The Rights of Patients as Consumers (환자의 소비자로서 권리)

  • The legal relationship between patient and physician is legally equal relationship. But, in times past, patients be compelled to sign an unequal contract, substantially. Because of the imbalance between supply and demand in the health care market. Today, the law of supply and demand in the health care market is running well. And as the cognition of citizens' rights grows, the relationship between patient and physician can also get a lot of changes. Patients have the right to know the information about medical care, and to decide whether or not to get treatment including invasions against their own bodies. In other words, Doctors have an obligation to explain to their patients. If doctors did not provide patients sufficient explanation or information, it violates the right of patients. This is a tort, or a breach of contract. To improve the remedy for violation of patient's right, patient is able to be protected by status as consumer. If patient is a kind of consumer in terms of medical consumption, he/she as consumer can enjoy supplementally the consumer's right. The patient as a consumer can exercise now a consumer's right as a constitutional right. In addition, with respect to consumer's rights, Framework Act on Consumers was enacted. This Act is based on constitutional provisions of Article 124 and the Act can be seen as a law that embodies consumer right because the provision of the constitutional law delegates specific contents. In the health care field, patients need to win recognition the statue of the consumer to hold the sovereignty of the consumer. In particular, if patients are consumers, they may be able to make good use of the quickly and efficiently collective dispute resolution and association lawsuit to rescue their damage, the Alternative Dispute Resolution(ADR) of Framework Act on Consumers.

The Assessing Comparative Study for Statistical Process Control of Software Reliability Model Based on Musa-Okumo and Power-law Type (Musa-Okumoto와 Power-law형 NHPP 소프트웨어 신뢰모형에 관한 통계적 공정관리 접근방법 비교연구)

  • There are many software reliability models that are based on the times of occurrences of errors in the debugging of software. It is shown that it is possible to do likelihood inference for software reliability models based on finite failure model and non-homogeneous Poisson Processes (NHPP). For someone making a decision about when to market software, the conditional failure rate is an important variables. The infinite failure model are used in a wide variety of practical situations. Their use in characterization problems, detection of outlier, linear estimation, study of system reliability, life-testing, survival analysis, data compression and many other fields can be seen from the many study. Statistical process control (SPC) can monitor the forecasting of software failure and thereby contribute significantly to the improvement of software reliability. Control charts are widely used for software process control in the software industry. In this paper, proposed a control mechanism based on NHPP using mean value function of Musa-Okumo and Power law type property.

An Efficient Algorithm for Mining Interactive Communication Sequence Patterns (대화형 통신 순서열 패턴의 마이닝을 위한 효율적인 알고리즘)

  • Communication log data consist of communication events such as sending and receiving e-mail or instance message and visiting web sites, etc. Many countries including USA and EU enforce the retention of these data on the communication service providers for the purpose of investigating or detecting criminals through the Internet. Because size of the retained data is very large, the efficient method for extracting valuable information from the data is needed for Law Enforcement Authorities to use the retained data. This paper defines the Interactive Communication Sequence Patterns(ICSPs) that is the important information when each communication event in communication log data consists of sender, receiver, and timestamp of this event. We also define a Mining(FDICSP) problem to discover such patterns and propose a method called Fast Discovering Interactive Communication Sequence Pattern(FDICSP) to solve this problem. FDICSP focuses on the characteristics of ICS to reduce the search space when it finds longer sequences by using shorter sequences. Thus, FDICSP can find Interactive Communication Sequence Patterns efficiently.

Space-Stretch Tradeoff Optimization for Routing in Internet-Like Graphs

  • Compact routing intends to achieve good tradeoff between the routing path length and the memory overhead, and is recently considered as a main alternative to overcome the fundamental scaling problems of the Internet routing system. Plenty of studies have been conducted on compact routing, and quite a few universal compact routing schemes have been designed for arbitrary network topologies. However, it is generally believed that specialized compact routing schemes for peculiar network topologies can have better performance than universal ones. Studies on complex networks have uncovered that most real-world networks exhibit power-law degree distributions, i.e., a few nodes have very high degrees while many other nodes have low degrees. High-degree nodes play the crucial role of hubs in communication and inter-networking. Based on this fact, we propose two highest-degree landmark based compact routing schemes, namely HDLR and $HDLR^+$. Theoretical analysis on random power-law graphs shows that the two schemes can achieve better space-stretch trade-offs than previous compact routing schemes. Simulations conducted on random power-law graphs and real-world AS-level Internet graph validate the effectiveness of our schemes.

Hangeul Keypad for Smart Phones Using Gesture

  • In accordance with development of smart phone, the importance of keypad was increasing, because the smart phone provides a variety of feature like word processor, chatting program, messenger and etc. In this paper, we propose the new Hangeul keypad for smart phones using gestures. And, also we do experiment for performance evaluation of the proposed keypad in this paper. The experiment shows that the proposed keypad is more efficient than other keypads.

Stabilized Algorithm Design of a Shipboard Satellite Antenna System (선박용 위성 안테나 시스템의 안정화 알고리즘 설계)

  • This paper presents the stabilization of a shipboard satellite antenna system. Hardware systems composing the pedestal, pedestal control unit and antenna control unit are designed and stabilization control law is obtained. A model on each control axis is derived and its parameters are estimated using a genetic algorithm, and the optimal state controller is designed based on the estimated model. An experimental result demonstrates the effectiveness of the proposed system.

  • The one of the most meaningful change in the recent ubiquitous environment is the omnipresence of public digital display device for providing ubiquitous information. It is the important issue to provide publicity as well as adaptive information to each user in the field of the public digital display device. This research proposes the idea ensuring fast response speed by the selection of user preference function. The preference function is selected by statistics using Zipf distribution in the system comprising mobile device and digital display device based on NFC (Near Field Communication). The idea is proved by CPM-GOMS model and the improvement of user response can be achieved.

