병원서비스코디네이터 교육과정이 교육만족과 의료서비스 품질에 미치는 영향 (The Effect of Hospital Service Coordinator Education Curriculum on the Education Satisfaction and the Quality of Medical Service)

  • The increase of the supply of medical service and the increase of hospitals have intensified the competition of hospitals, and the advancement towards internationalization in the opening of medical industry has triggered the infinite competition of medical profession. In addition, the high expectation of customers and quality improvement in the medical care in accordance with the improvement of overall income, and the change of active role of medical consumers according to the popularization and the improvement of rights awareness reflect the customer needs and choice in the medical service. Customers wanted to receive the kind and pleasant service under the up-to-date medical service. Therefore, as a solution, hospital coordinators were emerged for the purpose of smooth treatment and customer satisfaction by generalizing all service of hospital. Accordingly, this thesis attempted to investigate the effect of hospital coordinator education curriculum on the education satisfaction and the quality of medical service. In order to solve the purpose of this study, I, author reviewed the existing literatures, established hypothesis, and verified hypothesis by using the variety of statistics techniques such as reliability, validity, frequency analysis, and regression analysis. The verification of hypothesis is as followings: First, among education training factors of hospital coordinators, the quality of instructor significantly affects the satisfaction of hospital coordinator education training. Second, among training factors of hospital coordinator, the attitude of trainee significantly affects the training satisfaction of hospital coordinator. Third, among education training factors of hospital coordinator, education course significantly affects the training satisfaction of hospital coordinator education. As the qualities of instructor are better equipped, the satisfaction of education becomes higher. It indicates that the education method of instructors is important as an index to represent the qualities of instructor such as the appropriateness of education method, preparation, passion, visual materials, the adequacy of education procession, and specialized knowledge, and it has important effect on the satisfaction of education. In order to enhance the satisfaction of hospital coordinator education, the creation of education environment, making trainee concentrate on the education, is required by appropriately allocating programs, arousing interest in education, based on the attitude of trainee, discussion, and preliminary programs, preparation, ahead of enforcement of education. Fourth, the satisfaction of hospital coordinator education training significantly affects the reliability among the qualities of medical service. Fifth, satisfaction of hospital coordinator education training significantly affects hospitality I kindness among the qualities of medical service. If the education satisfaction of trainee is high, it is effective in the practical application such as dealing with complaints, the duty performance for the patients, and so on in offering the medical service, related to reliability and furthermore, we can find the positive change in the attitude change of medical professions related to the reliability of hospital coordinator. In addition, in the process of offering medical services such as the kind explanation on the duty, rapid response to the customers inquiry, and tidy uniform, practical effect was verified. Sixth, the education training factor of hospital coordinator significantly affects the reliability among the quality of medical service. Seventh, the education training factors of hospital coordinator significantly affect hospitality/kindness. In the education of hospital coordinator, the methods to attract the interest of trainee by emphasizing reliability should be sought and for gaining the practical effect of hospital coordinator education, the sufficient preparation and investigation on the education curriculum should be prerequisite and under this condition, intensified discussion on the instructor and education course is needed. In the design of education course, more education hours and subjects should be allocated in the part of hospitality in order to improve the practical application of hospitality. Therefore, it is meaningful in a sense that this study newly approached the components of hospital coordinator education and the need to modify the quality components of medical service in accordance with the study subjects was raised. This study also finds its meaning in that it provides basic materials for the study of future hospital coordinator education by suggesting the system development model of hospital coordinator education through preliminary study of education training. In addition, this study is meaningful in the aspect that it suggested the direction of education training by showing how the hospital coordinator education training would applied to the hospital coordinator course of the Continuing Education Center at Pusan and Kyungnam National University to some extent. Since all investigation of this study was approached from the side of hospital coordinator, the thoughts of patients who are beneficiaries of medical service, and care givers cannot be identified. Therefore, the satisfaction of patients and care givers through the experience of medical service, which is the essential prerequisite of medical service, should be importantly considered and investigated. Accordingly, The study of comparing and analyzing the views of both patients and care givers should be carried out in the future.

