The Factors that Affect the Reporting Behavior of Mandated Reporter (아동학대 신고의무자들의 아동학대에 대한 인식과 신고행동에 영향을 주는 요인에 대한 연구)

  • This is the study to find out the differences between the mandated reporters who reported child abuse and who did not report and to know which factors affect the reporting behavior The researcher sent questioners to 595 doctors, teachers, nurses and social workers in 3 different cities as a sample. 477 people responded to questioner and only 116 people who said that they have found out abused child during the last year were used for analysis of this research. Among 116 people, only 35.4% reported child abuse. There were significant differences between two groups, groups that reported child abuse and groups that did not report, in attitude about Abuse, the experience of child abuse training and knowledge about abuse. However, the result of Logistic regression showed that reporting behavior are significantly affected by occupation, experience of child abuse training and severity of abuse.

Characteristics of the Child Maltreatment at Day Care Centers and the Case Dispositions of Child Protective Services in Korea (한국 어린이집 아동학대의 학대 특성 및 아동보호서비스의 최종조치 관련 요인 분석)

  • This study examined the characteristics of child maltreatment cases which occurred recently at the Day Care Centers in Korea. The study utilized the case records system of the National Child Protection Agency (K-CPS) and analyzed all the cases reported to the K-CPS from 2010 to 2012 (n=462). Using the case records abstraction system developed for this study, based on the Maltreatment Case Records Abstraction System (MCRAI; Trickett et al., 2009), the detailed information on abuse cases as well as disposition outcomes was abstracted. The results showed the relatively low rate of abuse designation, low rate of reports from the mandatory reporters as well as overwhelmingly high rate of physical abuse. Diversity was detected in severity ratings in each type of abuse. Finally, determinants of dispositions differed for children, perpetrators and daycare centers. Based on the results, implications for practice and child maltreatment research were discussed.

Factors Affecting Intentions of Reporting Child Abuse: The Interaction between Type of Abuse, Sex, and Construal-level (아동학대 신고의도에 영향을 미치는 요인 탐색: 학대유형과 성별의 상호작용, 아동학대 신고에 대한 해석수준)

  • This study explored measures to promote the reporting of child abuse, instances of which are increasing year after year. To this end, 16 cases of child abuse, encompassing four instances of each of the four types of child abuse (physical, neglect, sexual, and emotional), were presented to participants to examine whether the perception of each type of abuse affected the degree of its perception as a case of child abuse. Next, the effects of the four types of child abuse on the intention to report child abuse (low vs. high) were investigated in terms of gender (male vs. female) and the construal level. The results revealed that the participants' differed in the intent to report child abuse, depending on varied factors despite the fact that they perceived all cases as child abuse. In particular, no difference was found between men and women in their intent to report child abuse for cases of physical abuse and neglect. However, women exhibited a stronger intent than men to report sexual and emotional abuse. Further, the intention of reporting child abuse was stronger at the high construal level (related to why child abuse must be reported) than it was at the low construal level (concerned with what to do about child abuse). The practical implications of this study include the provision of educational content, the creation of publicity materials that place differing emphases on sex, and the application of low construal level education for reporting child abuse.

Roles of Childcare Teachers toward Child Abuse Prevention (아동학대예방을 위한 보육교사의 역할)

  • The purpose of this study is to identify childcare teachers' self-reported perception of child abuse and neglect, reporting procedures, and reporting experience in Korea. The total average score of knowledge in child abuse and neglect was relatively high and most childcare teachers consider child abuse and neglect as a highly serious problem. About eighty six percent daycare teachers perceived reporting legislation toward child abuse and neglect, and most teachers in the study population perceived themselves as mandatory reporters. As the Child Welfare Act included a clause on mandated reporters, childcare teachers' role in intervening in child abuse cases has become more critical. In order to increase childcare teachers' reporting, education program should be designed for childcare teachers to effectively involve them in reporting child abuse and neglect.

Analysis of Precedents Related to Child Abuse Cases in Child Care Centers and Its Implications (어린이집 아동학대 사건의 판례분석과 시사점 : 아동학대범죄의 처벌 등에 관한 특례법을 중심으로)

  • In Korea, child abuse in child care centers occurs continuously, and it is becoming a social problem. The government has intensified the supervision of management in child care centers, and through strong countermeasures and prevention against child abuse, it enacted the special act on child abuse in oder to enable children to become healthy members of society. In this study, this researcher gasped the legal application on child abusers, and analysed how the punishment for abusers changed according to the application of the special act on child abuse, through examining precedents of child abuse in child care centers. 21 cases related to child abuse cases were collected by searching homepage of the supreme court and each district court in this study. As a result of analyzing the precedents, the sentence of the defendant did not increase greatly, and it differed from the criminal identification of the people in cases of child abuse on which the special act on child abuse was applied. Therefore, it can be seen that there is a demand for more rigorous legal application for abusers in order to prevent child abuse in child care centers.

