The purpose of this paper is to make research on the contents and discussions of the draft of revised UNCITRAL Arbitration Rules that have been discussed and considered by the Working Group. At its thirty-ninth session (New York, 19 June-7 July 2006), the Commission agreed that, in respect of future work of the Working Group, priority be given to a revision of the UNCITRAL Arbitration Rules (1976). At its forty-fifth session (Vienna, 11-15 September 2006), the Working Group undertook to identify areas where a revision of the UNCITRAL Arbitration Rules might be useful. At that session, it was considered that the focus of the revision should be on updating the Rules to meet changes that had taken place over the last thirty years in arbitral practice. The largely amended provisions of the draft of revised UNCITRAL Arbitration Rules are as follows : Notice of arbitration and response to the notice of arbitration (Article 3), Designating and appointing authorities (Article 4 bis), November of arbitrators (Article 5), Appointment of arbitrations (Article 6), Appointment of arbitrators in multi-party arbitration (Article 7 bis), Challenge of arbitrators (Article 9), Replacement of an arbitrator (Article 13), Pleas as to the jurisdiction of the arbitral tribunal (Article 21), Interim measures (Article 26), Form and effect of the award (Article 32), and Liability of arbitrators (Proposed additional provisions). There are some differences between the draft of revised UNCITRAL Arbitration Rules and the KCAB Arbitration Rules. In order to jnternationalize the Korea's commercial arbitration system, it is desirable that the main articles of the draft of revised UNCITRAL Arbitration Rules should be admitted to the KCAB Arbitration Rules. In conclusion, the Commission was generally of the view of any revision of the UNCITRAL Arbitration Rules should not alter the structure of the text, its spirit, its drafting style, and should respect the flexibility of the text rather than make it more complex. The Working Group agreed that harmonizing the provisions of the UNCITRAL Model Law should not be automatic but rather considered only where appropriate.

This is a historical study of the tea culture and its manners after checking the origin of the tea culture in Korea. Also I created the Blooming Lotus Pond Tea which can be utilized in various meetings or at homes in connection with the tea culture and etiquette by studying good manners, clothing and light refreshments in 'Kyucongyogyul' by Lee-E, 'Karyejibramdo' by Kim Jang-Seng and other books of the Chosun Dynasty. I created the Blooming Lotus Pond Tea by referring to the tea-ceremonies described in the poems by Hong Inmo, his wife, Lady Suh, and her descendants. They can be better harmonized with the modem tea culture rather than the strict procedures of traditional court ceremonies or marriage, funeral, and other formal tea ceremonies. About the costumes of the nobilities, that is especially referred to Kyukmongyogyul by Lee-I of the Chosun Dynasty for the etiquette, also 'The Living Manners' by Professor Lee Gilpyo and Choi Baeyong. In addition, the tea-food is made based on 'the five elements'. The Blooming Lotus Pond Tea is made of frozen lotus flowers and prepared in the lotus formed broad-rimmed tea-utensils and supposed to be shared with family members or guests. It's recommended to hold a poetry-party with a tea-party. At present, this kind of daily tea ceremony is being developed at homes. It'll be desirable if it could recreate the traditional way as a ceremonial tea culture. In that case, it'll regain the quality of the traditional etiquette by harmonizing tea culture and manners. Such a tea culture can contribute to the quality of people's ordinary life and the identity of our country.

In the automobile industry, reducing the weight is the most important objective for reducing air pollution and improving the fuel efficiency. For this reason, the application of aluminum sheets is increasing. When the sheets are applied to the automobile, using inappropriate variables for the material, product design, and press processing can generate tearing, wrinkling, and spring-back problems, which are the main types of failure in the manufacturing process. Therefore, it is necessary to reduce these failures by harmonizing the many variables and strictly managing the processes. In this research, we study the theoretical plasticity instability of Al5454 and obtain the forming limit diagram (FLD) using MATLAB. Moreover, we compare the theoretical FLD with an experimental FLD obtained from a stretching test.
This study analyzed the brand storytelling campaign of Pasteur drink-type yogurt 'Quebyon'. The basic idea of research comes from how unique brand name is able to success in Korean yogurt market. Pasteur storytelling campaign has focused on the product's branding and positioning. For analyzing the research, Brand Stewardship Model(BSM) which based on consumers' perspectives has been used. For successful storytelling campaign of Pasteur, strong brand name is needed. Pasteur has decided the brand name 'Quebyon' which means good movement of the bowels in accordance with the research results. And the positioning has been decided 'attack inside (the body) if it does not evacuate'. For powerful positioning, three criterions are decided. They are including harmony with the brand name, differentiation with competitors and easiness with memory. Finally, the Pasteur product dominates the Korean Bulgarian-style yogurt market. The success comes from the harmonizing of Quebyon yogurt's branding and positioning. In other words, the branding and positioning strategies were working effectively to the consumers. In conclusion, this study has proved why branding and positioning strategies are so important in brand storytelling campaign.
