  • The purpose of this study is to check the extent to which "instruction of physician or dentist" defined in the Medical Service Technologists, etc. Act is applied in relation to radiography examination procedures for radiological technologists. In addition, it is intended to present basic data on the requirement to revise the Medical Service Technologists, etc. Act in the radiological technologist's duty area and scope of work, The subjects of this study were radiological technologists with license, and the response data were collected after sending the questionnaire link written on the online questionnaire form. The final number of respondents were 1,018, and the response rate was 6.8%. Most of the negative responses were "I have never received 'instruction' for radiologic examination by a physician or dentist, including a radiologist in a medical environment." There were a high perception that "the professionalism in radiation examination on radiological technologists are higher than that of a physician or dentist." They answered that the current continuing education has a great impact on maintaining and continuing professionalism and learning new knowledge in the radiology field. In addition, the radiological technologists provide a very high level of education in areas related to radiography procedure ethics such as patient care, patient safety, and patient privacy protection, as well as specialized fields such as radiation-related examination methods, radiography examination dose, and patient exposure dose. Radiological technologists replied that they were receiving it consistently. In conclusion, in the current medical environment, the 'instruction' of a physician or dentist cannot be seen as being realistically performed. The phrase 'instruction' of a physician or dentist as defined in the Medical Service Technologists, etc. Act is considered inappropriate in respect of the fact that the state recognizes the qualifications of the medical service technologist through a license. It is thought that revision to a new term suitable for the current medical environment is necessary.

Extracting Risk Factors and Analyzing AHP Importance for Planning Phase of Real Estate Development Projects in Myanmar (미얀마 부동산 개발형사업 기획단계의 리스크 요인 추출 및 AHP 중요도 분석)

  • Myanmar is an undeveloped country with high development value among Asian countries. Therefore, various countries including the U.S. are considering entering the market. In this respect, demand for real estate development project is forecast to grow on increased inflow of foreigners and Myanmar's economic growth. However, Myanmar is a high-risk country in terms of overseas companies, including national risk. In this study, we conducted an in-depth interview with experts (law, finance, technology, and local experts) after analyzing data on Myanmar to extract risk-causing factors. Through this, 106 risk factors were extracted, and the final risk classification system was established by conducting three-time groupings using the affinity diagramming. And the relative importance of each factor was presented using the analytic hierarchy process (AHP) technique. As a result, the country-related risk, the fund-related risk, and the pre-sale-related risk were highly important. The research results are expected to provide risk management standards to companies entering the Myanmar real estate development type project.

  • The protection of fundamental rights of people is a natural duty of a state. Since Constitutional Law declare that a state is obliged to protect the fundamental rights of people obviously, it is reasonable to postulate that a state has a duty to protect every person's right much more positively. Of course, it is true that whereas right of freedom is much more important in modern states, the social right becomes more important currently. Nevertheless, we have no choice but to put an emphasis on the importance of the right of freedom like modern states. Thus states are still bound to try to protect the right of people, specific duty of behavior for the sake of right of freedom belongs to states. In particular, due to the fact that lifts are essential to our comfortable life and the demage from the accident concerning with the lifts is fatal, the strategy for securing the safety of using the lifts is significant to some extent. And because it is true that the experience of UK that put an emphasis on the role of civil actors is meaningful to us, there seems implications for us. Accordingly, it is possible to consider the material components such as the check of safety before installation for the sake of safety enhancement, quality control for lifts parts, specification of check criterion and variation of check cycle etc. and personal ones such as specification of qualification of competent persons, guarantee of competent person's independence, variation of obligator's duty and variation of user's obligation etc. However, as the situation of UK is one thing and that of Korea is another, we don't have to adhere to the policy and the experience of UK strictly. Rather, we had better apply the policy and experience of UK to ours appropriately.

Problem Analysis and Improvement Strategy for the Suicide Prevention Act (자살예방법의 문제점과 개선방안)

  • Suicide is Korea's first leading cause of death in their twenties and thirties. at a rate of 31.2 per 100,000 in 2010. The Korea suicide rate is over twice higher than OECD's average rate. Because of this reality the suicide prevention act(full title, the Act on Prevention of Suicide and Creation of Culture that Respects Life) was enacted in 2011. In 2008, the Korean government planned the suicide prevention programs to decrease the incidence of suicide to approximately 20 per 100,000 by the end of 2013. Despite the plan the suicide rate in Korea has increased to over 30 per 100,000 since 2009 and the plan was proved to be failed. Consequently, the government was unable to lower the suicide rate in last decade. It has shown that the reduction of suicide rate is a difficult and complex problem. This study shows that the root cause of suicide is based on social and legal exclusion and proposes that suicide prevention measures should be aimed at social cohesion and legal protection.