일개 농촌지역 보건지소 고혈압 환자의 치료지속성 (A Study on Therapeutic Compliance of Hypertensive Patients in a Rural Health Subcenter)

  • 본 연구는 일개 보건지소에 등록된 고혈압 환자의 치료율 및 관리율을 구하고 치료지속성과 관련성이 있는 변수를 파악하고 치료중단 이유를 조사하기 위하여 2000년 11월 이전에 군남면 보건지소에 등록되어 치료받고 있는 고혈압 환자 295명을 대상으로 하여, 의무기록조사와 전화설문조사를 병행하여 실시되었다. 그 결과는 다음과 같다. 1. 대상자 295명중 남자가 108명(36.6%), 여자가 187명 (62.7%)이었으며 평균연령은 남자 64.6세, 여자 66.3 세로 여성에서 더 높았다(p<0.05). 2. 대상자의 54.9%가 지속적인 치료를 받는 것으로 조사되었고, 간헐적 치료군이 19.3%, 치료중단군이 25.8%였다. 3. 성, 연령, 의료보장, 거주지 등 연구대상자의 특성중 거주지로부터 보건지소까지 이동시 소요되는 시간만이 치료지속성과 통계적으로 유의한 관련성이 있었다(p<0.01). 3. 치료중단의 이유로는 증상 또는 몸의 불편함이 없어서가 23.9%를 차지하였고 그 다음으로 타의료기관 이용(18.4%), 교통의 불편(17.9%), 약국 이용(14.9%), 거동 불가능(7.5%), 경제적인 이유(6.0%), 보건지소 서비스에 불만족(4.4%) 순이었다. 4. 전체 대상자 295명의 평균 치료혈압은 $144.9{\pm}12.9/86.9{\pm}8.6mmHg$이었고, 이들 중 평균 치료혈압 이 140/90mmHg 미만으로 적절히 조절되는 환자는 32.5%였다. 이러한 연구결과를 종합해 볼 때, 보건지소 고혈압 환자들의 낮은 치료율, 관리율을 개선하기 위해서는, 적극적인 추후관리와 고혈압에 대한 환자의 잘못된 인식을 교정해주는 효과적인 보건교육을 포함하는 보다 체계적인 고혈압 관리 사업이 요구된다고 하겠다.

전문직 표시·광고규제의 몇 가지 쟁점: 의료광고를 중심으로 (Regulation of Professional Advertising: Focusing on Physician Advertising)

