특별한 사정의 해석기준으로 나누었다. 이렇게 논점을 구분하여, EC No 261/2004 규칙의 각 규정들, 기존에 제시된 EU사법재판소 판례의 경향과 함께 본 A & Others 판결을 구체적으로 살펴보았다. 결론적으로는 본 판결의 취지와 항공여객운송실무상의 시사점 등도 생각해보았다. 또한 우리법과의 비교법적 논의도 간략하게나마 언급해 보았다.
Background: In workers with moderate to severe work-related traumatic brain injury (wrTBI), this study aimed to investigate the effect of the timing of rehabilitation therapy initiation on the length of hospital stay and the factors that can influence this timing. Methods: We used data obtained from the Republic of Korea's nationwide Workers' Compensation Insurance. In the Republic of Korea, between the years 2010 and 2019, a total of 26,324 workers filed a claim for compensation for moderate to severe wrTBI. Multiple regression modeling was performed to compare the length of hospital stay according to the timing of rehabilitation therapy initiation following wrTBI. According to the timing of the initiation of rehabilitation therapy following TBI, the proportions of healthcare institutions that provided medical care during each admission step were compared. Results: The length of hospital stay for workers who started rehabilitation therapy within 90 days was significantly shorter than that for workers who started rehabilitationment were first admitted to tertiary hospitals. Approximately 39% of patients who received delayed rehabilitation treatment were first admitted to general hospitals, and 28.5% were first admitted to primary hospitals. Conclusions: Our findings demonstrate the importance of early rehabilitation initiation and that the type of healthcare institution that the patient is first admitted to after wrTBI may influence the timing of rehabilitation initiation. The results of this study also emphasize the need to establish a Worker's Compensation Insuranceespecialized rehabilitation healthcare delivery system.
공기지연은 건설공사에 있어서 가장 빈번하게 발생하는 클레임의 발생요인이다. 공기지연으로 인한 지체상금은 판결과정에 있어서 많은 분쟁을 불러일으키고 있다. 지체상금은 '손해배상의 예정'으로 실제 발주자가 입은 손실에 대한 보상액이 되어야 한다. 그러나 실제로는 계약 불이행에 대한 위약금의 형태로 적용되고 있다. 이러한 지체상금은 발주자의 실제 손실과 차이가 있으며, 수급자에게 과도한 부담으로 작용한다. 본 연구에서는 발주자의 실제 손실에 기반을 둔 지체상금 산정방법을 제안하고자 한다.
해난사고에 의한 유류오염 피해가 발생할 경우 가장 큰 영향을 받는 분야는 해양 생태계 파괴에 따른 어업 피해라고 할 수 있는데, 지금까지 국내 유류오염사고에 대한 국제기금의 어업피해 보상율은 피해 청구액 대비 $20\%$내외로 인접국이나 유럽 국가에 비해 현저히 낮은 보상 수준에 머물고 있다. 이처럼 국제 기금의 피해 보상율이 낮은 이유는 국내 어업 여건상 국제기금에서 요구하는 오염 피해 입증 자료를 확보하기가 쉽지 않기 때문으로 향후에도 국내 어업의 여건이 획기적으로 변화하지 않을 경우, 현행 제도로는 현실적인 피해 보상이 실현되기가 어렵다는 것이 지금까지 유류오염사고 피해보상 결과에서 나타나고 있다. 본 연구는 최근 IMO에서 채택한 대형 유류오염사고에 대한 피해보상방안으로, 보상기준은 기존의 협약을 그대로 적용시키되 유류오염 피해보상한도 금액만을 크게 확대시킨 C8%협약 가입에 따른 실익을 파악하고자 지금까지 국내 유류오염사고에 대한 국제기금의 피해보상 실태와 최근 대법원의 판결로 최종 완료된 제5금동호 오염사고에 대한 피해보상 판결내용을 분석하여 유류오염피해 보상체제 보완의 필요성을 고찰하였다.
건설사업은 목적물의 특성, 사업규모, 계약방식 등에 따라 다양한 사업주체가 참여하고 그로인해 복잡한 의사소통 구조를 가지고 있기 때문에 이해관계의 대립으로 인한 클레임 및 분쟁이 지속적으로 발생하고 있다. 그런데 분쟁의 사례를 살펴보면 상당수가 시공사와 발주자 사이에서 발생하고, 발주자의 우월적 지위에 따른 불공정 관행이 원인이 되어 분쟁이 제기되고 있다. 이에 본 연구는 상대적으로 계약적 약자인 시공사를 정보 활용 주체로 설정하고 대한상사중재원의 중재판정 사례를 바탕으로 분쟁 발생 유형 및 원인별 분석뿐만 아니라 보상비용 등에 관한 분석을 수행하여 시공사의 분쟁에 따른 시간적, 경제적 손실을 최소화하고자 하였다. 이를 통해 공사 수행 중 발생 가능한 분쟁 대응전략을 수립하는데 도움을 줌으로 써 원활한 합의 유도 및 공사의 완성도를 높이는데 기여할 수 있을 것으로 기대한다.