Restricted Use of Contingent Workers and the Factors of Shift from Contingent to Standard Workers in Brazil (브라질 비정규노동의 제한적 활용과 정규직화 요인)

  • This study pays attention to the restricted use and the possibility of standard position of contingent workers in Brazil. The labor market of Brazil has been developed by formal and informal labor sector, and informal sector includes various precarious workers as well as contingent workers. According to Brazilian Statistics Department, not contingent workers but informal labor focused in this paper have been slowly decreased since year 2000. In this context, this study investigated on the reasons of decreasing contingent employment in Brazil. The results demonstrate that decreased informal employment and instead increased standard workers could not be interpreted by recent the Braizil's economic boom. Along with literature review, the author conducted the case study regarding employment of contingent workers at six large foreign companies in Sao Paulo. The results of this show that the use of contingent employment was prohibited in regular daily works by the labor law and thus firms employed contingent workers in only temporary positions. Further, firms often promise standard positions for contingent workers when temporary employment contract was terminated since there is little or no exist of the differences of wage between standard and contingent worker in terms of 'same work same wage' and 'minimum wage'. In here, labor unions play a key role in employment change from contingent position to standard job. Consequently, decreasing of contingent workers and stepping stone to regular jobs seems to be triggered by both legal regulation on contingent employment and strong unions. This institutional perspective may extend the theoretical view on the use of contingent workers, and the author discuss that Brazil's case could provide practical implications to Korean labor policy.

An Analysis of Legal System for Strengthening Actions against Operating Vessels Under the Influence of Alcohol at Sea (해상에서의 선박 음주운항 단속 강화를 위한 법 제도 분석)

  • In the last 5 years, a total of 567 accidents of operating vessels occurred under the influence of alcohol at sea, most of which occurred in fishing boats. Accidents caused by operating vessels under the influence of alcohol at sea are causing human and physical damages. There were 69 accidents caused by operating vessels under the influence of alcohol, leading to five deaths and one missing. The social damage due to operating vessels under the influence of alcohol is also increasing. Under the current law, punishment is given lightly compared to the seriousness of violation. In order to prevent the recurrence of accidents caused by operating vessels under the influence of alcohol, cases in Korea need to be analyzed. Regulations on the crackdown in foreign countries were compared to those in Korea and reviewed. In addition, risks of operating vessels under the influence of alcohol should be provided to ship workers while improving related laws and systems. In addition, efforts should be made to reduce the number of accidents due to operating vessels under the influence of alcohol by strengthening crackdowns on ships at sea so that accidents caused by operating vessels under the influence of alcohol could be prevented in advance in the future.

A Study on the Factors Affecting User Behavior of Internet Medical Apps (인터넷 의료 애플리케이션 사용 행위에 영향을 미치는 요소에 관한 연구)

  • Due to the recent economic development and the improvement of income level in China, the desire for quality medical services is increasing compared to the past. As an alternative to satisfy these needs, various applications using smart phones and the like are being developed. The new corona that occurred in December 2019 began to show great interest in non-face-to-face telemedicine services using smart phones due to the worldwide spread of the coronavirus. Therefore, in this study, a total of 200 people were surveyed on the top three mobile medical applications in China, and the data of 120 people who actually used medical applications were analyzed based on Venkatesh's UTAUT2 theory. A study was conducted on the intent to use and the factors affecting the in-law behavior. First, it has become clear that the interactive characteristics, expectations for effort, price value, interest in privacy, habits, and promotional conditions have a positive impact on the user's use. Second, it was investigated that the user's intention to use influences the behavior of use, and among the intentions of use, it was found that the mobilization characteristic expectation, hedonistic motivation, price value, habits, and promotion conditions affect the use behavior. Third, a study result was derived that the controlling variables such as gender, age, school age, and annual income do not affect the user's intention to use mobile medical applications as a controlling variable. Finally, due to the nature of mobile devices that use the Internet, various security vulnerabilities exist, and this can cause great damage or personal and social impact. Therefore, for the development of mobile medical services in China, it is necessary to re-establish a research model through comprehensive and in-depth considerations to supplement these problems in the future.

