Suggestions for Improvement of Youth Internet Regulation: Focusing on Youth Internet Regulation of the Major Country (청소년 인터넷규제 개선방향에 대한 제언: 주요국의 청소년 인터넷규제를 중심으로)

  • Advanced digital environment, ease of life would bring significant benefits, but rather indiscriminate access to information have occurred new social problems. Especially the youth and children using the Internet to increase in population resulting from harmful information on the Internet, concerns about the negative impact increases establish policies for the protection of youth and children emphasizes the importance of various activities international community. Despite major countries aim to self-regulation minimize the direct regulation through collaboration with the private sector cultivation and campaign, continuing education, Korea was analyzed that implement direct and coercive enforcement regulations such as 'internet game shut down' and insufficient social infrastructure to create activities. Therefore, in order to create a positive internet environment, self-regulation is essential with private experts and organizations based on cooperation and indirect regulation.

Rethinking the Regulation of Suggestive Advertising for Juvenile Protection: Focusing on the Meaning of 'Suggestive Advertising' (청소년 보호를 위한 '선정적 광고'의 규제에 대한 재고: '선정적 광고'의 의미를 중심으로)

  • Recently, it has been continually researched that the advertising regulation should be tightened since suggestive advertising in Internet affect more negatively juveniles. Most of the researches seem to overlook an important fact that the objects of the researches, suggestive advertising are different from the harmful advertising to juveniles defined by the Juvenile Protection Act because they approached with ethical perspectives, not legally. It can be judged that the suggestive advertising in the past researches are not actually harmful advertising regulated by the Act, so the suggestive advertising should be properly managed for protecting juveniles, not banned. In this context, this study suggested that more proper and reasonable advertising regulations in Internet environment for protecting juveniles, with reviewing the problems of regulation system of media product harmful to juveniles, focusing on the differences between 'suggestive' and 'harmful' advertising to juveniles by the Act.

A Study on the Standards for Regulating Obscenity on the Internet (인터넷상 음란물 규제의 법률적 기준에 관한 소고)

  • Korea also has tried to regulate the obscenity which is floating on the Internet in order to protect mainly minors. There are many statutes enacted to prohibit circulating pornographies to minors. However, there were minors who independently disseminate the pornographies to other minors. In the end, I can tell that existing statutes have not at least effectively regulate the obscenity on the Internet. Therefore, this article examines a possible limit of pornography on the Internet for the protection of minors, reviewing the CDA and the U.S. Courts' decisions. This article also examines the existing statutes' standard for regulating obscenity on the Internet in Korea. In addition, the article also tries to make a proposal to Korean legal systems that govern the obscenity on the internet.

A Meta-Analysis of Internet-Related Policy Research in Communication (인터넷 관련 규제정책 연구의 동향분석)

  • This study reviewed and ascertained policy researches relating to the Internet in the field of communication. With using a meta-analysis, this study attempts to classify 44 academic papers from 2000 to 2009 by research theme, methodology, theoretic rationale, related sub-theme, and targeted service and area. It is found that the themes of preceding researches examined herein were limited to the 4th domain in Developmental Model of Media Research. Such researches mainly relied on exploratory studies and only a few of them addressed theoretic rationales. Also, most of Internet regulation discussions focused on content regulation and general internet service. Lastly, researchers discussed laws having bearing on the Internet and social-cultural issues of the Internet.

A Study on Regulation of Video on Demand Advertisements (주문형서비스(Video on Demand) 광고 규제에 관한 연구)

  • This study points out the problems of absence of the legislation for standard regulation on Video on Demand(VoD) advertisement which grows so fast lately, for this it recommends making legal references, which have the definition of non-linear broadcasting & VoD advertisement and VoD advertisement standard regulation in the merged Broadcasting Act, and adopting co-regulation system. Pay TV operators providing VoD service have the opportunities to make money as subscribers uses it increasingly. In case of linear service, the Broadcasting Act regulates the advertisement strictly, but not the VoD ads. The reason why is that Korean legislation including the Broadcasting Act does not have legal reference to regulate it, instead of that, it rely on the self-regulation system which is operated by pay-tv players who provide the VoD ads. So, there is the limitation to protect the minors such as children and youth from the harmful VoD ads, to be invulnerable for advertisers to influence to advertising agents, and to ensure the regulatory effectiveness under player-centric self-regulatory regime. In this context, this study analyses the how to regulate VoD ads standard with a three-pronged approach. First, it analyses the VoD ads regulation system in overseas countries, UK, Canada, EU and Ireland. Each country has the legal reference to regulate it in the Broadcasting Act or lower statures and adopts the co-regulatory regime the NRA and the 3rd entity operate together. Second, it reviews the objectives and scope of VoD ads standard. This study recommends that the objective of it is users protection and the scope of it is standard regulation not commercial practice. Third, this study researches how to legislate for regulation of VoD ads standard. Considering VoD service's characteristics(non-linear service) and legal position of Ads agency(i.e. pay tv operators), it suggest that legal reference will be in the integrated Broadcasting bill, which is the general law, not individual. If it is available to regulate VoD ads standard with co-regulatory regime, it expects the enhancement of user protection from the harmful VoD ads and make up sustainability of the pay-tv players' self-regulation.

