A Study on Improving the Legislation and Institution of Bunkering Business (선박급유업의 법제도적 개선방안에 관한 연구)

  • Ship's Bunkering Business is one of the essential businesses creating added values of the port as a hub for a stream of the international logistics. Regulatory considerations of ship's bunkering business should be made to create a more relevant system and stabilize the bunkering industry so that the ports may produce more substantial added values. This paper suggests revisions the Harbor Transport Business Act, the Marine Transport Act, putting forward an idea of unifying safety management systems, establishing a guideline for bunker quality managements, and changing the laws regarding any wrongdoings of bunker suppliers. In conclusion, in order to increase the managerial integrity of the bunkering operators, reasonable burdens should be distributed across the government, refinery companies and ship-owners to achieve a more balanced state and enable long-term development to advance the business at issue, following a step-by-step approach to amend the contract practice, the laws and the systems.

A Comparative Study on Seafarers' Industrial Accident Compensation System - Focusing on the German Legislation - (선원재해보상에 관한 비교법적 연구 - 독일의 법제를 중심으로 -)

  • Seafarers are exposed to various unpredictable maritime risks due to the spatial specificity of the working environment of the sea; thus, sufficient compensation for injured crewmembers is needed. However, Korea does not provide such compensation. Therefore, this study attempted to examine the Maritime Labor Act and the Industrial Accident Insurance Act of Germany, an advanced European social insurance country, and derive implications compared to Korea. First, we investigated how compensations are managed by a public institution in Germany and by shipowners in Korea. Second, regarding the contents of accident compensation, Germany does not only provide continuous treatment and care through various support systems, but also operates various programs to enable a return to ship work. In contrast, Korea has a temporary compensation system that allows shipowners to avoid liability for accident compensation, which is disadvantageous to shipwrecked seafarers. Finally, in Germany, workers' compensation insurance is public, judged considering the origin of work, whereas in Korea, it is determined by shipowners or insurance companies. Therefore, it is necessary to establish a public institution in charge of crew accident compensation to ensure proper compensation for crewmembers in Korea and to improve the Seafarers Act or system to provide compensation for additional medical care, disability pension, and rehabilitation benefits.

A Study on the Seafarers Education for Cabotage in KOREA (한국의 카보타지를 위한 선원양성에 관한 연구)

  • The cabotage rule has been protecting the domestic industry from foreign competitions as a kind of trade barrier. In the United States, the shipbuilding industry has been maintained with the help of to the strict cabotage operations by reinforcing advantages for domestic crews and ships which are built in the U.S. For most countries, cabotage has been granted legitimacy in their coastal shipping by Low Carbon Transport in terms of economic and emergency reasons. The cabotage rule is required in the stable supply of the seafarers which rely on the legitimate maritime education. This study analyzes Korean cabotage system and the problems with regard to seafarers education. It is found that the resolution is set up the cabotage act such as Jones Act, U.S.

Effects of a Hands-on training on Sea survival knowledge, Shipboard fire-fighting knowledge and Emergency response leadership in Seafarers -Focusing on the Advanced safety training for coastwise vessels under the Seamen Act- (체험 실습 교육이 현직 선원의 해상생존 및 선상소화 지식과 비상대응 리더십에 미치는 효과 -선원법상 국내선 상급안전재교육 중심-)

  • The purpose of this study was to identify the effects of a hands-on training regarding maritime safety including abandon ship and fire-fighting as related to sea survival, fire-fighting knowledge and emergency response leadership in seafarers engaged on a seagoing ship. The study was conducted with a nonequivalent control group pre-posttest design. Two hundred-sixty-six participants were assigned to either the experimental group(128) or control group(138). The hands-on training regarding maritime safety included sea survival and fire fighting drill, and it was implemented with the experimental group for two days from July 1, 2015 to June 30, 2016. Data was analyzed using chi-square, t-test and ANCOVA by using IBM SPSS Statistics(version 24) program. The experimental group who had the hands-on training showed significantly higher sea survival knowledge(F=902.32, p<.001), shipboard fire-fighting knowledge(F=1013.76, p<.001) and emergency response leadership(F=1802.62, p<.001) for maritime safety compared with the control group who had traditional education. The results indicate that a hands-on training is an effective teaching method to improve sea survival, fire-fighting knowledge and emergency response leadership in seafarers engaged. Further study is needed to identify the effect of a hands-on training regarding maritime safety according to the environmental changes of seafarers.

