ICSID 중재판정의 '취소절차'에 관한 고찰 (A Study on the Annulment Procedure of ICSID Arbitral Awards)

  • This article examines the Annulment Procedure of ICSID Arbitration Award. Although the ICSID annulment procedure is not substantially different from arbitration procedure, it does have certain unique features. Article 52 of the Convention provides that the application for annulment must be made within 120days after the date on which the award was rendered. ICSID Arbitration Rule 50, in turn, stipulates that a request for annulment of a award must: i)be addressed in writing to the Secretary-General; ii)identify the award to which it relates; iii)indicated the date of the application; and iv)state in detail the grounds for annulment on which it is based. The grounds for annulment are limited to those in Article 52(1) of the Convention. With respect to the possibility of waiving the right to annulment in advance, commentators are divided. Some authors admit the possibility of agreements eliminating the right to request annulment. Other authors, instead, have taken the position that parties cannot waive their right to annulment in advanced because no provision in the Convention allows the parties to do so, and thus the right to request annulment is inalienable. In accordance with Article 52(4), annulment decisions must comply with the requirements for awards stipulated in Article 48. Therefore; i)the committee decide questions by majority; ii)the decision must be in writing and must be signed by the members of the committee who voted for it; iii)any member of the committee may attach his individual opinion to the award; and iv)ICSID must not publish the decision without the consent of the parties. Finally, under Article 52(4), parties are not allowed to request the interpretation, revision, or annulment of a decision on annulment. Even if the committee allegedly manifestly exceeded its powers or engaged in any conduct sanctioned by Article 52(1), the parties cannot request the annulment of the decision on annulment.

확장형 데이터 표현을 이용하는 이진트리의 룰 개선 (Refining Rules of Decision Tree Using Extended Data Expression)

  • 유비쿼터스 환경에서 데이터는 빠르게 변하고 새로운 데이터는 시간이 경과함에 따라서 출현한다. 그리고 때로, 메모리 공간이 충분하지 않다면, 모든 과거의 데이터를 잃을 수 있다. 그러므로, 과거의 모든 데이터를 잃지 않도록 또는 데이터를 처리하기 위해서 룰을 만들고 새로운 데이터와 결합하는 문제를 해결할 필요가 있다. 이진트리를 만들고 룰을 추출할 때, 각 룰의 중요도는 일반적으로 리프의 클래스의 총 개수로 정해진다. 주어진 데이터에 맞는 최소한의 유한한 상태 억셉터를 찾기 위한 계산 문제는 NP 하드 문제이다. 추출된 룰은 정확하지 않고 정보의 유실이 있다고 가정된다. 이러한 전제조건 때문에, 본 논문은 룰을 개선하기 위한 새로운 접근을 제시한다. 이것은 이전 지식 또는 데이터로 된 룰의 중요도를 제어하는 것이다. 룰 개선을 할 때, 본 논문은 다수와 소수 특성을 이용하는 푸루닝 방법을 사용하여 다양한 룰을 만들고 룰의 각각의 중요도를 제어하고 성능의 변화를 관찰한다. 본 본문에서 고정된 중요도를 갖는 확장된 데이터 표현을 갖는 이진트리 분류기가 사용되었다. 시험 결과는 룰 개선을 위한 새로운 정책을 이용해서 수행한 성능이 더 좋을 수 있음을 보여준다.

  • IEEE 802.11a에 의해 규정되어진 데이터 전송속도 12Mbps, 부호화 율 1/2, 구속장이 7인 무선 LAN용 비터비 디코더의 이론적인 성능분석을 위해서 Cramer법칙을 이용하여 전달함수를 구하고 가산성 백색 가우시안 잡음 환경하에서 각 구속장 별 첫 번째 사건에서의 에러 확률과 비트 에러 확률을 구하였다. 설계과정에서는 4 비트 연성판정을 위해 입력 심볼을 16단계로 양자화 하였으며, 역 추적을 위한 방식으로 메모리를 사용하는 대신 레지스터 교환방식을 사용함으로써 다수결 결정이 가능한 구조를 제시하였다. 구현과정에서는 12Mbps 고속의 데이터를 처리하기 위해 파이프 라인을 적용한 병렬구조를 갖는 비터비 디코더와 가산성 백색 가우시안 잡음 설계를 FPGA 칩을 사용하여 구현하여 실시간 환경에서 성능검증을 하였다.

한국 지방자치단체의 주민참여예산제도 운영에 관한 연구 - Support Vector Machine 기법을 이용한 유형 구분 (A Study on Korean Local Governments' Operation of Participatory Budgeting System : Classification by Support Vector Machine Technique)

  • 한국의 주민참여예산제도는 자치단체별로 자율적으로 운영되도록 하고 있어서, 본 연구는 이들을 몇 개의 유사한 유형들로 구분하여서 각각의 특징들을 살펴보고자 한다. 본 연구는 다양한 머신 러닝 기법들을 활용하여 2022년도 기초 시(市)를 중심으로 운영유형을 분류하였다. 그 결과, 여러 머신 러닝 기법(Neural Network, Rule Induction(CN2), KNN, Decision Tree, Random Forest, Gradient Boosting, SVM, Naïve Bayes) 중에서 SVM 기법이 성능이 가장 좋은 것으로 확인되었다. SVM 기법이 밝혀낸 운영유형은 모두 3개인데, 하나는 위원회 활동은 적게 하지만, 참여예산은 많이 확보하는 클러스터(C1)이고, 다른 하나는 주민참여예산제에 매우 소극적인 도시들의 클러스터(C3)이다. 마지막 클러스터(C2)는 참여예산에 전반적으로 적극적인데, 대다수 지역이 여기에 해당한다. 결론적으로 한국의 대다수 자치단체는 주민참여예산제를 긍정적으로 운영하고 있으며, 오직 소수의 자치단체만 소극적이다. 후속 연구로 지난 10여 년간의 시계열 자료를 분석한다면, 우리는 주민참여예산에 관한 지방자치단체 유형 분류의 신뢰도를 더욱 높일 수 있을 것으로 기대한다.

