The Research Methodology of Korean Commercial Arbitration in the Discipline-Fusion Perspective (한국 상사중재의 연구방법론 : 학문융합적 관점을 중심으로)

  • The main objective of this study is twofold. The first is to investigate the main currents of Korean commercial arbitration. The second is to investigate the research methodology of Korean commercial arbitration in the perspective of disciplinary fusion perspective. The main findings of Korean commercial arbitration are as follows: first, the incidence of commercial arbitration increased in the Korean Commercial Arbitration Board during the period of 2006-2010, second, the primary causes of trade claims are disputes related with payment and those related with sales contracts, third and finally, the number of countries seeking to resolve disputes through arbitration has increased, including European countries. In this setting, it is necessary to investigate commercial arbitration through the inter-disciplinary perspectives. This study suggests that there are five research methodologies of commercial arbitration. They are legal theory related methodology, institutional methodology, cultural methodology, causal methodology and empirical methodology. Traditionally, the legal profession leads the field of commercial arbitration. However, it is necessary to introduce other elements to the field of commercial arbitration. This study highlights the disciplinary fusion approach among five research methodologies of commercial arbitration.

The Effectiveness of Sensory Integrative Intervention: A Systematic Review (감각통합중재 효과에 관한 체계적 고찰)

  • Objective : The purpose of this study was to provide evidence for the effectiveness of Sensory Integrative Intervention (SII) through a systematic review. Method : The systematic review was executed using MEDLINE/PubMed, PsycINFO, CINAHL, Cochrane Library, OTSeeker. The key words for search was "effects of sensory integration", "sensory integration therapy", and "sensory integration intervention". 11 studies were used for data analysis, and the level of evidence were level I, leve lII and level IV. The substances of review were subject (population), method (intervention type), effect of the intervention, outcome parameter, and outcome measurement. Results : 1. The subjects of SII were autism spectrum disorders (30.7%), pervasive developmental disorder (15.4%) and preterm infants (15.4%). 2. Most frequently used method was the traditional intervention of J. Ayres (36.5%). The outcome parameters of SII were behavioral outcome (40.63%), motor performance outcome (28.13%), sensory-based outcome (25.0%), and academic outcome (6.35%). 3. The effects of SII were improvement of motor performance (66.7%), sensory-based (62.5%), and behavior problems (61.5%). In most studies, however, academic skill such as writing skill was not a positive outcome parameter in terms of effectiveness of SII. Conclusions : The results implied that the sensory integrative intervention is effective on motor performance, sensory-based and behavioral change, but not on the academic skill. It is suggested that the future research need to be done to examine whether and how the effect of sensory integration intervention can be long-lasting and contribute any academic skill and activities of daily living performance.

  • CISG is the most important international convention in the field of international sale of goods. Many arbitration organizations often invoke this convention when settling disputes between the parties concerned. China has been one of the contracting states since the effective date of CISG, and has settled many cases with it. This article aims at analyzing the legal status of CISG in China and the methods with which Chinese arbitration organizations apply CISG. Also, it looks into the existing problems, based on which it provides suggestions for improvement.

A Basic Study for the Development of Multidisciplinary Intervention Guide Map of Auditory Processing Disorders (청각처리장애의 다학문적 중재 안내도 개발을 위한 기초 연구)

  • People with auditory processing disorders(APD) do not exactly understand what they hear with normal hearing levels because of difficulties in the processing of auditory information in auditory nervous system. The purposes of this study are to investigate intervention strategies suggested by current literatures and to develop a guide map for APD intervention. The problem based intervention strategies are customized to the specific deficits of a subtype of Buffalo model and Bellis/Ferre model and general intervention strategies are recommended with compensatory strategy, auditory training, environmental modification and so on. Multidisciplinary team should determine and provide various intervention strategies to improve auditory capabilities of a child with APD intensively and persistently. APD intervention guide map is organized with four steps. It helps clinicians and teachers related with the intervention of APD find appropriate intervention strategies and process in order to reduce difficulties of a child with APD and a suspected APD.

A Literature Review on the Evaluation of and Interventions for Children's Motor Function (아동의 운동기능 평가 및 중재방법에 관한 문헌 고찰)

  • Objective : The purpose of this study was to examine foreign literature on the evaluation and interventions for motor functions in children. Methods : Studies in this review were identified by searching the PubMed, Cochrane Library (Embase) databases from those published form January 2010 to March 2020 using the following keywords: "motor function test" or "motor function measure" or "movement assessment" or "motor proficiency test" or "motor scale" or "motor skill" and children. Results : Of the total 37 identified studies, 14 analyzed evaluations, 23 analyzed interventions, all of which were randomized control trials. Studies on evaluations were increasingly more common, in contrast to studies on interventions for motor functions. The most frequent field of research was rehabilitation. The studies on evaluations included the AIMS and MABC-II, and GMFM was the most frequently used intervention. Interventions were most commonly used in task-oriented training (six studies). Conclusion : This study aimed to provide a basis for therapists to choose effective motor function evaluation and interventions for clinical trials by analyzing studies related to interventions for and evaluation of motor function in children.