  • 상업광고는 경쟁의 수단이자 그 자체 표현양식이기도 하다. 따라서 이는 영업의 자유(헌법 제15조)와 언론 출판의 자유(헌법 제21조 제1항)의 보호를 받는다. 영업의 자유 내지 경쟁과 관련하여서는 부정경쟁행위로서 제재되어야 하는 부당광고와 그 제한이 부당한 경쟁제한으로 오히려 금지될 수 있는 정당한 광고의 구분이 중요하다. 언론 출판의 자유 내지 표현과 관련하여서는 검열금지의 원칙(헌법 제21조 제2항)이 문제된다. 이 글에서는 이들 두 쟁점을 중심으로 (자유)전문직 광고규제, 특히 의료광고를 검토하였다. 그 결과는 다음과 같다. 첫째, (자유)전문직 광고, 특히 의료광고라 하더라도 사전심의를 받게 할 것은 아니다. 이는 검열금지가 상업광고에 대하여 적용되어야 한다는 뜻은 아니다. 검열금지를 상업광고에까지 적용하는 것은 부적절하다. 그러나 헌법재판소는 검열금지를 상업광고에 적용하고 있고, 실제로 의료광고에서 사전검열이 필요하다고 보이지도 아니한다. 사전심의를 지지하는 이는 주로 의료에 정보비대칭성이 있고, 잘못된 의료로 인한 해가 중대할 뿐 아니라 회복불가능하다는 점에서 그 근거를 찾는데, 의료법은 의료과오책임과 설명의무로 이에 대응하고 있고 의료광고가 여기에 미치는 영향은 매우 제한되어 있기 때문이다. 사전심의는 전면 폐지하거나 굳이 틀을 유지하려면 심의 받은 광고에 대한 인증제도 또는 완전한 자율규제로 전환하여야 한다. 둘째, (자유)전문직 광고, 특히 의료광고에 대하여 광고 일반보다 더 높은 규제를 가할 근거도 없다. 더 높은 수준의 규제를 가하여야 한다는 주장은 그 근거로 (자유)전문직은 윤리성, 비영리성을 갖고 있고, 특히 의료업은 국민건강보험체제에 편입되어 있는바, 경쟁이 이 체제의 안정성을 해할 수 있다는 점을 지적한다. 그러나 (자유)전문직이라 하더라도 직업윤리 등의 제약 하에 영리를 추구하고 경쟁할 수 있고, 또 실제로 하고 있으며, 의료업이 국민건강보험체제에 편입되어 있다는 사정 또한 경쟁의 수단 등에 일정한 제약을 부과할 뿐 경쟁 자체를 배제하지는 아니한다. 의료업에 대하여 일반 광고규제보다 더 엄격한 광고규제를 가하는 것은 초보의사에 대한 진입장벽으로 작용할 가능성이 높고, 그러한 점에서 경쟁제한적 행위로서 그 정당성이 의심스럽다.

부산 일부지역 복지관 무료급식 이용노인들의 급식만족도에 영향을 미치는 요인 (The Factors for Food Service Satisfaction of the Elderly Welfare Center Free Lunch Program Participants in Busan)

  • 저소득층 노인들의 영양과 복지욕구를 만족시키기 위한 서비스의 제공을 위한 기초자료의 수집을 위해 부산시 영도구에 소재하는 복지관에서 무료급식서비스를 받고 있는 노인 271명을 대상으로 설문조사 및 신체계측을 실시하였다. 2009년 9월 1일부터 10월 15일까지 조사를 실시한 결과는 다음과 같다. 조사대상자는 남자 84명(31.0%), 여자 187명 (69.0%)으로 전체의 50.9%가 독거하고 있었으며, 배우자와 동거하는 경우가 23.6%이었다. 생활비도 전체응답자의 70.5 %가 '정부보조금'에 의지하고 있었고, '가족이나 본인의 수입'은 22.6%, '연금이나 퇴직금'은 5.9%로 나타났다. 조사대상자들이 현재 앓고 있는 질병은 신경통 관절염-고혈압-당뇨병-골다공증-심장질환-위장질환 순이었다. 식사준비는 여자노인의 91.4%(171명), 남자노인의 50.0%가 본인이 한다고 응답하였다. 응답자가 급식서비스의 시행을 알게 된 경위는 전체의 36.5%(99명)가 '집 가까이 있어서' 자연스럽게 알게 되었고, 20.7%(56명)가 '담당공무원의 소개', 19.2%(52명)가 '복지사의 소개'로, 17.7%(48명)가 '친구의 소개'로 알게 되었다고 응답하였다. 앓고 있는 질환별 급식서비스가 필요하다고 생각하는 노인은 전체의 66.8%(181명)이었으나, 추가비용을 부담할 의향이 있다고 응답한 노인은 12.9%에 불과하였다. 급식서비스를 이용하는 이유로는 '경제적인 이유'를 40.0%(138명)로 가장 많이 꼽았고, 22.6%(78명)가 '친구를 만날 수 있어서', 16.5%(57명)가 '혼자 차려먹기 귀찮아서'로 응답하였다. 급식서비스 이외에 복지관에서 받고 있는 서비스는 의료서비스, 이 미용서비스, 건강검진 등이 높은 비율을 보였으며, 앞으로 받기를 원하는 서비스는 건강검진-반찬배달-의료서비스-주거에 대한 도움 등의 순으로 나타났다. 급식환경에 대한 만족도는 남자 4.43, 여자 4.28로 높은편이었으나, 위생만족도, 서비스만족도, 음식에 대한 만족도는 3.43~3.79 사이로 보통정도의 수준이었다. 조사대상자의 급식만족도는 급식유익인지도(p<0.01), 일상생활 수행능력(p<0.05) 및 직원친절만족도(p<0.01)와 양의 상관을 보였으며, 급식만족도에는 급식유익인지도($\beta$=0.684, p<0.001), 직원친절만족도($\beta$=0.322, p<0.01), 사회적지지만족도($\beta$=0.086, p<0.05)의 순으로 유의한 영향을 미쳤다. 이상의 결과는 급식대상 노인들이 급식의 유익성을 인지하게 하고 직원들의 친절교육을 강화하면서 다른 부가 서비스를 동시에 제공함으로써 사회적지지감을 높이 가질 수 있도록, 사회복지서비스와 사회참여활동을 통합한 급식서비스 모델의 개발이 필요함을 시사하는 것으로 생각된다.

