신용장개설은행(信用狀開設銀行)의 서류검토기준(書類檢討基準)에 관한 연구(硏究) (A Study on the Standard of Document Examination for Letters of Credit Issuing Bank)

  • The letter of credit is quintessentially international. In the absence of international legal system, a private system based on banking practices has evolved, commanding the adherence of the international letter of credit community and providing the foundation of th reputation of this instrument. To maintain this international system, it is vital that international standard banking practice should not be subject to local interpretations that misconstrue or distort it. The UCP is a formulation of international standard banking practice. It is neither positive law nor a "contract term" in any traditional sense and its interpretation must be consonant with its character as a living repositary of international understanding in this field. As a result, the interpretation and application of specific articles of the UCP must be consistent with its evolving character and history and with the principles upon which sound letter of credit practice is predicated. This study, especially, focuses on article 13 of the UCP500 and 95UCC 5-108. Both articles introduce a standard of document examination to be used by banks to determine whether they comply facially with the terms of the credit. While, in the UCP, this standard is called international standard banking practices, in the UCC, this standard is called standard practices. I think that both standards are not same. Thus, first, this study look for categories of both standards and scope of application. the second subject is how can issuing bank act in the face of non-documentary condtion under this standard of document examination. Third is correlation between the principle of Strice Compliance and the standard.

  • International transactions have the threat of non-payment by the buyer or non-performance by the seller. Parties tend to search for additional means of securing performance and payment beyond the mere agreement in the contract. Such security may be achieved by means of a letter of credit. When contracting parties have agreed to pay by means of a letter of credit, the buyer's bank takes upon itself the obligation to pay the purchase price when the seller tenders the documents that are stipulated in the letter of credit. The documents must comply strictly with the terms of the credit.. The documents play a crucial role in letter of credit transaction. The principles of abstraction, separability and strict compliance governing the letter of credit transaction are considered. The concept of fundamental breach of Article 25 CISG was discussed. This article examines whether a failure to deliver documents conforming to the terms of the letter of credit can constitute a fundamental breach of the sales contract as defined by Article 25 of the CISG by the seller and thereby enable the buyer to avoid the contract. For letter of credit transactions it should be accepted that the delivery of non-performing documents constitutes a fundamental breach, if the result of this breach is that the bank refuses to pay the price for the goods. On the other hand, in the interpretation of Article 25 CISG, it should be noted that if the parties have agreed to payment by means of a letter of credit, they have simultaneously agreed to apply the strict compliance principle to the delivery of documents in the sales contract. Finally the parties should ensure that inconsistency between the requirements under the documentary credit and the requirements under the contract of sale is avoided, since the buyer may be in breach of his payment obligation if the seller cannot get paid under the documentary credit when his documents conform with the contract of sale.

국제거래에서 대금지급보증서(payment guarantee)의 주요 조항에 대한 연구 (A Study on Some Major Clauses of a Payment Guarantee in International Transactions)

  • While a performance type guarantee is required as a security for non-performance risk by a seller, a payment guarantee is used as a security for non-payment risk by a buyer(or a borrower in a loan agreement). A payment guarantee is a type of independent bank guarantee, bank guarantee, bond, demand guarantee, or standby letter of credit. A guarantor accepts a credit risk of a principal which is normally a buyer in a contract for sale of goods. A payment guarantee is independent of the underlying relationship between the applicant and the beneficiary. The guarantor is only empowered to examine the beneficiary's demand and determine the payment on its face to the terms of the guarantee. A payment guarantee is thus different from a suretyship. The principle of independence carries a significant advantages for a guarantor as well as for a beneficiary. While a documentary credit requires B/L, commercial invoice, packing list, inspection certificate, etc., a typical payment guarantee does not require any evidence for a seller's performance of the underlying contract other than written demand. In this respect payment guarnatee can be a more secured facility than a documentary credit. A payment guarantee normally comes into force from the issuing date and shall remain in effect until all sums guaranteed shall be paid in full by a buyer(or a borrower) or by a guarantor. Although a guarantor shall pay a demand made in accordance with the terms and conditions of the payment guarantee, a payment demand may be denied when it is determined to be abusive or unfair.