Purpose: The purpose of this study is to present a plan to expand the employment of the elderly in Small business as one of the ways to solve the problem of the supply and demand of the company due to the aging population and the problem of the elderly poverty. Research design, data and methodology: The method of this study is a qualitative research method, and the researcher visited a small and medium-sized company directly and collected data by conducting an in-depth interview with a business owner. The interview period was conducted on a total of 15 business owners from November 5, 2013 to November 18, 2013. Results: First, the reason why companies hire the elderly is because they are suitable people, and the reason why they are not employed is because the elderly are not suitable. Second, it was found that the most recruiting paths continued to work after retirement. Third, the strengths of the elderly in their businesses were diligence, integrity, leadership, wisdom, warmth, and skill. Disadvantages the elderly in their businesses include wanting to be treated as an adult, poor productivity, poor accuracy, and health risks. Fourth, in case of hiring the elderly, they were considering convergence with young employees, and it was suggested that there are no difficulties in being an elderly because the companies hiring the elderly use the elderly according to the characteristics of the elderly. Fifth, It is realistic to actively utilize the employment system after retirement. Sixth, it was found that, unlike young people, it is not easy to recruit people on the Internet, so it is necessary to improve the system. Lastly, some industries clearly distinguished between the jobs of the elderly and the jobs of the young, but in many industries, it was desirable to create jobs for the elderly by harmonizing the main and secondary jobs. Conclusion: Ultimately, the work of the elderly in small and medium-sized enterprises should be reborn as a high-quality job that can solve the poverty of the elderly by working as a regular worker in the enterprise, rather than simply working for the elderly.
During the past few decades, we have witnessed three approaches to overcome the legal disparities between trading countries: - determining the individual governing law in accordance with the conflict of laws principle; - unifying and harmonizing private international law into uniform rules and substantive laws under the auspices of ICC, UNCITRAL, UNIDROIT and various NGOs ; and - drafting model laws like the UNCITRAL Model Law on Electronic Commerce and promoting member countries to enact them. Against this backdrop, the United Nations Convention on Contracts for the International Sale of Goods (CISG) and the process by which it was adopted, established the benchmark for the unification of commercial law. The CISG, completed in 1980, merged civil and common law concepts and came into force in 1988 after a certain number of countries endorsed the treaty. Besides the CISG, the U.N. Limitations Convention and the UNIDROIT Principles of International Commercial Law, to name a few, have attempted to set cross-border legal norms and standards in the international business transactions. However, since the advent of computer-based commerce, there have emerged all-out efforts to establish uniform rules before national legal systems have been developed. As a consequence, the Model Law on Electronic Commerce has become a specimen legislation covering functional equivalents of paper-based writing and signature. For the credit enhancement exemplified by the Uniform Rules for Demand Guarantees (ICC Publication No.458), the UNCITRAL prepared the U.N. Convention on Independent Guarantees and Stand-by Letters of Credit, which was adopted by the U.N. General Assembly in 1995 but remains still not effective as only two countries have ratified this treaty so far. In this connection, two draft conventions underway at UNIDROIT and UNCITRAL deserve our attention as the probability of unification in the Korean Peninsula is mounting. They are to create security interests for commercial finance in moveable equipment and accounts receivable. The UCC-type security rights are regarded to be useful to enable the North Koreans with limited properties to borrow from the banks.

This paper discusses how to effectively design a next-generation wireless communication system that can possibly provide very high data-rate transmissions and versatile quality services. In order to accommodate the sophisticated user requirements and diversified user environments of the next-generation systems, it should be designed to take an efficient and flexible structure for multiple access and resource allocation. In addition, the design should be optimized for cost-effective usage of resources and for efficient operation in a multi-cell environment. As orthogonal frequency division multiple access (OFDMA) has turned out in recent researches to be one of the most promising multiple access techniques that can possibly meet all those requirements through efficient radio spectrum utilization, we take OFDMA as the basic framework in the next-generation wireless communications system design. So, in this paper, we focus on introducing an OFDMA-based downlink system design that employs the techniques of hybrid multiple access (HMA) and frequency group (FG) in conjunction with intra-frequency group averaging (IFGA). The HMA technique combines various multiple access schemes on the basis of OFDMA system, adopting the multiple access scheme that best fits to the given user condition in terms of mobility, service, and environment. The FG concept and IFGA technique help to reduce the feedback overhead of OFDMA system and the other-cell interference (OCI) problem by grouping the sub-carriers based on coherence band-widths and by harmonizing the channel condition and OCI of the grouped sub-carriers.
