테러인식 척도의 확인적요인분석 (A Confirmatory Factor Analysis on the Awareness of Terrorism Scale in Korea)

  • 이 연구는 테러 인식에 대한 척도에 대하여 확인적 요인분석(Confirmatory Factor Analysis)을 사용하여 요인구조를 확인함으로써, 한국형 테러인식을 측정하는데 적합한 척도인지에 대한 정보를 제공하고자 하였다. 최오호 외(2016) 「국회청사 보안강화 방안에 관한 연구」에서 수집된 국회공무원을 대상으로 한 176명의 자료를 분석에 활용하였다. 연구결과 테러인식의 총 14문항으로 구성된 척도에서 테러우려 3문항, 테러발생인식 5문항, 테러대응 3문항, 테러대비장치 3문항의 요인별 모형적합도의 적합도 지수는 기준치를 충족하여 적합한 것으로 나타났다. 표준화회귀계수도 기준 값을 상회하고 있어 적합한 것으로 나타났다. 잠재변수 테러우려가 평균분산추출값의 기준 값에 다소 미치지 못한 것을 확인하였으나, 그 이외의 값은 적합한 것으로 나타나 집중타당도가 확보된 것으로 보았다. 이를 보충하고자 판별타당도를 검증한 결과 척도 수준이 적합한 것으로 나타났다. 따라서 이 연구에서 검증한 테러인식문항을 포함하여 테러와 관련된 이론과 선행연구를 바탕으로 테러인식을 측정하기 위한 적합한 문항으로 구성된 설문지가 개발되어 측정될 필요가 있다.

냉배수 방류에 따른 진해만의 해조류 성장 속도 변화 예측 (Prediction of Change in Growth Rate of Algae in Jinhae Bay due to Cooling Water Discharge)

  • 통영 LNG 기지에서 방류되는 냉배수가 진해만에 미치는 영향을 알아보고, 냉배수의 활용 방안 모색을 위해 총 4개의 냉배수 방류량에 대한 진해만의 환경변화를 1년간(2018년) 모의하였다. 실제 냉배수 방류량인 Case1(10 m3 sec-1)의 모의 결과, 모든 분기에서 냉배수에 의한 진해만의 환경변화는 매우 미미하게 나타났다. 모의 방류량인 Case2(100 m3 sec-1)의 경우 방류구 반경 5 km 범위에서 1 ~ 3℃의 수온 감소를 보였으며, Case3(1000 m3 sec-1)에서는 방류구 반경 8 km 범위에서 최대 4 ~ 5℃의 수온이 감소하였고 진해만 전 해역에 걸쳐 냉배수가 확산하는 결과를 보였다. 플랑크톤의 성장 속도는 최대 15% 감소하였으며(11월), 대형조류의 성장 속도는 행암만 부근에서 최대 6 % 증가하는 결과를 보였다. 상기 결과로부터 통영 LNG 기지에서 방류되는 냉배수에 의한 진해만의 환경변화는 미미한 것을 확인하였다. 또한 Case3 결과로부터 국소지역의 '적조 방재', '해조류 성장'을 목적으로 냉배수의 활용이 가능할 것으로 기대된다.

현장 월파계측을 위한 규칙파 조건에서 직립식 호안의 월파량 추정에 관한 모형실험 (Physical Model Experiment for Estimating Wave Overtopping on a Vertical Seawall under Regular Wave Conditions for On-Site Measurements)

