  • The summary of the case is as follows: a Korean passenger booked and purchased a business class ticket from Air France that was scheduled to depart from Paris and arrive in Seoul. When the passenger arrived at the check-in counter, he was told that all business class seats were occupied. It was because the flight was overbooked by Air France. The passenger cancelled the Air France flight and took another air carrier. After arriving in Korea, he brought suit against Air France for damages. The purpose of this article is to discuss the governing law when interpreting the contract of international air carriage in accordance with the Korean Private International Act (2001) and to analyze air carrier's civil liability for the bumped passenger in the overbooking case. If the parties have not chosen the applicable law the contract shall be governed by the law of the habitual residence of the consumer in the following situations: prior to the conclusion of the contract, the opposite party of the consumer conducted solicitation of transactions and other occupational or business activities by an advertisement in that country or conducted solicitation of transactions and other occupational or business activities by an advertisement into that country from the areas outside that country and the consumer took all the steps necessary for the conclusion of the contract in that country or in case the opposite party of the consumer received an order of the consumer in that country [Article 27 (1), (2) of the Private International Act]. Since the contract of international carriage falls into the consumer contract, the Supreme Court viewed that the governing law of the contract in this case would be the law of the habitual residence of the consumer (Supreme Court Decision 2013Da8410 decided on Aug. 28, 2014). This interpretation differs from the article 5 (4) of Rome Convention(80/934/EEC) which declares that the consumer contract article shall not apply to neither a contract of carriage nor a contract for the supply of services where the services are to be supplied to the consumer exclusively in a country other than that in which he has his habitual residence. Even though overbooking can be considered as a common industry practice, an air carrier must burden civil liability in case of breach of contract for the involuntary bumped passenger(Seoul Central District Court Decision 2014Na48391 decided on Jan. 29, 2015). In case of involuntary bumping, an air carrier must offer re-routing to passenger's final destination by an alternative flight. If an air carrier fails to effect performance in accordance with the tenor and purport of the obligation, the involuntary bumped passenger may claim damages(Article 390 of the Civil Code).

  • Ofloxacin, norfloxacin, ciprofloxacin, and enrofloxacin in chicken muscle were seperated by liquid extraction and determined with high performance liquid chromatography (HPLC) with fluorescence detector. Analysis was carried out using following conditions; Cl8 column (250${\times}$4.6 mm i.d. 5 ${\mu}{\textrm}{m}$ particle size), mobile phase composed of D.W. (containing 0.4% triethylamine and phospholic acid): methanol : acetonitrile (800:100:100, v/v/v), isocratic pump at a flow rate of 1.0 $m\ell$/min and 50 ${mu}ell$ of injection volume, fluorescence detector with EX278 nm/EM.456 nm. The calibration curves of four fluoroquinolones showed linearity (${\gamma}$$^2$$\geq$0.999) at concenration range of 0.025-0.6 $\mu\textrm{g}$/ml. The recoveries in fortified chicken muscle represented more than 80% with low coefficient of variation (〈10%) for concentration range of four fluoroquinolones. The detection limits for ofloxacin, norfloxacin, ciprofloxacin, and enrofloxacin were 23.5, 3.4, 3.0 and 2.5 ng/g in chicken muscle, respectively. We also monitored fluoroquinolones residue in muscle of chickens (broiler 1:227, Korean native chicken 219, laying chicken 77) using EEC-4-plate screening and HPLC conformation methods. Ten(broiler 5, Korean native chicken 5) out of the fifteen samples which were positively detected by EEC-plate screening method from 1,523 chicken meat were confirmed with ciprofloxacin and enrofloxacin by HPLC. The ranges of residual concentration were 0-0.12 ppm for ciprofloxacin and 0.01-6.79 ppm for enrofloxacin. In conclusion, our method could be applied effectively to determine four fluoroquinolones residues in chicken meat, and further survey for fluoroquinolones residue in chicken meat are needed for more effective control of fluoroquinolones used in livestock.

  • In this paper, we investigate achieving the full diversity order and power gains in case of using OSTBCs and quasi-OSBCs in the x channel system with interference alignment with more than 2 antennas at each terminal. A slight degradation is remarked in the case of quasi-OSTBCs. In terms of receiver structure, we show that due to the favorable structure of the channel matrices, the simple zero-forcing receiver achieves the full diversity order, while the interference cancellation receiver leads to degradations in performance. As compared to the conventional scheme, simulation results demonstrate that our proposed schemes achieve 14dB and 16.5dB of gain at a target bit error rate (BER) of 10-4 in the case of OSTBCs with 3 and 4 antennas at each terminal, respectively, while achieving the same spectral efficiency. Also, a gain of 10dB is achieved at the same target BER in the case of quasi-OSTBC with 4 antennas at each terminal.

