Rethinking OTT regulation based on the global OTT market trends and regulation cases (OTT 서비스의 유형과 주요국의 규제 정책에 대한 고찰)

  • Discussion on OTT regulation has become fiercer, as OTT services' impacts on the global and domestic media market have been exponentially growing. In South Korea, it is argued that, on the basis of the similarity between television program and OTT's video content, OTT needs to be regulated in order to protect fair competition and to control sociocultural effects. In many of the discussions, developed countries' cases have been used for supporting OTT regulation. In this paper, we first analyzed the global OTT market trends based on our own categorization of OTT services. then we assessed the validity of the application of the foreign cases in the current OTT regulation debates in Korea. We proposed six OTT types (aggregation, mediation, mediation-aggregation, multi-screen, outlet, and outlet-linear) simultaneously considering service operator' origin, business model, content format, and content delivery. These services have been consistently evolving, and the OTT market has been increasingly competitive especially around content differentiation. Regulators must be wary of hastily introducing competition regulation to the dynamically innovating OTT market. The foreign cases, including the US, EU, the UK, and Japan, hardly seem to be appropriate bases for strengthening OTT regulation. Rather, they were focused more on promoting competition in the domestic media market and enriching the content ecosystem. Therefore, we need to consider revision of the outdated media regulation frameworks instead of fitting OTT under them, and to recognize the priority of securing practical jurisdiction on global service providers before capturing local players into the conventional regulation systems.

  • Although the OTT industry is an area that needs urgent policy response as a priority area under the new industry regulatory reform master plan, various issues are occurring due to the lack of related institutional infrastructure. Therefore, this study aims to analyze the policy conflict structure in which regulatory obstacles and delays occur by listening to the opinions of major stakeholders and using the Q methodology to identify the regulatory innovation demand of the OTT industry. The analysis results are as follows. The analysis results are as follows. First, in the implementation of OTT-related policies, it is necessary to improve the standard system for the method of settlement of copyright fees. Second, it is required to improve the support method that can reduce the burden of OTT operators' fund. Third, it is necessary to supplement the system by changing the regulatory application method for potential regulatory issues related to zero-rating. This study can be utilized in the process of introducing a system in which various stakeholders are connected and developed in a complex manner in the process of regulatory innovation in new industries and services.

  • This paper illustrates not only the effectiveness of applying content quota system for on-demand video streaming platform, but also the effect of OTT regulation on copyright protection and cultural industry protection in a single market, focusing on the community's response to Netflix's entry into the EU market. Additionally, this paper examines on-demand video streaming services, growth of Netflix. The EU policy on the on-demand video streaming service market consists of 'portability' in the digital single market and content quota for copyright protection. In this paper, I analyze the market protection and the aspect of improving competitiveness of online streaming service industry. The EU is trying to protect the cultural industry and copyright protection in the region by applying and regulating the OTT business in content quota system, which has been applied only to European broadcasting companies.

A Study on the Displacement of Mobile OTT Video Services on Home TV (모바일 OTT 동영상 서비스 이용이 홈 TV 시청에 미치는 영향에 관한 연구)

  • This study examined whether mobile OTT video service substitutes home TV by using 3 screen data of Nielson-KoreanClick. According to the 2SLS estimation results, when the time spent on mobile OTT video service increased by 1% p, the time spent watching home TV decreased by 12.4%. The results also showed that 1%p increase in the time spent using YouTube app and the mobile OTT video services provided by telecommunication company(Oksusu, Alleh TV, VideoPortal) reduced the time spent on watching terrestrial channels on TV by 16.2% and 23.9%, respectively. The displacement of mobile OTT video service on home TV will be accelerated in the near future. In order to resolve the issue of regulatory unfairness with pay TV services and to safeguard viewer's interests, discussions to establish regulation for OTT video services should be taken place more quickly.

Enhancing Consumer Awareness and Privacy Protection in the Era of Over-the-Top(OTT) Services: Focused on Behavioral Information Collection and Personalized Content (OTT(Over The Top) 서비스 시대의 소비자 인식 및 개인정보 보호 강화: 행태정보 수집과 개인화 맞춤형 서비스를 중심으로)

  • This study investigates how consumers perceive the collection of behavioral information through 'cookies' on OTT platforms and the impact it has on personalized services. Through SPSS analysis on 120 consumers, which was conducted to examine four hypotheses, correlations were found between awareness of OTT companies' behavioral information collection and online tracking recognition, awareness and willingness to provide cookies, and the extent of confirming behavioral information collection terms during registration and online tracking recognition. The study concludes that consumer knowledge about behavioral information significantly influences the importance and intention to use personalized services, highlighting the need for regulatory measures by both companies and government entities.

