A Reform Proposal for Management of Regulated Prices (공공요금관리(公共料金管理)의 개선방안(改善方案))

  • The primary purpose of price regulation on public utilities and other public services is not to prevent them from rising and control inflation but to allocate resources efficiently and reflect social values, when market does not function perfectly. That is, price regulation by government is a policy tool which is aimed at microeconomic effects. Therefore, when a microeconomic policy tool is used for macroeconomic policy objectives, such as price stabilization, we can have problems stemming from the mismatch. One of the examples is distortions in the relative price structure of resources. As government suppresses increases in regulated prices in an effort to reduce inflationary pressures, some of the public services become relatively cheaper, resulting in excess use of those services under regulation. Also, inflexibility of adjusting regulated prices to the overall price changes results in deterioration of qualities of public services. This paper proposes a set of reform proposals which are itnended to minimize such government failures. It is argued that the authority of price regulation should be decentralized, and ultimately done by independent regulatory commissions for each service. The pricing should be based on the principle of separate and independent accounting by each service unit and the principle of beneficiaries bearing the costs of services.

Foreign Case Analysis and Implications for Risk Assessment of Industrial Insects (산업곤충 위해성 평가를 위한 국외사례 분석 및 시사점)

  • Industrial insect is defined as the insect utilized in industries that creates added value. Most of the industrial insects used in Korea are exotic species that are introduced through artificial means. Despite the rapid expansion of market for industrial insects, the system for risk assessment of industrial insects is not being adequately conducted. Although Korea carries out a risk assessment for the species designated as disease and insect pest by Animal and Plant Quarantine Agency, far too little consideration is being given to overall ecosystem, as the control system is covered in the Plant Quarantine Law. To solve this problem, we analyzed the Korean risk assessment system and looked at systems in other countries. The results show that it is essential for stakeholders to reach an agreement to set up fundamental directions for the system. Unless the integration system of taxonomical and ecological information is prepared, the ecological risk assessment should be conservative to protect ecosystems and should also follow the precautionary principle. It also requires cooperation among the ministries. In addition, the results indicated that a differentiation between risk assessment and screening is urgent. Several solutions such as setting up clear objectives in both assessment and screening stages, target species, steering organization and assessment criteria assessment systems from were proposed as practical institutional strategies. Among many foreign countries the assessment system from Ireland equally considers various factors such as economical, ecological safety and management aspects, It is also based on precautionary principle to fulfil its original purpose. It was suggested that the Ireland system would be the best reference that can be modified and applied into the Korean system by considering distinct characteristics of the industrial insects.

Cost Reduction Measure for River Water Quality Management by Cooperation between Local Governments:a Case of the Youngsan River (지자체간 협조를 통한 하천수질관리 비용절감 방안: 영산강을 대상으로)

  • Current TMDL based on the 'Polluter Pays Principle' in Republic of Korea is individually operated by each local government for the designed allocated pollution load of unit watershed and unit district. However, unlike the motion of the air contaminants, the polluted contaminants in a river move from upstream to downstream, and a river can affect to districts more than two. In addition, a decision making on the construction of a sewage treatment facilities follows the concept of 'economy of scale'. These reasons support the collaboration among local governments in order to reduce the costs in improving water quality. This study suggested a method to reduce water quality management cost by redistributing reduction load considering cost-effectiveness for an entire watershed. The assessment on the suggested method is conducted in Youngsan river watershed. Without variation in total load, reduction load assigned for unit watershed and unit district is retributed in the region where pollutant source is concentrated, and then water quality and cost reduction improved from the redistribution of reduction load is analyzed. The results show that the cost saved by the suggested method is KRW 124 billion for scenario-1 and 172 billion for scenario-2 considering total cost of KRW 788 billion for the existing plan. We expect that the suggested method is a good example to reduce water quality management cost in local governments for TMDL.

