  • Recently, despite of the effects of international Coordination and cooperation to prevent piracy, piracy is on an increasing trend every year. Such circumstances may have a bad effect on the sound development of world economy by means of trade in sea as well as treat to the safety of crews and safe operation of ships. Finally, Modern maritime piracy has become one of the major threats to safety at sea. We having Cargo-owners or Ship-owners attacked by piracy, it causes enormous economic losses. Therefore, Ship-owners and Cargo-owners insure Cargo Insurance, Hull Insurance and P&I Insurance to indemnity of losses which is caused by piracy. The Purpose of this paper was to explain the losses caused by piracy and studying the limits of the possibility of indemnity in the Cargo Insurance, Hull Insurance and P&I Insurance.

황산화물(SOx) 배출 저감 규제에 대한 국적선사의 인식과 대응 전략에 관한 연구 (A study on Perception and Response Strategy of Korean Ship Owners on Global Sulphur Cap 2020)

  • 본 논문에서는 황산화물(SOx) 배출저감 규제에 대한 국적선사의 인식과 대응 전략을 분석하기 위해 국제해사기구(IMO)의 환경규제 현황과 선박으로부터의 대기오염방지를 위한 규칙인 국제해양오염방지협약(MARPOL) 부속서 VI, 황산화물(SOx) 배출저감 기술적 방안, 해운산업과 국적선사의 경영현황을 살펴 보았다. 그리고 국적선사들 대상으로 설문을 진행하여 국적선사의 규제와 영향에 대한 인식과 대응 전략을 분석하였다. 평가요인의 선정 작업을 거쳐 국적선사를 대상으로 설문을 실시하였다. 빈도 및 교차 분석을 진행하여 규모별, 주력선종별 선사의 인식과 대응 전략의 차이, 국적선사의 대응 전략의 방향성을 알아보았다. 관련 선행연구 및 문헌들을 검토하면서 그 동안 국내외에서 다양한 관점으로 황산화물(SOx) 배출저감에 관한 여러 연구들이 시행되어왔음을 확인하였다. 본 연구에서도 규제 대응을 위한 기술적 방안들과 경제성 분석 관련 기존 연구들을 고찰하여 평가요인을 선정하였다. 분석 결과 대형선사가 중소 벌크선사에 비해 규제 대응의 준비가 원활히 실행되고 있는 것으로 나타났으며, 선사 규모와 주력선종별 선사의 규제에 따르는 환경적인 영향에 대한 인식이나 대응 전략에 대한 방향성은 비슷한 것으로 나타났다. 규제의 시행까지 약 2년이 남은 상황에서 정부와 관련기관의 지원 정책과 선사별 체계적인 분석과 계획을 바탕으로 적절한 대응 방안을 모색할 필요가 있다. 본 연구를 통해 국적선사들을 대상으로 주력선종별 선사들의 인식과 대응 전략의 차이를 파악하였지만 구체적인 대응 전략이나 기업의 데이터 수집의 한계가 존재하였다. 향후 연구에서는 본 연구의 한계점을 극복하여 보다 심도 있는 연구가 진행되어야 할 것으로 사료된다. 해운산업 관계자들이 황산화물(SOx) 배출저감 규제 대응 준비에 대한 중요성을 인식하고 국가적으로 중요한 해운산업의 경쟁력을 확보하기 위하여 최적의 대응 전략이 수립되기를 기대한다.

우리나라 해운산업의 경쟁력 실태분석 (A Study on the Situation Analysis for Competitive Advantage Power of Korean Shipping Industry)

  • The development of Korean shipping industry is maybe defined into three development stages-industry fixing stage, industry coordinating stage, industry development stage-. The development of shipping industry has been depended on the geovernment/authority role such as shipping policy, system, law, rules and regulations. In 1983, Korean shipping industry reorganization and coordination by shipping authority have made our shipping industry on the stable condition together with each company's efforts. Today's world economic environment such WTO/UR negotiation results get this government role limited. According to the being reduced government role, each company's competitive advantage power becomes more important. Besides, korean shipping industry is exposed into the entire and bitter world competition. In order to win and prevent the world shipping competition, it is necessary to look out the competitive advantage power of Korean shipping industry. The first purpose of this study is the situation analysis for competitive advantage power of Korean shipping industry. The second is to compare with our shipping policies with foreign ones concerned with ship, cargo, crew, tax and others. But in order to compare with foreign shipping, this study need their shipping statistics data, this study has some limit of the foreign data. This study has been carried on the basis of the following items. 1. Shipping environment, 2. Ships and ship acquirement(shipbuilding/purchasing), 3. Oceangoing cargo and ship's stowage rate, 4. Human factor in shipping-crew, 5. The incomes and costs in finacial statements. We have some conclusions as following through the this study. First, Korean shipping industry environment-competitive disadvantage situation- has changed rapidly due to the shipping market opening, free market entering of foreign shipping. Second, Korean shipping is disadvantageous due to the high tax rate and financing conditions in connection with ship acquirement. In order to improve the competitive advantage power, the shipping tax system and ship financing conditions should be reviewed to profitable for owners. Third, but both world and Korean oceangoing cargoes quantity have been increased annualy, Korean ship's cargo stowage rate is being decreased. This is serious situation but Korean shipping take well use of foreign vessel with hire. It is recommended to take use of owner's vessel and hired ones in the long range view, considering the world shipping management. But the number of crew has been decreased by 2, 000~3, 000 annualy, it is desirable that the long sea-experienced crew have been increased. Almost of owners usauly complain the crew cost is the main obstacles to competitive advantage power. Human factor is the most important firm's asset. All owners should pay attention to this though, and invest the proper budget to training, education, welfare as much as possible. In the long run this effects could be feedback to owners. Fifth, We must improve the financial statements structure, that is, the first step is to increase income, the second is to decrease cost, the third is to increase income on the same cost, the fourth is to decrease cost on the same income. It is essential to find out what the urgent investment is and what unnecessary cost is. At last, in order to competite world shipping race, each shipping firm must try for himself to retain the power. The government/authority is no longer dependable. I believe that each firm's power will be the industry's power, the industry's power will be the nations's power.

