개인정보 관련 국내기업의 역차별 상황에 관한 규제 분석과 개선방안에 관한 연구 (A Regulatory Analysis on the Reverse Discrimination against Korean Domestic Businesses in relation to the Data Protection and Regulatory Improvement Orientation)

  • 국내의 IT기업들은 개인정보보호에 관한 국내법의 규제와 집행이 엄격히 적용되는 반면, 해외 기업들에게는 여러 이유로 법의 적용과 집행이 동등하게 이루어지지 못하는 상황이다. 이에 따라 국내기업들은 해외기업에 비해 경쟁력이 약하여 규제의 역차별 상황에 놓여 있다. 이에 본 글에서는 개인정보보호법제상 규제항목을 5가지로 유형화하고 분석하였다. 또한 국내에 서비스를 제공하는 대표적 사이트(네이버(Naver), 다음(Daum), 구글(Google), 페이스북(Facebook))이 제시하는 개인정보처리방침(privacy policy)을 비교분석하고, 위의 규제항목별로 의무사항에 부합하는지 검토한다. 그리고 역차별 해소를 위한 종합적 법제 개선 방안을 3가지 측면으로 제안한다.

  • 2005년 1월 '민간투자법 개정'에 의해 민간투자대상시설이 BTL(Build-Transfer-Lease)방식에 의한 학교 복지시설, 군시설 등 새로운 사회기반 시설유형으로 대폭 확대되었다. 이러한 개정으로 과거 민간투자가 불가능했던 군시설물에 2006년 1.3조원을 시작으로, 2008년부터 2011년까지 1.6조원이 투입될 예정이다. 이렇게 증가하는 군시설 BTL사업의 성공적 수행을 위해서는 기존의 일반적 BTL사업의 문제점과 군 BTL 사업의 사례분석을 통해 현행 사업시스템의 문제점을 도출하고 그에 대한 제도적인 개선이 필요하다. 본 연구는 군BTL 사업의 제도 개선을 목적으로 기존 연구에서 지적된 BTL사업의 일반적인 문제점과 군시설 특성이 반영된 특수한 문제점을 분석하고, 군시설물 담당자를 대상으로 설문을 실시하여 각각의 문제점에 대한 심각성(severity)과 그에 따른 군의 대응정도를 파악하기 위한 역량분석을 수행하였다. 또한 도출된 문제점에 대한 전문가 패널토론을 통해 제도 개선방향을 제시하였다.

방사성동위원소 치료의 제도적 문제점과 개선 (Regulatory Problems in Radionuclide Therapy and Suggestions for Systematic Improvement)

  • Radionuclide therapy has been used for more than 50 years and proved to be a safe and effective modality. However, the patients' right to have the excellent medical service is seriously disturbed by excessive regulations of government institutions such as Korea Institute of Nuclear Safety (KINS), Health Insurance Review Agency (HIRA) and Korea Food and Drug Administration (KFDA). For example, the patients should wait for more than 6 months to have I-131 treatment in many hospitals it is strongly recommended to mitigate the regulations to resonable levels to solve the problems. If HIRA allow the hospitals to charge reasonable rate for radionuclide therapy room, then more hospitals would invest to build the radionuclide therapy rooms and the patients' waiting time would decrease. The waiting time would also decrease, if KINS allow 2 patients to share a radionuclide therapy room. Finally, it is strongly recommended to lower the threshold for approval of new therapeutic radiopharmaceuticals by KFDA, which would allow new effective therapeutic raoiopharmaceuticals to be introduced to clinical practices more easily.

지방자치단체 건축행정 개선방안에 관한 연구 (A Study on the Improvement of Building Administration by Local Government)

  • The non-mandatory guidance and illogical ordinance of local government generate complicated and vague regulations and procedures. These cause inconvenience in building administration, and give rise to unnecessary social and administrative expenses. The purpose of this study is to suggest the improvement of building administration by local government from an institutional point of view through the literature review and the specialist survey focusing on the problems arising from the building ordinances and non-mandatory guidance. The results of this study are as follows; In the first place, the connection between law and ordinance should be improved in a systematic, definitude manner and high-degree of completion. Second, the monitoring management system should be arranged in order to excavate and improve the non-mandatory guidance. Third, the effort should go into improving ability and disposition of building official. Fourth, it is necessary to materialize and clarify the regulatory contents and adjust them to fit the legal system. Lastly, it is important to reinforce incentives and procedures of verification in order to manage building ordinances of legal government's own free will. In order to improve of building administration by local government, it is necessary to make the structure of sustainable improvement and discuss not only institutional aspect but also elements of building administration in later study.

  • A Special Building Zone, which could relieve or ignore part of the Building Act and the regulations in relevant laws, was practically established for the creation of new urban landscape, the improvement of construction technology, and the improvement of construction-related policy. However, due to the lack of understanding the Special Building Zone as well as the insufficiency of detailed standards in policies, the system currently cannot be operated in universal matters. In such circumstance, this study, which is based on the current data on the Special Building Zone defined in exiting law, attempts to analyze the multi-unit housing that has been planned by the system of Special Building Zone. Also, this study aims to derive the Special Building Zone's possibilities and implications that contribute to the improvement of landscape, so as to suggest solutions for effective improvement of the system. With the results above, solutions for the improvement of the system can be derived and summarized as the following. On the one hand, from 'planning perspective', it is necessary to improve the system in a comprehensive way with consideration of urban and local contexts. On the other hand, from 'procedure perspective', some foundation shall be prepared for a system that can allows comprehensive tasks, including the settlement of the zone, the alleviation/elimination of regulations, the approval of building's construction, the process of construction, and the monitoring.

