In accordance with the establishment of 200 nautical miles EEZ regime as a customary international law since the mid - 1980s, the area of global high seas became reduced relatively. On the other hand, the importance of high seas fishing ground became serious for the distant-water fishing states like Korea. But it can be expected that international dispute on the jurisdictional problem of the fishing vessels engaging high sea fishery will occur frequently owing to institutional inertia of the UNLOS Convention on this matter. "The Draft Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas" as an international code of conduct for responsible fishing which was adopted by FAO in 1993 is providing the more consolidating and definiting rules for jurisdictional responsibility of flag states to make completion the loophole of the UNLOS Convention. As a precondition for the effective control and enforcement of activities of the fishing vessels engaging high sea fishery, the Draft Agreement is providing some articles allowing the flag states to hold the rights of granting nationality, fishery permission, fishery supervision and control with punishment for the fishing vessels entitled to fly their own flag. Accordingly it can be evaluated that this Draft Agreement does not deviate on the whole from the traditional practice and the basic legal principle of the UNLOS Convention.
In order to understand characteristics on bycatch of Korean tuna purse seine fishery, especially operations associated with Fish Aggregating Device (FAD) in the Indian Ocean, we conducted analyses related to bycatch by school association type (unassociated school, FAD associated school and log associated school) using the data collected by scientific observers from 2016 to 2018. The FAD used by Korean tuna purse seine fishery in the Indian Ocean was a drifting FAD, which belongs to non-entangling FADs according to the category proposed by the International Seafood Sustainability Foundation (ISSF). The target species of Korean tuna purse seine fishery are skipjack, yellowfin and bigeye tunas, accounting for 99% of the total catch. The ratio of bycatch was 0.97% in total catch and the discard accounted for less than 1%, indicating that most catch was retained on board. In terms of bycatch ratio by school association type, it accounted for 0.12% for unassociated school, 1.09% for FAD associated school and 1.25% for log associated school. As for the catch proportion of shark species by school association type, it accounted for 0.01% for unassociated school, 0.11% for FAD associated school and 0.10% for log associated school, which showed that unassociated school type was the lowest to affect bycatch of non-target and shark species. Given the proportion of bycatch compositions, however, it is considered that FAD associated school of Korean tuna purse seine fishery has less caught bycatch species of non-target and shark, compared to other fleets operating in the Indian Ocean.
We assessed the stock of the southern bluefin tuna (SBT, Thunnus maccoyii) by applying the MULTIFAN-CL model. The model is spatially disaggregated, with the population and fisheries stratified into a number of regions within the overall stock range. Catch, effort, length-frequency, and tagging data from 1965 to 2003 were stratified by three regions and four quarters (Jan-Mar, Apr-Jun, Jul-Sept and Oct-Dec). These data were used to estimate the instantaneous fishing mortality (F), biomass, spawning biomass, recruitment, and so on. The Commission for the Conservation of Southern Bluefin Tuna (CCSBT) used only Japanese data and did not consider migration for the SBT stock assessment. By contrast, we used Japanese, Australian, New Zealand, Taiwanese, and Korean data, and considered migration. As a result, the estimated annual average F of all age classes was 0.073/yr and the F of age class 6-10 was the highest. The results also showed that the biomass and recruitment of SBT had declined significantly after 1965. Compared with the CCSBT results, the estimated spawning biomass in this study was lower and more uncertain. However, we will conduct a sensitivity analysis to get more accurate biological parameters and results. In addition, we need to use the bootstrap resampling method to quantify the uncertainty.
