도시공간의 변화에 내재한 정치${\cdot}$경제적 논리의 규명-서울시 도심재개발을 대상으로- (The Political-Economic of Capitalism and its Effects on Spatial Dynamics)

  • 본 연구는 서울시 도심재개발을 대상으로 도시공간의 재편과정에 내재하는 정치.경제적 논리를 규명함으로써 도시의 형성과 변화가 사회구조의 산물임을 밝히고자 하였다. 서울시의 도심재개발 사업은 1970년대 전반부터 생산과정의 분화가 이루어짐에 따라 대기업 본사가 도심으로 집중하는 상황에서 시작되었다. 또한 도심재개발은 1980년대 불황국면에 접어들면서 더욱 활발해졌는데, 이는 불황시기의 유휴자본의 문제를 도시공간을 재개발하는데 투자하여 극복하려는 논리에 근거한 것이었다. 그리고 도심재개발은 이를 전체적인 수준에서 주관하고 토지소유권의 통합, 토지수용권의 인정, 제 3개발자 인정, 재정. 세제상의 혜택, 건축규제의 완화 등 법적. 행정적 지원기관인 서울시의 정책과 맞물려 있었다. 그 결과 생활터전으로써의 도심은 업무공간으로 단순화되고, 도심인구의 空洞化現象은 더욱 심화되었다.

LID관련 지방정부 조례제정 특성 기초연구 - 서울시, 수원시, 남양주시를 중심으로 - (A Basic Study on the features of LID-related Ordinance Enactment conducted by Local Government - mainly on Seoul City, Suwon City and Namangju City -)

  • 본 연구는 저영향개발(LID)의 전국적 확산을 위해 실질적으로 시설의 설치 및 관리의 주체가 되는 국내 지방자치단체의 주요 제도인 조례를 양적 질적으로 분석함으로써 향후 이를 도입하고자 하는 지방정부에 정책적 방향을 제시하기 위해 작성되었다. 저영향개발(LID)과 연관된 주요 검색어 4개(물의 재이용, 빗물, 물순환, 저영향)를 전문가 자문회의를 통해 추출하였으며, 법제처 사이트 검색을 통해 주요 검색어가 포함된 99개의 관련 조례를 도출하여, 이를 검색어별 지방정부 규모별로 분석하였다. 분석결과 과거 2000년대 중반에 제정된 빗물관련 조례가 물의 재이용 촉진 및 지원에 관한 법률에 의한 조례로 전환되고 있음을 알 수 있었고, 물순환과 저영향이라는 키워드를 포함한 조례가 현재 전국에 3개(서울특별시, 남양주시, 수원시)뿐인 것으로 나타났다. 내용적으로 저영향개발(LID)를 포함하고 있는 3개 지자체를 대상으로 업무 담당자 인터뷰를 실시한 결과 도출된 결과는 다음과 같다. 첫째, 현재 우리나라의 빗물, 물의 재이용 관련 조례는 강우강도 불투수율 등 지역 특성을 고려하기보다 행정자치부가 배포한 가이드라인에 따라 제정되고 있어 내용상 지자체마다 동일하다. 둘째, 현재 제정된 조례가 단순한 기술 시설에 국한되어 있어 토지이용 및 공간을 포함하는 저영향(LID) 개념을 포함할 수 없는 상황이다. 이에 저영향개발(LID)의 의미를 올바로 반영하기 위해서는 서울특별시와 같은 관련 조례 제정 및 강우강도, 불투수율 등 지역별 특성을 반영할 수 있는 새로운 가이드라인이 필요할 것으로 판단된다.