A Criticism of Path Dependence in the Broadcasting Programming Regulation : Focusing on Regulation of Programming Quotas (방송편성규제의 경로의존성 비판과 개선방향 : 편성비율규제를 중심으로)

  • With the activation of OTT and VOD services, the viewing behavior is rapidly changing, but the programming regulation has not escaped the ratio regulation in the same way as in the past. Therefore, this paper aims to examine the policy validity of the current organization ratio regulation and to suggest improvement directions based on this. To this end, the policy objectives and background at the time of the introduction of the domestic organization ratio regulation were considered and compared with the current status of the broadcasting market. As a result, this study found that it is difficult to apply the logical framework of asymmetric regulation at the time of the formation ratio regulation into the current status of broadcasting market, the existing framework was established and hold in the mutual relationship of various stake holders formed based on the asymmetric regulation. It was pointed out that the typical pattern of path dependency repeating only fine adjustment of ratio was shown. Based on this, this study suggests that it needs to be divided into the regulation by the public interest and the regulation by the industrial purpose according to the purpose of regulation, and it is necessary to be limited to the direct regulation corresponding to the public interest of the viewer. Also this study proposes that it is necessary to separate the regulation from promotion policies as well as to resolute asymmetric regulation in broadcasting policies.

  • 미디어 환경은 방송과 통신의 융합으로 모든 미디어는 언제(Anytime), 어디서나(Anywhere), 어느 단말기기(Anydevice)로도 원하는 콘텐츠를 자유롭게 이용할 수 있는 방향으로 발전하고 있다. 국내 미디어 정책의 주요 변화가 있었을 때는 1995년 케이블방송 도입, 2002년 위성방송 도입, 2008년 IPTV 도입, 2013년 OTT의 등장이다. 국내의 경우 2012년 지상파TV의 디지털 전환도 큰 정책변화 중의 하나였다. 그러나 국내 미디어 정책 및 제도는 미디어 환경변화와는 무관하게 여전히 매체별 접근에 기반한 미디어 산업 균형발전 논리를 추구하고 있다. 미디어 정책변화에 따른 지상파 차세대 TV방송(ATSC 3.0) 활성화에 대한 현안 사항을 쟁점별로 분석하여 정책방안을 제언하면 첫째, 아날로그 시대부터 유지되어온 국내 방송정책 및 법제의 플랫폼별 칸막이 규제를 풀어 지상파 플랫폼 규제를 완화하여야 한다. 둘째, 정부의 지상파 ATSC 3.0 부가서비스(이동)부터 규제 완화와 지원이 필요한 시점이다. 셋째, 지상파 차세대 ATSC 3.0에 대한 재난매체 지정이 필요하다. 마지막으로 기술중립적 서비스 허가체계인 Negative 규제방식을 도입하여 사업자의 기술결합과 기술혁신에 대한 유인 독려가 필요하다.

A Study on the Proposal of Spiral Evolution Model of IPTV, M-IPTV, OTT & Smart Media focusing on Exploration & Exploitation Theory (IPTV, M-IPTV, OTT, 스마트미디어 진화단계에 관한 탐색과 활용관점의 Spiral 모형 연구)

  • This study proposes the evolution model of emerging media platform including smart media (M-IPTV, Smart TV) and IPTV, through a spiral evolution model based on the theory of the exploration & the exploitation. Authors suppose that the IP media evolved from IPTV technology, evolution of which has come through the development model of serial circular process. For explanation of this evolution, we propose the research model integrating the spiral model and the exploration & exploitation theory. Researchers define the smart media as the evolved media from IPTV, through this proposed model. We expect this model to be the theoretical base of media regulation and setting direction of future media service. Thus, this research are summed up as follows. To begin with, we classify the evolutionary stage of IPTV from the view points of service feature, regulation frame and technological characters. Secondly, we organize and confirm the research model of IPTV evolution through case analysis of the 3 cycles of each evolutionary stage. As a result, discussion of this study helps understanding mobile IP media and smart media as a post IPTV and leads the solution of various regulation issues and the development of the innovative media service and content. In addition, it can guide the government for the evolutionary direction to promote the media and the content industry.

A Study on Creation of Fair Transaction Environment between Platform Operator and Contents Provider in Broadcasting Industry (방송 산업 내 플랫폼사업자와 콘텐츠사업자 간 공정거래환경 조성 연구)

  • In a broadcasting market environment that has a close interdependence between platform operators and content operators, problems such as conflicts over program usage fees, and home shopping transmission fees are intensifying. This study attempted to analyze the environment of the domestic broadcasting market and present implications, analyze the cause of user fee conflict between the platform and PP, and propose detailed alternatives to resolve user fee conflict disputes. The results of environmental analysis on the domestic broadcasting market are as follows. First, the growth engine of the broadcasting industry has changed to direct resources such as service usage fees and content fees, and commerce is increasing. Second, as hegemony in the domestic broadcasting market changes from terrestrial to paid broadcasting and OTT, monopolies in the entire broadcasting area are being dismantled by voluntary entry. Third, the need to overhaul the existing regulatory system is increasing due to the dismantling and reorganization of the existing broadcasting market. On the other hand, this study proposed a strategy to diversify the profit structure of PP, supply program after pre-contracting, and strengthen CPS bargaining power in order to resolve disputes between paid broadcasting platforms and PP sharply. In particular, as strategies to strengthen CPS bargaining power of small and medium-sized SOs, it proposed to jointly improve CPS-related systems through IPTV and individual SOs, to redefine fees for programs and to voluntarily use programs.