  • 월파를 근본적으로 차단하기 위한 구조물 마루높이의 증가와 같은 하드웨어적인 대책과 더불어 호안의 배후지역에 월파에 대한 정보를 신속·정확하게 전달하여 피난 및 통행을 규제하는 소프트웨어적인 방재 대책이 동시에 요구되고 있다. 본 연구에서는 현장에서 월파 정보 제공을 위한 현장 월파계측 시스템을 목표로 구조물의 마루높이를 초과하는 월파고의 시간변동을 이용하여 월파량을 추정하는 방법을 제안하였다. 직립식 호안구조물을 대상으로 수리모형실험을 수행하여 파랑 조건 및 구조물의 여유 마루높이에 따른 월파량 및 월파고를 계측하였다. 월파 발생시 구조물의 마루에서 발생하는 침수유속을 장파유속으로 가정한 월파유량계수를 도입하고 월파고의 시간변동으로부터 월파량을 추정하여 실험결과와 비교·검토하였다. 월파유량계수를 합리적으로 산정하는 경우 월파고만으로 월파량 추정이 가능함을 확인하였다.

교차로 교통상충기준 개발 및 평가에 관한 연구 (Development and Evaluation of Traffic Conflict Criteria at an intersection)

  • 현재까지 교차로 위험도 측정 방법은 실제 사고 자료를 이용한 분석을 통해 이루어져 왔다. 하지만 사고기록 자료의 수집에 많은 시간이 소요되고 사고기록자료의 신뢰성과 정확성의 결여로 인하여 사고기록자료를 통해 신속하고 정확한 교차로의 위험정도와 안전대책을 결정하기란 매우 어렵다고 할 수 있다. 따라서, 보다 신속하고 정확하게 교차로의 위험도를 예측할 수 있는 기법이 요구되는 바, 그 대안으로 교통상충기법이 제시되고 있다. 하지만 상충측정시 측정기준이 명확하지 않아 조사자의 주관적 판단에 의존하게 되므로 상충자료의 신뢰성에 문제점이 제시되고 있으며, 이에따라 객관적인 상충측정기준 수립에 관한 필요성이 대두되고 있다. 본 논문에서는 교차로에서 발생하는 상충유형을 선행차량과 후행차량의 진행방향별 상충특성을 중심으로 후미추돌, 측면충돌, 직각충돌, 그리고 대향좌회전충돌유형의 4가지로 분류하고, 공학적인 이론을 기반으로 정확하고 객관적인 상충측정기준을 정립하였으며, 정립된 상충기준에 의한 상충조사자료와 사고자료의 상관관계 분석을 통해 본 연구에서 제시한 상충기준의 적합성을 검증하였으며, 사고-상충, EPDO-상충간의 단순선형회귀분석을 실시하여 상충조사를 통하여 교차로의 위험도를 예측할 수 있음을 밝혔다. 교통상충측정시 본 연구에서 제시한 상충측정기준을 적용한다면 보다 신속하고 정확한 교차로 위험도 예측이 가능할 것이며, 이를 통해 교차로 운영개선효과와 위험교차로의 선정 및 관리 등에 효율적으로 활용될 수 있을 것으로 기대된다. 향후 본 연구에서 정립된 상충기준의 타지역 타교차로에 확대 적용 및 검증과 더불어, 본 연구에서 제시하는 유형에 포함되지 않는 기타 유형에 대한 상충기준의 개발이 필요할 것이다.에 가까운 우수한 해를 얻을 수 있다는 것을 알 수 있다. 비록 프로그래밍 과정이나 이론의 정식화가 유한요소법에 비해 상당히 어려운 점은 있으나 무요소법은 요소의 정보를 필요치 않으므로 사용자 입장에서는 매우 편리할 것이다. 앞으로 경계조건을 효과적으로 만족시키는 문제를 해결하고 효과적인 알고리즘이 개발된다면 실용적으로 유한요소법을 대신할 수 있는 좋은 대안이 될 수 있을 것이라 생각된다.ead up 되었을 때 3~6dB 정도 높게 나타났다.. 5. 마라도 주변해역의 추.동계 방어채낚기어장은 한국연안역으로부터 월동장 내지 산란장으로 남하하는 방어어군이 마라도 주변에 나타나는 연안계수와 외양계수(대마난류) 간에 형성되는 수온.염분전선, 섬주변의 소규모 와, 강한조류 및 지형적 특성(불규칙한 해저지형 및 고립도서)에 의해 이루어지는 왕성한 수평 및 연직 혼합 등과 같은 어장학적 호조건에 의해 마라도 주변에 체류하게 되고, 이들 체류어군은 조류방향에 따라 섬의 조상 측에 농밀군을 형성하는 섬의 조상측 어장이다.향을 주지 않는 것으로 나타났으므로 청소년 각자의 식습관 및 식품 섭취에 대한 관심을 고취시킬 필요가 있다고 생각된다.d with an MR peak in the vicinity of the coercive field. 일부지역 산업재해환자 실태 연구 -대구, 경북지역 일부 종합병원 중심으로- (A Study of Industrial Patients from Selected General Hospitals in the Kyung Pook and Taegu City Areas)