중국의 반(反)테러리즘법 제정을 위한 검토: 미국.영국.독일과 비교하여 (Review for the Enactment of Anti-Terrorism Law in China: Comparing it to those in the USA, Britain and Germany)

  • 중국은 광대한 영토와 다양한 민족, 종교, 그리고 문화 등이 공존하고 있다. 이러한 중국은 민족, 종교, 자원 등의 갈등으로 인하여 테러리즘 위협에 직면해 있다. 중국은 2011년 10월 29일 제11대 전국인민대표대회 상무위원회에서 반(反)테러리즘 업무강화와 관련한 결정(決定)을 하였다. 이 연구는 중국의 반(反)테러리즘 관련 결정과 미국, 영국, 독일의 대(對)테러리즘 관련법을 분석 및 평가하였다. 미국, 영국, 독일의 대(對)테러리즘 관련법은 크게 사전예방(事前豫防)과 사후진압(事後鎭壓) 측면, 대인적(對人的)과 대물적(對物的) 측면으로 구분하여 제정하였고, 대(對)테러리즘 관련 국가기관의 권한(權限)과 역할(役割)도 재조정(再調整)하였으며, 대(對)테러리즘 관련법 내용도 명시적이고 구체적이며 체계적이라고 할 수 있다. 그러나 중국의 반(反)테러리즘 관련 결정은 사전예방(事前豫防) 진압(鎭壓), 대인(對人) 대물적(對物的), 국가기관(國家機關)의 권한과 역할 등에 대한 한계가 있다. 이 연구에서는 중국이 향후에 반(反)테러리즘 관련법을 제정함에 있어, 외국의 대(對)테러리즘 관련법에 대한 시사점을 검토하였고, 개정된 중국 형법의 테러리즘 관련 범죄에 관한 규정을 반(反)테러리즘 관련 결정과 어떻게 접목할 것인가를 논의하였다.

외국의 조경관련 법제도의 비교분석과 한국에서의 조경기본법 제정을 위한 합리적 적용에 관한 연구 (The analysis of the foreign laws related to landscape architecture and a study on the reasonable application to the expected organic law for landscape architecture in Korea)

  • There is no special law of Landscape architecture in Korea. So, examining the concept from the legal basis of LA with the viewpoint of a natural scientist not a jurist, this study was conducted to grasp the present condition of the name and the related text of the foreign laws in force which were connected with LA.. And those foreign laws were arranged in the name and the text and classified by nations of regional groups and it was considered to the mutual relation with lots of laws which are scattered with the various laws. Current domestic regulations to the various fields of LA are assembled with the many related rules. The governmental organization conducting those business is nonexistent up to now and it is generally known to except the dept. of LA from the office organization in Korea. Being at a disadvantage as mentioned above, this study was progressed under the necessity of the scientific basis for the expected organic law of LA proposed to establish it by every field of LA. Though feels inconvenience if the study for the items itself of LA had been proceeded prior to the study of laws relating to LA throughout the study, such a extensive study will be a subject to be attempted constantly hereafter by all part of landscape architects. The contents of the study are as follows ; 1. The present condition of the foreign laws connected with LA 1. The proposal & analysis of the problems and the solutions to the domestic laws connected with LA 3. The proposal of the reasonable application pklan in order to establish the organic law for LA. Among the items relating to LA such as engineer, contract, planning, design and supervision, construction, maintenance, plant and planting, open space, facilities, aesthetics and sight, park, land use and development planning, urban and regional planning, leisure space planning, environmental conservation and ecology, structural engineering of construction, administration, right and penal regulations, the laws dealing with the matter relating to LA directly or indirectly are prescribed dispersedly in the many other related laws and it is concluded to be impossible for the independent law of LA is likely to be establish with not only selecting and arranging the matter having closed connections to LA directly but also being recognized as the systematic equipment of the LA business. It was to be analyzed the present condition of the collected foreign laws relating to LA. After pointing out the problems to the domestic related laws being at issue, the remedies for it were presented through the questionnaire of the landscape specialist in which the supporting opinions to the recognition to the problems and the solutions were come to a major portion. Three types of application such as applicable, non-applicable, applicable after examination were presented to decide whether or not the foreign related laws were applied to the domestic one. The result of analysis shows that 42 statutes and 9 ordinances are applicable, 4 statutes and 7 ordinances are non-applicable, 1 constitution, 81 statutes and 48 ordinances are applicable after examination.

