보도기사의 재산권적 가치와 무단전재를 통한 저작권 침해에 관한 연구 (A Study on the Property Values of News Articles and Copyright Infringement)

  • 공공의 영역에 속하는 뉴스의 사실 자체는 공기처럼 자유로운 것이지만, 이것이 노동과 자본의 투자로 뉴스로 전환되었을 때, 상업성이 인정되는 재산권적 가치를 갖게 되며, 이를 생산한 언론사는 배타적 권리를 갖게 된다. 상품으로서 뉴스는 재산인 것이다. 재판부도 이러한 취지에 부합하게 사실보도에 대한 저작권 보호의 범위를 넓게 인식할 필요가 있다. 법으로 보호되는 것은 표현의 방법, 사건에 대한 기자의 분석과 해석, 문장의 구성과 자료의 배열, 단어의 선택, 특정한 부분에 주어진 강조 등이다. 즉, 침해의 핵심은 일반적인 주제나 사건 보도에 있는 것이 아닌 취급의 유사성이나 표현 방법의 착취에 있다. 보도기사가 사실적 요소들을 열거하여 정보를 전달하고 있지만, 소재의 선택과 문장 속에서의 용어의 배열, 강조 등은 학문이나 예술과 같은 고도의 창작성을 갖는 것은 아니지만, 낮은 정도의 창작활동에 속하는 것이다. 따라서 보도기사를 단순한 사실의 전달에 머물러 창작성이 결여되었다고 판단하는 것은 저작권법 원래 취지와도 배치되는 것이다.

상수도수불화사업이 구강건강상태에 미치는 영향 (Study on Influence of Water Fluoridation Program on Oral Health Status)

  • 이 연구는 상수도수불화사업이 구강건강상태에 미치는 영향을 파악하여 향후 상수도수불화사업 수행의 기초 자료를 마련하고자 하였다. 상수도수불화지역인 청주시 상당구, 상수도수비불화지역인 안양시 만안구를 대상지역으로 하였으며, 2003년도 7월 3일부터 7월 22일까지 청주시 상당구 C초등학교와 안양시 만안구 A초등학교 5-6학년 학부모를 대상으로 상수도수불화에 대한 설문지 조사와 초등학교 5-6학년 학생을 대상으로 구강검사를 실시하였다. 그 결과는 다음과 같다. 1. 우식경험영구치지수(DMFT index)는 청주 1.69개, 안양이 2.11개로 상수도수불화지역인 청주에서 낮았다(P=.010). 2. 우식경험영구치율(DMFT rate)은 청주 6.72%, 안양 7.94% 로 상수도수불화지역인 청주가 낮았다. 3. 제1대구치건강도는 청주 95.54%, 안양이 94.10%로 상수도수불화지역인 청주에서 높았다(P=.002). 이 연구는 상수도수불화사업의 효과를 분석함으로써, 상수도수불화사업이 구강상태에 미치는 영향을 파악하고, 이에 대한 구강건강증진을 향상에 기초 자료를 제시하는데 의의가 있다. 국민구강건강증진은 아울러 구강건강보험재정의 비용절감과 연관이 있다고 사료되며, 이를 위하여 전국 모든 지역에 상수도수사용을 확대 실시하여, 상수도수와 불소화에 대한 적극적인 홍보와 교육을 통한 신뢰 구축이 추가적으로 필요하다고 생각된다.