북한 대외경제중재법의 실효성 고찰 (A Study on the Efficiency of the North Korean Foreign Economy Arbitration Law)

  • The economic cooperation between the South and North Koreas is a very important issue for the unification and economic development of both Koreas. In order to reach a successful economic cooperation, there is a need to coordinate the differences of the two countries before unification. The economic cooperation and the cooperation in other sectors will be followed by the entire unification. It is necessary to prepare a mechanism that could peacefully solve the conflicts and disputes that could arise during the actual process of cooperation, which will secure stable investments and trades. The study on the possibility of introducing the arbitration system as a conflict solving mechanism between the two Koreas is a very important subject, and the basis of this study is on the examination of the arbitration laws of North Korea. Therefore, the study on the efficiency of the North Korean arbitration laws on foreign economy is studying the possibility of a systematical solution to economic conflicts between the South and North Koreas. The problems and possible solutions of the North Korean foreign economy arbitration laws are summarized as follows. First, juridical cooperation system for both South and North courts of justice needs to be set up to smoothly carry out the main procedures. Mutual correspondence and telecommunication needs to be guaranteed, also remittance and the movement of goods shall precede. Second, the free liquidation of businesses by unit and the individual and independent management of wealth of the North Korean economic bodies, organizations and businesses shall precede to independently liquidate wealth and thus make arbitration possible. Third, amendments in the North Korea's foreign economy arbitration law shall be made to some parts of regulations on arbitration agreements and specific contents of written arbitration agreements to avoid conflicts regarding arbitration agreement. Fourth, the members of the North Korean arbitration committee shall impartially manage the committee only without taking the role of arbitrator, and the clause that allows the North Korean committee to nominate the arbitrator shall be erased. In case an agreement regarding the number of arbitrators is not reached, the three arbitrators general rule shall be applied. In case of requests from any of the parties, a third country arbitrator nomination shall be guaranteed. Also, the requested arbitrator by the party shall be nominated with the cooperation of the court. Fifth, the trial in case of non-appearance or written trial shall be added to the North Korean law in to prevent intended negligence or evasion. Sixth, regulations regarding the court's investigation of evidence shall be added to the North Korean law to make fair arbitration possible in case that government power is needed in order to investigate evidence. Seventh, provisions regarding majority decision shall be added in the North Korean law in the impossibility of unanimous decisions, and the certified system in the arbitration committee official text shall be erased to prevent arrogation and assure the power of the decision made by the arbitration government. Eighth, as "the wrong decision approved" reason for cancellation of arbitration in the North Korean law includes the content of the decision made by the arbitrator could lead to uselessness of arbitration, amendment will be necessary to limit it to legitimacy of the arbitration agreement and wrong procedures. It is hoped that this thesis will be of important use in understanding the issues on the workability and the solutions to the South and North Koreas' arbitration that could be presented during the negotiations for the countries' economic cooperation.

분류 트리 기법을 이용한 국내 일괄사육 양돈장의 차단방역 수준에 영향을 미치는 기여 요인 평가 (Classification Tree Analysis to Assess Contributing Factors Influencing Biosecurity Level on Farrow-to-Finish Pig Farms in Korea)

  • The objective of this study was to determine potential contributing factors associated with biosecurity level of farrow-to-finish pig farms and to develop a classification tree model to explore how these factors related to each other based on prediction model. To this end, the author analyzed data (n = 193) extracted from a cross-sectional study of 344 farrow-to-finish farms which was conducted between March and September 2014 aimed to explore swine disease status at farm level. Standardized questionnaires with information about basic demographical data and management practices were collected in each farm by on-site visit of trained veterinarians. For the classification of the data sets regarding biosecurity level as a dependent variable and predictor variables, Chi-squared Automatic Interaction Detection (CHAID) algorithm was applied for modeling classification tree. The statistics of misclassification risk was used to evaluate the fitness of the model in terms of prediction results. Categorical multivariate input data (40 variables) was used to construct a classification tree, and the target variable was biosecurity level dichotomized into low versus high. In general, the level of biosecurity was lower in the majority of farms studied, mainly due to the limited implementation of on-farm basic biosecurity measures aimed at controlling the potential introduction and transmission of swine diseases. The CHAID model illustrated the relative importance of significant predictors in explaining the level of biosecurity; maintenance of medical records of treatment and vaccination, use of dedicated clothing to enter the farm, installing fence surrounding the farm perimeter, and periodic monitoring of the herd using written biosecurity plan in place. The misclassification risk estimate of the prediction model was 0.145 with the standard error of 0.025, indicating that 85.5% of the cases could be classified correctly by using the decision rule based on the current tree. Although CHAID approach could provide detailed information and insight about interactions among factors associated with biosecurity level, further evaluation of potential bias intervened in the course of data collection should be included in future studies. In addition, there is still need to validate findings through the external dataset with larger sample size to improve the external validity of the current model.