지속적 제품관여도와 소비자 요구신뢰수준 간의 영향관계: 인지된 위험의 매개 역할에 대한 실증분석을 중심으로 (The Mediating Role of Perceived Risk in the Relationships Between Enduring Product Involvement and Trust Expectation)

  • When a consumer needs a product or service and multiple sellers are available online, the process of selecting a seller to buy online from is complex since the process involves many behavioral dimensions that have to be taken into account. As a part of this selection process, consumers may set minimum trust expectation that can be used to screen out less trustworthy sellers. In the previous research, the level of consumers' trust expectation has been anchored on two important factors: product involvement and perceived risk. Product involvement refers to the extent to which a consumer perceives a specific product important. Thus, the higher product involvement may result in the higher trust expectation in sellers. On the other hand, other related studies found that when consumers perceived a higher level of risk (e.g., credit card fraud risk), they set higher trust expectation as well. While abundant research exists addressing the relationship between product involvement and perceived risk, little attention has been paid to the integrative view of the link between the two constructs and their impacts on the trust expectation. The present paper is a step toward filling this research gap. The purpose of this paper is to understand the process by which a consumer chooses an online merchant by examining the relationships among product involvement, perceived risk, trust expectation, and intention to buy from an e-tailer. We specifically focus on the mediating role of perceived risk in the relationships between enduring product involvement and the trust expectation. That is, we question whether product involvement affects the trust expectation directly without mediation or indirectly mediated by perceived risk. The research model with four hypotheses was initially tested using data gathered from 635 respondents through an online survey method. The structural equation modeling technique with partial least square was used to validate the instrument and the proposed model. The results showed that three out of the four hypotheses formulated were supported. First, we found that the intention to buy from a digital storefront is positively and significantly influenced by the trust expectation, providing support for H4 (trust expectation ${\rightarrow}$ purchase intention). Second, perceived risk was found to be a strong predictor of trust expectation, supporting H2 as well (perceived risk ${\rightarrow}$ trust expectation). Third, we did not find any evidence of direct influence of product involvement, which caused H3 to be rejected (product involvement ${\rightarrow}$ trust expectation). Finally, we found significant positive relationship between product involvement and perceived risk (H1: product involvement ${\rightarrow}$ perceived risk), which suggests that the possibility of complete mediation of perceived risk in the relationship between enduring product involvement and the trust expectation. As a result, we conducted an additional test for the mediation effect by comparing the original model with the revised model without the mediator variable of perceived risk. Indeed, we found that there exists a strong influence of product involvement on the trust expectation (by intentionally eliminating the variable of perceived risk) that was suppressed (i.e., mediated) by the perceived risk in the original model. The Sobel test statistically confirmed the complete mediation effect. Results of this study offer the following key findings. First, enduring product involvement is positively related to perceived risk, implying that the higher a consumer is enduringly involved with a given product, the greater risk he or she is likely to perceive with regards to the online purchase of the product. Second, perceived risk is positively related to trust expectation. A consumer with great risk perceptions concerning the online purchase is likely to buy from a highly trustworthy online merchant, thereby mitigating potential risks. Finally, product involvement was found to have no direct influence on trust expectation, but the relationship between the two constructs was indirect and mediated by the perceived risk. This is perhaps an important theoretical integration of two separate streams of literature on product involvement and perceived risk. The present research also provides useful implications for practitioners as well as academicians. First, one implication for practicing managers in online retail stores is that they should invest in reducing the perceived risk of consumers in order to lower down the trust expectation and thus increasing the consumer's intention to purchase products or services. Second, an academic implication is that perceived risk mediates the relationship between enduring product involvement and trust expectation. Further research is needed to elaborate the theoretical relationships among the constructs under consideration.

