Since the internet is open to public in 1990, electronic commerce(EC) user has increase rapidly. Now EC is considered not only as communication method but also as new economical activities. EC is a kind of new commerce model which uses electronic means. And EC has global characteristics so that many country's legislation which regulates it differently makes an obstacle to vital of EC. The purpose of this study is to examine legal problems of internet electronic commerce. First, there are some legal problems whether electronic document has same legal function like traditional documents. Second, electronic signature must has authenticity, integrity, non-repudiation, writing and confidentiality in order to use looks like common signature. Finally, electronic contract is concluded on principle of mutual agreement. It is apparent that the concept of arrival is applied to the date and place in conclusion of electronic contract.

IT outsourcing studies have centered on the separate effect of formal contract and relational trust on IT outsourcing performance. In addition, previous studies ignored the importance of the relational capability that combine the formal contract and partnership can be able to deliver IT outsourcing effects. In this paper, we propose an IT governance commitment as a mediated role between relational capability and IT outsourcing performance. We collected data from 143 client companies of IT outsourcing and analyzed it using the PLS method. Our findings are revealed as following: At first, relational capability significantly and directly influence IT governance commitment as well as indirectly through formal contract and partnership. Secondly, IT governance commitment mediate between relational capability and IT outsourcing effect, and in turn affect IT outsourcing performance. The results and implications are further discussed.

The study suggests a contract model of application operation through case study of A bank's IT outsourcing application contract based on workload. The IT outsourcing order form has a problem in that the scope of work is ambiguous due to the integration of operation and maintenance. In this study, application operation and maintenance were separated by referring to application operation history provided in ISO/IEC15504-5 standard. The scope of the IT outsourcing service was clarified by organizing the definition and detail activities of the application operation business. Application operation contract method has generally applied estimation method by the number of input manpower and period by agreement between buyer and client. As there is no activity to calculate the number of input manpower based on the operational work history and based on the standard workload per activity. In this case is not guaranteed due to the simple agreement between the contractors. In this paper, we propose an application operating cost estimation model that measures the size of the operating software using function point analysis that is the basis of application operation tasks. In order to verify the validity of the application operation cost model, we verified the correlation between the application size and the labor cost through regression analysis using SPSS.

The business market of architecture has got a system that controls a deposit according to the price function. This system is written on a law of contract about countries. So the main body of construction has to make a reasonable contract. This study is written about a rate of numerical index on controling a deposit. We tried to fine problems and solutions of labor expenses, instrument costs and material costs which is so big and changable on the construction market Labor expenses are expressed according to the rate of construction scale between direct and indirect cost that applies ability of works. Instrument costs are expressed according to an output method of a unit price annually and a weight allowance of local instrument conditions and use frequence. The last material costs expressed according to a local weight allowance make a decision of the material cost index. They applies locally relative index more than absolute one on what uses the price rate of producers and importations. This solutions are not enough to apply to the real market, so it needs to exam and to be on the market after a feasibility study.

건설공사의 계약 이후에 발생하는 물가변동에 의한 계약금액의 조정방법으로 지수조정율 방식이 널리 활용되어 왔다. 그러나 지수조정율에 의한 방식에 사용되는 생산자물가지수는 건설공사의 특성이 반영되지 않은 범용적인 지수이기 때문에 실제 건설공사의 물가변동에 대한 설명력이 매우 부족하다. 이에 본 연구에서는 기존의 지수조정율에 의한 계약금액 조정방식의 문제점을 활용 지수측면에서 규명하고, 건설사업의 특성을 반영할 수 있는 건설공사비지수의 활용을 통하여 이러한 문제점을 개선하고자 하였으며, 사례연구를 통하여 그 효용성을 검증하였다.

The eventual goal of this paper is to help the generating companies and load-serving entities to choose appropriate relative levels of interconnected system versus bilateral trades while considering risk, and economic performance. In competitive power markets, electricity prices are determined by balance between demand and supply in electric power exchanges or bilateral contracts. The problem formulation is bilateral contract incorporated into Multi-area unit commitment with import/export and tie-line constraints. This proposed method considers maximizing own profit or minimize the operating cost among the generating companies in multi-area system. The feasibility of the proposed algorithm has been demonstrated using IEEE system with four areas and experimental results shows that proposed method is reliable, fast and computationally efficient

A Contract of marine insurance is a contract whereby the insurer undertakes to indemnity the assurd, in manner and to the extent thereby agreed, against marine losses that is to say, the losses incident to marine adventure. But the matter is that whether the problem of increased risk in insurance law should be understood by matching to nay state under general principle of contract law and whether that we should give any effect is more proper to the original object of the system. For this, it is understood that it is a case to be applied a "clausula rebus sic stantibus" in general today, but it is regarded as the matter that whether "clausula rebus sic stantibs" is charging any position in change of risk and whether we should understood the concept of the risk on the substance of the risk. Accordingly the recognition for the problem like this, study should examine closely into whether any system for the effect of increase in change of risk is more proper and rational system provide the supplementing points through our principle of insurance law and the study by comparing method.by comparing method.

Purpose : This paper reviews on the method of PNF stretching. Methods : This is literature study with Pubmed, medline, SPORT Discus, EBSCO, ProQuest and books. Results : PNF stretching is effective for increasing range of motion than static and ballistic stretching. CR(contract-relax) technique is effective and CRAC(contract-relax with agonist contraction) technique including agonist contraction is more effective. A minimum of one repetition, twice or three times per week is required for range of motion gains, needs to be conducted continueously. A minimum of 20% contraction intensity and more than 3 seconds contraction duration are needed to increase range of motion. Inclusion of static stretching of antagonist and agonist contraction is more effective. Conclusions : PNF stretching is more effective for increasing range of motion than other stretching methods, but, clinicians need to select proper techniques according to subjects and muscles, and conduct carefully when applying technique.

Bidding and contract systems are used for public construction projects to select contractors following fair competition principles and to execute national budgets effectively. Many challenges have arisen due to a lack of transparency and fairness and because bidding practices have been luck-based. Few comprehensive or comparative analyses have been conducted on the performance and limitations of bidding and contract systems, and empirical analyses designed to improve policies on and the practice of such systems are lacking. This study empirically analyzed current bidding and contract systems to seek ways of improving them. The study proposes several alternatives to resolve the problems with and irrationalities of the current system: 1) improving bidding and selection systems by changing them from a luck-based price competition into a technical merit- and value-based competition; 2) improving the assessment criteria to meet the current market level of bid and winning prices; 3) adjusting contractual responsibilities and sharing structures to meet the current trend; and 4) strengthening the competitiveness and expanding the social responsibility-based procurement systems of construction companies.

본 연구는 목적은 DACUM에 기반하여 소프트웨어 개발 및 구현 직군 계약학과 교육체계를 현장중심적으로 개발하는 데 있다. 국가직무능력표준을 토대로 계약학과로 개설할 직무의 모형을 설정하고, 교육 필요점 분석 및 적절한 교육방법을 조사하였으며, 핵심 과업별 지식, 기술, 태도를 도출하고 이를 유목화 하여 체계적 현장직무 교육훈련(S-OJT)교과목을 구성하고, 직무 전문가가 설정한 경력 경로에 따라 교과목을 위계화 하였다. 또한, 개발된 교과목을 기존의 교육과정과 연계시켜 소프트웨어 개발 및 구현 직군 계약학과 교육체계를 수립하였다. 본 연구결과를 토대로 현장에 적합한 계약학과 교육체계가 개발되기 위해서 추가적으로 검토되어야 할 사항을 제시하였다.
