Self-Disclosure and Confidential Responsibility of Professor Regarding Employee Invention (직무발명에 대한 교수의 자기 공개와 비밀유지 의무에 관한 연구)

  • A professor is an employed as a member of a college, and his invention is transferred to the Industry-Academic Cooperation Foundation (IACF). A professor often reveals his inventions in a thesis or at a symposium before the IACF applies for a patent. Such self-disclosure could be in violation of the confidential responsibility. This study analyzes the number of patent invalidation trials as well as self-revealed patent applications raised in connection with the confidential responsibility. This study also scrutinizes cases to figure out whether the confidential responsibility was breached depending on the time of the self-disclosure both before and after the succession of an invention. In addition, side effects that could accompany self-disclosure are investigated. In the case of the self-disclosure by the professor, an invention to which the college belongs fails to secure patent right or it is hard to obtain comprehensive right. Even if rights were secured, it could be invalidated. Furthermore, they could infringe the confidential responsibility of employees under the Invention Promotion Act, and also could contravene the confidential responsibility specified by the Enforcement Decree of the unfair Competition Prevention if the succession of the invention is confirmed. Therefore, colleges should manage self-disclosure of employee invention and take appropriate action.

Analyzing Health Information Technology and Electronic Medical Record System-Related Patient Safety Incidents Using Data from the Korea Patient Safety Reporting and Learning System (환자안전보고학습시스템 자료를 활용한 의료정보기술 및 전자의무기록시스템 관련 환자안전사건 분석)

  • Purpose: At present, there are a variety of serious patient safety incidents related to problems in health information technology (HIT), specifically involving electronic medical records (EMRs). This emphasizes the need for an enhanced electronic medical record system (EMRS). As such, this study analyzed both the nature of and potential to prevent incidents associated with HIT/EMRS based on data from the Korea Patient Safety Reporting and Learning System (KOPS). Methods: This study analyzed patient safety incidents submitted to KOPS between August 2016 and December 2019. HIT keywords were used to extract HIT/EMRS incidents. Each case was reviewed to confirm whether the contributing factors were related to HIT/EMRS (HIT/EMRS-related incidents) and if the incident could have been prevented (HIT/EMRS-preventable incidents). The selected reports were summarized for general clarity (e.g., incident type, and degree of harm). Results: Of the 25,515 obtained reports, 2,664 incidents (10.4%) were HIT-related, while 2,525 (9.9%) were EMRS-related. HIT/EMRS-related incidents were the third largest type of incident followed by 'fall' and 'medication incidents.' More than 80% of HIT/EMRS-related incidents were medication-related, accounting for approximately one-third of the total number of medication incidents. Approximately 10% of HIT/EMRS-related incidents resulted in patient harm, with more than 94% of these deemed as preventable; further, sentinel events were wholly preventable. Conclusion: This study provides basic data for improving EMR use/safety standards based on real-world patient safety incidents. Such improvements entail the establishment of long-term plans, research, and incident analysis, thus ensuring a safe healthcare environment for patients and healthcare providers.

A Study on Paradigm Shift of Ship Inspection System (선박검사제도 패러다임 전환에 관한 고찰)

  • According to the United Nations Convention on the Law of the Sea (Article 94), the flag state must fulfill its overall role to ensure maritime safety and operate the ship inspection system as a related measure. The Korean government (Ministry of Ocean and Fisheries) has implemented policies for reducing marine accidents to promote maritime safety; however, the target goal has not been achieved. The ship inspection system is a measure to prevent marine accidents, and for the effective operation of the system, a sufficient understanding of the origin of the ship inspection system is required. In this study, the trend of the international ship inspection system was identified by analyzing ship inspection system origins and the history of the system's paradigm shift. The recent international ship inspection system paradigm confirms international standardization and the active safety management of ship companies are becoming increasingly prominent. Based on this, the introduction of the 'PDCA cycle-based self-inspection system' is presented to the current domestic ship inspection system. This is a new type of inspection system that establishes the roles of interested parties based on the basic philosophy of the ISO 9000 series to improve the ef ectiveness of maritime safety. Additionally, the necessity for a non-face-to-face ship inspection system has emerged because of the COVID-19 pandemic. Hence, the transition to a 'mobile application-based ship inspection system' is proposed to accommodate the rapid development of information communications technology.

