Public Policy Exception under Russian Law as a Ground for Refusing Recognition and Enforcement of Foreign Arbitral Awards

  • This paper studies legal regulation of the public policy exception in the Russian Federation and domestic judicial practice on the issue. It reviews current legislation and analyzes a number of recent court cases where an arbitral award rendered by a foreign arbitration body was refused recognition and enforcement based on public policy violation. By doing so, it contributes to the knowledge on the concept of public policy in the Russian legal system and how public policy can affect the process of recognition and enforcement of foreign arbitral awards on its territory. The review of court cases demonstrates different aspects of how the public policy exception can be applied by Russian arbitrazh courts. Such decisions can provide a clearer picture of the kinds of situation that can lead to invoking the public policy clause by the court. Also, it is of practical value as persons preparing to file a claim or to be a defendant in a Russian court can be required to present existing court decisions in support of their claim or defence.

Health Behavior and Attitude of Residents toward the National Health Promotion Law in Kyungsan City (지역주민과 건강행태와 국민건강증진법에 대한 인식과 태도)

  • In order to ascertain the attitudes of residents to their health and the National Health Promotion Law, surveyors interviewed 1,220 subjects, 1% of men and women in Kyungsan city, who were twenty-year-old or more. The major findings are as follows: Men and women were 48.2% and 51.8%, respectively. The recognition rate of enacting and enforcing this law is 59.2% of men and 51.3% of women. With regard to the behavioral attitude to the health in the distinction of sex and age, current smokers are 31.2% of the interviewees, 61.6% of the men and 3.3% of the women. Current drinkers are 35.1%, 59.5% of the men and 12.3% of the women, but on the other hand there is little significance in the distinction of age. The acknowledgement proportion of enacting and enforcing this law is 59.2% of male and 51.3% of female. In terms of the recognition rate of the contents according to the general characteristics of interviewees, it appears that the indication of a warning expression on a packing paper of cigarette case and a liquor bottle is 92.4% and also the designation of a smoking free area in public facilities is 94.8%. Prohibition of cigarette-sale to the teenagers who are under 19, is 96.0%. Considering these facts, the recognition rate is high. On the contrary, 48.8% is accounted for encouraging a medical check-up before marriage which is in a low position. As a result of multiple behavior as a independent educational level, marital significant variables. In case of having undergone a periodic medical examination the recognition rate was high whereas frequent exercise led to the low recognition rate. Concerning the details of the undertaking in accordance with each factor of general characteristics, the greater part of them have been appraised successfully whether it is recognized or not. On the other side, no effect got answered about the result of the undertaking subjects to general and peculiar behavior attitude towards health was in effect or not. A great majority approved of more reinforcement of legal regulation about smoking and drinking regardless of whether they perceived the details of the law of promotion of National Health Promotion Law or not. Additionally there was significant difference in reinforcing legal regulation of smoking and drinking in compliance with the attitude of the substance of this law. With regard to education, public relations and evaluation about national health through public health centers by our government, the younger and the higher in education they are, the more deficient they feel. First of all, those who were aware of the enforcement of this law as well as plenty of scarcity answered that better service of disease prevention had to be expanded than ever. In consideration of the above-stated results, the education to public health and the business of public relations should be reinforced and a practical campaign for health life should also spread out for the purpose of encouraging to practise healthy life-style.

  • The diversity of RNA functions ranges from storage and propagation of genetic information to enzymatic activity during RNA processing and protein synthesis. This diversity of functions requires an equally diverse arrays of structures, and, very often, the formation of functional RNA-protein complexes. Recognition of specific RNA signals by RNA-binding proteins is central to all aspects of post-transcriptional regulation of gene expression. We will describe how NMR is being used to understand at the atomic level how these important biological processes occur.

  • This study examines and analyzes view hindrance factors of high-storied apartment houses at small town like 'Eup' where county office locates and it is found that hindrance factors include designation of residential area and height, length and form of main building. On recognition of view, most subjects of research considered high-storied apartment houses hindered urban view and its regulation is needed. Apartment houses at small cities become main factors of hindering urban view because they were located randomly regardless of scale of city and surrounding situation, but there is no measure to control it. Accordingly, view control through enaction of regulations is urgently needed with establishment of guidelines such as height of large buildings including high-storied apartment houses, length of main building, location and regulation of exterior design.

