Legal Issues on the Franchise Disputes and their Settlement by Arbitration (가맹계약분쟁과 중재에 관한 법적 문제)

  • Ever since franchising emerged in the industry of distribution, it has been growing explosively in the U.S.A. and all other countries as well. It is a method of expanding a business by licensing independent businessman to sell the franchiser's products and/or services or to follow a format and trade style created by the franchiser using the franchiser's trade marks and trade names. Franchising is a form of business that touches upon many different areas of law including, but not limited to, general contract law, general principles of commercial law, law of intellectual property, competition law, fair trade practices law and other industry specific laws e.g., the Fair Practices in Franchising Act in Korea. Arbitration is a long established, legally recognized procedure for submitting disputes to an outside person(s), mutually selected by the parties, for a final and binding decision. Despite its merits as an alternative dispute resolution, it has been criticized, on the other hand, particularly by franchisees' attorneys on the ground that even though it is required to protect the franchisees against the enforcement of pre-dispute arbitration agreements because of the franchisees' paucity of bargaining power vis-a-vis the franchiser, arbitration cannot afford it. Until recently, however, little has been written about the legal issues pertaining to franchise agreement and arbitration clause contained therein in Korea. This treatise reviews the cases and arguments in relation to the subject especially of the U.S.A., which have been accumulated for decades. The issues addressed herein are the pre-emption by the FAA, the disputes to be arbitrated, the selection and qualification of arbitrators, the place of arbitration hearings and the evidentiary rules applicable, the expenses of arbitration, theory of fiduciary duty and the like, all of which are relevant to franchise agreement.

The Study of Surface Plasmonic Bands Using Block Copolymer Nanopatterns (블록공중합체 나노패턴을 이용한 표면 플라즈몬 연구)

  • It is important to develop a simple method oftuning localized surface plasmon resonance(LSPR) properties, due to their numerous applications. In addition, the careful examination of the shape, size and combination of metal nanoparticles is useful for understanding the relation between the LSPR properties and metal nanostructures. This article describes the dependence of theLSPR properties on the arrays of metal nanoparticles obtained from a block copolymer(BCP) micellar thin film. Firstly, two different Au nanostructures, having a dot and ring shape, were fabricated using conventional block copolymer micelle lithography. Then, Ag was plated on the Au nanostructures through the silver mirror reaction technique to obtain Au/Ag bimetallic nanostructures. During the production of these metallic nanostructures, the processing factors, such as the pre-treatment by ethanol, silver mirror reaction time and removal or not of the BCP, were varied. Once the Au nanoparticles were synthesized, Ag was properly plated on the Au, providing two distinguishable characteristic plasmonic bands at around 525nm for Au and around 420nm for Ag, as confirmed bythe UV-vis measurements. However, when a small amount of Au seed nanoparticles, which accelerate the Ag plating speed,was formed by usinga block copolymer with a relatively highmolecular weight, all of the Au surfaces were fully covered by Ag during the silver mirror reaction, showing only the characteristic peak for Ag at around 420nm. The Ag plating technique on Au nanoparticles pre-synthesized from a block copolymer is useful to study the LSPR properties carefully.

Comparison of Characteristics of Ketapang and Gallnut for Development of Environmentally Friendly Black Dye (친환경 검정색 염료 개발을 위한 Ketapang과 오배자의 특성 비교)

  • The purpose of this study was to develop environmentally friendly black dye by comparing Ketapang and Gallnut, that have been traditionally used as a black dye. As a result of FT-IR and UV-Vis spectrophotometer analysis, Ketapang was characterized by condensed tannin, while Gallnut showed hydrolyzable tannin. Due to the dyeability characteristic analysis, the color fastness of the non-mordant dye was slightly lowered to grades 1-3. In the dry-cleaning fastness test, both non-mordant and iron mordant were excellent, in grade 4-5, and the daylight fastness was excellent grade 3-5 too. The $L^*$ values of Ketapang were 26.93 (pre-mordant) and 29.39 (post-mordant), which were higher than those of Gallnut, 41.90 (pre-mordant) and 43.02 (post-mordant), indicating that Ketapang was more easily colored as a black dye than Gallnut.

  • Some minor carotenoid pigments, luteints, lutein monoester, torulene, $\gamma$-carotene, and 5,6-monoepoxy-$\alpha$-carotene-like have been separated and identified from the abdominal skin of Bombina Orientalis. Their structures have been established through the physical and chemical properties, VIS-UV and IR spectral characteristics, and chromatographic behaviors.

The Preparation of Multi-walled CNT-PMMA Nanocomposite

  • Multi-walled carbon nanotube-poly methyl methacrylate (MWNT/PMMA) nanocomposite has been prepared by in situ polymerization of MMA dispersed with MWNTs. The MWNTs were functionalized by nitric acid and sulfuric acid treatment, and this was confirmed by FTIR spectrometer. The solution mixture of MWNTs and MMA was partially polymerized at $80^{\circ}C$, followed by the addition of AIBN and polymerization at $50^{\circ}C$. The MWNT-PMMA composite was prepared by casting the pre-polymer on the glass plate, and the optical properties have been studied using UV-vis spectrometer. The acid treated MWNTs were well dispersed in MMA with fairly good dispersion stability, while flocculation and sedimentation was observed from raw MWNTs in MMA.