A Study on Legal Issues of Data Portability and the Direction of Legislative Policy (개인정보 이동권의 법적 이슈와 입법 정책 방향)

  • The right to data portability needs to be introduced to strengthen the self-control of data subjects and promote personal data use. However, the right to data portability constitutes a high risk of invasion of privacy of data subjects and may infringe on the property rights of data controllers, so careful and thorough design is warranted. The right to data portability can intensify the concentration and monopoly of personal data, result in problems of overseas transfer of personal data held by public institutions, and enrich only the profits of giant platforms by burdening the data subject with high transfer cost. By contrast, SMEs are more likely to endure a personal data deprivation. From the proposed amendment to the Personal Data Protection Act are raised various legal issues such as. i) Whether to include inferred/derived data, personal data held by public institutions, activity data, sensitive data, and personal data of third parties within the scope of data portability; ii) whether SMEs are included in the data porting organization; iii) whether to exclude SMEs or large platforms from the scope of the data receiving organization; iv) Whether to allow the right to transmit to other data controllers, v) Whether to allow the overseas transfer of personal data held by public institutions, vi) How to safely exercise the right to data portability, vii) the scope of responsibility and immunity of a data porting organization, etc. The purpose of this paper is to propose the direction for legislative action based on various legal issues related to data portability.

A Study on Effective Real Estate Big Data Management Method Using Graph Database Model (그래프 데이터베이스 모델을 이용한 효율적인 부동산 빅데이터 관리 방안에 관한 연구)

  • Real estate data can be big data. Because the amount of real estate data is growing rapidly and real estate data interacts with various fields such as the economy, law, and crowd psychology, yet is structured with complex data layers. The existing Relational Database tends to show difficulty in handling various relationships for managing real estate big data, because it has a fixed schema and is only vertically extendable. In order to improve such limitations, this study constructs the real estate data in a Graph Database and verifies its usefulness. For the research method, we modeled various real estate data on MySQL, one of the most widely used Relational Databases, and Neo4j, one of the most widely used Graph Databases. Then, we collected real estate questions used in real life and selected 9 different questions to compare the query times on each Database. As a result, Neo4j showed constant performance even in queries with multiple JOIN statements with inferences to various relationships, whereas MySQL showed a rapid increase in its performance. According to this result, we have found out that a Graph Database such as Neo4j is more efficient for real estate big data with various relationships. We expect to use the real estate Graph Database in predicting real estate price factors and inquiring AI speakers for real estate.

Measures to improve the legal system for commercialization of sand dams (샌드댐 상용화를 위한 법제도 개선 방안)

  • Attempts are being made to use the sand dam as an alternative water resource securement facility by installing and operating sand dams in valleys, where water intake capacity is extremely limited, in areas with limited water supply in the upstream watershed of Korea. In the case of some countries in Africa, where sand dams are known to be most actively installed and used, it is difficult to find examples of establishing and applying a separate legal system for sand dams. A sand dam is a kind of groundwater dam, and in view of its concept, structural and technical form and characteristics, purpose, use, and function, it will be said that it has the legal character and status as a facility for securing groundwater resources specified in the current 「Ground Water Act」. Interpretation and application of regulations on facilities for securing groundwater resources also supports this. Therefore, it is legal and realistic to promote and implement the sand dam project as one of the installation and management projects for securing underground water resources based on the 「Ground Water Act」.

Revising Countermeasures Against Natural Disasters Act to Introduce a Coastal Compound Disaster Management Area (해안가 복합재해 관리구역 제도 도입을 위한 법령 개정의 주요 방향)

  • Coastal compound disasters are becoming more extreme and more frequent due to climate change. Thus, appropriate and systematic disaster management is necessary to reduce potential losses. One solution to this is the creation of a coastal compound disaster management area. However, Korea's "Countermeasures against Natural Disasters Act" needs to be reformed to introduce this coastal compound disaster management area. In this study, we tried to find the appropriate direction for reforming the Act in order to establish a basis for implementing regulations on the Coastal Compound Disaster Management Area with regard to three aspects: science-based management, cooperative management, and adaptive management. The study was on the premise that the system would be operated based on the provisions of the "Countermeasures against Natural Disasters Act". Consequently for effective science-based management, it is necessary to introduce a disaster risk assessment framework. Based on the results obtained through the implementation of this framework, the management areas should be set with differential measures. Next, cooperation among the various ministries is essential to successfully respond to disasters. This study recommends the establishment of an advisory council composed of the related government departments as a pragmatic solution. Finally, in terms of adaptive management, we found that parallelly utilizing non-structural measures could compensate for the limitations of structural measures.