  • Residential architecture was a lot more changed due to adopting modern residential type since 1960s. But people in farm houses are still living in a space of their past life causing a discrepancy. For this reason, the paper will identify the changed use for farm houses focusing on their plane views, and reason for the changed use as well. The result of this paper is expected to play a role for practical data to reasonably change and re-model farm houses located in back of cities such as Hyunpoong area. Targeted area for this paper, in order to survey change in residential environment due to industrialization and modernization, has narrowed down to 42 farm houses which are located Yuga-Myun, Hyunpoong-Gun, Dalsung-Gun where tradition and modern characteristics are harmonized being built before 1960s Researching relied on both documentary records and survey on the site, and survey on documentary records was performed in a way that preceding research for changed use of residential area was to be compared with people's farm houses in Kyeongsang-Do area, and survey on the site was carried out by photographing and land surveying and interview and analysis for them, and finally we acquired the result by analyzing use of interior for houses and plane view and relations between culture and social environment. From the result of this paper, there was a trend that farm houses had been improved function of a specific space by enlarging space and enlarged construction for inner rooms. And among spaces, kitchen and bath room was mostly enlarged its left side, and inner room had mostly enlarged its rear side, and kitchen was frequently enlarged in its side space. These kinds of variation in space is believed to be result of change of life style and house facilities

월정교의 복원적 고찰 (Restoration Study of Woljeong-gyo)

  • According to documentary records Woljeong-gyo(stone bridge) is built in 760(Silla the 35th King Gyeongdeok 19) and used as original function until 1280(Goryeo the 25th King Chungryeol 6) as Chunyang-gyo. But in those days "Donggyeongjapgi" was published in 1669(Joseon Hyeonjong 10) we assume that it was lost its original function. There are four pier in the type of a ship with the same distance in the middle of river. We can see it is the site of bridge as parts of stonework of bridge are remained. In 1975 the abutments and piers are surveyed and in 1984 stone investigation twice and excavation three times which were to plan restoration were done. Now the restoration of abutments both ends are worked. For restoration of Woljeong-gyo studied documentary records and excavation recoeds were collected and examined. It helped to see the bridge in southern China twice to restore the bridge. Unearthed articles such as yeonham(a kind of member to support roof tiles) and giwa(roof tile) gave decisive clues to assume upper structure of the bridge and from Chinese bridges are helped to type of the bridge. It is certain Woljeong-gyo was ranggyo which means that upper structure was made with wooden members and the stone piers shaped of a ship below and near the abutments both ends another buildings were. Youngjocheok(the architectural measure) of this bridge is similar to gokcheok(the metal measure, 301.84mm) used now that the length of piers is 46choek(尺), the width of that is 9choek(尺), the length between two piers is 42choek(尺), the length between abutment and pier is 38choek(尺). Also we can see that entirely the length of the bridge is 210choek(尺), width is 40choek(尺).

소련 초기의 기록관리제도와 그 변화 (The Organization of the Archival Systems and Their Transformations in the first period of the Soviet UnionAn Essay for Reconstruction on the Classification System of Government-General of Chosun)

  • This paper aims to research the historical development of the archival systems in the Soviet Union from 1917 to the 1920's. The Russian revolution was the turning point not only for the political and social changes but for the archival administration in Russia, as it provided the new Soviet regime with the chances to reorganize the archival institutions under Bolshevik rule. However, we must not forget the fact that the Russian Archival Workers' Union had taken part in the organization of the archival systems together with the Bolshevik revolutionaries. The Soviet government intended to transform the decentralized and poorly organized archival systems in the prerevolutionary years into the centralized and bureaucratized ones. In this meaning, the decree signed be V. I. Lenin on 1 June 1918 was estimated as the real basis for the Soviet archival centralization. Lenin's archival decree of 1918 encompassed the entire national documentary legacy, which was gradually extended to all types and categories of manuscripts and archival records by successive legislation. The concept of state proprietorship of all documentary records was designated "Single State Archival Fond"(Edinyi Gosudarstvennyi arkhivnyi fond), which was renamed as "Archival Fond of the Russian Federation" after the collapse of the USSR. The independent state administrative agency, that is, "Main Administration of Archival Affairs"(Glavnoe upravlenie arkhivnym delom) was charged with the management of the entire "Single State Archival Fond". While the Soviet Union reorganized its archival systems in the twenties, the archival institutions became under the severe control of the government. For example, M. N. Pokrovskii, the well-known Marxist historian and the political leader, headed the organizational work of archives in the Soviet Union, which resulted in the exclusion of the prerevolutionary specialists from the archival field in the Soviet Union. However, the discussions over the concept of "the Archival Fond" by B. I. Anfilov helped to develop the archival theories in the USSR in the twenties. In conclusion, the Soviet Union, having emphasized the centralization of the archives, developed its archival systems from the early period, which were the basis of the systematic archival institutions in Russia.