Number of sampling leaves for reflectance measurement of Chinese cabbage and kale

  • Objective of this study was to investigate effects of pre-processing method and number of sampling leaves on stability of the reflectance measurement for Chinese cabbage and kale leaves. Chinese cabbage and kale were transplanted and cultivated in a plant factory. Leaf samples of the kale and cabbage were collected at 4 weeks after transplanting of the seedlings. Spectra data were collected with an UV/VIS/NIR spectrometer in the wavelength region from 190 to 1130 nm. All leaves (mature and young leaves) were measured on 9 and 12 points in the blade part in the upper area for kale and cabbage leaves, respectively. To reduce the spectral noise, the raw spectral data were preprocessed by different methods: i) moving average, ii) Savitzky-Golay filter, iii) local regression using weighted linear least squares and a $1^{st}$ degree polynomial model (lowess), iv) local regression using weighted linear least squares and a $2^{nd}$ degree polynomial model (loess), v) a robust version of 'lowess', vi) a robust version of 'loess', with 7, 11, 15 smoothing points. Effects of number of sampling leaves were investigated by reflectance difference (RD) and cross-correlation (CC) methods. Results indicated that the contribution of the spectral data collected at 4 sampling leaves were good for both of the crops for reflectance measurement that does not change stability of measurement much. Furthermore, moving average method with 11 smoothing points was believed to provide reliable pre-processed data for further analysis.

Dyeing Properties and Color Characteristics of Silk Fabrics Dyed with Prunus yedoensis Matsumura Flower Extract (왕벚나무 꽃잎 추출물에 대한 견직물의 염색성과 색채특성)

  • This study was carried out to identify the optimum dyeing conditions for maximum dye uptake of Prunus yedoensis Matsumura flower extract on silk fabric and to investigate hue/tone characteristics and fastness properties of the dyed fabrics. As results, the flower extract was found to contain flavonoids by FT-IR and to show yellowish shade by UV-vis spectrum. Silk fabric was optimized for maximum dye uptake to five repetitions of dyeing at $80^{\circ}C$ for 60 min with an extract concentration of 600% owf in terms of both K/S and color differences. Pre-mordanting was more effective to dye uptake than post-mordanting for all of the mordants used. Un-mordanted and pre-mordanted fabric showed YR(Yellow Red) while most of post-mordanted ones did Y(Yellow). Main tones of dyed fabrics were sf(soft) and lt(light) in the case of unmordanting or Al-mordanting whereas they were d(dull) and g(grayish) by post-mordanting with Cu, Cr, and Fe, respectively. The fastness grades to rub and dry cleaning were reasonably good for most dyeing conditions while those to light were poor. Finally dyeing condition for each hue/tone of the dyed silk with the flower extract was optimized considering fastness properties.

Facile Synthesis of CdTe Nanorods from the Growth of Te Nanorods

  • One-dimensional CdTe nanorods (NRs) are obtained by the reaction of various Cd precursors with single crystalline Te nanorod templates, which are pre-synthesized from Te precursors by a simple and reproducible solvothermal method. Throughout the process, the diffraction intensity of different crystal facets of single crystalline Te NRs varied with reaction times. Finally, by alloying Cd ions along the axial direction of Te NRs, polycrystalline cubic phase CdTe NRs with diameters of 80-150 nm and length up to $1.2-2.4{\mu}m$ are obtained. The nucleation and growth processes of Te and CdTe NRs are discussed in details, and their properties are characterized by XRD, SEM, TEM, Raman scattering, and UV-vis absorption spectra. It was found that the key elements of synthesizing CdTe NRs such as reaction temperatures and Cd sources will strongly influence the final shape of CdTe NRs.

Optical Characteristics of Oxygen-doped ZnTe Thin Films Deposited by Magnetron Sputtering Method

  • ZnTe semiconductor is very attractive a material for optoelectronic devices in the visible green spectral region because of it has direct bandgap of 2.26 eV. The prototypes of ZnTe light emitting diodes (LEDs) have been reported [1], showing that their green emission peak closely matches the most sensitive region of the human eye. The optoelectronic properties of ZnTe:O film allow to expect a large optical gain in the intermediate emission band, which emission band lies about 0.4-0.6 eV below the conduction band of ZnTe [2]. So, the ZnTe system is useful for the production of high-efficiency multi-junction solar cells [2,3]. In this work, the ZnTe:O thin films were deposited on Al2O3 substrates by using the radio frequency magnetron sputtering system. Three sets of samples were prepared using argon and oxygen as the sputtering gas. The deposition chamber was pre-pumped down to a base pressure of 10-7 Torr before introducing gas. The deposition pressure was fixed at 10-3 Torr throughout this work. During the ZnTe deposition, the substrate temperature was 300 oC. The optical properties were also investigated by using the ultraviolte-visible (UV-Vis) spectrophotometer.

Study of Growth and Temperature Dependence of SnS Thin Films Using a Rapid Thermal Processing (황화급속열처리를 이용한 SnS 박막성장 및 온도의존성 연구)

  • We fabricated a tin sulfide (SnS) layer with Sn/Mo/glass layers followed by a RTP (rapid thermal processing), and studied the film growth and structural characteristics as a function of annealing temperature and time. The elemental sulfur (S) was cracked thermally and applied to form SnS polycrystalline film out of the Sn percursor at pre-determined pressures in the RTP tube. The sulfurization was done at the temperature from $200^{\circ}C$ to $500^{\circ}C$ for a time period of 10 to 40 min. At ${\leq}300^{\circ}C$, 20 min., p-type SnS thin films was grown and showed the best composition of at.% of [S]/[Sn] $${\sim_=}$$ 1 and [111] preferred orientation as investigated from using XRD (X-ray diffraction) analysis and EDS (energy dispersive spectroscopy) and SEM (scanning electron microscopy), and optical absorption by a UV-VIS spectrometer. In this paper, we report the details of growth characteristics of single phase SnS thin film as a function of annealing temperature and time associated with the pressure and ambient gas in the RTP tube.
