법정근로시간 단축의 거시경제 효과 분석 (An Empirical Analysis on Macro-economic Effects of the Proposed Reduction of Legal Working Hours in Korea)

  • 본 논문은 법정근로시간 단축에 대한 이론적 및 실증적 효과를 분석한다. 법정근로시간 단축은 이론적으로 임금소득을 상승시키며 소비를 촉진하는 효과가 있는 반면 실근로시간은 약간 줄어들거나 정체하며 비용 상승이 클 경우 고용이 감소하는 효과를 일으킨다. 거시모형을 통한 실증분석은 법정근로시간 단축으로 실질임금이 상승하고 소비가 증대하는 반면 실근로시간의 단축은 법정근로시간 단축 크기의 절반 정도에 그치고 비용 인상 인플레이션이 일어나 GDP와 투자가 감소하는 결과를 낳는 것으로 나타났다. 그리고 법정근로시간 단축이 단계적으로 시행될수록, 그리고 월차휴가, 생리휴가 폐지와 같은 보완장치가 더불어 시행될수록 이 같은 부정적인 효과는 줄어드는 것으로 나타났다.

  • 4차 산업 혁명으로 인해 우리 사회 전 영역에 걸쳐 적용되는 영향력은 날이 갈수록 빠른 속도로 발전을 거듭하고 있다. 최근 법률서비스 분야에서도 선진국 미국을 중심으로 인공지능 기술을 도입하여 법률시장의 혁신을 주도하고 있다. 이처럼 인공지능은 빠른 속도로 사람들의 보조역할을 떠나 사람들을 대체하는 수단으로 급성장할 것이 전망되는 가운데 우리나라 전문 법조인들이 이런 법률시장에서 생존하기 위한 필요한 방안을 검토함이 본 연구의 목적이다. 연구를 위해 국내 연구자들의 선행연구와 우리나라 각종 자료를 기반으로 분석한 후, 비변호사의 법률사무 취급을 전면 금지하는 변호사법 개정, 공공정보에 해당하는 판례에 대해 국가의 적극적인 개입, 법률 정보 서비스의 독점 문제 해결을 위한 국가와 민간이 서로 견제할 수 있는 방안을 도출하여 제시했다. 따라서 상기 연구는 향후 인공지능을 활용한 법률서비스 측면에서 많은 논의점을 던져 줄 것으로 기대된다.

  • 우리나라는 2011년에 개인정보보호법이 제정되어 국민의 개인정보를 안전하게 보호하고 권익을 보호하는 많은 역할을 해오고 있다. 개인정보처리자는 안전한 개인정보 관리를 위하여 안전성 확보 조치 기준을 의무적으로 준수해야 한다. 이렇게 행정 규제가 수반되는 문제임에도 누구에게 언제 어떻게 적용되는지가 명확하지 않다. 법 적용의 원칙은 법의 적용 범위나 대상이 명확해야 하고 대상자의 법적 안정성과 예측 가능성에 있어야 한다는 것이다. 의무 부과에 따라 대상자에 대한 범위, 기준, 안전조치 항목, 절차 등이 명확하고 구체적으로 명시되어야 하지만 현행법 제도는 미흡하다. 따라서 본 연구에서는 선행연구와 개인정보보호 실태조사 자료를 기반으로 적용 대상자 분류 기준, 대상 판단 근거 기준, 안전성 확보 조치 기준 등에 대한 문제점과 합리적인 개선 방안을 제시하였다. 이를 통해 적용 범위와 기준을 명확화, 구체화하여 합리적인 방안을 제시하여 제도의 실효성을 높이는데 기여하고자 한다.

안전한 캠핑장 운영을 위한 정책적 개선방안에 관한 연구 (A study on the Improvement of Policy Direction for Safe Camping Ground Activities)

  • Recently, national leisure activities have increased in proportional to having time and money to spare for living on. Especially, camping activities are positioned as a new leisure type for middle class families, so that it is expected that camping facilities are also rapidly increased. However, there is no institutional measures for safe camping activity. It is urgently requested that camping activities including designing and operating campsite are regulated within the legal system. In this study, the status of camping activities and its legal system are investigated. The strategic policy directions for safe camping activity are suggested in the view of legal system, operational guidelines, and institutional supports; (1) the legal basis for camping activities should be prepared. (2) the supervision of campsite management should be improved based on informational services. (3) the self-operation guidelines for campsite owners should be developed and provided. (4) the criteria of safety assessment for design and operating campsite should be prepared. (5) the safety information of campsite should be published and shared among camping communities.

연안침식방지를 위한 관리체계 개선방안 (A Study on Improvement of Management Framework for Coastal Erosion Protection)

  • Recently, coastal erosion has become an important issue in relation to keeping territorial integrity of a nation as well as protecting the coastal marine ecosystem. This study examines some apprehensions about the effectiveness of the existing legal system concerning prevention of coastal erosion. After examining several case studies in Scotland, the USA, and the Netherlands, this study proposes appropriate revisional legal measures that can be applied in Korea: first, the coastal management act should be revised for stronger, enforceable and practical legal grounds emphasizing minimal coastal erosion; second, the proposed "Comprehensive Coastal Erosion Prevention Plan" should be established and implemented in four steps such as characterization of issues through surveys of stakeholders and demand assessment, plan establishment, execution, and maintenance and management; third, there is a demand to establish and implement a legal framework to support monitoring activities which provide important data and information to prevent coastal erosion; fourth, the chronic region of damage is designated as the "Vulnerable Area" to be protected and managed accordingly; fifth, the "Coastal Coordination council" is established and operated for developing an integrated coastal management policy and visions for sustainable coastal zone, as well as coordinating and intervention of any activities which may cause coastal erosion.

