Dispute Resolution in Internet International Consumer Transaction (인터넷을 통한 국제소비자거래에서의 분쟁 해소방안 - ODR을 통한 분쟁해결방안을 중심으로 -)

  • Today's Internet environment is growing rapidly, and transactions based on it are also rapidly increasing. E-commerce allows merchants and consumers in different countries to easily trade goods across borders. However, the increase in international consumer transactions through the Internet is accompanied by an increase in disputes. International consumer transactions are characterized by a distinction among long distance, small sum, and different jurisdictions. International consumer transactions cannot be solved only by way of resolving disputes in past international transactions. The best way to resolve disputes between international carriers and consumers is through the Internet. In this regard, UNCITRAL has been preparing to enact legislation on ODR as a solution to international electronic trade disputes and, as a result, UNCITRAL adopted guidelines for operating the ODR procedure for building the ODR platform. The European Union has also increased its disputes in the European Union, which is active in the intra-regional market. Institutional improvements were made to solve this problem; therefore, the European Union (EU) has enacted the ODR Regulations for EU consumer disputes. Based on such, this study constructed the ODR platform, which is used as a way to resolve consumer disputes in the regional market.

Political Rationality of Natural Resources Policy - Analysis of Residents Gratification - (자연자원정책의 정치적 합리성에 관한 연구 : 주민 만족도를 적용하여)

  • This study analysed the influencing factors involved in deciding the policy through the analysis of procedure in the policy on the natural resources in local governments. To evaluate the political consensus of decision making in policy determination as political rationality in natural resources policy, we analyzed the degree of the satisfaction from the residents. Among the analysis factors of the satisfaction of natural resources policy, the most significant independent factors were the goal and the method of the policy, the institutional conditions and interested groups, the appropriateness of the content of decision making, supervising and controlling, cooperating relations, the effect of policy, and the consistency. From the analysis of the effect and the goal of policy, we found $70.5\%$ of residents was against the policy and only $27.8\%$ consented. Considering the appropriateness of supervising and controlling in accordance with the process of the policy decision and its execution, the influence of local governments and institutions concerned enjoying comparatively more economic benefits was strong, however, the involvement of the residents and supervising and monitoring institutions were found negligible.

The Current State and the Development Direction of the Studies on Improving of Broadcasting Language (방송언어 개선 연구의 현황과 발전 방향)

  • The purpose of this paper is to seek the development direction of the studies on improving of broadcasting language, by examining the fruits and the limitations of existing research. Firstly, this paper makes sure that the study on improving of broadcasting language is one of the subtypes of study on broadcasting language. Then the current state of the studies on improving of broadcasting language is analyzed by genre, problem, and assessment standard. According to this analysis, existing research is concentrated too much in certain genres such as current affairs and news, but also in certain problems such as accuracy or publicness infractions. Finally, this paper concludes by suggesting three development directions of the future studies on improving of broadcasting language as follows: (1) Accuracy or publicness related problems need no more studies on themselves but continuous and systematic monitoring and institutional device. (2) We need more interest and research on language used in certain genres such as TV home shopping and commercial break. (3) Fairness or soundness related problems need more studies on themselves, because the judgement or assessment standard of these problems is not only difficult to find out, but also in need of viewer and listener awareness investigation and social agreement procedure.

  • Social movements to improve the performance of buildings through remodeling of aging apartment houses are being captured. To this end, the remodeling construction cost analysis, structural analysis, and political institutional review have been conducted to suggest ways to activate the remodeling. However, although the method of analyzing construction cost for remodeling apartment houses is currently being proposed for research purposes, there are limitations in practical application possibilities. Specifically, In order to be used practically, it is applicable to cases that have already been completed or in progress, but cases that will occur in the future are also used for construction cost analysis, so the sustainability of the analysis method is lacking. For the purpose of this, we would like to suggest an automated estimating method. For the sustainability of construction cost estimates, Deep-Learning was introduced in the estimating procedure. Specifically, a method for automatically finding the relationship between design elements, work types, and cost increase factors that can occur in apartment remodeling was presented. In addition, Monte Carlo Simulation was included in the estimation procedure to compensate for the lack of uncertainty, which is the inherent limitation of the Deep Learning-based estimation. In order to present higher accuracy as cases are accumulated, a method of calculating higher accuracy by comparing the estimate result with the existing accumulated data was also suggested. In order to validate the sustainability of the automated estimates proposed in this study, 13 cases of learning procedures and an additional 2 cases of cumulative procedures were performed. As a result, a new construction cost estimating procedure was automatically presented that reflects the characteristics of the two additional projects. In this study, the method of estimate estimate was used using 15 cases, If the cases are accumulated and reflected, the effect of this study is expected to increase.