Positive and negative regulation of the Drosophila immune response

  • Insects mount a robust innate immune response against a wide array of microbial pathogens. The hallmark of the Drosophila humoral immune response is the rapid production of anti-microbial peptides in the fat body and their release into the circulation. Two recognition and signaling cascades regulate expression of these antimicrobial peptide genes. The Toll pathway is activated by fungal and many Gram-positive bacterial infections, whereas the immune deficiency (IMD) pathway responds to Gram-negative bacteria. Recent work has shown that the intensity and duration of the Drosophila immune response is tightly regulated. As in mammals, hyperactivated immune responses are detrimental, and the proper down-modulation of immunity is critical for protective immunity and health. In order to keep the immune response properly modulated, the Toll and IMD pathways are controlled at multiple levels by a series of negative regulators. In this review, we focus on recent advances identifying and characterizing the negative regulators of these pathways.

Emerging role of transient receptor potential (TRP) channels in cancer progression

  • Transient receptor potential (TRP) channels comprise a diverse family of ion channels, the majority of which are calcium permeable and show sophisticated regulatory patterns in response to various environmental cues. Early studies led to the recognition of TRP channels as environmental and chemical sensors. Later studies revealed that TRP channels mediated the regulation of intracellular calcium. Mutations in TRP channel genes result in abnormal regulation of TRP channel function or expression, and interfere with normal spatial and temporal patterns of intracellular local Ca2+ distribution. The resulting dysregulation of multiple downstream effectors, depending on Ca2+ homeostasis, is associated with hallmarks of cancer pathophysiology, including enhanced proliferation, survival and invasion of cancer cells. These findings indicate that TRP channels affect multiple events that control cellular fate and play a key role in cancer progression. This review discusses the accumulating evidence supporting the role of TRP channels in tumorigenesis, with emphasis on prostate cancer.

Detection, modulation, and transmission of sweet taste in regulation for energy homeostasis

  • Perception of sweet compounds is important for animals to detect external carbohydrate source of calories and plays a crucial role in feeding behavior of animals. Recent progress in molecular genetic studies provides evidence for a candidate receptor (heterodimers with taste receptor type 1 member 2 and 3: T1R2/T1R3), and major downstream transduction molecules required for sweet taste signaling. Several studies demonstrated that the sweet taste signal can be modulated by a satiety hormone, leptin, through its receptors expressed in a subset of sweet-sensitive taste cells. Increase of internal energy storage in the adipose tissue leads to increase in the plasma leptin level which can reduce activities of sweet-sensitive cells. In human, thus, diurnal variation of plasma leptin level parallels variation of taste recognition thresholds for sweet compounds. This leptin modulation of sweet taste sensitivity may influence individuals' preference, ingestive behavior, and absorption of nutrients, thereby plays important roles in regulation of energy homeostasis.

  • District unit plan was arranged for rational induction and regulation of development due to increase of demand for comfortable environment and change of recognition of urban view. This study analyzes cases of district unit plan since 2003 and draws the following conclusions to provide basic material necessary for landscape impact assessment and analysis of actual conditions. It used regulation of design factors and analysis of physical index in making view plan and focuses on characteristics of visual perception in predicting impact through simulation. Future landscape impact assessment must establish a variety of indices and application of various techniques.

  • At the choice of aviation company, safety appears as biggest variable than expenses, speed and comfort so these are concerned not only aviation companies but also countries and customers. Until now, ICAO has been making effort to reduce the flight accident through the safety advice of aviation part, establishment of standard, education, training and develop of navigation aids. Especially in 2008, they emphasize that the flight accident is reduced through researches and applications about SMS as safety regulation. Important primary factor to give influence about promotion of SMS is practice of organization and for this, to investigate recognition about safety management and culture of members. At point of this, this research analyze the recognition degree about how to manage safety and SMS for pilots an mechanics of Korea.

A Study on Differences in Perception of Export Disruption Factors by Characteristics of Small and Medium Export Companies (중소수출기업의 특성에 따른 수출 활성화 저해요인 인식차이에 관한 연구)

  • Exports play an important role in Korea's economy and industry. Korea's share in world trade is also increasing. Governments and trade organizations are making great efforts to promote exports. However, since SMEs lack resources of enterprises, SMEs have a lot of difficulties in increasing exports compared to large enterprises. For this reason, in this study, we analyzed the difference of perception of export difficulties according to characteristics of small and medium export companies. As a result, four factors such as overseas market information, price and cost, competitiveness and regulation of importing country were derived. In addition, we investigated the differences in recognition of export difficulties by the stage of growth of company, period of export, products exported, export department, size of company. There was a significant difference in recognition. Especially, The companies which are the early stages of growth, short export period, finished product, the smaller the size of exports companies are more difficult in export difficulties.
