Purpose: This paper investigates how companies respond to government regulations and disasters in a risk-managed society, and aims to initiate discussions on the future prospects and challenges. Specifically, it explores how companies can plan to respond to such disasters in the future, and stresses that the law should be to protect people's lives and ensure safety, rather than to punish companies. Research design, data and methodology: The study methodology is based on a review of existing literature, as well as trend analysis through big data analysis. The research analyzes the discourse in our society regarding the enactment of the Serious Accident Punishment Act. Results: This study supports that the Serious Accident Punishment Act should be implemented in a manner that does not impede corporate activities, but rather helps to ensure the safety of citizens' daily lives. The authors call for collaboration between communities, labor unions, and companies in achieving a cooperative governance system for a safer society. Conclusions: It highlights the importance of addressing disasters and government regulations in the context of a risk-managed society, and offers insights for both companies and policymakers on how to navigate these challenges. By prioritizing safety and cooperation, we can work towards building a safer and more resilient society

연구목적: 중대재해의 업무중단 리스크를 확인하고, 재해경감활동관리체계를 활용한 중대재해처벌법 준수방안을 제시한다. 연구방법: 문헌연구와 사례조사를 통하여 중대재해처벌법, 재해경감활동관리체계, ISO 45001 각각의 요구사항과 특징을 비교 분석하고 시사점을 도출하였다. 연구결과: 산업재해로 인한 업무중단 및 재무적 악영향을 확인하였다. 이를 기반으로 재해경감활동관리체계를 활용하여 중대재해처벌법의 문서화 요구사항을 재해경감활동관리체계와 연계하고, 중대재해처벌법 의무 이행기록을 관리할 수 있는 방안을 도출하였다. 결론: 재해경감활동관리체계의 구축·운영으로 중대재해처벌법을 준수할 수 있을 뿐만 아니라, 각종 재해 예방 및 2차 피해 최소화 등을 통하여 업무연속성 유지와 ESG 경영에도 기여할 수 있다.

연구목적: 중소기업에서 「안전보건경영시스템」의 유지와 실행만으로 「중대재해처벌법」의 요구사항에 적합하도록 「중대재해처벌법」과 「안전보건경영시스템」연계방안을 제시하고자 한다. 연구방법: 문헌조사와 같이 이론적 접근을 수행한다. 먼저 이론적 접근으로 「중대재해처벌법」의 안전보건관리체계를 살펴보고, 「안전보건경영시스템」의 요구사항을 분석하였으며, 그리고 2024년 「중대재해처벌법」이 적용되는 5인 이상 49인까지의 중소기업의 통계와 사고 사망자수를 조사하였다. 연구결과: 「안전보건경영시스템 (ISO 45001)」요구사항과 「중대재해처벌법」의 안전보건관리체계의 연계하는데 문제점이 발견되지는 않았다. 결론: 「안전보건경영시스템」인증을 받기 위한 시스템 구축과 실행으로 「중대재해처벌법」의 안전보건관리체계의 요구사항을 충족할 수 있으리라고 판단된다.

The Act on the Punishment of Serious Accidents to Prevent Large-scale Disasters, including Ferry Sewol and Taean Thermal Power Plant, passed the National Assembly on January 8, 2021, and has been in effect since January 27, 2022. However, the law, in which the representative of the headquarters is unlimitedly responsible for each worker's accident, is somewhat unreasonable at a time when a company owns dozens to hundreds of construction sites due to the nature of the construction industry. I agree with the purpose of enacting the law to reduce chronic serious accidents at construction sites, but it is necessary to carefully reconsider the implementation of the law in that punishment alone cannot achieve industrial safety. Previous studies focused on revising the Occupational Safety and Health Act, but there are few studies on the impact on the construction industry after the implementation of the Serious Accident Act. Therefore, this study attempts to derive problems related to the application of the Serious Accident Act and present improvement measures. To this end, after analyzing previous studies, SWOT analysis was performed by applying the Delphi method to derive strengths, weaknesses, opportunities, and threats. In addition, the results of two surveys of safety experts such as public institutions, academia, and companies were reflected, and its countermeasures were presented as follows. S/O strategy: establishing on-site execution capabilities of health and safety management system; W/O strategy: expanding legal and system execution checks; S/T strategy: establishing a risk response system; W/T strategy: expanding consulting by external specialized institutions

2022년 1월 27일부터 시행된 중대재해처벌법은 안전조치를 소홀히 한 사업주나 관리자를 중대재해 발생 시 1년 이상의 징역형에 처하도록 하고 있다. 이 중대재해의 처벌에 관한 법률이 올해부터 시행되면서 사회의 많은 관심을 받고 있다. 전문가들에 따르면 안전사고율을 낮추는 법안의 당초 취지와 달리 기업에 대한 처벌을 높이는 데 초점을 맞춰 법안을 만들었다는 의견이 대부분이다. 본 연구는 사례연구를 통해 이러한 내용이 사실인지를 확인하였으며, 이를 지속할 경우 기업과 근로자 간의 갈등이 심화되어 안전사고율이 감소하지 않을 것이다. 따라서 본 연구는 기업의 처벌을 무조건 늘리는 것이 아니라 설문조사를 통해 많은 상황을 비교하고 기업과 근로자가 안전사고율을 낮추기 위해 중대재해처벌법에 협력할 수 있는 방안을 제시하였다. 본 연구는 안전한 사회 건설을 위한 발전된 중대재해 처벌 법의 제정을 위한 기초자료로 활용될 것으로 사료된다.

