Due to the increasingly popular dissatisfaction regarding the inefficiency of arbitral proceedings, the Rules on the Efficient Conduct of Proceedings in International Arbitration, also known as the Prague Rules, was launched in December 2018, with the purpose of increasing the efficiency of arbitral proceedings by encouraging arbitral tribunals to take a more proactive role in conducting their procedures. In this article, the provisions of the Prague Rules are examined, in light of those of the IBA Rules on the Taking of Evidence in International Arbitration, in order to determine the efficacy of the Prague Rules on enhancing the efficiency in arbitral proceedings. The author concludes that more specific and detailed provisions, with respect to what the Rules means by such a "proactive arbitral tribunal," should have been explicitly included in light of the Rules' repeated emphasis on such. Also, the prospective outlook on the Prague Rules is not entirely clear as the text does not appear to fill in the gaps in other widely utilized arbitration rules or to supplement them in a satisfying way. However, given that only a short amount of time has passed since the launch late last year, only time will reveal how effective the Prague Rules will be in increasing the efficiency of arbitral proceedings, in accordance with its intended effect.
In the case of a sea transport contract, the decision of the governing law, together with the choice of lex fori, shall be a legal issue in all legal disputes involving damage to the goods. In sea transport contracts, a paramount clause is often established in conjunction with the governing law clause, which can lead to conflict between these two clauses. Most B/L's back clauses contain a paramount clause that provides that the Hague Rules, Hague-Visby Rules, or foreign laws that prevail over other provisions of the terms. The Hague Rules and the Hague-Visby Rules, however, set different standards regarding the extent of the sea carrier's liability. Therefore, in the interpretation of ground conditions, it is an important question whether the Hague Rules or the Hague-Visby Rules are applied or whether each rule is applied as a law. For example, the paramount clause in the Superior Pescadores case was problematic in the interpretation of the term 'Hague Rules.' In this case, the English Court held that the expression 'Hague Rules' could be used to mean the Hague-Visby Rules, and not exclusively the Hague Rules. Therefore, the Hague-Visby Rules were applied in the judgment of this case, which suggests that this case can be a valuable precedent in future legal matters.
Mining of association rules is to find associations among data items that appear together in some transactions or business activities. As of today, algorithms for association rule mining, as well as for other data mining tasks, are mostly applied to relational databases. As XML being adopted as the universal format for data storage and exchange, mining associations from XML data becomes an area of attention for researchers and developers. The challenge is that the semi-structured data format in XML is not directly suitable for traditional data mining algorithms and tools. In this paper we present an encoding method to encode XML tree-nodes. This method is used to store the XML data in Value Table and Transaction Table that can be easily accessed via indexing. The hierarchical relationship in the original XML tree structure is embedded in the encoding. We applied this method to association rules mining of XML data that may have missing data.
Due to the increasing use of very large databases, mining useful information and implicit knowledge from databases is evolving. However, most conventional data mining algorithms identify the relationship among features using binary values (TRUE/FALSE or 0/1) and find simple If-THEN rules at a single concept level. Therefore, implicit knowledge and causal relationships among features are commonly seen in real-world database and applications. In this paper, we thus introduce the mechanism of mining fuzzy association rules and constructing causal knowledge base form database. Acausal knowledge base construction algorithm based on Fuzzy Cognitive Map(FCM) and Srikant and Agrawal's association rule extraction method were proposed for extracting implicit causal knowledge from database. Fuzzy association rules are well suited for the thinking of human subjects and will help to increase the flexibility for supporting users in making decisions or designing the fuzzy systems. It integrates fuzzy set concept and causal knowledge-based data mining technologies to achieve this purpose. The proposed mechanism consists of three phases: First, adaptation of the fuzzy membership function to the database. Second, extraction of the fuzzy association rules using fuzzy input values. Third, building the causal knowledge base. A credit example is presented to illustrate a detailed process for finding the fuzzy association rules from a specified database, demonstration the effectiveness of the proposed algorithm.