An Analysis of the Rationale and Format of Music Intervention Studies With Patients Receiving Hospice or Palliative Care in Korea (국내 호스피스·완화의료 환자 대상 음악중재연구 내 중재 제시 방법 및 논거 분석)

  • The purpose of this study was to analyze the rationale and format of music therapy interventions with patients receiving hospice or palliative care in Korea. Through this analysis, I examined whether the music intervention used was based on a valid rationale and represented the professionalism expected of today's music therapy interventions. A total of 12 studies that met the selection criteria were identified, and the overall characteristics of each study and its format were analyzed. As a result of the analysis, it was confirmed that the rationale for each study and its format were influenced by the author's research field. The analysis also showed that the research on music-based interventions in hospice or palliative care settings was insufficient and involved a mix of professional and nonprofessional interventions. The results of this study suggest that importance of researchers possessing professional competence which requires offering a clear justification for their choice of interventions, music, and instruments. Additionally, these results emphasize the need for further development of evidence-based music therapy approaches in hospice and palliative care settings as the role of music in supporting patients in these environments has gained increasing recognition and validation.

A practical approach to commercial arbitration system in Pakistan (파키스탄의 상사중재제도에 관한 실무적 접근)

  • The commercial arbitration is considered an effective and rapid means in solving problems and finding solutions for disputes between the business partners. For the development of commercial arbitration, there is a need to study arbitration in practice as well as in theory. This paper analyse the situation of commercial arbitration system in Pakistan both with respect to domestic laws and international laws applicable in Pakistan. The Arbitration Bill 2009 aims to consolidate law relating domestic arbitration, international commercial arbitration, recognition and enforcement of foreign arbitral awards as well as settlement of international investment disputes. Pakistan while defending investment claims and in order to restore investor's confidence, in 2011, Pakistan introduced a law to secure foreign investments. This study explains the relationship of old and new Pakistani arbitration laws and elaborates the changes brought about by the new enactments and gives a comprehensive analysis of Pakistani arbitration laws, rules and procedures dealing with arbitration agreements and awards. In the absence of relevant trade information in Pakistan, this paper is designed to meet the needs of a Korean international trade scholars to obtain an understanding of Pakistani commercial arbitration system quickly.

Effectiveness of Medical Aid Case Management in Excessive Healthcare User by Interventions based on the Number of Accesss (의료급여 과다이용자의 중재방법별 접근횟수에 따른 사례관리 효과)

  • This study analyzed medical aid case management effects based on the number of access by visits, phone calls, letters, internal investigation, resource links, and requests, in medical aid case management business that is carried out to improve the quality of life of medical care beneficiaries and reduce financial cost. Secondary analysis study using data of 564 high-risk group in the medical aid case management and their healthcare utilization data. Letters had positive correlations with the scores of all case management domains. The higher visits was, the lower the score of self-health care ability was, and the higher the number of phone calls was, the higher the score for reasonable medical use was. While there was no significant difference in medical cost according to aid management by interventions, the higher visits and resource links were, the lower the subjects' total number of payment days was. There is a difference in the various areas of the quality of health -related life and medical use depending on case management by intervention method and its number. It is necessary to carry out the efficient number of access to case management by intervention method.

The Historical Origins and Modern Insights of the Chinese Arbitration System (중국 중재제도의 역사적 연원과 현대적 시사점)

  • Arbitration is a just and efficient method for resolving economic disputes. It adapts to the needs of economic development and is an important institution in today's society. Around the world, a tradition of resolving disputes through arbitration spontaneously developed in ancient times and gradually evolved into a legal system with the development of jurisprudence starting from the Middle Ages. In China, formal legislation on arbitration began in the modern era during the Republic of China period. However, the origins of arbitration as a method for resolving disputes can be traced back to ancient times, during the Qin and Han dynasties. The most significant modern arbitration legislation in China is the "Arbitration Law" enacted in 1995, which drew on the experiences of foreign arbitration laws. Despite this, there are still many areas in arbitration legislation that require improvement based on practical experiences. Currently, revisions to the Arbitration Law are underway, and historical experiences may offer valuable insights, assisting in better integrating the Arbitration Law with Chinese society. This article primarily focuses on the role and impact of the imported modern commercial arbitration system in China and how it can be harmonized with China's legal culture in the future.

Sensory Integration Interventions for Children with Autism Spectrum Disorder in Korea: A Systematic Review (국내 자폐스펙트럼장애 아동을 대상으로 제공되는 감각통합 중재방법: 체계적 고찰)

  • Objective : This study was intended to systematically consider the sensory integration intervention methods offered in Korea for children with autism spectrum disorder and to provide an evidence base for the application of sensory integration interventions. Methods : The subjects of this study were published studies in a national journal for the last 10 years from January 2011 to December 2020. The databases used for the search were RISS and DBpia. The search terms were 'autism', 'autism spectrum', 'sensory integration', and 'intervention'. A total of 10 studies were used in the analysis, which were analyzed at the qualitative and methodological quality of the research evidence and the results were presented according to the PICO (Patient, Intervention, Comparison, Outcome). Results : In the research analysis, the quality level of the evidence was highest at level IV, followed by level II. The methodological quality of the evidence was the most common for 'Good' research, followed 'Fair'. The study subjects were children with autism spectrum disorder and their parents, and the experimental design had the highest frequency of single-subject studies. Interventions have the highest number of studies confirming adaptive behavior and sensory modulation, and the evaluation tools used to measure interventions have the highest frequency of sensory profiles and Canadian occupational performance measures (COPM). All 10 studies used in the analysis showed positive improvements and statistically significant effects on various outcome values from sensory integration interventions. Conclusion : In the recent clinical environment, sensory integration interventions have been continuously conducted in children with autism spectrum disorder. In future research, it is necessary to conduct research on various sensory integration intervention methods and the high quality of the evidence for the application of sensory integration interventions.
