An exploratory study on practice-oriented reconceptualization of self-sufficiency : Service providers' reflections on their own experiences from the field (현장의 시각으로부터 구조화된 자활 개념 탐색 연구 : 자활사업 실무자의 이해를 중심으로)

  • A self-sufficiency service has worked as a typical workfare policy combined with public assistance in Korea since 2000. Despite of its long history, three core pillars in administrating the self-sufficiency service, policy, research, and practice, have respectively understood the meaning of self-sufficiency in terms of their own interests. As a result, the self-sufficiency service has recently faced with its own identity issues by showing failures to its environmental changes. The current situation makes it necessary to reconceptualize the definition of self-sufficiency by exploring its in-depth understanding perceived by service providers. Specifically, we analyzed practical reflections on 35 service providers' experiences which were collected via focus group interviews for two hours. The study findings presented that service providers had two antithetical approaches towards self-sufficiency. While a dominant approach to self-sufficiency has been concentrated on improving clients' economic outcomes such as employment, job retention, the escape from welfare trap, and increasing earnings and assets, the other approach has been extended to empower clients and achieve their well-being and quality of life. Yet, these contrary perspectives have led to suffer from their role confusions and identity crisis between the work-ready process and the employment-oriented outcomes. Specifically, they described self-sufficiency in terms of psychological, social, and integrated aspects. The psychological aspect included a process of developing inner strengths, intensifying job motivation, and coping with barriers of employment. The social aspect meant a path toward social integration through recovering human relationships. The integrated aspect covered more comprehensive support for their recovery of daily life and autonomy to make a decision for their own life. In conclusion, the study findings suggest that self-sufficiency should be more extensively considered as a stepwise process towards work-ready preparations beyond ultimate economic outcomes. Such an extended concept of self-sufficiency could contribute to restructuring the whole practice of self-sufficiency including organizational and program changes in the fields.

Current Trend of European Competition Damage Actions (유럽 경쟁법상 손해배상 청구제도의 개편 동향과 그 시사점)

  • This Article discusses the current trend of European competition damage actions focused on the recent Damage Directive and its transposition by the United Kingdom and Germany. The relevant Directive was signed into law in November 2014, and it requires the EU Member States to adopt certain measures to support competition damage actions. The required measures and principles by the Directive include right to full compensation, rebuttable presumption of harm, extensive disclosure of evidence, use of pass-on for defense and indirect purchaser suits. Although many Member States did not meet the deadline to transpose the Directive, the end of 2016, it is reported that 23 Member States have now, as of September 2017, made enactments according to the Directive. When we look at the transposition done by the United Kingdom and Germany, the revisions on their competition laws closely follow the contents of the Directive. However, it will take quite a long time before the amended provisions apply to actual cases since most of the new provisions apply to the infringement that take place after the date of the amendment. A similar situation regarding application time may happen in some other Member States. Furthermore, even if the terms of the competition laws of the Member States become similar following the Directive, the interpretations of the laws may differ by the courts of different countries. EU also does not have a tool to coordinate the litigations that are brought in different Member States under the same facts. It is true that the EU made a big step to enhance competition damage actions by enacting Damage Directive. However, it needs to take more time and resources to have settled system of competition private litigation throughout the Member States. Korea has also experienced increase in competition damage actions during the last fifteen years, and there have been some revisions of the relevant fair trade law as well as development of relevant legal principles by court decisions. Although there are some suggestions that Korea should have more enactments similar to the EU Directive, its seems wiser for Korea to take time to observe how EU countries actually operate competition damage actions after they transposed the Directive. Then, it will be able to gain some wisdom to adopt competition action measures that are suitable for Korean legal system and culture.

Effects of School Violence Experiecne, Perceptions of Violence, Non-Assertiveness and Prosocial Behavior on Adolescents' Conscientization toward School Violence -Focused on the Prosocial Behavior and Non-Assertiveness Mediators- (남·여 중학생의 학원폭력문제 의식화에 영향을 주는 요인에 대한 연구 -학원폭력 피해경험과 친사회적 행동성의 다중 매개효과 검증을 토대로-)

