A Study on Civil Liability as to Medical Practices Against the Premium Medical Treatment System (선택진료제를 위반한 의료행위의 민사책임에 관한 고찰)

  • In current law, the premium medical treatment system gives patients the right of choice between normal medical treatment service and premium medical treatment service. Only the doctors having a career more than a certain period of time fixed in the law are eligible for providing the premium medical treatment service. So, the premium medical treatment system is highly related to the patients' right to know and the right of self-determination. The system is also relevant to the so-called 'economic explanation' notion because patients should pay additional fee when they want to use this system. Meanwhile, the situation as follows is problematic as to this system. Although a patient applied for using the premium medical treatment system and the patient also chose his or her own doctor specifically, another doctor who was not selected as premium doctor could make a medical accident. Then, is the another doctor liable for damages because the accident was a medical malpractice or a breach of medical contract? In this study, we are going to examine the problems related with the premium medical treatment system. First, we examine the current law related to the system. Second, we look into the economic explanation duty and its application to the premium medical treatment system. Finally, we examine a real judgment case about a medical practice against the premium medical treatment system and we propose our solution to this case.

  • By means of the model competition, this research analyzed the factor of patient management, the factor of policy support, and the factor of medical treatment system. Concretely, the factor of policy support forms a positive effects on the factor of medical treatment system. Practically, well-established healthcare policy provide and facilitate the effective medical treatment system. of the hospital. And, in the effective medical treatment system, hospitals try to develop the patient management of the chronic disease. From the empirical research, this paper concluded that the factor of medical treatment system. mediated by the factor of policy support. Also, the factor of medical treatment system promotes the development of patient management in the chronic disease.

  • Tele-medicine and emergency medical system are necessary for moving from an accidental point or far distance to a hospital and emergency treatment or home treatment before a hospital. Emergency treatment is extremely important in the case of death before arriving a hospital and deformed or disabled by medical treatment delay. A necessary element for this medical system is the emergency communication system. This system is on preparing for an ability of furnishing patient status to a corresponding health service by monitoring the patient at an ambulance of the accident place. This is the transportation of basic biological information of a patient to a medical center by wireless communication system and the corresponding hospital or medical center examine the patient by monitoring, then they can send emergency medical order to the patient for emergency treatment. The TRS is most efficient way of emergency medical communication system, which is currently used with popularity. In this paper studied simultaneously a way of detecting and transporting bio-logical signals, and monitoring of transporting data with communication of voice in the accident place or ambulance.

Investigation of an Infrared Temperature Measurement System for Thermal Safety Verification of Plasma Skin Treatment Devices

  • In this paper, we developed a temperature measurement system based on an infrared temperature imaging module for thermal safety verification of a plasma skin treatment device (PSTD). We tested a pilot product of the low-temperature PSTD using the system, and the temperature increase of each plasma torch was well-monitored in real-time. Additionally, through the approximation of the temperature increase of the plasma torches, a certain limitation of the plasma treatment time on skin was established with the International Electrotechnical Commission (IEC) guideline. We determined an appropriate plasma treatment time ($T_{Safe}$ < 24 minutes) using the configured temperature measurement system. We believe that the temperature measurement system has a potential to be employed for testing thermal safety and suitability of various medical devices and industrial instruments.

  • Nowadays hospitals have been improving their job performances through informatization and also establishing an advanced, integrated medical information system through their manager's decision making support system in order to play roles as a hub hospital providing high quality medical services integrated with ICT technology. This study connects the OCS system and HIS system to the integrated medical information system to design an optimized, customized mobile health care and medical treatment environment and also investigates the systematic medical system that can perform patients' cure and medical treatment promptly and accurately in order to maximize convenience of treatment by inquiring into patients' information and information of medical treatment promptly.

The influence of complex traditional Korean medical treatment on the Peripheral Facial Paralysis induced stress (한방복합치료(韓方複合治療)가 STRESS로 유발된 말초성안면신경마비(末梢性顔面神經麻痺)에 미치는 영향)

  • Objective: This study was to evaluate the influence of stress on Peripheral Facial Paralysis during the complex traditional korean medical treatment. Methods: We investigated 41 cases of patients with Peripheral Facial Paralysis who were given the complex traditional korean medical treatment. one group had stress as main factor, the other group didn't it. we evaluated the treatment effect of each group by using Gross Grading System of House-Brackmann, Yanagihara's Unweighed Grading System. Results : 1. In age, sex, lesion, duration of disease, frequency of treatment, duration of treatment, we found that two groups have no significant differences. 2. Pain back of the ear showed the highest frequency in symptoms at onset. 3. Boyangwhanotang showed the highest frequency in oriental herb medicine treatment. 4. As a result of evaluation by using Gross Grading System of House-Brackmann, Yanagihara's Unweighed Grading System, treatment score after 2weeks was marked more higher than score before treatment and treatment score after final treatment was more higher than treatment score after 2weeks on each groups. 5. After final treatment, Non-stress group had signficant result on Gross Grading System of House-Brackmann, Yanagihara's Unweighed Grading System compared with stress group. Conclusion : These results suggested that patient with Non-stress group should be get better than stress group.

