The purpose of this work aims to analyse the principles of good faith under international transaction with CLOUT and UNILEX cases. Article 7(1) CISG sets the stage for the interpretation by promoting a uniform approach using good faith and the international charter of the convention. In other words, article 7(1) defines the purpose and the principle of interpretation and is applied to the Convention as a whole. As such, it also includes article 7(2), which goes beyond the big picture and settles the problems of gap filling. It is also important to understanding that the mandate of the CISG is to look for a solution, which is not only restricted to interpretation but extends to solving a problem. The problem in this work is to find out how gap filling is achieved and, because of the autonomous mandate of interpretation, to explain and understand its relationship with domestic law. The solution to the interpretation of article 7(2) must be found within the four corners of the CISG. To restate, article 7(2) describes two situations where gap filling is needed. First, if the matter is governed by the Convention but not expressly settled, then a gap must be filled in conformity with general principles on which it is based. Second, if the matter is not covered then the gap must be filled taking domestic law into consideration. There are two reasons why a matter may not be covered by the Convention. First and most obviously, it has been specifically exclude from the sphere of Application by the CISG itself, such as validity in article 4. Second, changes in business methods will lead to gaps. The United Nations has established a service known as CLOUT. This contains abstracts of hundreds of selected decisions of both courts and arbitration tribunals. And UNILEX is cosponsored by the Italian Centre for Comparative and Foreign Law Studies and UNIDROIT Contract Principles. The cases are in abstract format, but, when available, the full text of the case in the original language is also supplied.

The continuing need for more compact and reliable switching power supplies have aroused a renewed interest in a well founded control technique the Magnetic Amplifier(Magamp). Magamp have some advantages of higher power density simple control circuit, good regulation, high frequency and high performance. The control method with magamp become attractive solutions for high current post regulated output applications. In this study, it is proposed that the magamp technique in flyback converters with multiple output windings. Operation principle of the proposed approach is described and a description of magamp control loop behavior is given first from a circuit level point of view. Then the focus is shifted to look at the same issue from the block diagram point of view. Experimental verifications on 50W multiple output flyback converter are conducted. Simulations and experimental results show that the proposed approach is high efficiency and voltage regulation of the auxiliary output is excellent.
In this paper, a new approach is proposed for the efficient generation of computer-generated holograms (CGHs) using the spatially redundant data on a 3D object and the novel look-up table (N-LUT) method. First, the pre-calculated N-point principle fringe patterns (PFPs) were calculated using the 1-point PFP of the N-LUT. Second, spatially redundant data on a 3D object were extracted and re-grouped into the N-point redundancy map using the run-length encoding (RLE) method. Then CGH patterns were generated using the spatial redundancy map and the N-LUT method. Finally, the generated hologram patterns were reconstructed. In this approach, the object points that were involved in the calculation of the CGH patterns were dramatically reduced, due to which the computational speed was increased. Some experiments with a test 3D object were carried out and the results were compared with those of conventional methods.
A higher order analytical solution for static analysis of a truncated conical composite sandwich panel subjected to different loading conditions was presented in this paper which was based on a new improved higher order sandwich panel theory. Bending analysis of sandwich structures with flexible cores subjected to concentrated load, uniform distributed load on a patch, harmonic and uniform distributed loads on the top and/or bottom face sheet of the sandwich structure was also investigated. For the first time, bending analysis of truncated conical composite sandwich panels with flexible cores was performed. The governing equations were derived by principle of minimum potential energy. The first order shear deformation theory was used for the composite face sheets and for the core while assuming a polynomial description of the displacement fields. Also, the in-plane hoop stresses of the core were considered. In order to assure accuracy of the present formulations, convergence of the results was examined. Effects of types of boundary conditions, types of applied loads, conical angles and fiber angles on bending analysis of truncated conical composite sandwich panels were studied. As, there is no research on higher order bending analysis of conical sandwich panels with flexible cores, the results were validated by ABAQUS FE code. The present approach can be linked with the standard optimization programs and it can be used in the iteration process of the structural optimization. The proposed approach facilitates investigation of the effect of physical and geometrical parameters on the bending response of sandwich composite structures.

This paper develops a least-squares approach to the solution of the optimal control problem for the Navier-Stokes equations. We recast the optimality system as a first-order system by introducing velocity-flux variables and associated curl and trace equations. We show that a least-squares principle based on $L^2$ norms applied to this system yields optimal discretization error estimates in the $H^1$ norm in each variable.