개인정보보호를 위한 ELIS의 자치법규서식 개선방안 (Improvement Method of ELIS Local Laws and Regulations Format for Personal Information Protection)

  • 본 논문에서는 강원도 기초자치단체 18기관 가운데 4개 주요시에 대하여 자치법규의 개인정보 요구 실태를 파악하였다. 자치법규정보시스템(ELIS)을 활용하여 지자체의 자치법규에서 별지서식을 대상으로 전수조사를 실시하였다. 분석결과 슈퍼키인 주민등록번호를 포함하여 거부감이 있는 스마트폰 번호, 자택 전화번호 등의 개인정보 요구가 심각한 상태로 조사되었다. 개선방안으로 PIMS 준수와 개인정보 자동검색엔진의 시급한 개발을 제안하였다.

  • 국립전파연구원에서는 방송통신설비의 운용자 및 이용자의 안전과 서비스 품질 향상을 위하여 위해 방지 및 오용, 고장 방지, 장애인에 대한 접근의 용이성, 단말장치간 상호호환성, 전송 품질과 망 접속 등에 관한 단말장치의 세부 기술기준을 정하여 고시하고 있으며, 방송통신설비 기술의 발전과 서비스의 다변화에 빠르게 대응하기 위하여 단말장치 기술기준의 제 개정 연구를 추진하고 있다. 2013년 신규 융합 서비스 및 초고속 인터넷 서비스의 확산, 방송통신 서비스의 품질 제고를 위해 단말장치의 신호 전력 측정 대역의 확장과 의사회로의 대체 종단 사용 기준, 디지털 회선 접속 단말의 펄스 형상 기준 등에 대한 연구를 추진하고 이에 대한 타당성 검증을 위한 테스트베드 시험 결과를 제시하였다.

Recommendations for Improving Incentive Systems in the Building Sector of South Korea

  • Purpose: Reducing energy consumption and greenhouse gas emissions is a primary concern throughout the world, and the building sector is a particularly efficient area for making these reductions. In South Korea, the government has recently enacted policies for "Green Growth" that, among other things, enforce regulations in the building certification rating system (BCRS) and reorganize existing incentive systems. Method: In this study, we examined regulations and incentive systems used in the United Kingdom, Germany, and the United States that encourage the use of energy efficient technologies in construction and compared these policies to those used in South Korea. We also disseminated surveys to experts in the fields of architecture, planning and design, and engineering to better understand their knowledge and perception of the BCRS and its incentive systems. Additionally, we sought their recommendations for improving these incentive systems. Result: Based on our comparative case studies of regulations and incentives in other countries, alongside recommendations from experts in South Korea, we concluded that incentive systems in South Korea are limited and require improvement. We make recommendations for strengthening existing regulations and incentives and for implementing new incentive programs.

  • 석회석은 시멘트의 원료로 년간 약 8천만 톤 이상이 주로 강원도와 충북지역에서 채굴되고 있다. 그러나 노천채굴에 따른 환경오염원의 유발과 환경보전의 논리로 개발에 많은 제한을 받고 있다. 최근에는 개발기술이 향상되고 있으며, 개발조건 역시 변화되고 있기 때문에 이에 맞추어 석회석 개발과 관련된 제도 역시 부분적으로 수정, 보완되어야 할 것이다. 따라서 본 연구에서는 환경오염저감을 위한 몇가지 대책과 관련 제도의 부분적인 개정 방안을 제시하였다. 이와 같은 과정을 거처 환경보전과 개발의 조화속에 시멘트 산업의 획기적 발전이 있길 기대한다.

한약・생약제제 품목허가신고심사 규정 변화에 관한 고찰 - 건국이후부터 2012년까지 - (A Study on the Changes in Regulations Regarding Approval, Notification and Review of Herbal Medicinal Preparations and Crude Drug Preparations - From 1948 to 2012 -)

  • Objectives : The purpose of this study was to analyze and identify the problems of the changes in regulations that are relevant to approval, notification, and review of herbal medicinal preparations and crude drug preparations. Methods : I collected the regulations of approval, notification, and review of medicinal products mostly from official gazettes, analyzed enactment and amendments regarding herbal medicinal preparations and crude drug preparations, and studied it from the view point of Korean medicine field. Results : Regulations in regards to approval, notification, and review of herbal medicinal preparations and crude drug preparations were first established in 1978. Herbal drugs started to be categorized as crude drug preparations in 1981 and the regulatory outlines were completed in 1999. From 2008 to 2012, the regulatory standards that let crude drug preparations be new drugs from natural products were established. Through those procedures, the followings became crude drug preparations: 1) wholly new prescriptions that are not recorded in Korean Medical Classics, 2) prescriptions that are recorded in Korean Medical classics but prepared with new standard, composition and efficacy, 3) prescriptions that are recorded in Korean Medical classics but prepared with new formulation, and 4) herbal drugs. In case of herbal medicinal preparations, however, only regulations that are related to 1) drugs prepared with new compositions that are not recorded in Korean Medical Classics, 2) drugs with same prescription and same formulation, and 3) drugs with new formulation were arranged. Conclusions : Actual circumstances on crude drug-oriented regulations regarding approval, notification and review and future forms of prescription and drug administration in Korean Medical Institutions can be expected due to expansion in range of herbal medicinal preparations and shrink in that of on-site preparations. Reasonable improvement in efficient usage of modernized herbal medicinal preparations in Korean medical institutions and prospective cooperation from related pharmaceutical industry are needed.