충북지역 매장문화재 보존조치 유적의 현황 및 보존방안에 관한 연구 (A Study on the Present Condition of Conservation Measures for Buried Cultural Heritages in Chungbuk Area and Preservation Plan)

  • 발굴 조사 된 매장문화재는 학술적, 역사적 가치에 따라 문화재청장이 보존조치를 결정하지만, 이전·복원 후 관리, 보존, 활용은 체계적으로 이루어지고 있지 않고 있다. 또한 보존유적 및 보호시설의 손상으로 보존방안과 활용도에 대한 문제점이 발생되고 있다. 이에 충북 지역 보존유적에 대한 현황을 조사하여 보존방안 및 활용방안에 대하여 제시해 보고자 하였다. 충북에는 총 43개의 보존유적이 있었으며, 관리주체의 명확성 여부를 떠나 대부분 체계적인 관리는 이루어지고 있지 않았다. 잘못된 보존처리와 재료의 선정 등으로 인해 유구 및 보호시설이 훼손 되어지고 있는 상태로 확인되었으며, 보존유적의 훼손으로 전시, 교육, 체험 등 활용성에서도 문제점을 확인하였다. 이러한 문제점 해결에는 법적·제도적 장치의 개선, 예산·전문 인력 확보. 표준화 매뉴얼 개발 및 적용, 지속적 모니터링, 예방보존, 이전 지료 및 방법 연구, 목록화 작업, 전문 박물관 및 복합 테마 파크 조성 등 중·장기적인 계획이 세워져야 할 것이다. 또한 조사된 보존유적에 맞는 보존방안을 제시하고, 이를 기반으로 보존·관리가 이루어지면 보다 체계적·과학적으로 보존·관리되고 교육, 전시, 홍보 등 다양한 목적으로 활용될 수 있을 것으로 판단된다.

  • 후기산업사회에서 몸에 대한 관심은, 몸의 개념을 단순히 건강한 몸으로부터 스타일을 구현하는 도구로서, 개인의 품격을 드러내주는 외피로서, 그리고 자신의 정체성을 수행하는 터전으로 확장시켜 나가는데 큰 기여를 했다. 이에 따라 몸 이미지(body image)는 물질적 몸 그 자체에 못지 않게 중요한 하나의 재현으로서 존재론적 의미를 갖게 되었다. 이 경향은 여성에 있어서 극대화되고 있으며 이 과정에서 사회문화적 통념은 여성들의 몸 이미지의 전형을 제시하면서 이를 내면화하도록 강제하고 있다. 몸에 대한 사회문화적 관심이 높아지면서 중요한 학문적 개념으로 등장하고 있는 몸 이미지 개념은 정신, 육체, 개인과 사회의 특성에 대한 인식론적 가정들을 토대로 하고 있다. 이 논문에서는 주요 학문 대상으로 부상하고 있는 몸 이미지의 이원론적 형성과정, 즉 사회문화적 전형(stereotype)화와 이 전형들이 시각 체계(the scopic regime)를 통해 주관적으로 내면화되는 과정의 상호 역동성에 대한 이론적 논의를 살펴보고 이 상호작용이 실제몸매관리산업 광고에 등장하는 몸 이미지에서 어떻게 드러나는지 이미지 분석을 통하여 검증해보았다. 분석대상은 다국적 몸매관리업체인 M사 광고 이미지와 광고 문안, 그리고 보도자료 등 홍보 문건이다. 이 분석을 통해 한국의 몸 이미지의 전형이 서구화되어 있고 이에 남성적 응시가 다각도로 용해되어 있으며 이의 내면화가 매우 정교하게 이루어지고 있음을 발견할 수 있었다. 이로써 여성 몸 이미지의 건강한 생산과 확산이 여성의 주체적 노력에 의하여 이루어져야할 것이라는 당위성이 대두되었다.

계층별 한방의료 이용 실태에 관한 연구 (A Study on the Patient's Attitude of Korean Medicine by Social Classes)