마케팅 믹스 요소가 브랜드 자산에 미치는 영향에 관한 연구 (The Effect of Marketing Mix elements on brand Equity)

  • Many researches on brand equity have been focused in definition about it, factors of it, and the process of formation. Most of them have been used by voluntary production category, as is durable goods or nondurable goods. But this study, using the model is developed by Foote, Cone & Be1ding(FCB) Company, classified four fields, high-low involvement, rationality(rational or sensitive) involvement. The selected goods is a sensitive high involvement(casual wear). This study investigate the effects of brand equity and search the influences of brand equity formation according to factors of marketing mix. To this goals, this study kept a literature survey and a demonstrative research. In literature survey, there are several definitions of brand and brand equity. The research model is derived from selected factors of marketing mix and former study. This study used the regression analysis to verify effects from brand equity through the selected marketing mix. The research data is collected from the capital area. The focus of this study is effects of brand equity according to marketing mix. The followings are results and suggestions of this study. First, in the price factors, the affirmative effects are revealed the perceived quality and the brand awareness in a rational high involvement goods, the perceived quality and the brand associations in a sensitive high involvement goods, all factors of brand equity in a rational low involvement goods, and the perceived quality in a sensitive low involvement goods. As summary, the important characteristics is the price factors to consumers, and consumers recognize that a high price means a high quality. Second, in the store image factors, the affirmative effects are revealed all brand equity factors in a rational high involvement and a sensitive high-low involvement. A good store image incites more interest, contact, and visit from potential consumer. And such store offers more consumer satisfaction, simulates more active and positive conversation to consumers. Third, in advertising spending factors, the affirmative effects are revealed the brand awareness and associations in a rational high involvement and a sensitive high involvement, all brand equity factors in a rational low involvement and a sensitive low involvement. An advertisement increases not only a brand awareness but also strong brand associations. Forth, in price promotion factors, the affirmative effects are revealed the brand associations in a rational high involvement, the negative effects are revealed all brand equity in sensitive high involvement. According the result about the effects of brand royalty through the brand equity factors, a perceived quality and brand associations have positive effects to brand royalty in all factors. Consumers choice a deep perceived quality than other competitive brand. So, brand equity will increase according to a qualitative grade of a perceived brand by consumers. Brand associations represent a quality and a degree of involvement. In conclusion, brand associations and equity have a positive relation each other. According to the analysis results about a brand royalty of selected marketing mix factors, the affirmative effects are revealed the store image and price promotion factors in a rational high involvement, the price and store image in a sensitive high involvement, and the price and advertising spending in a rational low involvement. The results about the affect of selected marketing mix factors according to brand equity, are the perceived quality in a high involvement, and all brand equity factors in a low involvement. The affirmative effects about a store image are revealed all equity factors in high-low involvement. In advertising spending factors, the affirmative effects are revealed the brand awareness and associations in a high involvement goods, and the perceived quality and the brand awareness in a low involvement goods. In price promotion factors, the affirmative effects are revealed the brand awareness in a low involvement goods, and the negative effects are revealed the brand awareness in a high involvement goods. According to a degree of involvement, the results of a brand royalty through a brand equity factors are following. The affirmative effects are revealed the perceived quality and the brand royalty in a high involvement goods, and the brand awareness are revealed a negative effect. The affirmative effects are revealed the perceived Quality and the brand associations in a low involvement goods. So, in a high involvement goods, the brand royalty is built by strong brand associations, but, in a low involvement goods, the brand royalty is built also by a perceived Quality and a brand awareness. This study have some concept of limitation. So, this study presents a future direction of research. First, a future study has to have more deep analysis for this study analyzed through a limited marketing mix factors. Second, a future research has to get mutual effects about brand equity of marketing mix factors for this study has an individual marketing decision factors. Third, for the future, a brand equity needs a research about a several goods such as services, profit or nonprofit, industrial products, culture, and so on. Forth, the research have to diversify a various data for population.

