올해부터, 국토해양부 장관이 고시하는 최저가낙찰제 대상공사에 대하여 포괄대금지급보증제도가 시행되며, 건설근로자 노무비 구분관리 및 지급 확인제가 추진된다. 또한 근로계약 체결시 근로조건 일반사항이 명시된 서면을 근로자에게 반드시 교부해야 하며, 장애인 고용부담이 강화된다. 본지는 올해부터 달라지는 건설 중소기업 관련 개편 시행되는 각종 제도를 소개한다.

현행 건설일용근로자의 포괄임금 계약에 대한 대법원의 판결과 고용노동부의 지침이 변경되어 혼란이 야기되고 있다. 고용노동부는 지난 8월 8일 건설 일용근로자의 포괄임금제 업무처리 지침을 변경하고 일선 사업장에 시정 지시 공문을 발송하고 있다. 새로 변경된 건설 일용근로자의 포괄임금제 업무처리 지침은 일당제 일용근로자의 고용형태를 두 가지로 구분하여 일급에 포함되었다고 볼 수 있는 수당과 그렇지 않은 수당을 명시하고 있다. 일급에 포함되었다고 볼 수 없는 수당의 경우 해당 근로수당을 포함하여 체결된 근로계약이 부적정하다는 입장이며, 이에 따라 일당제 일용근로자를 사용하고 있는 사업장에 시정지시를 하고 있다는 것이다. 그러나 현행 판례 및 행정해석, 기존 고용노동부의 지침은 제수당을 미리 합산한 일정금액을 지급하기로 하는 포괄임금 계약을 인정하고 있다. 이처럼 판례와 고용노동부의 지침이 서로 다르고, 새로 변경된 고용노동부의 지침을 반영하는 새로운 판례가 아직까지 나오지 않았기 때문에 사업장에서는 사례별로 유연한 대응이 필요하다.

산업안전 문제는 과거 기업의 인사노무 관리에서 뒷전에 밀리는 경향을 보였으나 요즘은 다르다. 사업주와 근로자의 안전에 대한 인식이 높아지며 산업재해 예방은 기업 인사관리의 주요 관심사의 하나로 자리 잡았다. 그러나 영세 소규모 기업들은 산재 예방에 대한 투자 여력 부족에 따라 아직도 산재가 매우 빈번하게 발생하고 있는 실정이다. 이런 점에서 한국산업안전공단이 주도적으로 영세 중소기업의 산재예방을 위한 시설투자 자금, 환경 개선 자금을 지원하는 '클린사업장 조성사업(클린사업)'은 실효성 높은 재해방지 프로젝트로 평가되고 있다. 인쇄업계의 관심도 매우 크다. 재해예방과 작업환경 개선에 도움을 주는 이 사업은 구인난 해소에도 크게 기여하고 있다.

The radio frequency identification (RFID) technology allows various forms of applications in many industries including construction. and in Korea, RFID has already been adopted for the use in daily labor control, logistics monitoring of ready-mix concrete, supply chain management of long-lead items, such as structural steel members and curtain walls. Even though RFID tags have varied reading performances depending on various factors including material of tracking target and surrounding environment, there is no information on how much the reading performance of an RFID tag can be achieved against a specific construction components or materials. Therefore, the objective of this research is to identify the actual reading performance of various RFID technologies and to derive a method to maximize the reading performance for the use in the supply chain management process of curtain wall components.

This paper reviews recent records issues surrounding former president Roh Moo-Hyun's private possession of the copies of the presidential records in Korea. While the former president transferred his records to the National Archives of Korea, he copied his electronic presidential records and kept them in his house after the term. His retention of the "records copies" arouse critical records issues and criminal charges. In this paper, I examined the definition of presidential records and legal status of records copies, authenticity of electronic copies of public records in public and private records systems, nature and scope of presidential privilege of access to his records, and most importantly, political neutrality of national archives. I examined these issues comparing with foreign experience, especially that of the United States which has the Presidential Records Act like Korea. All issues are examined in the professional spirit of archives principles and archives ethics. Legal status of the electronic copies of presidential records is not firmly established and the criminal charge seems groundless. However, it is against public archives principles and ethics that private former president privately possesses and manages private information and national security information held in the electronic copies of the presidential records. Presidential Records Act of Korea provides an effective tool to protect the presidential records for 15 years and it should be respected. It is time to consolidate the public records management institutions in Korea, not to disintegrate them.

The Presidential Archives preserve and manage the president's records and archives, which accounts for the social and governmental operations during the president's term of office. However, search systems and online contents provided by the Presidential Archives are difficult to use. This study proposed an LOD-based archival information service for the comfort of users. The proposed service has a better extension of archival information service contents from President Roh's term. The provision of details is divided into three steps: first step sets up the establishment methods, second step creates ontological design, and third step converts it to RDF and connects to other institutions. Through the process, this study suggests an extension of archival information service in the Presidential Archives.

During the last few years, the use of Pre-tensioned spun High strength Concrete(PHC) pile has been gradually increased in many construction sites such as super high-rise and large building construction. there is almost no specific code and/or standard described in the specifications to check verticality for Pre-tensioned Spun High Strength Concrete pile installation process. The most commonly used method for the vortical PHC pile installation is a naked-eye measurement or water level measurement conducted by assistant crew in the construction sites. And recent analysis results of the pile cutting work revealed that it frequently makes a lot of cracks which significantly reduce the strength of the pile and is very labor intensive work, thus requiring a large amount of additional time, costs, and efforts. The main objective of the research is to analize problems and to improvement. measure of PHC Pile Construction. The improvement measure present to the main problem with survey and discussion.

The curtain-wall work has been more frequently applied in the construction industry since demand of high-rise buildings has been increased. The curtain-wall work is usually performed with the frame work simultaneously for reducing construction period, but it might be delayed because of several problems caused by interference of process. However, there is not an appropriate tool which can be used by a work manager for adjusting quantity of the construction equipments or the workers when the curtain-wall work was delayed. To resolve this problem a construction simulation anticipating and analyzing potential problems before starting the work can be applied in the curtain wall work. This research suggests a general model for the curtain-wall work by using construction simulation and produces a combination of construction equipments and workers which can estimate optimum work productivity.

In domestic public construction, disputes are increasing due to differences among stakeholders regarding contract price adjustment. In particular, the actual cost-plus fee for overhead costs due to the schedule extension cannot be agreed upon at the administrative phase, and most of them seek judicial judgment. Thus, this study aims to propose a 'sufficiently satisfactory' alternative to reach an agreement before disputes in order to minimize disputes related to the calculation of additional overhead costs. To this end, this study proposes three alternatives based on the rate method. Firstly, when calculating additional overhead costs, it is not calculated as an actual cost-plus-fee method, but as a rate compared to direct labor costs among net direct costs. Secondly, the calculated indirect labor costs are compensated for up to the legal maximum of legal limit costs such as general management costs, profits and so on. Thirdly, it reflects overhead costs increased or decreased due to change orders. Risks were analyzed by collecting expert opinions on the proposed methods and applying actual cases. Finally, as a result of investigating the level of consensus for each stakeholder, it was confirmed that all stakeholders could agree regardless of the size of the company. The result of this study is expected to as a useful tool among stakeholders in the construction fields that can be able to easily agreed upon.