항만물류는 국가와 기업에 경쟁력 강화의 중추적인 산업으로 우리나라 수출입 물동량의 대다수를 차지할 만큼 중요한 역할을 하고 있어 우리나라의 산업중에서도 그 중요성은 실로 엄청나다. 이처럼 중요한 역할을 하고 있는 항만은 하역작업, 부두내 이송작업과 보관이 동시에 이루어지며 굉장히 복잡한 흐름으로 구성이 되어 있다고 할 수 있다. 특히 항만하역작업은 대형선박, 컨테이너이송을 위한 크레인작업등 대형 하역기계들과 운반장비들이 이동하며 수많은 재해의 위험이 도사리고 있고 재해 발생시 중대재해로 이어지는 경우가 많아 항만하역근로자들은 항상 재해의 위험에서 벗어날 수 없는 환경이다. 본 연구는 중대재해처벌법에 대한 문헌연구들을 통해 중대재해처벌법이 항만하역근로자들에게 어떠한 영향을 미쳤는지에 대해 파악하고, 항만근로자와, 항만관리감독자의 중대재해처벌법 시행에 따라 안전교육에 대한 만족도 변화가있는지 알아봤다. 본 연구를 통해 항만하역근로자는 인지,태도,경험 요인에서 관리자보다 안전에 대한 인식을 더 많이 하고있는 것으로 나타났다. 이는 항만하역 관리자는 하역작업에 투입되지 않기 때문에 근로자보다 안전에 대한 인식이 근로자보다는 낮게 분석되었다. 이는 근로자에게 안전한 작업을 교육하고 안전에 대해 경각심을 가져야되는 관리자들이기에 항만하역 관리자에게도 안전에 대한 인식에 대한 변화가 필요할 것으로 보여진다. 중대재해처벌법이 22년 1월 27일 시행되어 법 시행초기 단계로 법이 정착까지 실무업무를 일선에서 수행하고 있는 담당자들은 많이 혼동되고 애매한 부분들이 많이 발견되고 있다. 업무에 혼선이 생기지 않도록 법에 대한 명확한 기준과 현업에서 안전재해가 발생되지 않는 목적으로 중대재해처벌법이 개정이 필요해 보인다. 또한 향후 보다 의미 있는 연구 결과를 도출하기 위해서는 문헌연구를 심화하여 여러 요인들을 찾아보고 인터뷰등의 조사방법을 사용하여 근로자와 관리자의 재해 인식에 대한 연구가 지속적으로 필요할 것으로 보인다.

Safety has once again emerged as a social issue due to the enforcement of the Serious Disasters Punishment Act and the occurrence of major disasters recently. As such, the safety culture related to unsafe human behavior is drawing attention as various discussions about the importance of safety and accident prevention are currently being undertaken. This study aims to determine whether changes in the level of safety culture in companies affect the accident rate. To this end, we targeted three workplaces in the same company in the domestic manufacturing industry, and 2,790 people were surveyed using DNV's Safety Will(ISRS-C version 4.0) for safety culture level diagnosis. The change in safety culture level and accident rate were compared and analyzed after carrying out safety culture level improvement activities for 5 years. As a result, the level of safety culture increased by 5.8 points, an overall improvement of 9.5%, while the total number of accidents decreased by 20%, from 5 to 4, indicating a general decreasing trend in accident occurrence. Results confirmed that the change in the level of safety culture affects the accident rate, and the improvement in the level of safety culture affects a reduction in accidents. Therefore, this study suggests that efforts to improve the level of safety culture within a company can be associated with accident reduction and accident prevention outcomes.

Recently, the importance of disaster prevention has emerged as serious accidents have occurred frequently, in which workers died or seriously injured at industrial sites. In response, the government enacted the 'Act on the Punishment of Major Disasters' to strengthen the responsibility, punishment intensity, and regulation of business owners for accidents at the site. In particular, the construction industry accounts for a large proportion of serious accidents, so safety levels need to be raised through on-site management. This study aims to reduce the occurrence of disasters at construction sites and to improve the work efficiency of safety managers. To derive detailed elements of the safety manager's work, domestic and overseas cases were investigated. The derived items were analyzed for the difficulty and preventive effects of the work through a survey of experts, and they will contribute to disaster prevention by presenting tasks to be focused and suggesting ways to improve inefficient tasks.

Construction work has potential risk factors in the process. Therefore, the safety management task is very important and requires continuous management. In particular, the importance of safety management in construction projects has been highlighted recently with the introduction of the act on punishment of serious disasters. In this perspective, this study intends to select and present high-risk construction types that requires safety management. The presented result is expected to present standards for systematically performing safety management of construction projects.

중대재해 처벌 등에 관한 법률에 따라서 터미널 운영사는 재해예방에 필요한 인력 및 예산 등 안전보건 관리체계의 구축 운영과, 재해 발생 시 재발 방지 대책의 수립 및 이행이 필요하다. 자율주행 항만장비 도입에 따른 항만 시설 내 안전사고를 예방하고, 안전사고 발생시 기민하게 의사결정을 지원할 수 있도록 항만시설 안전관리시스템 연계 활용 방안에 대한 연구이다.