  • 본 연구는 글로벌 콘텐츠에 나타난 AI 윤리의 문제적 상황을 진단하고, 인간의 정체성을 강화하기 위한 담론이 무엇인지를 파악하고자 했다. 연구 진행을 위해 넷플릭스(Netflix) 오리지널 콘텐츠 <소셜딜레마>(The Social Dilemma)를 분석대상으로 선정했다. 연구방법은 서사분석을 채택했다. 분석결과 <소셜딜레마>는 전통적인 시사 다큐멘터리 구조를 보였으며, 이야기 전개를 위해 주로 전문가와 통계자료를 활용한 것으로 확인되었다. 미얀마 학살 사건, 가짜뉴스 전파 등 국내외 사례를 열거하며 콘텐츠 핵심 주장을 강화하기도 했다. 인물의 관계에서는 개발자와 미디어 기업, 이용자와 광고주 사이의 이항대립이 명확하게 드러났다. 해결책으로는 기업에 대한 강력한 규제와 소셜미디어의 이용 중단을 주장했다. 하지만, <소셜딜레마>는 AI 기술의 오남용을 지적하는 수준에 머무르며, 인간 고유의 정체성과 사회적 관계를 외면하는 서사를 구성했다. 이러한 결과는 AI 시대를 맞아 인간의 사회성과 관계성, 학습 능력의 중요성을 강조하는 콘텐츠의 필요성을 제기한다.

  • The purpose of this study is to figure out the plans to improve business in Hotel French restaurants. This study conducts documentary study and empirical study. To achieve the purpose, a survey was conducted by 172 staffs of Hotel French restaurants in Seoul. The result of this research is as follows. Hotel restaurant operators recognize the importance of promotion and development of new sales goods. But they haven't done long-term marketing directions focusing on cost-saving and ephemeral sales promotion effects. Hotel restaurants should establish public information strategies uniformly and look for the plans that offer customers adequate information. Also, they should make a differentiation strategy within the same industry, can always give recency to customers, and enhance the event-connecting promotion menu and business activation.

  • Japan is an advanced Asian country with a young, visual and stimulating culture that fascinates even western countries. The aim of this article was to provide an in-depth understanding of youth subculture as a medium of interpreting contemporary Japanese society and fashion, and understanding the values of Japanese youths today. The study of Japanese culture, youth culture, and Japanese youth subcultures of the 2000s and their clothing styles are based on documentary research and internet research, including a wide range of books and dissertations, and English, Korean and Japanese websites. It studies the unique youth subcultures of the country from the perspective of a Korean researcher who lives in a more fashion-conservative neighbouring country.

Design Evolution and Spatial Composition of Schindler's Demolished Cabin for Mr. and Mrs. Popenoe of 1922 at Coachella, California

  • A cabin for Mr. and Mrs. Popenoe of 1922 was designed by the eminent Los Angeles architect, Rudolph M. Schindler. It stands out as an early exemplar of Schindler's most notable work in its unique employment of compositional strategy. Unfortunately, the cabin was demolished before an in-depth research was executed. In addition, there remains no documentary record with regard to the construction process, structural details and the use of materials of the built cabin. However, a set of drawings of the house are housed in the Schindler Archive. Reworking drawings and fabricating a scale model based on the materials obtained from the Archive, this article first depicts the evolution of the design, and then, attempts to investigate underlying principles governing the spatial composition of the cabin.