Self-Disclosure and Confidential Responsibility of Professor Regarding Employee Invention (직무발명에 대한 교수의 자기 공개와 비밀유지 의무에 관한 연구)

  • A professor is an employed as a member of a college, and his invention is transferred to the Industry-Academic Cooperation Foundation (IACF). A professor often reveals his inventions in a thesis or at a symposium before the IACF applies for a patent. Such self-disclosure could be in violation of the confidential responsibility. This study analyzes the number of patent invalidation trials as well as self-revealed patent applications raised in connection with the confidential responsibility. This study also scrutinizes cases to figure out whether the confidential responsibility was breached depending on the time of the self-disclosure both before and after the succession of an invention. In addition, side effects that could accompany self-disclosure are investigated. In the case of the self-disclosure by the professor, an invention to which the college belongs fails to secure patent right or it is hard to obtain comprehensive right. Even if rights were secured, it could be invalidated. Furthermore, they could infringe the confidential responsibility of employees under the Invention Promotion Act, and also could contravene the confidential responsibility specified by the Enforcement Decree of the unfair Competition Prevention if the succession of the invention is confirmed. Therefore, colleges should manage self-disclosure of employee invention and take appropriate action.

Analyzing Health Information Technology and Electronic Medical Record System-Related Patient Safety Incidents Using Data from the Korea Patient Safety Reporting and Learning System (환자안전보고학습시스템 자료를 활용한 의료정보기술 및 전자의무기록시스템 관련 환자안전사건 분석)

  • Purpose: At present, there are a variety of serious patient safety incidents related to problems in health information technology (HIT), specifically involving electronic medical records (EMRs). This emphasizes the need for an enhanced electronic medical record system (EMRS). As such, this study analyzed both the nature of and potential to prevent incidents associated with HIT/EMRS based on data from the Korea Patient Safety Reporting and Learning System (KOPS). Methods: This study analyzed patient safety incidents submitted to KOPS between August 2016 and December 2019. HIT keywords were used to extract HIT/EMRS incidents. Each case was reviewed to confirm whether the contributing factors were related to HIT/EMRS (HIT/EMRS-related incidents) and if the incident could have been prevented (HIT/EMRS-preventable incidents). The selected reports were summarized for general clarity (e.g., incident type, and degree of harm). Results: Of the 25,515 obtained reports, 2,664 incidents (10.4%) were HIT-related, while 2,525 (9.9%) were EMRS-related. HIT/EMRS-related incidents were the third largest type of incident followed by 'fall' and 'medication incidents.' More than 80% of HIT/EMRS-related incidents were medication-related, accounting for approximately one-third of the total number of medication incidents. Approximately 10% of HIT/EMRS-related incidents resulted in patient harm, with more than 94% of these deemed as preventable; further, sentinel events were wholly preventable. Conclusion: This study provides basic data for improving EMR use/safety standards based on real-world patient safety incidents. Such improvements entail the establishment of long-term plans, research, and incident analysis, thus ensuring a safe healthcare environment for patients and healthcare providers.

A Study on Paradigm Shift of Ship Inspection System (선박검사제도 패러다임 전환에 관한 고찰)

  • According to the United Nations Convention on the Law of the Sea (Article 94), the flag state must fulfill its overall role to ensure maritime safety and operate the ship inspection system as a related measure. The Korean government (Ministry of Ocean and Fisheries) has implemented policies for reducing marine accidents to promote maritime safety; however, the target goal has not been achieved. The ship inspection system is a measure to prevent marine accidents, and for the effective operation of the system, a sufficient understanding of the origin of the ship inspection system is required. In this study, the trend of the international ship inspection system was identified by analyzing ship inspection system origins and the history of the system's paradigm shift. The recent international ship inspection system paradigm confirms international standardization and the active safety management of ship companies are becoming increasingly prominent. Based on this, the introduction of the 'PDCA cycle-based self-inspection system' is presented to the current domestic ship inspection system. This is a new type of inspection system that establishes the roles of interested parties based on the basic philosophy of the ISO 9000 series to improve the ef ectiveness of maritime safety. Additionally, the necessity for a non-face-to-face ship inspection system has emerged because of the COVID-19 pandemic. Hence, the transition to a 'mobile application-based ship inspection system' is proposed to accommodate the rapid development of information communications technology.