Variations in the species composition, biomass and size distribution of fisheries resources in the Uljin marine ranching area were investigated using trammel nets at two stations (artificial reef and natural rocky area) from 2009 to 2010. During the survey, a total of 74 species were sampled with a mean density of 132 ind./net and mean biomass of 21.56 kg/net. In the natural rocky area, a total of 45 species were sampled at a mean density of 202 ind./net and mean biomass of 28.81 kg/net, while in the artificial reef area, samples included a total of 56 species, with means of 62 ind./net and 14.30 kg/net. The dominant species, comprising over 3% of the total number of individuals, were Suberites ficus (30.8%), Ovalipes punctatus (19.2%), Paralichthys olivaceus (11.7%), Pleuronectes herzensteini (4.7%), Kareius bicoloratus (3.5%), Pseudopleuronectes yokohamae (3.5%) and Eopsetta grigorjewi (3.0%). The dominant species, in terms of biomass, comprising over 5% of the total biomass, were P. olivaceus (22.1%), S. ficus (18.7%), O. punctatus (7.2%), Hexagrammos otakii (6.6%), P. yokohamae (5.7%), K. bicoloratus and P. herzensteini (5.3%). A cluster analysis and non-metric multidimensional scaling (nMDS) analysis based on the Bray-Curtis similarity of fourth root transformed data for number of species and individuals, was divided into two groups: the artificial reef area (group A) and the natural rocky area (group B).
We examined for differences in the growth and fertility of microscopic stages between Costaria costata and Undaria pinnatifida in crossed temperature×irradiance (12, 17, 22℃×20, 60 μmol photons m–2s–1) and daylength×irradiance (8, 12, 16, 24 h×20, 60 μmol photons m–2s–1) experimental designs. After 13 days in culture, maximum gametophyte growths of the two species were obtained under the following combinations of factors: 17℃×60 μmol photons m–2s–1 and 24 h daylength×60 μmol photons m–2s–1. C. costata gametophytes produced sporophytes about 6 days earlier than those of U. pinnatifida. Sporophyte densities were highest in the 12 h daylength×60 μmol photons m–2s–1 combination after 20 days in C. costata (9.7 plants mm–2) and 26 days in U. pinnatifida (9.1 plants mm–2). However, optimal growth conditions for the microscopic sporophytes differed between species: 17℃×60 μmol photons m–2 s–1 for C. costata, 12℃×60 μmol photons m–2 s–1 for U. pinnatifida. Thus, C. costata gametophytes grew faster and produced sporophytes earlier than those of U. pinnatifida, even though the haploid gametophytes of the two species responded similarly to environmental conditions. Optimal growth temperatures for the microscopic sporophytes also differed between species.
Tuna purse seine fishery (TPF) constitute more than 60% of distant water fishery production in Korea based on a statistic of 2018, and 28 ships from four different companies were under operation at the western and central Pacific Ocean. On this research, common risk factors during TPF were investigated via enumeration of five years Korean fisherman's insurance payment statement, followed by some counterplans to diminish the accident rate. The accident rate of TPF on the Pacific Ocean peaked by 43.0% in 2014 and constantly decreased to 23.0% until 2018, presenting an average of 33.6%. Meanwhile, the accident rate on the Indian Ocean reached the highest point 55.1% in 2014 and declined to 11.6% in 2016, having an average of 24.7%. The average accident rate of the Indian Ocean scored 8.9% lower than the rate of the Pacific Ocean, but no statistic significance was observed. Depending on the process of operation, 'casting or hauling of net' was the most frequent part that people received an injury (40.4%). When the accidents were classified by their types, 'falling down' was the most recurrent cause of the injuries (28.5%). At the point of severity, the worst injuries were induced by crush hazard. Considering aforementioned accident frequency and severity, all the factors on the accident type list were divided into three different groups including high risk, moderate risk, and common risk. This study is expected to contribute to the reduction of occupational accidents during the work of fishermen and establishment of a safety management system for distance water fishing vessels.