A city is the center of all the economic activities, politics, administration and creation of cultures, and it is also a social community. It is also an environment in which human beings live and act, and thus, psychological and emotional pleasure are greatly demanded. Facilities of cities, buildings and harmonizing each and every structures with the environment sets up the image and the identity of a city because they are the most important visual structuring elements in cityscapes. Currently, most of the cities in Korea including Seoul, are in discordance with their natural environment because of all different sorts of buildings and signboards are jumbled up close together. The traditional, local colors have disappeared form those cities and all cities look the same. It is hard to find traditional beauty and identities of the cities in Korea, and the Korean cities are not even close to the threshold of other foreign cities. In order to solve these problems, there is a dire need of improving the modification of cityscapes in the long run. This research aims to understand the current abstruse situation Korean cities are in, analyze their problems and describe actual methods of improving those cities so that they can have a more ordered and organized structures. Also, this research should be used as a data of future researches based on citiscapes.
The purpose of this study is to examine modern people's lifestyle and identify their needs by analyzing clothing behavior through city nomads' attitudes in dairy life, tastes, and methods to pursue in their life. This study tries to understand substitute values as ethical life emerging recently, free life style of mental emotion, clothing behaviors, and fashion style represented by the results. Upon observing city nomads' fashion trend, tunics symbolizing flexibility and comfort and simultaneously reflect colors in a monk style or from basic items that have been used. City nomads' fashion trend also reveals androgynous freeness-and-easiness. City nomads reflect a folksy inspiration, and different cultural perspectives appear in a mixed fashion. Multi-purpose gypsy/boho style is ideal for traveling and occupying smaller spaces in line with the nomadic lifestyle reflectings an American casual image partially by way of gypsy or bohemian nuances. Motorcycle jeans symbolizing functionality for traveling are becoming a part of everyday life. The fashions discussed are categorized as urban, tourer, sports and road. Everyday sportswear - athleisure - is attracting attention enabling a healthy and sound lifestyle. Athleisure is fashion wear harmonizing workplace with leisure, and everyday life and social gatherings. Athleisure represents a significant collapse of the boundary of high fashion and street fashion. Urban- tech wear is light and enables modern people to perform garment and gear functions simultaneously, making storage useful using various technical devices by elevating activity and functionality. Urban outdoor fashion holding functionality and adding modern fashion in appearance has appeared.
Purpose: This study aims to develop menu for tofu, which will satisfy a variety of needs of people by harmonizing tofu and other ingredients. Methods: In the present study, the standard recipes were made for tofu menu development by improving the existing recipes like Dubu-seon, Dubu-kimchi, Dubu-jeongol, and Sundubu-jjigae (soft tofu stew). Based on newly developed recipes, the nutritional analysis was conducted using the analyzing program of the Korean Nutrition Society (CAN-Pro 4.0). Food styling was devised considering the shape and color of plates, layout, and color harmony. Table design was devised empirically employing tablecloth, napkin, dinnerware, glasses, cutlery, centerpiece, and figures. Results: Food styling of Dubu-seon was devised by improving the visual aspect, using Korean traditional five cardinal colors. It turns out that the improvised version of Dubu-seon (prepared following the new recipe) can satisfy 15.1% of amount of recommended dietary fiber intake per day for both male and female adults. In case of Dubu-kimchi, the dish was developed as a one-dish meal by supplementing protein and improving food styling. Beef was added in a form of a meatballs which is especially preferred by children. However, the amount of salt was reduced due to the strong and spicy taste of kimchi itself, resulting in 32% of daily intake of sodium. Dubu-jeongol was also improvised by reducing protein content, and more vegetables were added. Food styling was also improved. Concerning Sundubu-jjigae, protein was supplemented by addition of mushrooms rather than the existing way of adding shellfish. The sodium content was 133.88 mg, which is merely 10% of daily intake. Conclusion: With the new developments in tofu menus, new food styling, and table design, this study aims to contribute towards the rise in sales in the food service industry in terms of being used as basic and critical data.