연명의료결정법의 시행과 제도적 실현을 위한 방안 (Act on hospice-palliative care and life-sustaining treatment decision-making and institutional measures for its implementation)

  • First of all, this study shows the legal issues of hospice and palliative care, and the legal basis for lifelong medical practice is generally derived from medical, civil and criminal law regulations, and is applied to patients who are severely ill and dying in principle. In addition, those what is particularly meaningful about hospice and palliative care in terms of legal aspects are discussed the determination of the purpose of care and the provision of medical adaptability and adult guardianship, in particular the legal criteria for the work and status of patient representatives. As such, the purpose of care is to form part of the contract of care and to be agreed between the patient and the physician. In addition, the patient may not write to his/her agent in advance, and the patient may admit discretionary powers to his/her agent, but the patient's will is to be considered. In conclusion, the medical institutional ethics committee should play an active role, especially in the case of no-agents/family or no intention of the patient.

Analytic Hierarchy Process for Prioritizing Radiation Safety Measures in Medical Institutions

  • Background: This study aimed to prioritize policy measures to improve radiation safety management in medical institutions using the analytic hierarchy process. Materials and Methods: It adopted three policy options-engineering, education, and enforcement-to categorize safety management measures, the so-called Harvey's 3Es. Then, the radiation safety management measures obtained from the current system and other studies were organized into action plan categories. Using the derived model, this study surveyed 33 stakeholders of radiation safety management in medical institutions and analyzed the importance of each measure. Results and Discussion: As a result, these stakeholders generally identified enforcement as the most important factor for improving the safety management system. The study also found that radiation safety officers and medical physicists perceived different measures as important, indicating clear differences in opinions among stakeholders, especially in improving quality assurance in radiation therapy. Hence, the process of coordination and consensus is likely to be critical in improving the radiation safety management system. Conclusion: Stakeholders in the medical field consider enforcement as the most critical factor in improving their safety management systems. Specifically, the most crucial among the six specific action plans was the "reinforcement of the organization and workforce for safety management," with a relative importance of 25.7%.

항공에서 부주의 또는 무모한 운항 형태에 관한 연구 (A Study on the careless or reckless flight in aviation)

  • "The prohibition of careless or reckless flight" is the regulation specified not only in the national air law but ICAO ANNEX and FAR. This article(item) has not been categorized properly unlike other items and the question such as why this is described as a fundamental and essential act can be answered only by the party subjected to administrative measures in case of Korea and this kind of violation is so rare that it is not easy to understand the legal meaning and the function of the term, "The prohibition of careless or reckless flight" In case of U.S where aviation cases are common, the distinction between the term "careless" or "reckless" operation depends on whether to recognize the given situation. Some incidents happened by failing to aware NOTAM, violating ATC, or T/W landing where a pilot did not recognize the violation itself are considered to be "Careless" flight. Others such as low altitude high speed flight, approximate flight, Rejecting ATC instruction where a pilot intends to or is remiss in safety are regarded as "Reckless" flight. For pilots who are required to take the highest level of care from preparing for flight to stopping engines or completely disembarking passengers from a plane, the clear understanding of the most basic concept of "careless" or "reckless" flight should be emphasized for the safe flight and it is the time for the authorities to set a standard for proper measures by definite legal interpretations.

Analysis, Recognition and Enforcement Procedures of Foreign Arbitral Awards in the United States

  • Korean businesses, and their legal representatives, have observed the improvements of enforcement of commercial judgments through arbitration over traditional collections litigation in U.S. Courts-due to quicker proceedings, exceptional cost savings and more predictable outcomes-in attaching assets within U.S. jurisdictions. But how are the 2016 interim measures implemented by the Arbitration Act of Korea utilized to avoid jurisdictional and procedure pitfalls of enforcement proceedings in the Federal Courts of the United States? Authors examine the necessary prerequisites of the U.S. Federal Arbitration Act as adopted through the New York Convention, to which Korea and the U.S. are signatories, as distinguished from the Panama Convention. Five common U.S. arbitration institutions address U.S. "domestic" disputes, preempting U.S. state law arbitrations, while this article focuses on U.S. enforcement of "international" arbitration awards. Seeking U.S. recognition and enforcement of Korean arbitral awards necessitates avoiding common defenses involving due process, public policy or documentary formality challenges. Provisional and conservatory injunctive relief measures are explored. A variety of U.S. cases involving Korean litigants are examined to illustrate the legal challenges involving non?domestic arbitral awards, foreign arbitral awards and injunctive relief. Suggestions aimed toward further research are focused on typical Korean business needs such as motions to confirm foreign arbitration awards, enforce such awards or motions to compel arbitration.

선원 직업성 상병 관련 규정 및 제도 분석 (Analysis of the Law and System for Crew's Occupational Illness)

  • 최근에 경제 발전과 인식의 변화에 따라 국내외적으로 직업병에 관련된 많은 연구가 진행되고 있으며, 그에 따라 상당한 성과도 발생되고 있다. 하지만, 선원들의 열악한 근무환경에 비해 승선근무에 따라 발생하는 직업 관련성 상병에 대해서는 체계적인 연구가 이루어지지 못하고 있으며, 사후(事後) 처리적인 보상에 관련된 연구들만 이루어지고 있는 것이 현실이다. 그래서 이 연구에서는 선원의 직업성 관련 상병에 대한 기초 조사를 근거로 하여 그에 대한 관련 법령 및 제도를 검토하였다. 그리고 선원의 상병 예방과 발병 후 신속하고 적절한 지원을 하기 위한 법적 개선점을 제안하고자 한다.
