A Study on the Principle of Equilibrium in Standard Terms Contract in European Law (유럽법제에서 형평성 원칙에 따른 표준계약조건의 유효성에 관한 소고)

  • In English Law it seems that it is essential to apply the principle of equilibrium in the contract, however, it does not seemed to apply as the general rule of the principle of contract. Especially it seems that English Court didn't pay attention to the principle of equilibrium in 18th century. If one of the party do not appeal the equilibrium of the contract, it does not make any difference even today. However the Court may cancel or withdraw the construction of contract between the parties where the principle of equilibrium is damaged by fundamental problems like just-price. In French Law it seems that they have more wide definition of the principle of equilibrium. The French Court may consider that the application of good faith is the performance of condition of the contract between the parties and has no power to relieve of one party of his expressed obligations or warranty. In German Law, it seems that the principle of good faith is fundamental to take into account interest of the parties. They may agree to supply information or not to interfere with a commercial agent regarding performance and maintenance of the contract.

  • The aim of this paper is to establish variational principle on cone metric spaces and to give some existence theorems of solutions for equilibrium problems on cone metric spaces. We give some equivalences of an existence theorem of solutions for equilibrium problems on cone metric spaces.

  • In this paper, we introduce and analyze a new class of generalized mixed equilibrium-like problems. By using the auxiliary principle technique, we suggest three iterative algorithms for the generalized mixed equilibrium-like problem. Under certain conditions, we establish the convergence of the iterative algorithms. Our results extend, improve and unify several known results in this field.

  • Cooperation among network users would be possible in a near future, as real time communication between them can be available by telematics. This implies that non-cooperative assumption like Wardrop's principle, which has been widely used so far in network modelling may not be appropriate for route choice problem. So a new principle requires for describing such cooperative case. This paper presents a criterion, which represents cooperative route choice behaviour among network users. With some examples, we compare the non-cooperative principle and the cooperative one presented in this paper. Numerical results from the examples show that the new principle would be better than the existing one.

  • In this works, we consider a class of regularized equilibrium problems in Banach spaces. By using the auxiliary principle techniques to suggest some iterative schemes for regularized equilibrium problems and proved the convergence of these iterative methods required either pseudoaccretivity or partially relaxed strongly accretivity.

  • This study is a generalization of 'stable dynamics' recently suggested by Nesterov and de Palma[29]. Stable dynamics is a new model which describes and provides a stable state of congestion in urban transportation networks. In comparison with user equilibrium model that is common in analyzing transportation networks, stable dynamics requires few parameters and is coincident with intuitions and observations on the congestion. Therefore it is expected to be an useful analysis tool for transportation planners. An equilibrium in stable dynamics needs only maximum flow in each arc and Wardrop[33] Principle. In this study, we generalize the stable dynamics into the model with multiple traffic classes. We classify the traffic into the types of vehicle such as cars, buses and trucks. Driving behaviors classified by age, sex and income-level can also be classes. We develop an equilibrium with multiple traffic classes. We can find the equilibrium by solving the well-known network problem, multicommodity minimum cost network flow problem.

REGULARIZED MIXED QUASI EQUILIBRIUM PROBLEMS

  • In this paper, we introduce and study a new class of equilibrium problems, known as regularized mixed quasi equilibrium problems. We use the auxiliary principle technique to suggest and analyze some iterative schemes for regularized equilibrium problems. We prove that the convergence of these iterative methods requires either pseudomonotonicity or partially relaxed strongly monotonicity. Our proofs of convergence are very simple. As special cases, we obtain earlier results for solving equilibrium problems and variational inequalities involving the convex sets.

Location Value and Price Leadership in a Product Differentiation Model

  • This paper considers the value of location in a linear city model and examines the product differentiation equilibrium of duopoly providing different benefits to consumers. We show that if the value of location is small, symmetric location equilibrium occurs where two firms follow the maximal differentiation principle. However, as the value of location increases, asymmetric location equilibrium occurs where the low-value-location firm moves to the high-value-location firm and thus adjusted maximal differentiation principle holds. We also investigate two different price leadership model and demonstrate the relationship between the value of location and the role of price leadership. In particular, we show that when the location value is high, the price leadership by high-value-location firm will appear as a unique equilibrium.

  • In Lagrangian mechanics, attention is directed at the body as it moves through space. Each body point is identified by the position it would have if the body were to occupy an arbitrary reference configuration. A result of this approach is that the analyst often describes the body by using quantities that may involve more than one configuration. This is particularly common in incremental calculations and in changes of the choice of reference configuration. With the rise of very powerful computing machinery, the popularity of numerical calculation has become great. Unfortunately, the mechanical theory has been evolved in a piecemeal fashion so that it has become a conglomeration of differently developed patches. The current work presents a unified development of the equilibrium principle. The starting point is the conservation of momentum. All details of configuration are shown. Finally, full dynamic and static forms are presented for total and incremental work.

  • The network equilibrium theory is to estimate the travel choices on a transportation network when the resulting travel times and costs are one basis for the choices. Increasing use of this principle on travel assignment problem lead to develop the combined choice models including not only travel options such as mode and route, but location options like trip distribution problems. This paper, first, reviews earlier developments of variable demand network equilibrium models, combined modeles of trip distribution and assignment, and entropy constrained combined models. Then various model structures of combining travel choice models based on network equilibrium theory and entropy constraints are discussed.