국제항공운송협약의 Door to Door 운송에의 적용에 관한 문제점 (Problems on the Door to Door Application of International Air Law Conventions)

  • This article demonstrates that both the Warsaw Convention Systemand the Montreal Convention are not designed for multimodal transport, let alone for "Door to Door" transport. The polemic directed against the "Door to Door" application of the Warsaw Convention systemand the Montreal Convention is predominantly driven by the text and the drafting philosophy of the said Contentions that since 1929 support unimodalism-with the rule that "the period of the carriage by air does not expend to any carriage by land, by sea or by inland waterway performed outside an airport" playing a profound role in restricting their multimodal aspirations. The drafters of the Montreal Convention were more adventurous than their predecessors with respect to the boundaries of the Montreal Convention. They amended Art. 18(3) by removing the phrase "whether in an aerodrome or on board an aircraft, or, in the case of landing outside an aerodrome, in any place whatsoever", however, they retained the first sentence of Art. 18(4). The deletion of the airport limitation fromArt. 18(3) creates its own paradox. The carrier can be held liable under the Montreal Convention for the loss or damage to cargo while it is in its charge in a warehouse outside an airport. Yet, damage or loss of the same cargo that occurs during its surface transportation to the aforementioned warehouse and vice versa is not covered by the Montreal Convention fromthe moment the cargo crosses the airport's perimeter. Surely, this result could not have been the intention of its drafters: it certainly does not make any commercial sense. I think that a better solution to the paradox is to apply the "functional interpretation" of the term"airport". This would retain the integrity of the text of the Montreal Convention, make sense of the change in the wording of Art. 18(3), and nevertheless retain the Convention's unimodal philosophy. English courts so far remain loyal to the judgment of the Court of Appeal in Quantum, which constitutes bad news for the supporters of the multimodal scope of the Montreal Convention. According the US cases, any losses occurring during Door to Door transportation under an air waybill which involves a dominant air segment are subject to the international air law conventions. Any domestic rules that might be applicable to the road segment are blatantly overlooked. Undoubtedly, the approach of the US makes commercial. But this policy decision by arguing that the intention of the drafters of the Warsaw Convention was to cover Door to Door transportation is mistaken. Any expansion to multimodal transport would require an amendment to the Montreal Convention, Arts 18 and 38, one that is not in the plans for the foreseeable future. Yet there is no doubt that air carriers and freight forwarders will continue to push hard for such expansion, especially in the USA, where courts are more accommodating.

온천관광지 개발실태 조사연구 (Study on the Development Status of Korean Hot Springs)

  • Hot springs development will be more activated with the five-day work week system than before. Nevertheless, investment and development achievement of hot springs has not resulted in a successful performance to foster townships, and this calls upon locals to build a guideline to develop hot springs. This study intends to analyze laws on hot springs, which influence mostly on the hot spring development, to gather up the information on the present state of the development, and to suggest considerations for further development plans. Features of the hot spring development are as follows: One is that metropolitan cities will discover hot spring resources more than small cities. Therefore the development will be twofold : one for resort tour and the other for one-day rest and recreation. In addition, Korean laws on hot springs are more site development-oriented to support tourism and recreation than to protect environment and discover unused resources. This makes hot spring development easier and efficient being supported by hot spring law, law on territory development and use, and tourism promotion law. On the other side, planned landscape trimming can be uniformized and unharmonized in terms of local identity and environment-friendliness. This is why careful considerations such as goods and bads of the local resources, local history and culture are needed in hot spring development. A long-term development project should include remodeling based on local identity and development trends. The third point indicates that Korean hot springs development has recorded relatively low performance due to difficult private capital attraction, and a high fence on land purchase and development approval. It is essential to release restrictions on the hot spring development-especially on those whose development performance has not been successful so that best practice can be supported by the government in remodeling and marketing. New plans on hot spring development should be also examined based on developer's capacity and local authorities' volition on the plan. Last point shows that most hot springs development plans have been designed only based on territory utilizing plan and facilities arrangement, not considering much on fund-raising, operational plan or feasibility analysis. Therefore the tourism promotion law should reinforce guidelines on tourist site approval system by supplementing criteria. At the same time, an education on tourism development planning is necessary to deepen developers' understanding, since most developers are experts more on city development, landscape architecture, designing, constructing and engineering than tourism development.