  • 2014년 9월 29일부터 아동학대 가해자에게 무기징역까지 처벌을 강화하고, 친권 제한도 가능케 한 '아동학대범죄의 처벌 등에 관한 특례법(아동학대처벌법)'이 시행되고 있다. 동법의 내용으로는 기존 형법상 '3년 이상의 유기징역'에 집행유예가 가능한 학대치사죄에 대해 법정형을 '무기 또는 5년 이상의 징역'으로 높이고 별도의 감경사유가 없는 한 집행유예가 불가능하도록 했다. 아동학대 가해자가 친권자라는 이유로 피해아동을 격리시키기 힘들었던 점을 개선하기 위해 친권을 제한할 수 있는 길을 터놓았다. 부모(친권자)가 중상해를 입히거나 상습적으로 학대한 경우엔 검사가 법원에 친권상실을 청구해야 하며, 검사가 하지 않으면 아동보호전문기관의 장이 청구를 요청할 수 있도록 했다. 본고에서는 아동학대의 실태를 기초로 하여, 아동학대처벌법의 내용과 문제점을 살펴보기로 한다.

Mental Representation for Family in Abused Children: Focusing on Types of Child Abuse (피학대 아동의 가족에 대한 정신적 표상: 성, 연령 및 학대유형별 비교를 중심으로)

  • The purpose of this study is to examine the family perception according to abused children's sex, age, and abusive type. The subjects were 45 abused children including 15 physically abused, 15 neglected, and 15 physically and emotionally abused children from age 7 to 14. The results were that boys showed more noncomplient behaviors to their parents, more concerns and more rejective behaviors to examination. Girls perceived their mothers as stressors more than those of boys. School-aged children perceived their mothers as allies than those of adolescents. Adolescents showed more rejective behaviors to examination and more anger. Physically and emotionally abused children experienced more family conflicts and showed more negative resolutions, and more noncomplient behaviors than those of abused children. Neglected children showed more depressive mood than those of abused children.

Analysis of Precedents Related to Child Abuse Cases in Child Care Centers Applied to the Act on Punishment against Child Abuses and Its Implications (아동학대처벌법을 적용한 어린이집 아동학대 사건에 관한 판례 분석 및 시사점)

  • For the recent 5 years, the trends showed that the child abuses by parents was declined while that by child care teachers and principals, employees in child welfare institution was increased. In particular, significant increase of child abuses by child care teachers and principals should be paid attention more than the abuse by the others. The government had already enacted the Act on Punishment against Child Abuses in 2014 to respond and prevent from child abuses strongly. However, as the cases of child abuses continued, questions were raised on the effectiveness of the regulation or whether the court performed well to play a role to punish the assailants of child abuses by amended regulations was suspected. This study is aimed to review the application cases of the Act on Punishment against Child Abuses through the precedents of child abuses in child care centers and to analyze how the punishments to assailants have been changed compared to application of Child Welfare Act. This study has the meaning to grasp the incompleteness of legal application on the child abuse cases and provide the basic data to improve the legal and system.

A Phenomenological Study on the experience of the physically abused children (학대받은 아동에 대한 현상학적 연구)

  • This study is conducted to understand the meanings and nature of the experience of the physically abused children. This is a phenomenological study utilizing van Manen's method to present the children's inner world. The participants for this study were 10 children, in the age of 8 to 12, who were physically abused by their parents. Data were collected by using semi-structured interviews by the workers who regurally contacted children at the service agencies. Data were analyzed by using 'line by line' reflection by two graduate level students and by the researcher. Eight essential themes were drawn and used for the phenomenological understanding which reveals the meanings given by the children experiencing abuse. There were some suggestions for the abuse counsellors based on these findings.

  • This study was conducted to identify nursing students' perceived professional responsibility for child abuse, perceived behavior control, children's rights awareness, and degree of intention to report child abuse, and to identify influencing factors on the intention to report child abuse. Data collection was collected through a questionnaire among 150 nursing students from University C and University D in Province C from April 28 to May 15, 2023. The collected data were analyzed using SPSS statistics 29.0 program. The factor influencing nursing students' perceived intention to report child abuse was the perception of children's rights. The explanatory power of intent to report child abuse was 13.6% overall. Nursing students' perceived intention to report child abuse was positively correlated with perceived behavioral control and perception of children's rights. Based on the results of this study, it is necessary to study educational programs and environments to increase awareness of children's rights in order to increase the willingness of nursing students to report child abuse.