  • Digital transformation calls for a new social contract that must transform the existing norms and paradigms of our society. Digital constitutionalism is a way of building new order through a new social contract and is an ideology that aims to establish and ensure a normative framework for the protection of fundamental rights and balance of power in the digital environment. The Internet/Digital Bill of Rights is a representative example of constitutionalization based on this ideology. Initially, it took the form of an informal, non-binding declaration led by civil society organizations or various stakeholders, setting forth normative principles adapted to the changing nature of digital society. More recently, they have taken the form of formal charters, declarations, or laws containing principles at the national or regional level. The "Digital Bill of Rights" proposed by the Korean government can be seen as an example of this trend, but it does not fully reflect the recent trend of Internet/Digital Bills of Rights in terms of substantive and procedural legitimacy. Even if the government provides a certain normative direction, it needs to be combined with a concrete action plan in each area to create a balance of norms with digital technologies and industries instead of simply being a "declaration".

Application and Expansion of the Harm Principle to the Restrictions of Liberty in the COVID-19 Public Health Crisis: Focusing on the Revised Bill of the March 2020 「Infectious Disease Control and Prevention Act」 (코로나19 공중보건 위기 상황에서의 자유권 제한에 대한 '해악의 원리'의 적용과 확장 - 2020년 3월 개정 「감염병의 예방 및 관리에 관한 법률」을 중심으로 -)

  • In the pandemic of infectious disease, restrictions of individual liberty have been justified in the name of public health and public interest. In March 2020, the National Assembly of the Republic of Korea passed the revised bill of the 「Infectious Disease Control and Prevention Act.」 The revised bill newly established the legal basis for forced testing and disclosure of the information of confirmed cases, and also raised the penalties for violation of self-isolation and treatment refusal. This paper examines whether and how these individual liberty limiting clauses be justified, and if so on what ethical and philosophical grounds. The authors propose the theories of the philosophy of law related to the justifiability of liberty-limiting measures by the state and conceptualized the dual-aspect of applying the liberty-limiting principle to the infected patient. In COVID-19 pandemic crisis, the infected person became the 'Patient as Victim and Vector (PVV)' that posits itself on the overlapping area of 'harm to self' and 'harm to others.' In order to apply the liberty-limiting principle proposed by Joel Feinberg to a pandemic with uncertainties, it is necessary to extend the harm principle from 'harm' to 'risk'. Under the crisis with many uncertainties like COVID-19 pandemic, this shift from 'harm' to 'risk' justifies the state's preemptive limitation on individual liberty based on the precautionary principle. This, at the same time, raises concerns of overcriminalization, i.e., too much limitation of individual liberty without sufficient grounds. In this article, we aim to propose principles regarding how to balance between the precautionary principle for preemptive restrictions of liberty and the concerns of overcriminalization. Public health crisis such as the COVID-19 pandemic requires a population approach where the 'population' rather than an 'individual' works as a unit of analysis. We propose the second expansion of the harm principle to be applied to 'population' in order to deal with the public interest and public health. The new concept 'risk to population,' derived from the two arguments stated above, should be introduced to explain the public health crisis like COVID-19 pandemic. We theorize 'the extended harm principle' to include the 'risk to population' as a third liberty-limiting principle following 'harm to others' and 'harm to self.' Lastly, we examine whether the restriction of liberty of the revised 「Infectious Disease Control and Prevention Act」 can be justified under the extended harm principle. First, we conclude that forced isolation of the infected patient could be justified in a pandemic situation by satisfying the 'risk to the population.' Secondly, the forced examination of COVID-19 does not violate the extended harm principle either, based on the high infectivity of asymptomatic infected people to others. Thirdly, however, the provision of forced treatment can not be justified, not only under the traditional harm principle but also under the extended harm principle. Therefore it is necessary to include additional clauses in the provision in order to justify the punishment of treatment refusal even in a pandemic.

