  • Among the themes for CSR(Corporate Social Responsibility), consumer issues include protecting the health and safety of consumers who purchase and use the products. In particular, ensuring product safety is a major theme of consumer issues for corporate social responsibility. Currently, the government implements the Electrical Appliances and Consumer Products Safety Control Act for product safety management and selects products that may harmful to consumers as safety control items, and manages the products by designating them as 4 types of safety certification, safety confirmation, supplier conformity verification, and safety standard compliance. In this paper, we propose management plans for the establishment of a more reasonable classification type of safety management target for 48 items of consumer products to be controlled by the act, and confirm the validity of the plan. First, we perform cluster analysis using data for CISS (Consumer Injury Surveillance System) to derive a new classification type of the safety management target. Next, we compare the results of the cluster analysis with the classification type of the act and the existing scenario classification method RAS (Risk Assessment by Scenario) and the causal network method RAMP (Risk Assessment Method based on Probability). Based on these results, we propose two new plans of safety management target classification and verify its validity.

  • The U.S. Supreme Court delivered a decision on the case between AT&T and Concepcion, which confirmed the contractuality of a defense as a threshold to distinguish between what is a viable defense for invalidation of consumer arbitration agreement and what is not. In this paper, the adhesiveness of arbitration clause, which is a unique character for consumer arbitration, is investigated in the U.S. as a legal defense to invalidate the consumer arbitration agreements, and its contractuality and related legal doctrines are analyzed. The legal issues of consumer arbitration have been analysed in several legal perspectives including the voluntary, knowing and intelligent doctrine, doctrine of separation, contract of adhesion and the contractuality of defenses. Among all of these, the first three issues are related with arbitration clause, and the last one, the contractuality of defenses, reflects the nature of defenses invalidating the consumer arbitration agreement.

  • Today's arbitrations see themselves as the most effective scheme for dispute resolution in a variety of transactional context. While some kind of ADR system was already introduced in Korea as of 2007 with revision of the Consumer Basic Law, consumers' needs in dispute resolution remain unmet. Recently one consumer arbitration case divides the U.S. Supreme Court. Of course, the result of the case is expected to affect tens of millions of arbitration agreements in the States which has the most developed scheme in consumer arbitrations. While Arbitration clauses in adhesion contracts are not automatically held to be substantively unconscionable, Class action waivers are one of the most controversial issues in consumer arbitration. In this study, with the theoretical background of consumer arbitrations general, and contractual defenses against adhesive contracts, reviewed are U.S. federal courts' attitudes toward certain consumer arbitration agreements including the class arbitration waiver. Moreover, several issues in AT&T case are examined for practical implications for consumer dispute resolution. All of these are expected to initiate further research to find some guidelines for the proper status and operation of consumer arbitration here in Korea.

This study examined the representative incentive, the sales promotions which can effect on the consumer decision making process and current issues of them. For the purpose, a coffee specialty store was hypothesized and the subjects were 20∼30 years old, since the sales promotions can be more effective toward the younger consumers making their decisions low-involvement goods and services. The conclusions can be summarized as follows; Consumers understand the advantages and disadvantages of sales promotion very well, and use them rationally and usefully to maximize their satisfaction. the sales promotions act as incentives in the all steps of decision making processes. Generally, consumers prefer to get things at a good price, so in this survey, the discount coupons and the point accumulative membership had more effect than others. Consumers pointed out controversial issues of the sales promotions as follows: the sales promotions could bring about cost rising and unnecessary and/or impulse buying, and stir up speculative motivation. These are common serious problems in the sales promotions. The sales promotions are very useful tools in promoting sales but not fundamental in the long run. Marketers and manufacturers should keep it in mind that the best way to satisfy the consumers is to keep all things in good quality and moderate price.

  • This study includes definitions and major issues relating to product safety, and reviews about product safety laws of Korea and of other countries. In addition, this study suggests several ideas for a future governmental policy concerning product safety and the government policies to guide in securing consumers' safety of products. First, we need to set up consumer safety policies and laws dealing with complex consumer safety issues and to integrate existing laws for the safety of products. Second, opening a consumer safety agency and training workers who have relation to the safety policy, as a profession, are necessary. Third, it is required to redefine the product safety guidelines, strengthen the safety policy and to minimize safety regulations by the government directly. Fourth, each product of the safety management policies must be regularly evaluated and given feedback for improving its effectiveness. Fifth, information gathering, disclosing, and having a feedback system related to product safety should be rebuilt for the effective management of unsafe products. In addition, laws and the aims of product safety management being changed to focus on the consumers, control on imported products, collaboration with network and mutual-assistance systems of product safety-related agencies including international organizations and major countries and taking leading roles in the world are essential.