Improvement of Procedures for Reasonable Implementation of TMDL (수질오염총량관리제의 합리적인 시행을 위한 시행절차 개선방안)

  • The policy of total maximum daily load (TMDL) was introduced to manage wasteload within the loading capacity to achieve water quality standards in the watershed. While the TMDL was implemented, the institutional and technical correction for the improvement of procedure was accomplished even though there were various problems and basically through the process of trial & error. However, a fundamental improvement of this policy is needed to implement the TMDL. This study has come up with a new viewpoint on improving this procedure for reasonable implementation of TMDL. First of all, the water quality and flowrate monitoring of the tributaries should be implemented. This should be done through the establishment of a monitoring system which will include standards of scope, a set time period, water quality parameters and frequency follow ups for the implementation of TMDL. The basic plan in all of the watersheds should be developed based on the establishment of water quality parameters and standards for water use and ecological purposes according to the results of the water quality and flowrate monitoring in the watersheds. The implementation plan for water quality improvement should be established in the watersheds where exceeds the targeted water quality standards. The performance assessment of TMDL should be conducted every year to meet the satisfaction assessment of water quality standards in the watersheds. Finally, if the water quality standards in the watersheds can not be attained or the water quality parameters and standards should be changed, the implementation procedure will be performed according to the iterative process. On the contrary, the policy of TMDL in the watersheds where the water quality standards have been met the goal will be finished.

Outpatient Day-Care Management of Unruptured Intracranial Aneurysm: A Retrospective Cohort Study

  • Objective: This study aimed to assess the outcomes of outpatient day-care management of unruptured intracranial aneurysm (UIA), and to present the risks associated with different management strategies by comparing the outcomes and adverse events between outpatient day-care management and management with longer admission periods. Materials and Methods: This retrospective cohort study used prospectively registered data and was approved by a local institutional review board. We enrolled 956 UIAs from 811 consecutive patients (mean age ± standard deviation, 57 ± 10.7 years; male:female = 247:564) from 2017 to 2020. We compared the outcomes after embolization among the different admission-length groups (1, 2, and ≥ 3 days). The outcomes included pre- and post-modified Rankin Scale (mRS) scores and rates of adverse events, cure, recurrence, and reprocedure. Events were defined as any cerebrovascular problems, including minor and major stroke, death, or hemorrhage. Results: The mean admission period was 2 days, and 175 patients (191 aneurysms), 551 patients (664 aneurysms), and 85 patients (101 aneurysms) were discharged on the day of the procedure, day 2, and day 3 or later, respectively. During the mean 17-month follow-up period (range 6-53 months; 2757 patient years), no change in post-mRS was observed compared to pre-mRS in 99.6% of patients. Cure was achieved in 95.6% patients; minimal recurrence that did not require re-procedure occurred in 3.5% patients, and re-procedure was required in 2.3% (22 of 956) patients due to progressive enlargement of the recurrent sac during follow up (mean 17 months, range, 6-53 months). There were eight adverse events (0.8%), including five cerebrovascular (two major stroke, two minor strokes and one transient ischemic stroke), and three non-cerebrovascular events. Statistical comparison between groups with different admission lengths (1, 2, and ≥ 3 days) revealed no difference in the outcomes. Conclusion: This study revealed no difference in outcomes and adverse events according to the admission period, and suggested that UIA could be managed by outpatient day-care embolization.