  • The purpose of this study is to research the actual conditions of industrial accident patients and to produce worker satisfaction and a rational and effective counter measure pain. Direct interviews with 179 cases (in and out patients) were carried out during a three month period from April to July 1990, at six hospitals two general hospitals Sun Lin and Sung Mo in Po Hang, and four general hospitals in Taegu Kyung Pook University Hospital, Dong San Medical Center, Young Nam Medical Center and Catholic Hospital. The results of this study are summarized as follows: 1. Among the 179 cases, 51.6 % were male and 48.4 % were female. The two largest age groups were 30~39, 31.8 % and 20~29, 27.4 %. Among the 179 cases, 51.6% were married, the largest family number was 2 to 3, 41.1% and 4 to 5, 25.6%. Educationally, graduation from high school was the largest group, 46.4% among the patients, followed by middle school and primary school. The largest group income level was from 40~69만원, 45.2%. The largest group of patients who worked over 50 hrs. a week was 52.0%. The largest group of patients who worked less than 1 year was 44.7%, of the patients in work places of less than 100 people, 60.3% were injured and in work places of 100~299 people, 20.1% were injured. In manufacturing, the lagest group injured was 55.3%, the next group was transport, stroage, communication. The largest group of production workers injured was 40.2%. 2. The cause of injury in the largest group was facility problems, 33.5%. The next group was unsafe habits, 30.2% a lack of safety knowledge, 17.9% and insufficient supervision, 12.3%. The 30~39 year age group was head the highest number of injuries, 40.4% work places with more than 10 yeras of work, 44.4% work palces with more than 1000 people, 56.3% and mining accidents, 80.0%. Among these groups the highest cause of injury was due to facility problems. 3. The accident pattern showed machinery injuries 28.5% as the largest group, followed by falls & falling objects 17.3%, fire & electric 15.1%, struke by an object 14.5%, followed by overaction and vehicular accidents. The accident pattern showed 46.4 % among workers over the 50 year age group, workers in the 5~10 year group, 50.0 % places employing more than 1000 workers, 35.3 % : construction 73.7%, and construction workers 57.1%, among these fall & falling objects caused the greatest number of injuries. 4. The largest group of injuries was fractures 54.8%, trauma 14.5%, amputation 11.7%, open wound, and burns. The largest number of fractures occurred in people in the 30~39 year age group, 63.2 % over 10 years of work, 55.6% in work places of 300~400 people, 63.6% construction 63.2% and general workers 57.2 %. 5. The largest group of injuries was upper extremity 45.3%, lower extremity 24.0%, trunk 18.5 % and head or neck 12.2%. Of these groups, upper extremity injuries were the highest in those less 20 years old 75.0%, less than 1 years of work 59.5%, in work places of 500~999 people 60.0%, manufacturing 56.6 % and production workers 55.6%. 6. Periods of injury showed 34 people injured in September, to be the largest followed by October, 32 August, 22 people July, 19 people and the lowest December, 2 people. During the week, Friday had the largest group injured, 35 people followed by Saturday, 26 people and the lowest was Wednesday, 17 people, During the day 1400 hours had the largest group injured, 38 people followed by 800 hours, 31 people. 7. On a basis of 5 as the highest mark, the average, according to worker satisfaction showed facility safety 3.55, work environment 3.47, income 3.44, job 3.21 and treatment 2.98. 8. The correlation between general characteristics and injury showed that age was directly correlated to the duration of work(r=.2591) p<0.01, age was directly correlated to industry (r=2311) p<0.01, and the duration was directly correlated to occupation(r =.4372) p<0.001.

