  • Product liability(PL) and product safety(PS) is one of the most costly and confusing problems facing manufacturing today. Accordingly, this paper presents an integral process for product safety and product liability resulting from a defective product and proposes countermeasures of PL and PS for the four types of risk based on severity and frequency. Finally, we have presented a framework and practical procedure to provide the manufacturer with useful way of analyzing the risk potential of consumer products.

An Integral Model for Product Liability and Safety using Hazard Analysis.

  • This paper presents an integral model for product safety and product liability resulting from a defective product. The essence of the paper is the process of supply of manufacturing products which satisfy the product liability and the product safety in terms of consumers expectation levels. The main criteria of the product safety is the hazard level which involves in the severity and frequency. The proposed model shows the process to supply the manufactured products under the conditions that they are suitable in comparison of hazard level and safety level established by each company. If the product do not meet the safety level, this paper proposes that four different types of PL and PS countermeasures for the risk types are forward, respectively.

제품안전분야의 국내표준 개발을 위한 로드맵의 개발 (Development of a Road-map for Promoting Product Safety Standards)

  • In 2002 Product Liability Act newly got into effect in Korea so that efforts for Product Safety got a new chance to promote safety standardization. Under the supervision of the Korean Agency for Technology and Standards (ATS) and the Korea Standards Association (KSA), the enterprise titled "Standardization of Product Safety" took the first step in 2000. Thenceforth a lot of standards and guidelines for product safety have been developed. The results of the enterprise were in the type of technical manual as well as report, technical guidelines, and specific technical safety standards. In this paper, the authors narrated those sequential efforts for Product Safety, and introduced the basic concept on which standardization of Product Safety Management System was conducted and individual safety standard has been developed. Based on this systematic concept, a global road-map as well as specific road-maps for developing safety standards in individual industry were supplied. Finally, suggestions for proceeding to the whole risk management system including other risky factors were appended.

소비자 제품과 관련된 휴먼에러의 예방을 위한 제품안전활동 (Product Safety Activities for Preventing Human Errors Related with Consumer Products)

  • Consumer products are produced on the premise that consumers can use their products safely and effectively no matter how serious human errors they may make. However, different careers and educational experiences of them may induce diverse human errors when they want to use them. In that sense, not a few policies to reduce human errors may show some implications for human error prevention and industrial design of consumer products. In this paper, producers' safety efforts required by Product Liability(PL) Act were reviewed in view of human error prevention, and legal aspects of manufacturers' responsibility for consumer products were discussed in relation to Product Liability Act. Then, principal approaches for them were introduced under the title of System Safety Precedence. After that, major key points for preventing human errors related with consumer products - such as ergonomic design and effective labeling - were discussed with reference to ISO standards. Therefore, it was shown that all the efforts required by PL Act would be correspondent to human error prevention in the whole manufacturing processes if understood by ergonomists. To make a conclusion, it could be said that, for human error prevention, the principle of System Safety Precedence would be indispensable, and that all the efforts for preventing human errors should be systematically organized in Product Safety Management Systems.

제조물책임법에 대비한 산업안전분야의 대응방안 (Suggestions for Counterplans in the area of Industrial Safely for the Product Liability Act)

  • From July 1st 2002, the Product Liability Act will be efficacious in Korea, and its influence will be prevalent over all industrial folds. However, little attention has been paid to the Act and its influence in the area of Industrial Safety. Therefore, this paper aimed to call the people's attention to them, and to suggest some points for counterplans in that n As for counterplans to the Product Liability, there are two different approaches - Product Liability Prevention (PLP) and Product Liability Defense(PLD). Between them, PLP is more safety-oriented approach, and especially Product Safety(PS) will be the core of it. Related with this, it was noted that productive goods which are utilized as productive materials or tools in the later process or industries could be troublesome when the Act is efficacious. As a solution, the necessity of cooperation among manufacturing plants belong to the similar industry, and of development of qualitative techniques applicable to analyses of consumers behavior was emphasized. Ant the interest and participation of Human Behavioral Scientists, Ergonomists as well as Consumer Psychologists were called upon. Also, it was suggested that an integrative approach including administrative or governmental management system for industrial goods should be developed.

  • 스틸렌 공중합체의 열적특성과 독성인자를 평가하기 위하여 활성화 에너지, 물리적 특성 및 마취성 기체와 같은 독성물질의 발생가능성에 대하여 조사하였다 고온 분해시에 Kissinger법과 DSC법에 의해 계산된 활성화 에너지는 25${\~}$50 Kcal/mol이었다. 이것은 화재발생가능성에 대하여 좋은 정보가 될 것이다 FED계산으로부터 PS, SAN 및 ABS에 대한 $LC_{50}$의 값은 8,580, 265 및 308 $mg/m^3$이 되었다. FT-IR에 의해 분석한 열분해 반응의 메카니즘은 측쇄반응이 아니고 주쇄반응이었다.