본 연구의 목적은 1990년대부터 급속히 증가한 대형할인점에 대하여 입지영향인자를 추출하여 의사결정에 객관성을 확보하고 대량의 데이터베이스를 이용하여 숨겨진 유용한 정보를 입지 선정에 활용하는 것이다. 이를 위해 대형할인점이 입점하는데 미치는 인구학적 변수, 경제학적 변수 그리고 주변환경적 변수에 대한 다양한 인자를 통계자료를 수집하고 연구대상 지역의 공간 자료를 구축하여 공간 연관성 분석을 실시하여 공간 연관규칙을 추출하였다. 결과의 검증을 위해 추출된 규칙과 대형할인점의 매출액을 이용한 적용성 여부를 상호 비교하였다. 검증 결과 추출된 공간 연관규칙이 해당 대형할인점에 많이 부합할수록 매출액도 많은 것으로 나타났다. 본 연구를 통해 공간 연관규칙을 활용하여 객관적이고 매출에 이익을 주는 대형할인점의 최적입지 선정을 기대할 수 있다.
More than 1 million automobile insurance repairs occur per year globally, and the related repair costs add up to astronomical amounts. Insurance companies and repair shops are spending a great deal of money on manpower every year to claim reasonable insurance repair costs. For this reason, promptly predicting insurance claims for vehicles in accidents can help reduce social costs related to auto insurance. Several recent studies have been conducted in auto insurance repair prediction using variables such as photos of vehicle damage. We propose a new model that reflects auto insurance repair characteristics to predict auto insurance repair claims through an association rule method that combines gradient descent and location information. This method searches for the appropriate number of rules by applying the gradient descent method to results generated by association rules and eventually extracting main rules with a distance filter that reflects automobile part location information to find items suitable for insurance repair claims. According to our results, predictive performance could be improved by applying the rule set extracted by the proposed method. Therefore, a model combining the gradient descent method and a location-based association rule method is suitable for predicting auto insurance repair claims.
Discovery of association rules has been used useful in many fields, especially in the fields of the inventory display, catalog design and cross selling. In previous works, all transactions In the database are treated uniformly. In this paper, we present a method for partitioning transactions in the database using time weights. Transactions are assigned different weights as time goes on. Examples show that these method provides purchasing patterns in the database as well as finding association rules.
Mining association rules in web log files can be divided into two steps: 1) discovering frequent item sets in web data; 2) extracting association rules from the frequent item sets found in the previous step. This paper suggests an algorithm for finding frequent item sets efficiently The essence of the proposed algorithm is to transform transaction data files into matrix format. Our experimental results show that the suggested algorithm outperforms the Apriori algorithm, which is widely used to discover frequent item sets, in terms of scan frequency and execution time.

This study contributes to a understanding of judgement of rules of origin and extend level of generalization of exchange law, WTO, FTA Regulations by review interaction relation.
Purpose - We assess the trade remedies rules in a host of Korea's FTAs to explore the trade policies for the effective implementation of FTA trade remedies rules. Also we develop the strategies of the future FTA negotiations of trade remedies rules. Design/methodology - After we review the key features of FTA trade remedies rules, we examine whether the rules are WTO-consistent or not. Next, we touch upon the WTO-plus characteristics of some provisions. Our main methodology is to compare the trade remedies rules in the numerous Korea's FTAs. Another methodology is to link those rules to the relevant WTO agreements and WTO dispute cases with a view to drawing lessons for trade policies and FTA negotiations. Findings - We find that most of the trade remedies rules are WTO-consistent. Moreover, we find that notification and consultation requirment, mandatory lesser duty rule, explicit prohibition of zeroing method, and public interest clause are WTO-plus. We also find that there are limitiations in the application of some global safeguard exclusion rules because of their non-mandatory nature. Originality/value - While most of previous studies focus mainly on the unique aspects of specific FTAs, our study analyzes comprehensively the trade remedies rules in the various Korea's FTAs. Based on the comprehensive analysis, we figure out the areas to be clarified and improved for the effective implementation of FTAs and the strategies for the future FTA trade remedies negotiations. As a consequence, our paper is expected to contribute to the academic research on FTA policies as well as the national economy.