호주 민간경비산업 고품질 규제수단 검토 및 시사점 (Australian Case Study in Regulatory Techniques to the Security Industry Reform and Policy Implications)

  • 흔히 '성장의 한계가 없는 고도 성장산업'으로 불리는 민간경비업은 1980년대 이래 쉼 없는 양적 팽창을 거듭해왔다. 현대에서 민간경비의 역할은 생활안전 뿐 아니라 안보에도 중요한 위치를 차지하고 있으며, 그 교량적 기능은 가속화되고 있다. 치안서비스의 한 축으로써, 민간경비산업의 건전한 육성발전을 촉진하기 위해 세계 각국은 고유의 필요에 따라 각기 독특한 자격제도와 규제수단을 마련해 운영해오고 있다. 그간 우리나라에는 민간경비산업이 고도로 활성화 된 주요국의 규제개혁 사례가 다수 소개된 바 있다. 하지만 지금까지 소개된 선진국의 제도정비연구는 전반적으로 영미와 독일, 이웃 일본 중심이었다. 그러나 경비산업의 활성화 논의와 규제해법 담론을 이끌고 있는 많은 선도국들이 있으며, 그 중 대표적으로 일찍이 경비서비스를 공공재로 인식하여 단계적 제도개선 노력을 지속해온 광대한 인구부족 국가 호주를 꼽을 수 있다. 이러한 맥락에서, 본 연구에서는 1980년대부터 민경 역할분담을 확대해온 호주의 경비산업규제 접근방식을 살펴보고 이로부터 민간경비 산업 전반의 리스크 관리와 거시건전성 감독정책 방향에 대해 국내에 주는 시사점을 도출하였다. 연구결과, 호주의 경비산업 관리 운영은 (1) 의심스런 경비업자 측근에 대한 강도 높은 모니터링과 지문을 날인하는 제도의 운영, (2) 무영장 경비업체 압수수색제도, (3) 부적격자 삼진아웃 퇴출제도 등을 특징으로 하였다. 민간경비는 사회 안전을 보장하는 공공재적 성격이 강하므로, 서비스의 균일한 신뢰성 담보를 위해서는 정부주도의 보다 전문적인 관리와 선제적 개입이 요구된다. 이에 본 연구에서는 호주의 사례를 바탕으로, (1) 규제 프로그램의 리스크 유형별 효과성 측정을 토대로 한 규제품질평가에 대한 필요성, (2) 중장기적 규제영향분석을 위한 전담기구의 설립, (3) 규제준수 유도를 위해 활용될 수 있는 규제 믹스(regulatory mix) 전략에 관한 가이드라인을 제시하여 정책적 시사점을 도출하였다.

열처리 온도에 따른 니켈실리사이드 실리콘 기판쌍의 직접접합 (Direct Bonding of Si(100)/NiSi/Si(100) Wafer Pairs Using Nickel Silicides with Silicidation Temperature)