  • With the increasing concerns of victimization of school violence, this paper is intended to present a pioneering study on the victims' conscientization which may result from their own experience of school violence by peers. The predominant concern of the study consists in: (1) the direct effects of individuals' perception toward violence in general, non-assertiveness, school violence experience by peers, and prosocial behavioral tendency on the individual conscientization of school violence problems; (2) the indirect effects of both individual prosocial behavioral tendency and perceptions toward violence through non-assertiveness on individual conscientization of school violence problems;(3) the sexual differences of the five latent variables(perceptions toward violence in general, non-assertiveness, prosocial behavioral tendency, school violence experience by peers, and conscientization of school violence problems; (4) the sexual differences of both direct and indirect correlates on conscientization of school violence problems. Research is based on a survey conducted with 526 adolescents (268 males and 258 females) from 16 middle schools located in different districts of the city of Pohang. In order to address the research questions, structural equation models on adolescents' conscientization of school violence are explored. A variety of tests are conducted (configural invariance, metric invariance and structural invariance, intercept invariance, critical ratio for difference test, multi-group analysis, latent mean analysis including Cohen's effect test). The major findings of the study support the significance of both direct effects and indirect effects of the four latent factors(perceptions of violence in general, non-assertiveness, prosocial behavioral tendency, school violence experience by peers). The individual prosocial behavioral tendency has a positive mediating effect on the enhancement of individual conscientization toward school violence problems. However, we fail to find the direct positive effect of individual violence experience on the conscientization of school violence problems. In conclusion, a range of practical implications for social workers and other related professionals who are engaged in helping out the adolescents with school violence by peers are suggested based on the study findings.

A Study on Improvement of Laws regarding Welfare for the Aged (노인복지 관련법제의 발전방향)

  • Korea is expected to become an 'aged society' with more than 14 percent of the public aged 65 years or more by 2018. The rapid aging is giving rise to various problems within the society along with falling birthrate in a short period of time. In this context, the role and function of laws on welfare for the aged must be particularly emphasized. Also the Senior Citizens Welfare Act is of great importance as it provides social welfare service on the basis of functional connection with social insurance and public assistance. First, this paper looks into the history of laws related to welfare for the elderly such as the Senior Welfare Act, the Act on Long-term Care Insurance for Senior Citizens and the Basic Old Age Pension Act as well as the findings of earlier studies. In the second place, it will break down such laws by main components aiming to examine details of the laws and questions raised regarding them and to seek ways to achieve improvement with an emphasis on health care, old age income security, housing welfare(assisted living facilities), job security for the aged. The Senior Welfare Act offers substance of social welfare service for the elderly. Income security, health and medical care, welfare measures through long-term care and assisted living facilities, social participation by working are the key elements and all of them should be closely associated to ensure citizens get sufficient public support in their old age. For this purpose, the Senior Welfare Act is under a normative network with laws such as Act on Long-term Care Insurance for Senior Citizens and Basic Old Age Pension Act. Current laws on welfare for the aged including Senior Welfare Act are not sufficiently responsive to the aged society of the 21st century. Income security combined with decent social participation, health and medical care closely connected with long-term care system, efficient expense sharing between government and local government, enhancement of effectiveness of welfare measures can be considered as means to improve current welfare system so that the elderly can enjoy their old age with dignity and respect.

Social Worker's Experience of NEET Youth Support Project : Focusing on the Vision Plan (청년니트(NEET) 지원 사업에 대한 종합사회복지관 사회복지사의 경험 : 희망플랜 사업을 중심으로)

  • In the reality that the seriousness and concern about the youth problem is increasing, this study focuses on the vision plan project supporting the NEET youth in the social welfare field. Therefore, this study analyzed how the social workers recognized the NEET problem before participating in the project, what difficulties they experienced in the process of the project, and how they coped with these difficulties. The results of the study are as follows. Social workers were saddened by the seriousness of the youth problem before their participation, but they recognized that there was no way to solve it and many social workers were not fully aware of the youth or NEET issues. In this context, in the course of running a project with NEET youth, social workers experienced difficulties due to the nature of the NEET youth, difficulty in forming a relationship with NEET youth, and difficulties for young people not to spend time in the program. And social workers also faced difficulties due to the lack of know-how in the project, difficulties in operating the center alone, and difficulty in achieving employment goals. In the process of coping with these difficulties, social workers have actively sought, persuaded and supported the NEET youths to participate in the project, adapted the time, place and method to the youth, and removed the stigmatization element in the project. They also worked closely with local residents, local institutions and municipalities, formed networks, and changed the viewpoint of providing work experience rather than getting young people, but seeing long-term outcome. As a result, social workers have experienced not only individual change but also social welfare organization, field, community and local institutional change. Based on these results, this study suggested that the social welfare practice field should provide various activities in the process of supporting the youth gap year policy. In addition, this study suggests that the social workers play a role in connecting various actors rather than suppliers when working with young people, and that the social welfare field should expand the scope of project to include youth.