  • This study aims at looking into the use of oriental medical services in treating disease and patient's attitude of oriental medicine by social classes. The first to be explored through this study is medical accessibility, classifying them by age, gender and job. Second is to examine kinds of oriental medical services and expenses incurred in treating the disease. Third is to compare satisfaction for the services offered and investigate into relations between disease and oriental medicine through cross-analysis by class, and provide fundamental materials for enhancing accessibility to oriental medical centers for treating chronic diseases. The 1,376 households for the period of time from Apr. to Jun. 2005, were asked to answer to the questionnaires offered. The conclusion from the survey can be summarized as follows. Medical services for the onset of disease were less offered to females, older group, low schooling, and low-income bracket. It is attributable to an economic cause, in both genders. The in- and outpatients' rate were found higher in groups of female, older age, low-income and blue-color workers. Use of oriental medical centers were higher in outpatients than inpatients probably for low-income brackets were less frequently put on regular physical checkups, more exposing to diseases. Each hospitalization was found over six days longer in average; 19.7 days for oriental medical hospitals, 12.5 for hospitals. The hospital charges that patients should pay for one hospitalization showed 909,000 won in oriental medical hospitals, much higher than 518,000 won in hospitals. Outpatients were also found to pay more for oriental medical services; 55,000 won for oriental medical hospitals, 19,000 for hospitals. As to outpatients' satisfaction, oriental medical hospitals were generally found to be a little more satisfactory than general hospitals; 11.2% of respondents answered Very Satisfactory. Satisfaction to services offered to outpatients showed 82.2% of respondents responded to Over Satisfactory for herb clinics, 76% for general hospitals. For future intention to use oriental medical services, females, over 51 years old, lower education and income, and blue color workers showed more intention to use them. To be more competitive in treating chronic diseases, it is necessary that oriental medical services become more accessible through extending its coverage of insurance into more medical herbs and their prepared packs, as well as mapping out extensive publicity strategies to make known to the public about high efficacy of medical herbs and their safety.

대학도서관의 전시에 대한 효과분석 - 이용자와 사서를 중심으로 - (An Empirical Study on the Effectiveness of the Exhibits in University Libraries)

  • 도서관의 봉사활동 중에서 이용자의 다양한 정보욕구를 충족시키고 아울러 도서관에 대한 이미지를 쇄신시킬 수 있는 효과적인 방법 중의 하나가 바로 전시라고 할 수 있겠다. 따라서, 본 연구의 목적은 전시에 대한 사서와 이용자의 인식도와 견해를 조사함으로써 대학도서관의 전시가 도서관에 미치는 효과 및 영향을 알아보고자 한다. 연구방법은 설문지 조사로서 설문의 내용은 크게 전시행사를 개최함으로써 가져올 수 있는 5가지의 효과로 나누고, 각 분야별로 세분된 항목들을 구성하여 그 효과를 분석하였다. 조사는 1995년 7월에 이용자 360명과 사서 90명을 무작위로 추출하여 실시하였으며. 설문지의 분석은 단순빈도 분석, 교차분석, T test, 일원변량분석 등의 통계적 방법을 사용하였다. 본 연구를 통해 밝혀진 결과를 토대로 논의하면 다음과 같다. 1. 대학도서관의 전시는 도서관 이용자의 교육에 효과가 있는 것으로 나타났다. 토 대학도서관의 전시는 이용자의 자료이용률의 증가에 효과가 있는 것으로 나타났다. 3 대학도서관의 전시는 도서관의 홍보에 효과가 있는 것으로 나타났다. 4. 대학도서관의 전시는 도서관장서의 개발에 효과가 있는 것으로 나타났다. 5. 대학도서관의 사서들이 준비하는 전시행사는 학술논문과 같은 학술적 가치가 있는 것으로 나타났다. 본 연구에서 조사한 사서들의 견해를 종합하면 사서들은 대학도서관의 전시행사가 매우 중요한 것으로 인식하고 있었으며 전시행사에 직접 참여할 의향 또한 매우 높은 것을 알 수 있었다. 따라서 대학도서관은 전시를 위한 풍부한 예산지원과 운영요원 등의 전폭적인 지원을 아끼지 말아야 할 것이다.