An Exploratory Study for Metaverse Governance in the Public Sector (공공 메타버스 거버넌스에 대한 탐색적 연구)

  • The global pandemic and the development of virtual and augmented reality technologies have led a metaverse boom that enables a lot of interactions in virtual worlds, and is being utilized in various fields such as business, government, and education etc. Despite the growing interest in the metaverse, its scope and definition are still unclear and the concept is still evolving, making it challenging to establish its governance. Governmental entities are also investing intensively in public metaverses to make public value and promote social welfare, but they are underutilized due to lack of systematic governance. Therefore, in this study, we propose a public metaverse governance framework and identify the relative importance of the factors. Furthermore, since a public metaverse should be accessible to anyone who wants to use, we explore the factors of shadow work and examine the ways to minimize it. Based on the socio-technical system theory, we derived public metaverse governance factors from previous literature and topic modeling and then generate a framework with 23 factors through expert interviews. We then tested relative priority of the factors using the analytic hierarchical process (AHP) from the experts. As a result, the top five overall rankings are: 'roles and responsibilities', 'standardization/modularization', 'collaboration and communication', 'law and policies', and 'availability/accessibility'. The academic implications of this study are that it provides a comprehensive framework for public metaverse governance, and then the practical implications include suggesting prioritized considerations for metaverse operations in the public sector.

Analysis of Fiber Damage data Due to Physical and Chemical Causes (물리적, 화학적 원인에 의한 섬유 손상 데이터 분석)

  • In this study, the physical and chemical fiber damage caused by knives, scissors, and chemicals was analyzed and used as technical data to determine the cause of the damage. Using 4 types of knives, 5 types of scissors and 4 types of chemicals(Sulfuric Acid, Hydrochloric Acid, Sodium Hydroxide, Potassium Hydroxide) physical and chemical to Cotton, Wool, Polyester, Rayon, T/C (Polyester 50%, Cotton 50%), T/W (Polyester 50%, Wool 50%) Damages were created and analyzed for damage caused by tools and chemicals. For penetrating damage caused by knives and scissors, 'V' type damage was generally seen when the blade part was penetrated, 'T', 'ㅁ', ''C' type damage was found, and in the case of scissors, 'Y' ' This type of damage was common. Fiber damage caused by chemicals showed various damage such as remanent trace, corrosion, degraded, contracting, and color changes. Physical damage of fibers showed differences in characteristics according to the shape characteristics of tools, and chemical damage showed differences in characteristics according to chemicals and types of fibers.

A Study on the Method of Creating a Safety Vulnerable Class Distribution Diagram for Non-Structural Countermeasures in the Comprehensive Natural Disaster Reduction Plan (자연재해저감종합계획 비구조적 대책의 안전취약계층도 작성방안에 관한 연구)

  • The comprehensive natural disaster reduction plan, the highest plan in the disaster prevention field, was implemented by local governments. second plan is currently being formulated. In order to minimize human and property damage, structural and non-structural measures for each of the nine disaster types are established and implemented for 10 years. Structural measures are based on engineering and quantitative analysis, and the criteria for setting reduction measures are clear. Non-structural measures, however, currently lack the set criteria. the basic disaster and safety management law included the safety vulnerable class in 2018. Currently, the safety vulnerable class of the detailed establishment criteria of the comprehensive natural disaster reduction plan is being established, including children, the elderly, and the disabled. However, due to the lack of data securing and database construction by local governments, it is difficult to prepare a location map for establishing reduction measures for the safety vulnerable. Therefore, in this study, OPEN API data of the safety vulnerable class were collected and statistical information and GIS of SGIS information services were used. The distribution diagram of the safety vulnerable class in Samcheok, Gangwon-do, which is a sample area, and the distribution diagram of the safety vulnerable class in units of the output area (OA) in Geundeok-myeon were prepared.