CFPR을 이용한 선사 및 화주 상생을 위한 정책지원방안 도출에 관한 연구 (An Analysis of Drawing Government Supporting Policies for Mutual Growth of Shippers and Ship owners using CFPR method)

  • 해운경기 침체를 극복하지 못한 기업경영의 실패는 해운산업과 관련된 전후방산업 전반에 부정적인 영향을 미친다. 본 연구에서는 선사, 화주, 항만 관련 기관들을 대상으로 전문가 조사를 실시하여, 선사 및 화주 상생을 위한 정부의 정책지원 방안을 도출하는 것을 연구의 목적으로 한다. CFPR(Consistent Fuzzy Preference Relation)을 연구방법으로 사용하여 정부정책 우선순위를 제시한다. 연구결과 전체 14개 정책 가운데 "화주의 선사 또는 선박 지분 참여 확대 (0.102)"가 가장 높은 순위를 보였고, 다음으로 "국내 화주 중심의 서비스 품질 강화(0.101)", "컨테이너 화물 장기 운송계약 모델 마련(0.085)"등을 중요하게 인식하는 것으로 나타났다. 선주 및 화주 상생을 통한 한국해운의 회생을 위해서는 올바른 정부정책수립 및 우선순위 선정을 통한 정책집행이 중요한데, 본 연구를 통하여 정책과 우선순위를 제시한 점에 기여도가 있다. 향후 연구에서는 해운산업 이해 집단 간 인식차이를 비교한 구체적인 분석이 필요하다.

상법상 선장의 지위와 선박소유자의 대리권의 판례에 관한 연구 (A Study on legal status of shipmaster and precedent of his Authority)

  • The master of ship is always authorised to perform whatever acts are ordinarily necessary for the safe and proper prosecution of the voayge with regard to both ship and cargo. In other words, when a ship is away from her home port, where her business was managed, the master generally carried the owner's authority, and ordinarily he had power to enter into engagements, on their behalf, for carrying goods in the ship, or for letting her service, provided those engagements were consistent with the usual manner of employing her adopted by the owners. Accordingly he has always to decide onboard for an adequate applying of statutory law and cases whenever he acts. But the master would appear to have no such autho-rity where he can communicate with the owners without difficulty as, now-a-days, he nearly always can. This paper, therefore, intend to review some guidance of his authority in accordance with the Korean Code of Commerce as well as precedent based on it. The paper is also simply to place at the disposal of young shipmasters and those who aspire to command some legal information concerning limit of master's authority away from vessel's home port through legal commentation on the precedent, which may assist them to a better understanding of the many problems they may be faced with in the course of their ca-reers. In order to make an efficient study of legal structure concerned for shipmaster's authority, several up-to-date precedents are selected and described herein by writer's opinion for preventing unreasonable legal dispute in this field before courts in future.

전술적 선박 스케쥴링의 최적화 분석에 관한 연구 (A Study on the Optimization Analysis of Tactical Ship Scheduling)

  • This paper treats the optimization analysis of tactical ship scheduling problems in the world seaborne bulk trade. The authors use the term 'tactial' to describe the ship scheduling problem where the owners should employ skillful tactics as an expedient toward gaining the higher profits per period in short term. Relevent research and related problems on ship scheduling problems are reviewed briefly and a model for the tactical ship scheduling problem formulated as Set Problem is introduced by modifying the previous work of Fisher(1989). The reality and practicability of the model is validated by some ship-ping statistics. Proper solution approaches are outlined in the context of computational tractability in tackling the Mixed Integer Propramming. Some underlying consideration for the computational experiment is also mentioned. The authors conclude the paper with the remarks on the need of user-friendly Decision Support System for ship scheduling under varying decision environment.