일부(一部) 중학생(中學生)의 성(性)에 대한 의식행태조사(意識行態調査) (A study on the Awareness and Behavior about Sex of Middle School Students -from middle school students in Taegu area-)

  • A survey was made of 976 students who were selected among students of 5 middle schools at Taegu so that it could furnish basic knowledge about sex education of adolescents by analyzing students recognition of sex, acquaintance with the opposite-sex, sex-education, The survery took a month from Nov. 1, to Nov 30, 1991. The results of this study are summarized as follows. 1. The general characteristics of the surveyed students. The survey consisted of 332 boys middle school student & 325 girls middle school students, 157 male & 162 female students of coeducational middle schools. 32.9% of them were from the first grade, 33.2% from the second grade & 33.9% from the third grade. 35.7% of them believed in Buddhism, 19% Christianism and the mode of their living standard, 86.7%, fell on 34.7% of their parents engaged in commerce and they were followed by salary man and public officals, 93.1 % of the students, parents were alive. 44.9% of their fathers were graduates of high school and 42.2% of their mothers middle school. 2. Sexual maturity 89.1 % of the surveyed girls had experienced menstruation. The mode of first menstruation, 48.2%, was at the age of 13 and the mean of it was 12.9, 3.7% the surveyed boys had exprienced a wet drem before. The mode of the first wet dream, 40.0%, was at the age of 14 and the mean was 13.4. 21.3% of surveyed students had the experience of masturbation but the number of girls fell far short of that boys. The mode of the first masturbation, 37.0%, was at the age of 14 and the mean was 13.4. 3. The acquaintance and sexual relations with the opposite sex 1) Analyzing the students actual conditions with the opposite, I found out that 52.3% of them wanted to have any kind of relations with the opposite and that 30.25 had already had some kind of relations. 73.2% of the students having relations with the opposite thought the other sex merely as a friend and the number of students who were thinking that way was distributed evenly among schools. 28.8% of the students had got acquainted with the other sex through their frieds and there were not much difference between boys and girls in the method of getting acquainated with the opposite. About 35.2% of the students having relations with the opposite came from the third grade. 47.8% of them answered that the meeting place was not fixed and 26.4% answered that they were meeting their parthers outdoors. 60.7% replyed that they were not disturbed in their studies by the relations with the other sex. 2) Most of the students 79.4%, answered that they had never had sexual relations and 16.3% of the rest said that thery were expressing their feelings by grasping each other's hand. 3) 16.6% of the surveyed students asid that they had the exprience of smoking, 1.1 % of an illusion caused by inhaling chemical addhesives, 44.0% of drinking and 41.4% of warching pornographic films. 4. The knowledge and attitude about the sex 1) The distribution and analysis according to schools and grades : 64.8% of the surveyed students answered correctly to the questions about mensturation, 49.3 % did so about wet dreams, 94.3 % did so about conception, 60.6% did so about child birth, 73.9% did so about AIDS and 50.1 % did so about sexual diseases. Roughly speaking, they had not much knowledge of sexual diseases. 2) The recognition of sex according to schools and grades : 39.0% of the students said that they had worries about sex. 33.1 % of what they worried was concerned with their bodies and 26.8% was about the acqaintance and relationship with the opposite sex. The girls were much more concerned about the former and the boys the latter. 51.1 % of the students asid that they had no specific opinion of masturbation but 19.2% said that's alright if self-restrained. About the sexual intercourse before marriage, 75.7% said negatively. 5. The need for sex education most of the students, 99.4% said they needed sex education and there was not much difference in that thought among schools. And 49.7% answered that schools, families, and societies were equlally important in sex education. About half of the students, exactly 50.2%. considered it as the main reason of sex education to prevent accidents cauesd by ignorance of sex. 81.4% said that they had had some kind of sex education. Most of the educations, 87.0%, had taken place at schools but 5.2% said they were getting most of the knowledge about sex from therir friednds, juniors and seniors. 59.5% of the students who had ever had a sex education said "Just so, so" when asked of the level of their contentment but the number of students who said "satisfied" was only a few, 16.1 %. 20.7% of the survered answered that thery wanted sex education to be made in the course of home life, and 26.6 % of the students most wanted to know about the acquaintance and relationship with the oppostie sex, 29.0% preferred nurse teachers as proper councellors of sex education. The mode of their present councellors, 42.0%, was friends but only 7.6% answered they dicussed with teachers. 6. The correlation analysis between general characteristcs and sexual behaviors of the surveyed students revealed that sex had a signigicant(P<0.001) positive correlation with parents' love toward students(P<0.01), the experience of masturbation, smoking, an illusion caused by inhaling chemical adhesives and the experience of watching pornographic films. And the standard of living had a significant(P<0.01) positive correlation(P<0.01) with grade point average, parents' existence(P<0.01) and parents' love, but a significant(P<0.01) negative correlation with sexual worries. grade point average had a significant(P<0.01)negative correlation with the experience of an illusion caused by chemical adhesives(P<0.01) and smoking. Parents' existence had significant(P<0.01) positive correlations with parents' love and smoking but a significant(P<0.01) negative correlation with the experience of an illusion by chemical adhesives. There was a significant(P<0.01) negative correlations between parents' love and the experience of an illusion by chemical adhesives, and a significant(P<0.001) positive correlation among masturbation and sexual worries, smoking, an illusion by chemical adhesives and the experience of watching pornographic films. There was a significant(P<0.001) positive correlation among acquaintance with the opposite sex, smoking, the experience of an illusion by chemical adhesives and watching pornographic films. Sexual worries had significant(P<0.01) positive correlations with smoking, the experience of an illusion by chemical adhesives and watching pornographic films. smoking had a significant positive correlation with drinking the experirence of, an illusion by chemical adhesives and watching pornographic films. Finally, there was a significant(P<0.01) positive correlation between the drinking experience and the illusion experience by chemical adhesives. According to the results mentioned above, the fact is certain that there is a great need for sex education of adolescents. Therefore, it is desirable that the schools teach sexual physiology and normal positively and that sex education including hygien education be an independant course in the curriculums. Furthermore, it is essential that the schools should have enough nurse teachers to take up sex education, expand training opportunities for them and that they develop educational materials. Considering the unbalance of the level of sex educations between boys and girls, I want to suggest that all boys and girls have sex education evenly and lead happy lives by correction irrational thought about sex, that is to say, sex discrimination, Sex education programs, especially of middle school students, should be reexamined if it is to give the students effective and profitable knowledge about sex. In addition, the government should establish a policy of adolescents' sex education to have healthy opinions of sex settled nationwide.