Welfare States and Welfare Attitude: A Comparison of Sweden, France, US, and Korea (복지인식 구조의 국가간 비교 - 사민주의, 자유주의, 보수주의 복지국가와 한국 -)

  • The Purpose of this study is to observe the existence of welfare attitude split between welfare regimes clique and to explore the effect of institutional(regime) characteristics on welfare attitude. And Second purpose is to find the characteristics of structure of welfare attitude and then to clarify the characteristics of welfare attitude in Korea. This work contribute to find the point of solidarity and split and to work out the strategical clues for constructing pro-welfare politics. To compare the attitude on the state responsibility about the welfare, Sweden, France, US, and Korea is selected. And the effect of sex, age, education level, income class, and labor status which are abstracted from existing welfare state comparative study are analyzed. The result show the difference in welfare attitude score between countries. The welfare attitude score is Sweden, France and US in order. the Score in Korea is lowest. In the case of the effect structure of welfare attitude between countries, there are no differences between Sweden and France. But the specific characteristics in US and Korea, are observed. And the effect structure of sex, class, labor status is equal in Sweden, France, and US. That is, women, people in low class, and people in low labor status more emphasize the state responsibility on the welfare. But the effect structure of age of US is different comparing other countries. In US, the old age is tend to less support the state responsibility. The education level operate as the effect factor in only US. And Korea show the different effect structure on the welfare attitude. This understanding about structure of welfare consciousness become the basis to construct the strategy for welfare state by proposing the point of consensus and conflict to conversion of welfare paradigm.

A Comparative Study on the origin and development of Welfare State in Korea and France (한국과 프랑스 제 3공화국의 사회정책과 국가)

  • The objective of this article is to compare the characteristics and the origin of Welfare State in Korea and France. This study also finds out the causes of underdevelopment of Welfare State in Korea. In the third Republic of France, the first Industrial Accident Compensation Law was legislated in 1898. The discussion of the project of Law commenced in 1880. The Parliamentary Debate on the legislation of the Law had continued for 18 years. The leaders of the debate was the group of progressive Republicans(Radicals) in the French Parliament. In Korea, it was also in the period of the third Repulic, the President and several members of the Supreme Committee of National Reconstruction (Guk-Ga-Jai-Gun-Choi-Go-Ho-Eui), the authoritative military government who enacted and developed the Social Insurance Law of Industrial Accident Compensation, the first Law of Welfare State in Korea. However, Korea and France show more differences than similarities in the terms of the origin of the Welfare State. The motivations and goals of social policies of the two countries were quite different at the beginning stage. In France, the progressive Republicans of Parliament made welfare state policies in order to maintain the politico-social hegemony and social peace by provision of economic supports to workers. In Korea, the group of military officers had begun the welfare legislation in order to win the general election and obtain political power in 1963. Comparison on the origins of the welfare states in the two countries shows similarities as well as differences in terms of the role of actors. In France, the state and the owners of big enterprises had agreed and played positive roles in the legislation of the welfare state policies. However, the owners of small companies, merchants and farmers had played negative roles. Like the French case, Korean government and owners of big enterprises had played positive roles. The state as a major actor of the legislation of the social insurance programs in the two countries are slightly different. In Korea, the owners of small companies had played negative roles in making of medical insurance programs in 1976. Comparison of the current state of two welfare states shows substantial differences in terms of the development of the welfare state. What is the reason for such differences? Why does Korean Welfare State underdevelop? Historically, the developmentalism as an major ideology of the third Republic of Korea has continually influenced the underdevelopment of the Welfare State. It implies that Koreans have to invent a new ideology of Welfare State which can replace the developmentalism and support the development of Welfare State in the future. Without such a new ideology, it is very difficult to develop an european style welfare state in Korea.

Distancing Philosophy from the Real Ruling Power, a Philosophical Belief or an Opportunist Behavior Compromising with Reality? - centered on Kim Tae-Gil - (현실 권력과의 거리두기 철학(함), 철학적 소신인가 현실 타협적 기회주의 행태인가 -김태길을 중심으로-)