A Study on the Improvement Strategy of Specialized Institution for Efficient Operations of Maritime Traffic Safety Audit Scheme (해상교통안전진단제도의 효율적 운영을 위한 전문기관의 발전방향에 대한 고찰)

  • To improve and modify the problems in Maritime Traffic Safety Audit(MTSA) Scheme, "Maritime Safety Research Center(MSRC)" in Korea Ship Safety and Technology Authority(KST) was designated as specialized institute for MTSA through general revision of "Enforcement of MTSA"(March 2012). However, the roles of the MSRC such as preliminary review of safety audit report, comments on target project and etc. had not been defined clearly on the related maritime safety laws compared with other specialized institutes in other similar audit scheme. In this research, the improvement strategies were proposed for development of specialized institute through SWOT analysis, gathering the opinion from related professions and also comparison with the roles and current status of operation in other similar specialized institutes. In conclusion, the 'Screen & scoping system', 'Consultant system' were proposed for efficient operation of the MTSA Scheme, and the systematic and operational improvements such as a revision of maritime safety lan and etc. were also suggested for integrated management about costal development works, development of specialized institute.

  • The penalty clauses of 'Aviation Act' and 'Aviation Safety and Security Act' going into effect now were legislated because the aviation safety is being more influenced by the aviation safety system compared to the ground or maritime transportation and it is possible the aircraft can harm to people and wealth located in the ground as well as threaten the safety of the passengers and crew on board when it is the target of crimes. However, analyzing the current acts, applicable objects and behavioral requirements of some provisions are too general, and they are providing severely high penalties in many clauses without separating applicable objects and behavioral requirements. In addition, there are some critical legislative defects and there is a problem in terms of law-applicable area in the legal system. It is inferred that these legislative problems of the criminal special-law related to the aviation were caused by following reasons; first, aviation security experts or policy-makers than criminal law experts attended more actively in the enactment process, second, the communication among specialist groups were not accomplished well enough.

  • The necessity of improving manning standards in the Ship Officer's Act has recently been strongly advocated by the fisheries industry. The fisheries industry maintained the position of the relaxation of current manning standards. However, the Labor unions, Marine Officers Association, and Radio Officers' Association persisted to strengthen the standards or to keep the current standards. This paper studies the appropriateness of current manning standards and processes its improvement scheme to secure the safe operation of vessels.

  • In order to prepare for the enforcement of the "ransportation Services Improvement Act for the Mobility Handicapped People" which was passed in parliament in Dec. 2004, various equipments and installations need to be developed to ensure appropriate level of safety for the mobility handicapped to use maritime transport. In this paper, we investigated the current status of domestic passenger vessel usage by the mobility handicapped, to analyse the requirements for amenities necessary for the mobility handicapped and developed accessibility guidelines for amenities for the mobility handicapped persons in order to prepare for the enforcement of the "ransportation Services Improvement Act for the Mobility Handicapped People"

A Study on the Application for Domestic Remote Operator Licensing System for Maritime Autonomous Surface Ships Using the AHP (AHP를 활용한 자율운항선박 원격운영자의 국내 면허체계 적용방안에 관한 연구)

  • Maritime Autonomous Surface ships(MASS) are gradually gaining importance. Until fully autonomous ships are developed, they will likely be controlled by remote operators who are based in a Remote Operations Center. However, there is currently no internationally or domestically established licensing for them. This issue can potentially pose a risk to navigation safety due to operations being handled by unqualified remote operators. We conducted a literature review and proposed criteria for the adoption of a licensing system for remote operators. We have futher offered alternatives to integrate this license into the existing officer licensing system, and analyzed them using Analytic Hierarchy Process(AHP). Subsequently,, theprimary need to enact legislation for remote operators is observed. The most preferred approach is to include the occupation of a remote operator in the Ship Officer Act, Article 4: Occupational Categories and Class of Licenses. Therefore, it would be logical for the organizational structure of the Remote Operation Center to mirror the traditional Bridge Resource Management. This study will contribute to the efficient training of remote operators and the safe navigation of autonomous ships with a focus on human resource management.

A Legal and Institutional Study on the Activation of Marine Salvage (해양구난 활성화를 위한 법제도적 연구)

  • It is very important to salvage the vessel and seafarer rapidly and efficiently when maritime accident occurred, as maritime accident has a bad effect on vessel, seafarer and shipping industry as well as the whole community itself. Especially, marine salvage in relation to the accident involving huge marine pollution and loss of life will be regarded as a more important process because the accident would result more severe damages. However, domestic marine salvage forces are weaker than other country's, and private marine salvage company has poor technical and commercial base even though the Korea Coast Guard and Navy have relatively more modernized equipments and squad. Thus, it is very important to promote marine salvage operation capacity because it is related with the national security as well as the national economy. In this regard, this study examines the promoting method of marine salvage including its public and private section from the perspectives of law and systemic revision.