기술거래사 등록교육 서비스 만족도에 관한 연구 (The Study on the satisfaction of educational services of technology transfer agents' registration)

  • 최근 오픈이노베이션 경영의 하나의 방법으로 기술개발을 함에 있어 기업 단독의 활동이 아닌 기술혁신의 시너지 효과를 달성하기 위해 기술개발과 인프라 조성 간 연계 강화가 중요시되고 기술이전 사업화 촉진이 요구되고 있다. 이러한 기술사업화가 성공적으로 수행되기 위해서는 많은 전문가를 필요로 하게 되는데, 대표적인 전문가가 기술거래사이며, 기술거래사는 기촉법 제14조, 동 법 시행령 제21조 및 기술거래사 등록 관리요령을 살펴보면 자격을 부여받기 위해서는 기술거래사 등록교육 과정을 40시간 이상의 교육을 이수하여야만 하고 2010년 고시 개정 후 등록교육은 사단법인 한국기술거래사회가 주관하여 진행을 하였으며, 2011년 1월과 2011년 11월 총 2회에 걸쳐 진행을 하였다. 이에 따라 전문지식을 향상시키기 위한 기본교육 서비스 품질에 대한 심도있는 평가를 통해 교육서비스의 질을 향상시키고 서비스 품질 개선방안을 모색하고자 본 연구를 수행하였다. 연구의 결과 서비스품질과 교육서비스 품질만족, 그리고 교육이수 후 태도의 관계를 살펴보면 다음과 같다. 첫째, 서비스 품질은 교육 서비스 품질만족에 긍정적인 정(+)의 영향을 미치며, 또한 서비스 품질 요인의 세부 항목 유형성, 신뢰성, 응답성, 확신성, 공감성의 모든 요인이 교육서비스 품질만족에 긍정적인 정(+)의 영향을 미침을 증명하였다. 둘째, 교육서비스 품질만족은 교육이수 후 태도에 긍정적인 정(+)의 영향을 미침을 알 수 있다. 셋째, 서비스 품질은 교육이수 후 태도에 긍정적인 정(+)의 영향을 미치며, 또한 서비스 품질 요인의 세부 항목 유형성, 신뢰성, 응답성, 확신성, 공감성의 모든 요인이 교육이수 후 태도에 긍정적인 정(+)의 영향을 미침을 증명하였다. 본 연구 결과는 교육개선방안을 수립을 위한 기초자료로 활용하여 기술거래사 등록교육 전략 수립에 유용하게 활용하고 지속적인 연구 활동을 통해 기술시장의 활성화를 가속화시키며 기술거래를 효율적으로 관리하기 위한 질적으로 우수한 기술거래사를 양성할 수 있기를 기대한다.