대학이 지역에 미치는 영향 지표 개발을 위한 탐색적 연구 (An Exploratory Research on Measuring the Local and Regional Impacts of Universities)

  • 대학의 새로운 책무로서 지역사회 공헌이 중요한 이슈로 부각됨에 따라 해외 대학들은 이를 지표화하여 자체 평가 및 대외 홍보에 적극적으로 활용하고 있다. 최근에 한국의 대학들도 대학 자원 이용을 확대하고 대학과 지역의 민관 단체 및 기업들과의 협력을 강화하기 위한 여러 사업들을 추진하고 있으나 맹아기에 머물고 있는 수준이다. 이에 본 연구는 대학이 지역에 미치는 사회경제적 영향에 대한 외국 대학 및 기관의 적용 사례를 분석하고, 이를 토대로 한국 대학에 적용 가능한 평가 지표를 발굴하고자 한다. 본 연구에서는 정부 및 독립 기구 차원에서 대학이 지역에 미치는 영향을 종합적으로 분석한 대표 사례인 영국고등교육위원회(HEFCE)가 수행한 대학 지역 영향 평가에 대해 고찰하고, 다양한 지표를 활용하여 대학의 지역 영향에 대한 백서를 발간하고 있는 북미와 유럽의 대표적인 대학인 미국 로체스터 대학과 영국 버밍엄 대학의 사례 분석을 통해, 한국의 대학에 적용가능한 공통 지표를 추출하였다. 그 결과, 대학의 지역 영향 평가 지표로 6개 분야(경제적 영향, 연구, 교육, 문화예술봉사, 지역발전, 대학 특성화)에 24개 항목을 도출하였다. 이 지표들은 대학정보공시서비스인 '대학알리미'와 대학별 보유 자료를 통해 확보 가능하여, 한국 대학에 적용 가능할 것으로 판단된다.