  • 실리사이드반웅을 이용하여 니켈모노실리사이드의 양측계면에 단결정실리콘을 적층시켜 전도성이 우수하며 식각특성이 달라 MEMS용 기판으로 채용이 가능한 SOS (Silicon-on-Silicide) 기판을 제작하였다. 실리콘 기판 전면에 Ni를 열증착법으로$ 1000\AA$두께로 성막하고, 실리콘 기판 경면과 맞블여 후 $300~900^{\circ}C$온도범위에서 15시간동안 실리사이드 처리하여 니켈모노실리사이드가 접합매체로 되는 기판쌍들을 완성하였다. 완성된 기판쌍들은 IR (infrared) 카메라를 이용하여 비파괴적으로 접합상태를 확인하고. 주사전자현미경 (scaning electron microscope)과 투과전자현미경 (tranmission electron microscope)을 이용하여 수직단면 미세구조를 확인하였다. Ni 실리사이드의 상변화가 일어나는 온도를 제외하고는 Si NiSi ∥Si 기판쌍은 기판전면에 52%이상 완전접합이 진행되었음을 확인하였고 생성 실리사이드의 두께에 따라 나타나는 명암부에 비추어 기판쌍 중앙부에 두꺼운 니켈노실리아드가 형성되었다고 판단되었다. 완성된 Si NiSi ∥ Si 기판쌍을 SBM 수직단면에 의괘 확인한 결과 접합이 완성된 기판중심부의 접합계면은 $1000\AA$ 두께의 NiSi가 균일하게 형성되었으며 배율 30,000배의 해상도에서 계면간 분리부분없이 완전한 접합이 진행되었음을 확인하였다. 반면 기판쌍 에지 (edge)부분에는 실리사이드가 헝성되지 않은 비접합상태가 발견되었다. 수직단면루과전자현미경 결과물에 근거하여 접합된 중심부에서는 피접합되는 실리콘의 경면과 니켈이 성막된 실리콘 경면 상부계면에 10-20$\AA$의 비정질막이 발견되었으며, 산화막으로 추정되는 이 막이 접합률을 현저히 저하시키는 것을 확인하였다. 접합이 진행되지 않은 에지부는 이러한 산화막이 열처리 진행중 급격히 성장하여 피접합 실리콘층의 분리가 발생하였다. 따라서 Si NiSi ∥Si 기판쌍의 접합률을 향상시키기 위해서는 피접합 실리콘 계면과 Ni 상부층간의 비정질부를 적극적으로 제거하여야 함을 알 수 있었다.

사고로 남편을 잃은 여성의 경험 (A Study on Woman's Experience of Being Bereaved of Her Husband by an Accident)

  • Relatively young widows, who are left with young children by a sudden death of their husbands, will be faced with not only psychological troubles such as individual anxiety and frustration but also the dual burden of playing both father and mother roles in a family, Also, family members have difficulty in adapting themselves to new circumstances of the family system, the training and raising of family members, and management of the family economy. In this study, the realistic resources on the experience of middle-aged women who are bereaved of their husbands by accidents were explored. The purpose of this study is to help widows adapt to life in society and live a more positive life by setting a new goals and recovering from a lost and twisted life. 11 women, who have experienced the loss their husbands and live in the Seoul metropolitan area were studied. The research took 116 days from December 15, 1995 to April 8, 1996. The method of research was direct interviews. While having interviews with them, the contents were recorded with their consent. The ground theory was that used by Strauss & Corbin(1990) in the analysis of the data. 81 concepts were analyzed and they were subdirided into 22 subordinate categories through the course of the analysis. These were then classified into 9 general categories. In the course of being categorized, 'absurdity' was showed as a core category. The subordinate categories 'surprise', 'gloom', 'grudge', 'helplessness', 'emptiness', and 'loss' were united in the core category 'absurdity'. Ominous presentiment, belated notice, death, surprise, gloom, grudge, helplessness, emptiness, loss, the situation of the children, lack of support from neighbors, support from neighbors, mulling over ways to live, choosing a job, strengthening, reinforcement, burden, sadness, smoldering, yearning, overcoming these 22 subordinate categories were re-composed into 9 general ones the husband's death, absurdity, presence of children, existence of support, self-support ability, preparation of countermeasures, self-reinforcement, toilsomeness, and overcoming. 'Absurdity' widows experience was shown in the results of 'toilsomeness' and 'overcoming' through reaction, confrontation, and adaptation. According to the analysis the central phenomenon was absurdity, the causal condition of the death of a husband, the presence of children and the existence of support, and the meditated situation of self-support. To solve absurdity, the preparation of countermeasures and self-reinforcements were shown resulting in toilsomeness and overcoming. Through the contrast in the data, the following statements were deduced: (1) If the death of the husband is expected, the more a widow will feel absurdity. (2) The more children she has and the younger she is, the more a widow will feel absurdity. (3) The lower support she is given, the more a widow will feel absurdity. (4) The larger self-ability she has, the more actively she will prepare countermeasures. (5) The smaller self-ability she has, the more passively she will prepare countermeasures. (6) The larger self-ability she has, the weaker self-reinforcement she will preform. (7) The smaller self-ability she has, the stronger self-reinforcement she will perform. (8) The more actively she prepares countermeasures for absurdity, the better she will overcome. (9) The more passively she prepares counter measure for absurdity, the worse she will overcome. (10) The stronger self-reinforcement for absurdity she performs, the better she will overcome. (11) The weaker self-reinforcement for absurdity she performs, the worse she will overcome. Through the results in this study, the following suggested: 1) A study whose object is all family members, and a comparative study on the case of a husband who has lost his wife should be done. These studies can be expected to develop a more refined theory. 2) Because of the collapse of the extended family system and the changes of family culture in Korea, a widow's status and position are apt to be ambiguous between her husband's home and her parent's. Therefore a new study on family culture should be made. 3) A continuous study on growing social Self Help Groups should be requested for the widows of this study to re-establish and recover from their twisted and scattered lives.

