In relation to the determination of the appropriate choice of law in most of the maritime law issues, 'the law of the flag' or 'the law of the ship's nationality' is commonly used to apply to several provisions which is imposed in Korean Private International Law. But the theory of the law of the flag or ship's nationality suffers from serious problems in case of flag of convenience which is a flag flown by a vessel registered in one state, with which the vessel has few or no connections, while in reality the vessel is owned in or operated from another state. In this case, the article 8 of Korean Private International Law which stipulates the Exception of Choice of Law Clause can be applied to this matter, and thus it is essential to consider many factors which can be used in determining the applicable law through the most significant relationship or genuine link theory.
The purpose of this study is to develop a marital enhancement program based on reality therapy. The program consists of 8 session contents: program orientation, need strength profile between husband and wife, quality world and marital life, perception about marital life, comparison between quality world and perceived world, total behavior in marital life, communication between husband and wife, integration and application. This study mainly focuses on applying counseling theory (choice theory and reality therapy) to family life education for enhancing a conjugal relationship. In this way, participants of Marital Enhancement Program can experience a therapeutic effect as well as an educational effect.
Compliance with information security policies has been an important managerial concern in organizations. Unlike traditional general deterrent theory, this study proposes whistle-blowing as an alternative approach for reducing internal information security policy violations. We build on the theories of planned behavior and rational choice as well as develop a theoretical model to understand the factors that influence whistle-blowing attitudes and intention at both the organizational and individual levels. Our empirical results reveal that altruistic and egoistic concerns are involved in the development of whistle-blowing attitudes. The results not only extend our understanding of whistle-blowing motivation but also offer directions to managers in promoting internal disclosure of information security breaches.
The purpose of this study is to derive the factors for the general consumers to choose the store to buy seafood. Survey on 414 general consumers by questionnaires was conducted to find out the factors for them to choose the stores in the traditional market and large supermarket, and through the analysis on the results the factors for general consumers to choose large supermarkets were derived when they buy seafood and at the same time the degree of its importance was analyzed. The results of the survey showed that the general consumers chose large supermarkets to buy seafood despite the fact that they recognized the seafood prices are lower in the traditional markets than in the large supermarkets. Particularly, the results of analyzing the sixteen criteria for choosing the store in which to buy seafood were grouped into four: the 'assortment of goods and high quality', 'service', 'price and promotion' and 'convenient accessibility.' The results of examining the order of priority based on the four factors showed that the 'assortment of diverse seafood and high quality' was found to be given the first priority, followed by 'convenient accessibility' and 'prices and promotion factors', with 'service' being statistically insignificant. Based on these results, Monroe (1975)'s consumers' store choice process is summarized as follows. Before buying seafood, the consumers who use large supermarkets have the desire for buying seafood and then judge the properties of the store which they will use. In this process, consumers were satisfying their needs in large supermarkets in the criteria of 'assortment of diverse seafood and high quality', convenient accessibility', and 'prices and promotion factors' which were found to be statistically significant in this research. Accordingly, the general consumers choose to buy seafood in large supermarkets rather than in the traditional markets. The general consumers were more satisfied with using large supermarkets than using traditional markets, so after they have initially bought seafood in the large supermarkets, they habitually buy seafood in the large supermarkets without going through Monroe (1975)'s 'eight stage process for the store choice.' When such habitual store choice behavior continues for a long time, it results in becoming structural.
This paper suggested an approach to characterize travel choice behaviors using the implicit price instead of the indirect utility. The choice criterion to compare the implicit prices of available trip options was developed from the utility maximization problem of a trip maker which is supposed to choose the best option from the available ones differentiated by only by the quantitative attributes such as travel cost and time but also by qualitative attributes such as comfort and safety. The utility maximization problem is constructed under household production theory, and is incorporated with a special kind of joint homogeneous production functions. The implicit price of a certain trip option is the sum of the monetary price and the multiple of travel time and the value-of-travel-time, and the value-of-travel-time refers to the portion of wage, which can be assignable to the trip-making activity. This choice criterion is statistically identifiable, and behaviorally plausible. Moreover, this criterion has the expression simpler than the indirect utility, and therefore could be an effective target of the statistical estimation for travel choice behaviors.