  • When current cyber attacks to information and communication facilities are examined, technologies such as chase evasion technology and defense deviation technology have been rapidly advanced and many weak systems worldwide are often used as passages. And when newly-developed cyber attack instruments are examined, technologies for prefect crimes such as weakness attack, chase evasion and evidence destruction have been developed and distributed in packages. Therefore, there is a limit to simple prevention technology and according to cases, special procedures such as real-time chase are required to overcome cyber crimes. Further, cyber crimes beyond national boundaries require to be treated in international cooperation and relevant procedural arrangements through which the world can fight against them together. However, in current laws, there are only regulations such as substantial laws including simple regulations on Punishment against violation. In procedure, they are treated based on the same procedure as that of general criminal cases which are offline crimes. In respect to international cooperation system, international criminal private law cooperation is applied based on general criminals, which brings many problems. Therefore, this study speculates the procedural law on cyber crimes and presents actual problems of our country and its countermeasures.

Recent Developments in Law of International Electronic Information Transactions (국제전자정보거래(國際電子情報去來)에 관한 입법동향(立法動向))

  • This paper focuses on two recent legislative developments in electronic commerce: the "Uniform Computer Information Transactions Act" ("UCITA") of USA and the "preliminary draft convention on the use of data message in [international trade] [the context of international contracts]" ("preliminary draft Convention") of UNCITRAL. UCITA provides rules contracts for computer information transactions. UCITA supplies modified contract formation rules adapted to permit and to facilitate electronic contracting. UCITA also adjusts commonly recognized warranties as appropriate for computer information transactions; for example, to recognize the international context in connection with protection against infringement and misappropriation, and First Amendment considerations involved with informational content. Furthermore, UCITA adapts traditional rules as to what is acceptable performance to the context of computer information transactions, including providing rules for the protection of the parties concerning the electronic regulation of performance to clarify that the appropriate general rule is one of material breach with respect to cancellation (rather than so-called perfect tender). UCITA also supplies guidance in the case of certain specialized types of contracts, e.g., access contracts and for termination of contracts. While for the most part carrying over the familiar rules of Article 2 concerning breach when appropriate in the context of the tangible medium on which the information is fixed, but also adapting common law rules and rules from Article 2 on waiver, cure, assurance and anticipatory breach to the context of computer information transactions, UCITA provides a remedy structure somewhat modeled on that of Article 2 but adapted in significant respects to the different context of a computer information transaction. For example, UCITA contains very important limitations on the generally recognized common law right of self-help as applicable in the electronic context. The UNCITRAL's preliminary draft Convention applies to the use of data messages in connection with an existing or contemplated contract between parties whose places of business are in different States. Nothing in the Convention affects the application of any rule of law that may require the parties to disclose their identities, places of business or other information, or relieves a party from the legal consequences of making inaccurate or false statements in that regard. Likewise, nothing in the Convention requires a contract or any other communication, declaration, demand, notice or request that the parties are required to make or choose to make in connection with an existing or contemplated contract to be made or evidenced in any particular form. Under the Convention, a communication, declaration, demand, notice or request that the parties are required to make or choose to make in connection with an existing or contemplated contract, including an offer and the acceptance of an offer, is conveyed by means of data messages. Also, the Convention provides for use of automated information systems for contract formation: a contract formed by the interaction of an automated information system and a person, or by the interaction of automated information systems, shall not be denied on the sole ground that no person reviewed each of the individual actions carried out by such systems or the resulting agreement. Further, the Convention provides that, unless otherwise agreed by the parties, a contract concluded by a person that accesses an automated information system of another party has no legal effect and is not enforceable if the person made an error in a data message and (a) the automated information system did not provide the person with an opportunity to prevent or correct the error; (b) the person notifies the other party of the error as soon as practicable when the person making the error learns of it and indicates that he or she made an error in the data message; (c) The person takes reasonable steps, including steps that conform to the other party's instructions, to return the goods or services received, if any, as a result of the error or, if instructed to do so, to destroy such goods or services.

  • The education system is the communication field should be based on the characteristics of communication science and the function of manpower. However, the current education system at the level of college is insufficient and irrational to meet the requirements of the telecommunication field in our country. The main reasons are as follows: 1. Misunderstanding the characteristics of communication science. 2. Indiscretion of the categories of communication manpower due to lack of coordination between academic circles and communication industrial field. Telecommunication function could be performed only by combining the engineering and the suitable operational control. The communication engineering is similar to the electronic engineering, but the former should follow the miscellaneous international protocol and the domestic regulations, being only a means for the telecommunication function. In order to improve the education system of communiation, we aim to identify the principle of communication science, orthodoxy of the education, the categories of communication industrial field and manpower. The present system has been formed on the basis of ignoring the attributes of manpower and historical background of communication science. Therefore, this paper proposes to set up new departmental organizations for educating communication manpower as the following: In addition, this paper proposes a new curriculum model of the above twodept, and we believe that it well turn out more scientific, effective and reasonable education for the communication science. 1. Modification of the present formation, designated Electronic Communication Department. 2. New formation model: A. The best future model such as establishing ad independent telecommunication college which is composed of : Dept. of Radiocommunication Dept. of Telecommunication Enginnering Dept. of Communication Industrial management Dept. of Transmission Engineering Dept. of Telecommunication Law B. An immediately practicable proposal model instead of the existin Dept.. which is composed of the first two Dept. of the above five Dept. In addition, this paper proposes a new curriculum model of the above two dept. and we believe that it will turn out the education for the communication science to be more scientific, effective and reasonable.