Design of a CAM-Type Traffic Policing Controller with minimum additional delay (시간지연을 최소화한 CAM형 트래픽 폴리싱 장치 설계)

  • In order to satisfy the desired QoS level associated with each existing connection, ATM networks require traffic policing during a connection. Users who respect the contract should receive the function of transparent traffic policing without any interruption. However, contract violations should be detected and mediated immediately. So we propose a CAM type policing controller to allow user cell streams to minimize additional delay. The proposed policing scheme controls policing actions including traffic shaping by suitably spacing cells on each virtual circuit. This policing action is based on parallel processing of multiple cell stream which arrive in ATM multiplexed virtual circuits. We have developed an analytical model of the proposed policing scheme to examine the amount of cell loss and delay, which depends on traffic load, the size of policing buffers and minimum spacing cell time.

  • There has been lots of discussions and new policies to encourage people to start new businesses. However, they key issue such as how to raise the success rate of new start-ups still needs to be resolved. Many believe that the success of policies and discussions for promoting entrepreneurship in Korea highly depends on how to lower the risks with which early stage start-ups encounter. In this backdrop, this study aims at providing an emerging approaches in entrepreneurship, 'lean start-up', which can work as an effective method with which early stage entrepreneurs can minimize challenges they face. Even though lean start-up is a widely accepted concept among practitioners and recognized as a useful tool for entrepreneurship and education, but has not got deserved attention from the academic world. This paper offers basic framework and key principles of lean start-ups, furthermore, shows Korean cases of step-by-step application methods of its concepts. It also suggest key issues in adopting lean start-up strategy. This study has implications and contributions for entrepreneurs, educators and researchers through providing comprehensive perspectives on process of the lean start-up strategy.

  • In the case of the domestic medical industry, work is conducting according to the convenience of the developer without guiding principles regarding tailoring and a number of processes and products that should not have been omitted considering the characteristics of corresponding sites were discovered. As a result of this omission, it was found that the delivery period was not met and problems arose for an extensive period of time after the activation of the system. The lack of critical processes and products had a negative impact on the productivity and quality of the software. This paper defines the processes that need to be followed as a basis and the products that need to be prepared during the development of a medical information system. Also, additional processes and products are presented depending upon the condition of the project. Especially, the step-by-step assessment processes and products to manage the assessment results were seriously dealt with in this study to strengthen the compliance of processes and the product quality.

  • This study was conducted to analyze the text relating to the environmental conservation and ecology among the text of the constitution of Korea and collect the domestic laws(40 statutes, 1 guide, 1 leading case) and the foreign laws(1 constitution, 34 statutes, 2 ordinances, 3 leading cases). To make the text of the collected domestic and foreign laws a comparative analysis of the conceptual principle, plan establishment and project operation, types, policy and allied projects, rights and duties, allowed and restricted acts, environmental impact assessment and administration procedure and system of the environmental conservation and ecology by items, it was considered to the mutual relation with lots of laws which are scattered with the various laws and studied to how to set the many foreign countries on their laws connected with the environmental conservation and ecology from the other department and carry out the advanced environmental works.

Metadata Elements Design and Application for Japanese Newspaper 'Chosunsibo' Issued in Colonial Korea (일제강점기 일본어신문 『조선시보』의 메타데이터 요소 개발과 적용 연구)

  • This study aims to develop metadata elements and vocabularies of 'Chosunsibo' issued in Korea during the Japanese colonial era. Despite the vast amount and historical values, newspaper articles in Chosunsibo are still unsearchable and difficult to access. To the end, this study includes as follows: (1) analyzed the DB construction and metadata elements of newspapers issued in Korea during the Japanese colonial, (2) investigated the morphological characteristics and content of 'Chosunsibo', and (3) derived metadata elements, encoding schemes and controlled vocabularies for 'Chosunsibo'. The final draft was verified in three methods: (1) review and revise through data input tests, (2) consulting by a DB expert agency, and (3) drawing up of crosswalks with metadata standards and related cases. The scope of this study is to design the metadata schema of the historical newspaper 'Chosunsibo' and develop a data input system based on that schema.