  • The purpose of this study was to identify novel extracts of brawn algae with the high deodorant capacity and antioxidant activity. To achieves this, an composition, deodorant performance and free radical scavenging activity were analyzed in powder and water extracts of Ecklonia cava(PEC/EEC), Saccharina japonica(PSJ/ESJ), Eisenia bicyclis(PEB/EEB), Sargassum spp.(PSS/ESS) and Hizikia fusiformis(PHF/EHF) using several analytical methods. Major component of five powders was verified as PEC, phlorotannin; PSJ, alginic acid and glutamic acid; PEB, carotenoid, chlorophyll, phlorotannin, tocopherol and fucoxantin; PSS, ${\beta}$-carotene and polyphenol; PHF, tannin. The highest level of DPPH scavenging activity was detected in EEC($IC_{50}=23.018{\mu}g/ml$), followed by EEB, ESJ, EHF and ESS. The deodorizing performance to ammonia was maintained high level in PEC, PSJ, PEB and PSS, while PHF showed low level in the same condition. But, the deodorizing performance to acetic acid was slightly higher in PSJ and PEC than those of PEB, PSS and PHF. Based on the results of DPPH scavenging activity and deodorizing capacity, we selected fractions of S. japonica as leading extracts and further prepared the 70% acetone extract (AESJ) and 70% ethanol extract (EESJ) from PSJ. The contents of total flavonoid, total phenol and total condensed tannin was significantly increased with 112-209% in AESJ and EESJ compared to those of ESJ. Also, a similar enhancement was observed on the level of DPPH scavenging activity and deodorizing performance against ammonia/acetic acid in AESJ and EESJ. Therefore, these results suggest that AESJ and EESJ contained with high total phenol and total condensed tannin contents may exhibit high deodorant capacity and antioxidant activity as well as has the potential for use as a powerful biomaterial for antibacterial deodorant.

  • Educational evaluation involves data collection and the analysis of various education-related factors to make decisions that improve educational quality. Systematic educational evaluation is essential for enhancing the quality of education. This study reports a case of student-conducted process evaluation of a medical school's student support system and the procedure for devising improvement plans. Sixteen Inje University College of Medicine students participated in the Education Evaluation Committee (IUCM-EEC) to understand the educational improvement process as learners and actively achieve improvement. The Quality Improvement Committee of the Inje University College of Medicine (IUCM-QIC) decided to reform its student support system based on a previous educational evaluation in 2019. The evaluation of the student support system was conducted for 10 months in 2021 by the student subcommittee, under the guidance of the IUCM-EEC. The CIPP (context-input-process-product) evaluation model was used for a systematic evaluation. Accordingly, the subcommittee developed evaluation criteria and indicators, and analyzed relevant data collected from surveys and the previous literature. For further recommendations and revision ideas, the student subcommittee members interviewed faculty members from six other medical schools and also conducted a focus group interview with the dean and vice deans of IUCM. Finally, the student subcommittee submitted a report to the IUCM-QIC. Communication with various stakeholders is essential for a successful evaluation process. In this case, students, as key stakeholders in education, evaluated the student support system. Their active participation helped improve their understanding of the evaluation process.

  • In this paper, we have analyzed the effect of SNR estimation error on the BER performance of MMSE-DFE in high-speed binary CDMA system. Since MMSE equalization algorithm requires the SNR value of input signal, it should be estimated using CAZAC sequence in preamble. However, when AWGN and ISI exist simultaneously, it is impossible to estimate the exact SNR value of input signal and thereby equalizer's performance may be deteriorated. The simulation results can be used as a guideline for selection of SNR estimation algorithm for MMSE-DFE design.

  • The Council Regulation (EEC) No 2092/91 of 24 Juni 1991 on organic production of agricultural products and indications referring thereto on agricultural products and foodstuffs. This Regulation describes the legal framework for agricultural products and foodstuffs obtained organically. The Regulation establishes a harmonized framework for the production, labelling and inspection of agricultural products and foodstuffs in order to increase consumer confidence in such products and ensure fair competition between producers. This article presents a study about inspection and certification system of organic production of agricultural products and foodstuffs in Germany. In order to guarantee respect for the rules of production, the Regulation provides for an inspection system to ensure that operators who produce, prepare or store organic products or import them from third countries notify the competent private and public authorities in the Member States of their activities. These inspection authorities must, at the very least, ensure application of the minimum inspection and precautionary measures laid down in Annex III to the Regulation. For the production of meat, the Regulation states that the Member States must guarantee the traceability of products throughout the production, processing and preparation chain.