우리 나라 농촌지역(農村地域)에 부합하는 1차(次) 보건의료전달체계(保健醫療傳達體系) 정착구현(定着具現)에 관한 연구(硏究) -마을 보건임원(保健任員) 개발(開發)- (A Study on Implementation of Primary Health Care Delivery System meet to Rural Area in Korea -Village Health Voluntary Worker Development-)

  • A study was carried out from October 1977 to September 1978 in order to develope health care delively system which will meet to rural area in Korea. For the study objective a model of health care delivery system of Myun (township) area was developed which is adopted the net-work of village health voluntary worker who will play the role of bridge for communication related with health and illness between families or village people and health subcenter, and :he model health care delivery system net-work was set in the area of Soodong Myun, Yangju Gun. which is the rural health demonstration area of Ewha Womans University since 1972. The activities and attitude of 22 village health voluntary workers were observed and analized. during the study period. The results are as follows; 1. For the field activities of village health voluntary workers. a guide line which is described with specific behavioral objectives was developed and used for not only training of the workers but also evaluation of their field activities. 2. During the study period, the number of 971 village people were served primary health care service by village health voluntary worker and the service was classified largely into symptomatic medications (92%) and preventive measures (8%). 3. Comparative percentage of the number of 894 symptomatic cases cared by village health voluntary workers to 5,695 cases of patient treated by Soodong Health Subcenter during the same period was 15.7%. 4. Annual utility rate of village health voluntary worker by Myun total people was 16.1% but utility rate by Rie was varied from 38.2% to 2.8% which shown there were considerable differences in each Rie. In order to settle the village health care service, the obstructive factors of utility should be detected and their counter measure must be taken. 5. As the health need of village people increases, it is expected that the supplement of drug excluding present sit basic drugs is inevitable, but considering the ability of village health voluntary worker, the selection of additional drugs and education, plan should be carefully studied. 6. It is desirable that a financial resource for supplementary purchase of first aid kit, drugs and materials whould be alloted from village public fund like Saemaeul Women's Club fund, which has already practiced in a few villages in the study area. 7. As pointed out by village health voluntary workers, in order to improve the village health, village leaders should be in the center of it and the cooperation of whole village people is a core of healthful village development, and it is reasonable that the health subcenter backs up these voluntary health activities by village people in techniques. 8. It seems effective that a supplementary education for village health voluntary worker be accomplished by a planned education through regular meetings like worker's monthly meeting and irregular post guide when Myun Health Workers can handle the problems found during the round trip of villages. 9. It is desirable that village health voluntary workers, who are recommended by a civil voluntary organization like Saemael Woman's Club, are charged by natural villagc unit, are given a function of village health care service and used through basic education at health subcenter. 10. It is advisable that the village health voluntary worker's service is compensated not by a form of money, but by other way such as an exemption of medical fee of worker herself or her families in health subcenter can be one method. 11. Daily health activities of each village health voluntary worker should be reported to health subcenter by biweekly or monthly in order to get not only for basic data of the program but also for evaluation the program. It is recomandable that the report form should be simple and clear enough for village health voluntary worker to fill it effectively. 12. Village health care service should be developed into a Saemaeul Movement in which village people actively participate. For this, the appointed function of village health voluntary worker should be absorbed into those of living Environment Betterment Section or Family Planning Section of Saemaeul Women's Club or it is desirable that establish a new section, Village Health Promoting Section and make it involve the appointed functions of those sections mentioned above.