A Study of Music Regulations of Broadcasting Advertising (방송 광고의 음악 규제에 대한 연구)

  • This study reviewed critically the music regulations of broadcasting advertising and analyzed the post reviews of Korea Communications Standards Commission(KCSC) to find their problems and suggest alternatives for their improvements. As general core regulations, lyrics changes of children's song is banned except in non-commercial public advertising and lyrics changes to folk songs are permitted unless it includes the product related expressions, such as brand name; both of their arrangements are permitted. According to the items, the lyrics of the CM song of drug advertising should not include its brand name; alcoholic beverage advertising is banned if the lyrics of the CM song include product-related brand name or an expression encouraging drinking. The rationales of these regulations of restrictions or prohibitions of music in broadcasting advertising are unclear and are insufficient. Therefore, it will be necessary to improve them based on the evidence or knowledge by more valid research in the future.

A Discrimination System Model of Harmful Contents using Collective Intelligence and Collective Emotions (집단지성 및 집단감성을 활용한 유해 콘텐츠 판별 시스템 모델)

  • The case of South Korea's Internet newspapers, harmful advertising is illegal but rampant. The children and youth are not protected, so effective measures are urgently required. Therefore, to achieve self-regulation, a discrimination system model using collective intelligence and collective emotions is proposed. This study is to suggest a Discrimination System Model of harmful contents using collective intelligence and collective emotions as the actual program of self-regulation. The Discrimination System model forms the level of harmful contents by using contents, form, text, size as well as the implied and reminiscent story of image as discriminant factors of a group testing. The formed level is established for harmful contents discriminant criteria after going through the process of generalization again. It can be not clear and ambiguous for internet newspaper banner ads to be measure the level of harmfulness. This Discrimination System will have the strengths of resolving this problem.

  • The openness of the Web allows any user to access almost any type of information easily at any time and anywhere. However, with function of easy access for useful information, internet has dysfunctions of providing users with harmful contents indiscriminately. Some information, such as adult content, is not appropriate for all users, notably children. Additionally for adults, some contents included in abnormal porn sites can do ordinary people's mental health harm. In the meantime, since Internet is a worldwide open network it has a limit to regulate users providing harmful contents through each countrie's national laws or systems. Additionally it is not a desirable way of developing a certain system-specific classification technology for harmful contents, because internet users can contact with them in diverse way, for example, porn sites, harmful spams, or peer-to-peer networks, etc. Therefore, it is being emphasized to research and develop context-based core technologies for classifying harmful contents. In this paper, we propose an efficient text filter for blocking harmful texts of web documents using context-based technologies.

The design and implementation of user interface based on contents rating service for blocking harmful Internet information (유해 인터넷 정보 차단을 위한 내용 등급 서비스 기반 사용자 인터페이스 설계 및 구현)

  • The circulation of unwholesome information such as obscene and violent information is gradually increasing based on the rapid expansion of information communications infrastructure. Those kinds of information are harmful to the adolescents and even cause social problems so that active countermeasure is requited. In order to cope with the spread of unwholesome information, appropriate regulating methods are absolutely in need by establishing or revising information communications-related laws. In this paper, we had analyzed domestic and foreign programs with existing harmful information blocking method, and then designed and implemented a selective blocking program based on Platform for Internet Contents Selection(PICS) by using selective blocking technology based on Internet contents rating system. We also proposed a compromised rating system blocking method that consists of selective filtering function by age and the popular blocking list. The proposed system has advantages in that there would be no increase in network load resulting from blocking list update and inquiry, it is possible to perform active selective filtering considering user's age, and it may introduce self-imposed rating.