  • The primary purpose of this study was to provide the basic materials for C.V.A inpatients' actual use of medical service at the hospital with both the western and oriental medical department and the attitude on cooperative treatment. The results of this study were as follow: First, the subjects' general characteristics including job, monthly mean income and age made statistical differences to their pathological characteristics such as part of primary paralysis, detailed name of disease and cause of elicitation. Second, their general characteristics including religion and job produce statistical difference to their actual use of medical service, like medical institution form, term of treatment and type of medical institution at first-aid. Third, through the awareness of cooperative treatment system, the effect of C.V.A treatment and the shorten of the C.V.A treatment term were higher at oriental medical department inpatients and cooperative treatment serviced inpatients than western medical department inpatients and cooperative treatment non-serviced inpatients. Fourth, the biggest problem on current dual medical system is increase medical expenses and the biggest reason on not vitalized cooperative service is prejudice of both parts.

  • Alcoholic polyneuropathy is a disorder of the peripheral nervous system that interferes with sensory, motor, and autonomic nerve function. This study was to report the effect of Oriental medical treatment on a patient with alcoholic polyneuropathy. Conservative Oriental medical treatment was done to a man of 84 years who was diagnosed as a alcoholic polyneuropathy and suffered from both distal dominant leg weakness & symmetrical paresthesia and ataxic gait. The changes of symptoms, reflexes and sensory test were checked by Toronto Clinical Neuropathy Scoring System(TCNSS). Reflexes, motor and sensory impairments were improved after the Oriental medical treatment. I reported good effects of Oriental medical treatment on alcoholic polyneuropathy. Oriental medical treatment can be helpful to improve the symptoms of alcoholic polyneuropathy.

Legal Standings of the Patient and the Doctor within the National Health Insurance - With its focus on the issue of arbitrary medical charge cover - (건강보험에 있어서 의사와 환자간의 법률관계 - 임의비급여 문제를 중심으로 -)

  • In providing general medical treatments, the medical service contract between the patient and the doctor is the mutually responsible onerous contract. However, the nature of the mutually assumed contract standings of the patient and the doctor has been changing since the implementation of the national health insurance program. For instance, besides the cases of beyond excessive medical charges and medical negligence, if the doctor charged for his/her medical treatments violating the post-treatment/nursing cover criteria, the overpaid medical charge, regardless of being collected with the patient's consent, has to be refunded back to the patient. Medically needed aspects, treatment results, and unfair benefits favoring the patient are not at all taken into consideration in the health insurance scheme. This makes it easier for patients to get refunds for their share of the medical payments by involving the Health Insurance Review & Assessment Service or the National Health Insurance Corporation, without engaging in civil law suits (for reimbursement claim) against doctors. In other words, the doctor's responsibility to provide medical treatments and the patient's responsibility to pay for the medical treatment provided within the contractual realm are being demolished by the administrational arbitration of the National Health Insurance system. The basic rights of medical service providers, and the patient's right to choose are as important constitutional rights, as the National Health Insurance program, which is essential in the social welfare system. Furthermore, the development of the medical fields should not be prevented by the National Health Insurance system. If the medical treatment services can be divided into necessary treatments, general treatments, and high quality treatments, the National Health Insurance is supposed to guarantee the necessary and general treatments to provide medical treatments equally to all the insured with limited financial resources. However, for the high quality treatments, it is recommended that they should not be interfered by the National Health Insurance system, and that they should be left to the private contract between the patient and the doctor.

Model Construction for Treatment-Seeking Behaviors in Patients with Arthritis (관절염 환자의 치료추구행위 분석에 의한 이론구축 - 병원치료와 민속요법 이용행태 -)

  • This study was undertaken to explore the antecedent factors and process of the treatment-seeking behaviors of medical and alternative treatments in patients with arthritis using methodological triangulation. The data were collected from 995 arthritic patients who were registered either in a center of rheumatology for medical treatment or residents of community having no treatment to classify different treatment patterns. Sixteen patients with various types of treatment only, alternative treatment only, and no treatment were selected among the total samples to identify the antecedent factors through in-depth interview. The quantitative data were analyzed by percentile, t-test, chi-square test and discrimant analysis using SAS PC program, while the qualitative data were analyzed by means of grounded theory methodology. Treatment-seeking behaviors of patients change from the early stage to the sick-role stage. At the early stage, initial characteristics of pain and acculturation of medical professionalism affect the choice of treatment patterns. The acculturation of medical professionalism is affected by health care accessibility, level of education, duration of sickness and lay referral system. At the sick-role stage, lay referral system and acculturation of medical professionalism affect the choice of treatment patterns. The acculturation of medical professionalism is affected by characteristics of symtoms, perceived treatment effects, perceived causes of diseases and socio-economic status as well as health care accessibility, level of education and lay referral system. In conclusion, different factors as well as common factors are influencing the treatment-seeking behaviors depending on the disease and treatment stages. More detailed further studies are required to explore the value system or medical acculturation of patients which is one of the most important factors in decision-making about treatment modalities.