Health Promoting Lifestyle Behaviour in Medical Students: a Multicentre Study from Turkey

  • Background: The aim of this study was to determine the predictors of health promoting lifestyle behaviour among medical students attending seven of the medical schools in Turkey. Materials and Methods: This crosssectional descriptive study was performed during the second semester of the first and last (sixth) years of study from March to May 2011. A questionnaire with two sections was specifically designed. The first section contained questions on demographic characteristics; the second consisted of the Health Promoting Lifestyle Profile II (HPLP) Scale. From a total of 2,309 medical students, 2,118 (response rate 91.7%) completed the questionnaire. Data were analyzed using descriptive statistics, t, Anova, Tukey test and binary logistic regression analysis. The research was approved by the Ethics Committee of Erciyes University. Results: The mean age was $20.7{\pm}2.9$ years and it was found that 55.1% were men, 62.3% were in the first year. The overall prevalence of smoking was 19.1%, and for drinking alcohol was 19.4%. HPLP point averages of the first year students were $129.2{\pm}17.7$, and for last year $125.5{\pm}19.0$. The overall mean score for the HPLP II was $2.5{\pm}0.4$. They scored highest on the spiritual growth subscale ($2.9{\pm}0.5$), interpersonal relations ($2.8{\pm}0.5$), health responsibility subscale ($2.3{\pm}0.5$), nutrition subscale ($2.3{\pm}0.5$), stress management subscale ($2.3{\pm}0.4$), and the lowest subscale physical activity ($2.0{\pm}0.5$). It is established that student's grade, educational level of parents, economic status of family, marital status, smoking and general health perception of the students resulted in a significant difference in HPLP Scale total score average and the mean score of majority of subscales. There was no statistically significant difference between the total HPLP when evaluated for gender, chronic disease, alcohol drinking status and BMI. Conclusions: Based on these results, particularly in the curriculum of medical students in order to increase positive health behaviours including physical activity, health promotion issues, and giving more space to aim at behaviour change in these matters is recommended.

양돈 농가의 안전사고 발생현황 및 안전보건 관리수준 (A Survey on the Present State of Occurrence of Safety Accidents and Safety and Health Management Levels Among Swine Farmers)

  • Objectives: The purpose of this study was to seek measures for improvement and management of farm work safety and health by conducting questionnaire surveys and on-site investigations to ascertain the present state of occurrence of safety accidents and safety and health management levels among swine farmers. In particular, the purpose of this study is to provide basic data for the establishment of measures for the management of safety and health suitable to the characteristics of related working environments. Methods: Questionnaire surveys were conducted among 223 farmers engaged in swine farming in 14 regions, and 10 farms were visited in order to implement multilateral methods, including in-depth interviews, along with field surveys. Results: The surveys indicated that 26.2% of all respondents experienced farm-work related safety accidents and body-reaction related accidents showed a high ratio at 31.1% of all respondents. With regard to cause materials of safety accidents, work other than that directly related to swine raising showed high ratios of safety accidents, with pigsty facility related accidents at 26.6%. Although most workers recognized the dangers latent in the working environments, their behavior and responses to the prevention of safety accidents were still insufficient due to a lack of understanding of safety and health management. In the survey on the present state of personal hygiene and wearing of protective equipment, workers were found to have been exposed to dangerous and harmful environments both inside and outside pigsties, but the actual states of their wearing protective safety equipment were very poor. Conclusion: Given the results of this study, swine farmers well recognize problems in their control of safety accidents and management of safety and health, but their knowledge about safety and health education and management guidelines was insufficient. Therefore, safety and health education, public relations, and customized personal protective equipment suitable for swine raising work should be developed in order to address the foregoing problem.