  • In this paper, the main subjects with which I deal are as follows: (1) Is Distancing Philosophy from the real ruling power a way of practical-philosophical resistance, based on social reformation as a axiological directivity of Kim Tae-Gil's ethical thought, though it is negative type of resistance? Or is it a sort of transformed value-free opportunist behavior which allows antidemocratic ruling group to coerce the people into submission, assuming an uncompromising stand seemingly? (2) Is Kim's defense argument on the opening of the course of National Ethics and the all-out activation of National Ethics education under Park's Yushin Regime derived from his own philosophical belief? Or is it brought out from the external conditions and circumstances surrounding Kim Tae-Gil which forces him to participate in the national undertaking for the settlement of the course of National Ethics in the university? The 'provisional' answers about the two subjects are as follows: (1) Kim's Distancing Philosophy is a type of practical philosophical revolt against the dictatorship power under Yushin Regime, though it is negative form of resistance. We can accept this philosophical elucidation above all by confirming the fact that the reform of reality is the main ethical trait running through his entire ethical thought system. However distancing philosophy disclose the crucial limits to allow itself to boil to the philosophical practice compromising with real ruling power eventually, though it is intended upon its own social ethical directivity and conviction. (2) The primary factor which affects Kim to propose such an advocation argument on the course of National Ethics and the education of National Ethics is the external conditions and circumstances surrounding him, especially the power-relation between he and ruling group and intimate human relation between he and his superior philosophers who carries out the role of a ideologue for the Yushin Regime, rather than his own philosophical belief. But no matter what primary factor, Kim's action to make a advocating argument to support the course and the education of National Ethics is to blame, on that account that he cannot adequately his social responsibility and role given to him as a reformist moral philosopher who will pursue the realization of righteous democratic society. Along with that, It is not too enough to criticize him sharply for such defending action. The reason is that his supporting stance for National Ethics education is brought out, by not adhering closely to the philosophical way of distancing from the dictatorial power devoid of political legitimacy and moral justification.

Usefulness of Customized Cervical Spine Immobilizer in Head & Neck Image-Guided Radiation Therapy with Tomotherapy® (토모테라피를 이용한 두경부암 영상유도 방사선 치료 시 개인별 경추고정용구의 유용성 평가)

  • Purpose : Standardized pillow may not support patient's individual cervical spine thoroughly when head and neck radiation therapy with $Tomotherapy^{(R)}$. Therefore, the purpose of this study was to make a comparative analysis for the difference of using standardized pillow only and using customized cervical spine immobilizer with standardized pillow. Materials and Methos : The head and neck cancer patients who are treated image-guided radiation therapy(IGRT) with $Tomotherapy^{(R)}$ were divided into two groups, 20 patients using standardized pillow only, and 20 patients using customized cervical spine immobilizer with standardized pillow. We achieved 20 mega-voltage computed tomography(MVCT) image per patient, compared curvature of the cervical spine in MVCT with curvature of the cervical spine in CT-simulation. Results : Results of comparative analysis were curvature consistency 95.9 %, maximum error of distance 41.9 mm, average distance error per fractionation 19.4 mm, average standard deviation 1.34 mm in case of using standardized pillow only, curvature consistency 98.9 %, maximum error of distance 12.9 mm, average distance error per fractionation 5.8 mm, average standard deviation 0.59 mm in case of using customized cervical spine immobilizer with standardized pillow. Conclusion : Using customized cervical spine immobilizer shows higher reproducibility and low distance error, therefore customized cervical spine immobilizer could be useful for head and neck cancer patients who need radiation therapy.

The Study on the Relationship between Personal Characteristics of Foreign Students and Motivation of Korea Employment: Focus on TOPIK, Motivation to Study in Korea, and Major Satisfaction (외국인 유학생의 개인 특성이 한국 취업 동기에 미치는 영향 분석: TOPIK과 유학동기, 전공만족도 중심으로)

  • The main purpose of this study is to investigate the effects of motivation of the employment in Korea with gender, nationality, motivation of studying in Korea, major satisfaction and Korean proficiency level of foreign students who are studying in Korea. The second purpose is to analyze the current factors, to leverage educational management and to make and support some policy of Minister of Education for international students in order to promote utilization of employment of the students in Korea during 4 years of studying. This paper is used by IBM SPSS Statistics 24 Version for data analysis. As a result of the analysis, the average of students in Southeast Asia, Central Asia and South and North America Africa was higher than Japan and China in terms of motivation of employment in Korea. First, the external motivation to study in Korea has affected TOPIK with positive influence. Second, in the relationship between motivation to study in Korea and the majors satisfaction, the higher the internal motivation of study, the higher the majors' satisfaction level. Third, in the relationship between motivation to study in Korea and motivation of the employment in Korea, internal motivation to study has a positive effect on motivation of the employment. As internal motivation increases, grade of the motivation of the employment increases. Fourth, the relationship between major satisfaction and employment showed positive (+) effect. In other words, the higher the major satisfaction, the higher the motivation of the employment. Fifth, TOPIK has a negative effect on motivation of the employment. It means that external motivation was the main factor that positively influenced TOPIK and internal motivation was also main factors that positively influenced both major satisfaction and motivation of the employment in Korea. Sixth, when the internal motivation has an effect on motivation of Korea employment, the higher the major satisfaction as the parameter, the higher the motivation of Korea employment. Therefore, it will be helpful to understand the meaning of studying motivation and major satisfaction of international students, and to be used as basic data on education policies of universities and governments supporting the career and employment for international students.