NUI/NUX의 경우, 제스처 인식이나 음성 인식 등의 인식 알고리즘이 필요하다. 하지만 이러한 인식 알고리즘은 전처리, 정규화, 특징 추출과 같은 단계를 거쳐야하기 때문에 구현이 복잡하고, 트레이닝에 많은 시간을 투자해야 한다는 단점이 있다. 최근에는 NUI/NUX 개발 도구로 Microsoft 사의 Kinect가 개발되어 개발자와 일반인들에게 많은 관심을 받고 있고, 이를 이용한 다양한 연구가 진행 중에 있다. 본 저자들의 이전 연구에서도 사용자의 신체적 특징을 이용하여 뛰어난 직관성을 가진 핸드 마우스를 구현하였다. 하지만 마우스의 움직임이 부자연스럽고 정확도가 낮아 사용자가 사용하기 다소 어려웠다는 단점이 있다. 본 연구에서는 Kinect를 통해 사용자의 신체적 특징을 실시간으로 추출하고, 이를 이용해 가상 모니터라는 새로운 개념을 추가한 핸드 마우스 인터페이스를 설계하고 구현하였다. 가상 모니터는 사용자의 손으로 마우스를 제어할 수 있는 가상의 공간을 의미한다. 이를 통해 가상 모니터 상의 손의 좌표를 실제 모니터 상의 좌표로 정확하게 매핑(mapping)이 가능하다. 가상 모니터를 사용함으로써 이전 연구의 장점인 직관성을 유지하고, 단점인 정확도를 높일 수 있다. 추가적으로 뇌파 집중 지표를 이용해 사용자의 불필요한 행동을 인식하여 핸드 마우스 인터페이스의 정확도를 높였다. 제안하는 핸드 마우스의 직관성과 정확성을 평가하기 위하여 10대부터 50대까지 50명에게 실험을 하였다. 직관성 실험 결과로 84%가 1분 이내에 사용방법을 터득하였다. 또한 동일한 피실험자에게 일반적인 마우스 기능(드래그, 클릭, 더블클릭)에 대해 정확성 실험을 한 결과로 드래그 80.9%, 클릭 80%, 더블 클릭 76.7%의 정확성을 보였다. 실험 결과를 통해 제안하는 핸드 마우스 인터페이스의 직관성과 정확성을 확인하였으며, 미래에 손으로 시스템이나 소프트웨어를 제어하는 인터페이스의 좋은 예시가 될 것으로 기대된다.

中國通用航空立法若干問題研究 (Some Issues on China General Aviation Legislation)