  • The importance of ADR(Alternative Dispute Resolution), which has the advantage of expertise, speed and neutrality due to the increase of arbitration cases due to domestic and foreign construction disputes, has emerged. Therefore, in order for the nation's arbitration system and the arbitration Organization to jump into the ranks of advanced international mediators, it is necessary to research the characteristics and advantages of these arbitration Organization through a study of prior domestic and foreign research and operation of international arbitration Organization. As a problem, First, education for the efficient promotion of arbitrators (compulsory education, maintenance education, specialized education, seminars, etc.). second, The effectiveness of arbitration in resolving construction disputes (hearing methods, composition of the tribunal, and speed). third, The issue of flexibility and diversity of arbitration solutions (the real problem of methodologies such as mediation and arbitration) needs to be drawn on the Arbitration laws and practical problems, such as laws, rules and guidelines. Therefore, Identify the problems presented in the preceding literature and diagnosis of the defects and problems of the KCAB by drawing features and benefits from the arbitration system operated by the international arbitration Institution. As an improvement, the results of an empirical analysis are derived for "arbitrator" simultaneously through a recognition survey. As a method of improvement, First, as an optimal combination of arbitration hearing and judgment in the settlement of construction disputes,(to improve speed). (1) A plan to improve the composition of the audit department according to the complexity, specificity, and magnification of the arbitration cases - (1)Methods to cope with the increased role of the non-lawyer(Specialist, technical expert). (2)Securing technical mediators for each specialized expert according to the large and special corporation arbitration cases. (2) Improving the method of writing by area of the arbitration guidelines, second, Introduction of the intensive hearing system for psychological efficiency and the institutional improvement plan (1) Problems of optimizing the arbitration decision hearing procedure and resolution of arbitration, and (2) Problems of the management of technical arbitrators of arbitration tribunals. (1)A plan to expand hearing work of technical arbitrator(Review on the introduction of the Assistant System as a member of the arbitration tribunals). (2)Improved use of alternative appraisers by tribunals(cost analysis and utilization of the specialized institution for calculating construction costs), Direct management of technical arbitrators : A Study on the Improvement of the Assessment Reliability of the Appraisal and the Appraisal Period. third, Improvement of expert committee system and new method, (1) Creating a non-executive technical committee : Special technology affairs, etc.(Major, supports pre-qualification of special events and coordinating work between parties). (2) Expanding the standing committee.(Added expert technicians : important, special, large affairs / pre-consultations, pre-coordination and mediation-arbitration). Measures to strengthen the status role and activities of expert technical arbitrators under enforcement, such as the Act on Promotion of Interestments Industry and the Information of Enforcement Decree. Fourth, a measure to increase the role of expert technical Arbitrators by enacting laws on the promotion of the arbitration industry is needed. Especially, the establishment of the Act on Promotion of Intermediation Industry should be established as an international arbitration agency for the arbitration system. Therefore, it proposes a study of improvement and differentiation measures in the details and a policy, legal and institutional improvement and legislation.

  • This study focuses on some institutional improvement for revitalization of change in building use of officetel to lifestyle lodging industry. First as analysis method, this study establishes a failure factor for change in building use of officetel to lifestyle lodging industry. Second, analyzes an urgent importance to improve it in aspect of a legal institution or management for revitalizing a change of building use of officetel to lifestyle lodging industry. As a result, a failure factor of change in building use from officetel to lifestyle lodging industry is deducted in 4 articles with 13 detailed index. As a result of AHP, 'existing contractor's 100% agreement condition' is the first place, 'commercial /semi-residential area in zoning' is the second place, 'relative cleanup zone' is the fourth place, 'late changes of building use by a complex licensing procedure' is the fifth place, 'operational risk of consignment' is the sixth place, 'deficiency in publicity of related institution' is the eighth place, 'lack of concept in lifestyle lodging industry of building code' is the ninth place, 'basic constructional condition such as parking lot sewage and fire protection system' is the tenth plce, 'installation of ventilation facility' is the eleventh place, 'installation of bathroom and shower room in each room' is the twelfth place, 'installation of kitchen facility' is the thirteenth place.

A Study on the Application of District Unit Planning Techniques to Activate Efficient Urban Regeneration (효율적 도시재생 활성화를 위한 지구단위계획기법 적용에 관한 연구)

  • The purpose of this study is to derive the linkage between urban regeneration and district unit planning, in order to supplement the limitations of the spread of the effects of individual urban regeneration projects. To this end, institutional changes and previous studies with theoretical backgrounds were reviewed, the urban regeneration strategic plan and district unit plan cases in the spatial scope of Jeju Island were analyzed, and a unified administrative procedure to strengthen linkages was proposed. In addition, when selecting priorities for active regions, we reviewed how to use the indicators of involvement of residents, which enabled the project to be performed smoothly by grasping the participation of residents and the elements of complaints. Also a hypothetical target site was set up and suggested how to establish a district unit plan by type. Depending on the circumstances and environment of the site, the use of the land use plan and the regulation and mitigation of the district unit plan may be appropriately used to expect the inhabitants to expand their participation and revitalization. This study suggests ways to revitalize decayed areas beyond systematic urban planning in connection with systematic plans, to improve administrative procedures, and to promote bottom-up projects.

Current Status and Issues of Data Management Plan in Korea (데이터 관리 계획의 국내 현황 및 과제)

  • With the recent development of digital technology, the research paradigm is evolving towards data-driven. National management and utilization of research data is a key element not only to enhance research transparency and efficiency, but also to prepare for a data-driven society. Policies and infrastructure for sharing and utilization of research data from publicly-funded research are being actively promoted worldwide. In Korea, related regulations were recently revised to mandate to submit a data management plan (DMP) when proposing a national R&D project. In order to effectively implement the sustainable DMP system, researchers need various support. In addition, guidelines and implementation procedures are essential for management and utilization of research data at the national or institutional level. In this paper, we provide an overview of the data management plan, examine the current status and issues in Korea, and suggest a template and checklists of data management plan, and an implementation procedure at research institutes.