The multinomial logit model, based on random utility maximization (RUM) theory, has been the predominant model used in travel mode choice contexts. In this paper, the travel mode choice model based on random regret minimization (RRM) theory is proposed as an alternative to the RUM model, and the applicability of the RRM model is examined. The presented model is applied to the case of inter-city travel mode choice in Korea. The empirical results show that the RUM model and RRM model have parameters that are consistent with the intuition. The goodness of fit statistics in the RRM model improved compared with the results of the RUM model. Consequently, these results show the possibility of using the RRM model in the context of travel mode choice.
In this paper I will undertake three tasks: first, to identify the difference between John Rawls's liberal conception of liberty and Will Kymlicka's; second, to briefly examine the problems with liberal conception of liberty; finally, to propose a certain alternative that will be able to make liberal conception of liberty more meaningful In Kymlicka's view, Rawls seems to fail to make the best defence of freedom of choice because he wants to explain of individual freedom on the basis of Kant's moral theory about liberty. Kymlicka thinks that it is not a desirable way of defending liberal conception of liberty. According to his liberal theory, Rawls's defence of freedom of choice might make us think that we should have our freedom of choice for its own sake because freedom is the most valuable in the world. So Kymlicka wants to provide stronger argument to defend freedom of choice in liberalism. He insists that it is our projects and tasks that are most important things in our lives. Furthermore, he argues that we should conceive our freedom of choice as a precondition for pursuing those projects and practices that are valued for our good lives. Now I want to look at two concepts of liberty in liberalism with Rawls's theory and Kymlicaka's. In this paper, I shall look at criticisms of the liberal account of freedom of choice. These would give us a certain chance for understanding true freedom.
Economic sanctions and inducements are types of 'policy instruments' based on 'economic tools' to influence other international actors. Ongoing debates on sanctions and inducements have exposed drawbacks for relying on individual case studies. There are some studies in the literature that attempt theoretical analysis of sanctions and inducements, but they are mostly based on rational choice theory. In reality, however, there exist so many cases that cannot be explained by rational choice theory. These are called anomalies or exceptions. The literature introduces specific variables to interpret these anomalies and thus sacrifice the universality of the theory. From this point of view, prospect theory would present an effective tool to analyze economic sanctions and inducements. It is a behavioral economic theory that tries to model a decisions making process in reality. The theory says that people make decisions based on subjective value of losses and gains from an individual reference point, and that people evaluate these losses and gains using heuristics. Thus prospect theory could offer a different frame which has greater explanatory range without adding new variables. As a result of this study, target's losses of 'back down' towards economic sanctions loom larger when the reference point level increases, therefore, the effectiveness of sanctions decreases. However, target's losses of 'stand firm' towards economic inducements loom larger under the same condition of reference point, therefore, the effectiveness of inducements increases. The findings of the paper suggest meaningful implications to the economic policy towards North Korea.
For the past several years, performance assessment has been widely used by mathematics teachers. The superiority of performance assessment items compare to multiple choice items has been discussed by many researchers, however these discussions tend to be lack of empirical data. Thus, this study aims to examine the effectiveness of tree response items in comparison with multiple choice items. Using the information function in Item Response Theory(IRT), item information of free response items and multiple choice items from the Third International Mathematics and Science Study-Repeat(TIMSS-R) were obtained and compared. Test informations of the whole mathematics area as well as each content area of mathematics were computed. On average, tree response items yielded more information than multiple choice items, especially in measurement and data interpretation. This study also revealed that free response items estimated students' mathematics ability more accurately than multiple choice items with smaller number of items.
Purpose - Based on the funding-horizon theory, this study aims to test the effects of cash needs and the persistence of external funding needs on firms' external financing. Design/methodology/approach - Financial data of Korean listed companies were collected from DataGuide. Immediate and near-term cash shortfalls are defined using the methodology of Haung and Ritter (2021). We estimate multinomial logit regressions for the financing choice. Findings - First, all three cash depletion variables used in our study increase the likelihood of external financing. Second, firms prefer to issue debt to meet immediate spending and equity to meet long-lived cash needs. Third, this effect is more pronounced for high R&D firms. Fourth, chaebol firms with internal capital markets defer raising external capital for immediate and near-term cash needs. Research implications or Originality - This paper provide empirical evidence that immediate and near-term cash needs induce external financing, and the persistence of cash needs affects the choice between debt and equity, the finding which is consistent with the funding-horizon theory of financing decisions. Being the first paper to test the funding-horizon theory using Korean data, this paper contributes to the literature on the capital structure of Korean firms.