  • General aviation and air transport are two wings of the civil aviation industry. Chinese air transport is developing rapidly, and has become the world second air transport system only second to US since 2005. However, Chinese civil aviation is far behind the world average level, and cannot meet requirements of economic construction and social development. The transition and structural adjustment of Chinese economy provide the general aviation with a unprecedented broad market. The prospect of general aviation is promising and anticipated. The development of general aviation industry needs the legislative supports, and the current legislative conditions of Chinese general aviation are undoubtedly far behind the realistic requirements. Accelerating the legislation in Chinese general aviation industry requires scientific legislation concept. First, Legislation must promote development of general aviation industry. The general aviation will serves as a Chinese emerging industry that boosts domestic demand, promotes employment and expedite domestic economic development. We should, based on both the concept of promoting the industrial development of general aviation and national industrial planning, enact and rectify relative laws and regulations. And we should also straighten out the relationship between aviation security and industrial development and promote the revolution of low-altitude airspace management in an all-round way, in order to improve the utilization rate of airspace resources, classify and establish airspace, simplify examination and approval procedure and intensify operation management. In addition, what we should do is to expedite the infrastructure layout construction, guide the differentiated but coordinated development of general aviation industries in various areas, establish a united supervision mechanism of general aviation, redistrict the responsibilities of Chinese Air Control Agency and set up legislation, law enforcement and judicial systems with clarified institutions, clear positioning and classified responsibilities, so as to usher in a new era of the legislative management of Chinese general aviation industry. Second, shift the focus from regulations to both regulations and services. Considering the particularity of the general aviation, we should use American practices for reference and take into account both regulation and service functions when enacting general aviation laws. For example, we should reduce administrative licensing and market supervision, and adopt "criteria" and "approval" management systems for non-commercial and commercial aviation. Furthermore, pay attention to social benefits. Complete social rescuing mechanism through legislation. It should be clarified in legislation that general aviation operators should take the responsibilities of, and ensure to realize social benefits of environmental protection and ecological balance .Finally, rise in line with international standards. Modify Chinese regulations which is inconsistent with international ones to remove barriers to international cooperation. Specify basic legislative principles. One is the principle of coordination. Realize coordination between the civil aviation and general aviation, between military aviation and civil aviation, and among departments. Two is the principle of pertinence. The general aviation has its own rules and specialties, needing to be standardized using specialized laws and regulations. Three is the principle of efficiency. To realize time and space values of general aviation, we should complete rules in aerospace openness, general aviation airport construction, general aviation operations, and regulation enforcement. Four is the principle of security. Balance the maximum use of resources of Chinese airspace and the according potential threats to Chinese national interests and social security, and establish a complete insurance system which functions as security defense and indemnificatory measure. Establish a unified legal system. Currently, the system of Chinese general aviation laws consists of national legislation, administrative laws and regulations and civil aviation regulations (CAR). Some problems exist in three components of the system, including too general content, unclear guarantee measures, incomplete implementation details, and lacking corresponding pertinence and flexibility required by general aviation regulations, stringency of operation management and standards, and uniformity of standards. A law and regulation system, centered on laws and consisting of administrative laws regulations, industrial regulations, implementation details, industrial policies and local laws and regulations, should be established. It is suggested to modify the Civil Aviation Law to make general aviation laws complete, enact the Regulations of General Aviation Development, and accelerate the establishment, modification and abolition of Chinese general aviation laws to intensify the coordination and uniformity of regulations.

國土管理의 方向定立을 위한 國土診斷 -專門家 集團의 問題意識을 中心으로- (Spatial problems of Korea -A delphi survey-)

  • 본 연구는 국토관리의 기본방향을 정립하기 위한 기초 연구로서 국토 전반에 걸쳐 문제의 현 상황을 파악하고자 하였다. 이를 위해 국토문제에 관심을 가지는 전문가 집단을 대상으로 국토정책, 취락계층별 문제, 정책 및 전략평가, 당면 지역문제, 국토환경, 북한에 대한 평가 등에 대한 델파이 조사를 행하였으며, 문헌조사도 병행하였다. 국토의 전체적인 수준은 소비, 주거, 노동 환등을 영위하는데 대체로 만족하나, 교육, 휴양, 공동 생활 등의 부문에서는 상대적으로 미흡하다고 평가되었다. 국토구조의 핵심문제로 공간적 집중과 격차 를 생각하고 있었으며, 토지이용의 기본방향에 대해서는 개발과 보전을 적절히 절충하자는 의견이 제시되었다. 국토 환경 수준에 대해서는 대체로 낮게 평가하고, 정부의 환경관리 정 책에 대해서도 비판적이었다. 한편 취락계층별로 상이한 공간문제를 갖고 있는 것으로 조사 되었다. 북한지역은 국토기반시설이 취약하지만 환경의 질은 양호한 것으로 인식되었다. 국 토의 바람직한 미래상으로는 "건강한 국토"를 제안하며, 그 기본원리로는 미래지향적 국토 관리, 국토의 일체성 회복, 국토구조의 진취적 개편, 국토이용에 있어서의 공공성 확보, 국토 관리 패러다임의 친환경적 전환 등이 요구된다.