전사적 PL 대응시스템의 핵심요인이 기업 성과에 미치는 영향 (Effects of Essential Companywide Components of PL Response System on Company's PL Performance)

  • PL (Product Liability) refers to the legal responsibility of a manufacturer or seller for bodily injuries or property losses caused by product defects. Therefore, it is important for companies to construct a product liability response system that strategically manage and effectively adapt to product liability. A PL response system refers to companywide operations of PL prevention (PLP) measures, product safety (PS) measures, and PL defense (PLD) measures appropriate for a company's scale and environment. To establish an enterprise product liability response system, each essential component of corporations should be systematically operated and maintained considering the scale and characteristics of the corporations. Essential components of PL response system is Strategy, Organization, Training, Technology, Investment, and Awareness. Role of essential components is that companies need specific strategies to secure product safety and protect customers from product defects, and appropriate organizations must be composed for effective operation of such strategies. The objective of this paper seeks to examine the relationships among the essential components of the product liability response system and PL performance. PL performance consists of positive performance and negative performance. In particular, positive performance include increased efforts in product or process innovation such as strengthening research and development (R&D) to produce safer products without defects. In order to carry out this research we obtained 98 questionnaire of manufacturing company. A summary of the analyses is as follows: First, the awareness and technology among essential components affect significantly to the positive performance. Second, the awareness and strategy among essential components negative affect to the negative performance.

거시환경요인과 복합제품시스템의 기술진화: 원자력 발전 플랜트의 사례를 중심으로 (Macro-environmental Drivers and Technological Evolution of Complex Product System: Evidence from Nuclear Power Plant)

  • 복합제품시스템이란 고도의 엔지니어링과 설계 기술이 집약되어 있는 복잡한 시스템 형태의 제품으로 국가 경제 발전 및 에너지, 교통, 통신 등 사회 인프라 구축과 밀접하게 연계되어 있다. 이에 따라 복합제품시스템의 기술진화를 이해하기 위해서는 기술개발 주체의 기술진보 노력을 넘어서 복합제품시스템을 둘러싼 거시환경요인이 기술진화에 미친 영향을 복합적으로 고찰하는 것이 필요하다. 이에 따라 본 연구에서는 원자력 발전 플랜트 사례를 중심으로 복합제품시스템 기술진화에 대한 정책, 경제, 그리고 사회적 요인의 영향을 종단적으로 서술하였다. 인터뷰에 기반한 1차 자료와 다양한 참고 문헌에 기반한 2차 자료를 복합적으로 활용한 결과, 원전 기술의 진화는 "원자력의 평화적 활용을 위한 응용연구"(1950년대~1960년대), "원자력 발전 시장 확산 - 1차 르네상스"(1970년대), "원자력 발전 안전성 제고와 후발국의 추격"(1980년대~2000년대 후반), 그리고 "원자력 발전 시장 2차 르네상스를 위한 안전성의 최우선화와 차세대 원자로 기술 개발"(2010년대 후반~현재)의 4단계에 걸쳐 진행되는 것으로 나타났다. 또한 각 단계별 기술진화에 있어 각국의 에너지 정책과 원자력 발전 연구개발 투자와 같은 정책적 요인, 경기 사이클에 의한 전력 수요의 변화, 전력원 간 경쟁과 같은 경제적 요인, 그리고 안전성에 대한 사회적 수용과 환경오염에 대한 인식 등의 사회적 요인 등이 중요한 영향을 미쳤음을 확인하였다. 본 사례 연구는 보다 거시적인 관점에서 복합제품시스템의 기술진화를 고찰할 수 있는 이론적 접근방법을 제시하였다는 점에서 그 의의가 있다. 따라서 복합제품시스템을 육성하고자 하는 국가들은 기술개발 투자와 노력뿐 아니라 정책과 경제, 사회적 요인을 통합적으로 고려하여 이를 기술진화에 활용하기 위한 노력을 경주해야 할 것이다.

PL 대응체계 구축 방안 (Building of PSMS in corporate of ISO 9000 certification)

  • The manager of manufacturing industry just not to have known what to do related to the law of product liability(PL) that was put into operation in July 1, 2002. The law of PL is a public law about defective product, which was established in order to compensate consumer's damages of property and body caused by product, to make sound society by the safety products and to take international competitiveness. But the existing civil law has been having clause that compensation to be taken is limited. The law of PL is resolving this limitations and is characterized by the easy relief from damages of defective product. The decision in the case of Green-man has been a precedent since the court sentenced the manufacturer to liability. The law of PL has been in force in 27 countries, including all of the EU countries, Japan, Philippines and China. It has been shown that the corporations which meet the Global Standard, could survive in global competition. The economic effects by the law of PL are the increase of consumers relief production cost by the lawsuits. This paper will recommend more biref method that is able to cover PSMS by use of QMS. It will make domestic corporation improve in the plan, manufacture and sale of products to meet the Global Standard.

범용 고분자 제조공정의 재해분포 특성 (Characteristics of Accidents Distribution in General Polymers Manufacturing Processes)

  • 산업현장에서는 폴리에틸렌(PE), 폴리프로필렌(PP), 폴리염화비닐(PVC), 폴리스테렌(PS) 및 폴리우레탄(PU)과 같은 다양한 종류의 범용 고분자 제품들이 광범위하게 제조 사용되고 있으며, 이들 제조현장에서는 화재 폭발 등으로 인해 산업재해가 많이 발생하고 있다. 이러한 사고를 예방하기 위해서는 과거에 발생한 사고사례를 수집 분석하여 사고특성 등을 파악하여 동종 혹은 유사사고 예방에 활용하는 것이 중요하다. 본 연구에서는 안전보건공단에서 운영하고 있는 산업재해통계시스템의 데이터베이스를 기초로 하여 SPSS를 활용하여 범용 고분자 제조공정별 재해분포 특성을 고찰하였다. 이들 결과는 범용 고분자 제조공정의 사고를 방지하고, 공정의 안전성을 확보하는데 활용하고자 한다.