The fishing vessels operation is a kind of maritime profit-making activities, which are complicatedly integrated by the basic and supplemental fishing activities with navigation. The Fishing Vessels Act of Korea defines the character of fishing vessels and gives a legal status to them, and this Act itself is linked with the allied public laws including the Ships Act of Korea. For this reason, the legal status of fishing vessels as Korean flagged ships by the public law is analogous to the general commercial vessels. And the specific character of ownership of the fishing vessels by the Korean Maritime-Commercial Act as a privated law is analogous to the general commercial vessels, nevertheless the Chapter 4(Carriage of goods) and the Chapter 5(General average) of this Act do not apply to the fishing vessels except the fish carriers. A fishing vessel possesses the legal status as a Korean flagged ship by having it registered and putting it on record under the provision of national law, however the principle of genuine link is an important factor for acquisition of nationality. Especially, the basic rules by the Law of the Sea those are attended with the distant-water fishing vessels operation at the overseas fishing ground are summarized as follows ; Firstly, the rights of navigation and fishing activities on the high seas are fundamentally recognized to all states, but the freedom is restricted according to the international legal order aiming at protection of reasonable interests of other states and conservation of the living resources and marine environment. Secondly, in the EEZ or EFZ the freedom of navigation is recognized, but fishing activities are exclusively ruled by the national law of the coastal state. Thirdly, foreign fishing activities are prohibited but the right of innocent passage is recognized in the territorial sea, while both activities are prohibited in the internal waters of the coastal state.
Reproductive ecology of the snow crab Chionoecetes opilio was investigated in terms of the reproductive organs, abdominal flap, fecundity, and maturity. Specimens were collected with gill nets and trawls from June 2002 to May 2003 in the eastern waters of Korea. The female and male C. opilio are distinguished only by the shape of the abdominal flap, which is triangular in males and circular in females. The gonads of female and male crabs are generally X-shaped. The male gonad is white, while the female gonad appears milk-white after spawning and then turns from light orange to dark orange with maturation. The female gonads matured from June, and mature and immature groups could be distinguished from December to February or March. Brooding eggs changed from bright orange to dark brown with formation of the compound eye immediately before hatching. Accordingly, the main spawning season is February and March. The minimum maturity carapace width of female crabs was 61.1 mm, and the mean fecundity is about 108,300 eggs.
To examine species composition, abundance and biomass of demersal organisms in the East Sea, bottom trawl survey was conducted at 7 sea areas from 2005 to 2007. A total of 107 species were collected and were composed of 54 fish species, 16 crustacea, and 37 mollusks in the East Sea from 2005 to 2007. Yearly abundance per area which caught by trawl survey in the East Sea from 2005 to 2007 ranged from a high of $292,234inds./km^2$ in 2005 to a low of $192,092inds./km^2$ in 2006. The abundance by sea area showed a peak in 76 sea area, and the lowest in 63 sea area. The abundance per area by season showed a peak in summer, and the lowest in spring. The most dominant species in abundance were Clupea pallasii, Neocrangon communis, Chionoecetes opilio. Yearly biomass per area which caught by trawl survey in the East Sea from 2005 to 2007 ranged from a high of $10,322kg/km^2$ in 2006 to a low of $7,096kg/km^2$ in 2005. The most dominant species in biomass were Chionoecetes opilio, Clupea pallasii, Dasycottus setiger. The biomass by sea area also showed a peak in 76 sea area, and the lowest in 93 sea area. The abundance by season also showed a peak in summer, and the lowest in spring. As a result of cluster analysis, demersal organisms community of 76 sea area showed a large difference with other sea area, and that of summer showed a large difference with other season.
One of the fundamental duty of the assured in a marine insurance contract is maintaining seaworthiness of the ship insured. Since duty of the seaworthiness of ship is a shipowners implied warranty in the marine insurance, the breach of the duty of seaworthiness by assured is recognized as immunity for the underwriter. This is a measure to protect the underwriter through prevention of unexpected casualties which may be occurred from the unseaworthiness. In the Korean Marine Insurance Act the legal character of the assured's duty of seaworthiness is not clear whether it is a legal duty or contracted one. Accordingly, in this paper the author pointed out that the duty of seaworthiness of the ship should be interpreted according to the English Law. As a conclusion, the hull insurance does not require even implied warranty concerning seaworthiness, since it is recognized as one of implied fundamental warranty of the English Marine Insurance Act. Especially, this issue pointed out is very meaningful and advisable under the consideration of the existing conditions of the marine insurance regime for the distant-water fishing vessels and the catch carriers in Korea.