한국선급 입급선 항만국통제의 출항정지 분석에 관한 연구 (A Study on Ships of KRS Registered the analyses of Detentions for Port State Control)

  • This study analyzes inspection results of ships by Port State Control. Particularly, this research focuses on a detention trend of vessels that registered to Korean Register of Shipping. In order to conduct this research, we have searched 170 ships that got a detention with a Code-30 within recent 46 months period. The deficiencies of the detentions are inspected by ship types, ship years, flags, ports inspected, and criteria. Moreover, we categorized the deficiencies for the detentions into 17 types for internal and external inspections. As the results of the comparison study, bulk and general cargo carriers dominate the portion of detentions by almost 66 percent. Self-induced detention due to a lack of preparation by crews and company support are the main reasons of repeated detentions from the same type ships. Ships between six and ten years old show the lowest detention rate by 4 percent whereas ships less than five years old generate the highest detention rate by 22 percent. The main categories of the detentions from ships less than 5 years old are a lack of documentation and certification, and the clues support our opinion that owners and crews may neglect to prepare the inspections because their strong confidence for the ship condition due to young ship age. As a result of a great effort of Korean government and shipping companies to reduce a detention rate, the detention rate has been recently reduced to 0.3 percent. The results also require companies with the flag of convenience ships to spend more effort to reduce the detention rate, too. We expect that using social networking service by Korea Register will lower the detention rate by sharing relevant information real-time to ships and owners.

정기용선에 있어서 용선료 연체의 효과 - 영국 판례를 중심으로 - (Is it a Condition? : The Effect of a Charterers' Failure to pay Hire on time in a Time Charter)

  • On 2013 the English court delivered a decision that the payment obligation under time charter party is a condition. According to this judgement, The Astra, a breach of the obligation to pay hire on time entitles the owner both to withdraw the ship and sue the charterers for damages for the difference between the contract and market rate for the remainder of the contracted period. On 2015, however, the English court stood at the other side. In Spar Shipping, the court confirmed that the obligation to pay hire is not a condition of the contract but an "innominate term" - from the charterers' breach ship owners can exercise their contractual right to withdraw, but owners' right to sue for damages depends on whether the charterers have deprived the owners of the substantial benefit of the contract, or shown an intention to do so. This article aims to compare both decisions over the points that (1) the importance of on-time payment under a time charter party, (2) as a critical and main question in this article, whether the mattered payment clause is a condition or innominate term, (3) whether the on-time payment clause is merely a penalty or a reasonable liquidated damage. Based on various reasons, I am on a position that the payment of hire is not a condition but an innominate term. Default in punctual payment by a charterer, in the absent of clear contractual agreement, needs to be decided further whether that breach removes the substantial benefit of the contract from the owners.

여객선 컨버젼(Conversion) 동향에 대한 연구 (A Study on the Tendency on Conversion of Passenger ship)

  • 최근 들어 선박안전 관련 규정이 개정되거나 운항환경이 변화하면 선주사들은 이에 효과적으로 대응하기 위하여 크루즈선을 포함한 여객선을 새로 건조하는 대신 경제적 부담이 적은 기존 선박에 대한 선체개조 즉 컨버전을 많이 실시하고 있다. 컨버전은 선체의 주요 제원을 포함하여 선박의 구조강도, 유체역학적 성능, 여객수 및 화물 용량 등 많은 부분에 변화를 가져오므로 이의 수행에 앞서 세심한 사전 검토가 필요하다. 그러나 아직까지 여객선의 컨버전과 관련된 연구가 수행되지 않았기에, 본 연구에서는 이러한 컨버전을 직접 수행한 컨설팅사들의 보고서를 중심으로 그 동향을 조사하고 분석하여 그 결과 랭스닝 컨버전이 선박의 주요 제원이나 성능에 가장 큰 변화를 발생시킨다는 사실을 확인하였다. 이와 더불어 랭스닝 컨버전을 염두에 두고 건조할 경우 선체개조로 인해 발생하는 문제점들을 최소화하기 위하여 헐 스캔틀링, 선형, 절단 위치 등과 같은 기본설계 단계에서 미리 고려해야 할 요소들에 대해 제시하였다.

선박소음예측 및 데이터베이스 프로그램 개발 (A Study on the Prediction and Database Program of Ship Noise)

  • Ship owners are demanding quieter vessels since crews have become more sensitive to their acoustic environment. Accordingly, designers of shipyards need to respond intelligently to the challenging requirements of delivering a quiet vessel. In early design stage, to predict shipboard noise the statistical approach is preferred to other methods because of simplicity. However, since the noise characteristics of the ships vary continuously with the environments, it is necessary to update the prediction formula with data base management system. This paper describes the feature of database program with the prediction method. Database management programs with GUI, are applied to Intranet system that is accessible by any users. Statistical approach to the prediction of A-weighted noise level in ship cabins, based on multiple regression analysis, is conducted. The noise levels in ship cabins are mainly affected by the parameters of the deadweight, the type of ship, the relative location of engines and cabins, the type of deckhouse, etc. As a result of verification, the formulas ensure the accuracy of 3 ㏈ in 83 % of cabins.