규제혁파, 드론 촬영 자유구역 지정을 위한 선결조건 연구 (Abolition of restrictions and research on precondition for nominating drone photographing free area)

  • 본 연구의 배경은 드론 시장이 거대해짐에 따라 정부는 '드론 촬영 자유구역 지정'을 논의하고 있으나 법 제도 및 절차, 관련 환경요건들이 상충되거나 명확하지 않아 선행되어야 할 요건들을 정립할 필요성이 제기되었다. 연구목적은 촬영 불가지역 범위를 설정하고 자유구역 지정 및 절차에 관한 선결조건을 제시하는 것이다. 연구방법은 문헌연구를 통해 설문서 구성, 인터뷰를 통해 항목 구체화, 전문가 선택 및 참여자 토의를 통해 조건을 제시한다. 연구결과는 항공안전법 등 개정 2개, 자유구역 지정 기준 및 절차 8개, 안내소 운용 등 4개를 도출하였다. 기대효과는 첫째, 드론 촬영을 항공안전법에 포함으로 자유구역 지정에 관하여 국토부와 협의체 구성이 가능하다. 둘째, 촬영금지 영역을 공중까지 확대하여 입체적인 드론 보안이 가능하다. 셋째, 자유구역 지정을 쉽게 적용할 수 있도록 '용인지역 표준모델'을 제시하였다. 향후 연구방향은 드론 촬영 관련 항공안전법 우선 개정과 국가정보원과 연계한 33개 관할지역의 자유구역지정 절차를 준용하여 추진이 필요하다.

  • Since world coordinate system is entirely used because of the revision of land surveying law, it is needed that transformation of coordinates of geo-spatial information established by korea coordinate system to be performed. It is required, however, to have a plan for transformation of world coordinate system because the coordinate system is not unified due to the geo-spatial information system using dualistic control data of both old and new data of korea coordinate system. For this purpose, in this study, I have calculated coordinate transformation coefficient per control data of korea coordinate system and proposed a plan of transforming a dualistic coordinate system which is based on control data of korea coordinate system effectively into world coordinate system through verification of accuracy of transformation per control data.

  • The "standard regulation" of the vehicles from "urban transit law" are being adopted to electric multiple unit in domestic. In the standard regulation, there are two types for EMU. One is heavy EMU for Seoul. The other is large EMU for Pusan, Daegu, Gwangju, Daejeon, Incheon. Korea Railroad Research Institute, with the assistance of the Ministry of Land, Transport and Maritime Affairs, "advanced EMU development project" are progressed, and 6th year started at September, one unit to six cars is completed. Now "urban transit vehicle performance tests are on the current progress. The main characteristics of AUTS(Advanced Urban Transit System) are as follows. One inverter control one motor, DDM(Dircet Drive Motor), no driving gear, plug door and steps, mounting and maintenance costs down, passenger convenience improvement. This paper describes the key features the next generation EMU, and performance test results, and the commercial success method of national R&D business.

한국에서의 매립지에 대한 환경영향평가 (Environmental Impact Assessment for the Waste Landfill Site in the Republic of Korea)

  • Most of the solid waste has been land-filed as an ultimate disposal method in Korea, with might induce many environmental problems by generating odor, particulates and leachate. The landfill site should be considered as a kind of pleasant facility to neighboring residents. Currently, for a landfill site, while the environmental law requires to perform the EIA before the planning. EIA has been performed after the selection of the landfill-site. That might be controversal to the purpose of doing EIA. In this study, the weakness of the EIA for the landfill-site was analysed and was suggested for comprehensive EIA in Korea as well.