  • In a seminal judgment of November 2002 (Case C-476/98) relating to the compatibility with Community laws of the 'nationality clause' in the 1996 amending protocol to the 1955 U.S.-German Air Services Agreement, the European Court of Justice(ECJ) decided that the provision constituted a measure of an intrinsically discriminatory nature and was thus contrary to the principle of national treatment established under Art. 52 of the EC Treaty. The Court, rejecting bluntly the German government' submissions relying on public policy grounds(Art. 56, EC Treaty), seemed content to declare and rule that the protocol provision requiring a contracting state party to ensure substantial ownership and effective control by its nationals of its designated airlines had violated the requirement of national treatment reserved for other Community Members under the salient Treaty provision. The German counterclaims against the Commission, although tantalizing not only from the perusal of the judgment but from the perspective of international air law, were nonetheless invariably correct and to the point. For such a clause has been justified to defend the 'fundamental interests of society from a serious threat' that may result from granting operating licenses or necessary technical authorizations to an airline company of a third country. Indeed, the nationality clause has been inserted in most of the liberal bilaterals to allow the parties to enforce their own national laws and regulations governing aviation safety and security. Such a clause is not targeted as a device for discriminating against the nationals of any third State. It simply acts as the minimum legal safeguards against aviation risk empowering a party to take legal control of the designated airlines. Unfortunately, the German call for the review of such a foremost objective and rationale underlying the nationality clause landed on the deaf ears of the Court which appeared quite happy not to take stock of the potential implications and consequences in its absence and of the legality under international law of the 'national treatment' requirement of Community laws. Again, while US law limits foreign shareholders to 24.9% of its airlines, the European Community limits non-EC ownership to 49%, precluding any ownership and effective control by foreign nationals of EC airlines, let alone any foreign takeover and merger. Given this, it appears inconsistent and unreasonable for the EC to demand, $vis-{\grave{a}}-vis$ a non-EC third State, national treatment for all of its Member States. The ECJ's decision was also wrongly premised on the precedence of Community laws over international law, and in particular, international air law. It simply is another form of asserting and enforcing de facto extraterritorial application of Community laws to a non-EC third country. Again, the ruling runs counter to an established rule of international law that a treaty does not, as a matter of principle, create either obligations or rights for a third State. Aside from the legal problems, the 'national treatment' may not be economically justified either, in light of the free-rider problem and resulting externalities or inefficiency. On the strength of international law and economics, therefore, airlines of Community Members other than the designated German and U.S. air carriers are neither eligible for traffic rights, nor entitled to operate between or 'free-ride' on the U.S. and German points. All in all and in all fairness, the European Court's ruling was nothing short of an outright condemnation of established rules and principles of international law and international air law. Nor is the national treatment requirement justified by the economic logic of deregulation or liberalization of aviation markets. Nor has the requirement much to do with fair competition and increased efficiency.