Shape rolling has been studied experimentally by many researchers. As large numbers of process variables are involved and the material flow is difficult to analyze in shape rolling, the use of numerical techniques as an engineering tool becomes extremely attractive. The first numerical approach to the three-dimensional plastic deformation of rolling was to investigate side spread in flat rolling. Oh and Kobayashi conducted a pioneering study in this field by applying an extremum principle for rigid, perfectlyplastic materials combined with the numerical computation. Since then, several other researchers have used three-dimensional finite element method for analysing spread in rolling . In this paper we proposed a dada-aided Doppler estimation method for underwater acoustic communication. The training sequence is non-dedicate, hence it can be designed for Doppler estimation as well as channel equalization. We assume the channel has been equalized and consider only flat-fading channel. First, based on the training symbols the theoretical received sequence is composed. Next the least square principle is applied to build the objective function, which minimizes the error between the composed and the actual received signal. Then an iterative approach is applied to solve the least square problem. The proposed approach involves an outer loop and inner loop, which resolve the channel gain and Doppler coefficient, respectively. The theoretical performance bound, i.e. the Cramer-Rao Lower Bound (CRLB) of estimation is also derived. Computer simulations results show that the proposed algorithm achieves the CRLB in medium to high SNR cases.
For the first time, an accurate analytical solution, based on coupled three-dimensional (3D) piezoelasticity equations, is presented for free vibration analysis of the angle-ply elastic and piezoelectric flat laminated panels under arbitrary boundary conditions. The present analytical solution is applicable to composite, sandwich and hybrid panels having arbitrary angle-ply lay-up, material properties, and boundary conditions. The modified Hamiltons principle approach has been applied to derive the weak form of governing equations where stresses, displacements, electric potential, and electric displacement field variables are considered as primary variables. Thereafter, multi-term multi-field extended Kantorovich approach (MMEKM) is employed to transform the governing equation into two sets of algebraic-ordinary differential equations (ODEs), one along in-plane (x) and other along the thickness (z) direction, respectively. These ODEs are solved in closed-form manner, which ensures the same order of accuracy for all the variables (stresses, displacements, and electric variables) by satisfying the boundary and continuity equations in exact manners. A robust algorithm is developed for extracting the natural frequencies and mode shapes. The numerical results are reported for various configurations such as elastic panels, sandwich panels and piezoelectric panels under different sets of boundary conditions. The effect of ply-angle and thickness to span ratio (s) on the dynamic behavior of the panels are also investigated. The presented 3D analytical solution will be helpful in the assessment of various 1D theories and numerical methods.
In current study, for the first time, Nonlinear Bending of a skew microplate made of a laminated composite strengthened with graphene nanosheets is investigated. A mixture of mechanical and thermal stresses is applied to the plate, and the reaction is analyzed using the First Shear Deformation Theory (FSDT). Since different percentages of graphene sheets are included in the multilayer structure of the composite, the characteristics of the composite are functionally graded throughout its thickness. Halpin-Tsai models are used to characterize mechanical qualities, whereas Schapery models are used to characterize thermal properties. The microplate's non-linear strain is first calculated by calculating the plate shear deformation and using the Green-Lagrange tensor and von Karman assumptions. Then the elements of the Couple and Cauchy stress tensors using the Modified Coupled Stress Theory (MCST) are derived. Next, using the Hamilton Principle, the microplate's governing equations and associated boundary conditions are calculated. The nonlinear differential equations are linearized by utilizing auxiliary variables in the nonlinear solution by applying the Frechet approach. The linearized equations are rectified via an iterative loop to precisely solve the problem. For this, the Differential Quadrature Method (DQM) is utilized, and the outcomes are shown for the basic support boundary condition. To ascertain the maximum values of microplate deflection for a range of circumstances-such as skew angles, volume fractions, configurations, temperatures, and length scales-a parametric analysis is carried out. To shed light on how the microplate behaves in these various circumstances, the resulting results are analyzed.

The purpose of this study was to criticize (through available documents) the lecture in English at colleges. It is necessary that a study of English is emphasized in the era of internationalization. But, the indiscreet extension of lecture in English without consideration of the purpose, principle, and philosophy of college's education needs reflective thinking. This study criticized four dimensions, in other words the effectiveness of lecture in English, criteria of internationalization and college's competition of lecture in English, social inequality of lecture in English, and the harmfulness in the value of Korean language of lecture in English. First, most researches expressed the indiscreet extension of lecture in English was not effective in both students and professors. Second, many scholars and agencies on the internationalization and college's competition excluded the lecture in English as criteria. Third, the indiscreet extension of lecture in English had the possibility of social inequality. And fourth, the indiscreet extension of lecture in English had harmfulness in the value of Korean language and Korean's thought. College's education is an ivory tower in society. So, colleges should discard the thought that extension of lecture in English is the best way. Colleges should keep the purpose, principle, and philosophy of college's education.
