A Study on the Liability for the loss of deck cargo under a time charter - Focused on the decision in the Socol 3 - (정기용선계약에서 갑판적재화물 손해에 대한 책임에 관한 연구 - Socol 3호 판결을 중심으로 -)

  • It could be debated that the owners were indemnified from the charterers even in respect of the loss of deck cargo caused by the negligence on the part of the owners' servants by a clause 13(b) of NYPE(1993) form, where NYPE(1993) incorporated the Hague/Visby Rules by a paramount clause and did not contained an on deck statement to state or identify what or how much deck cargo was being carried, however the relevant bills of lading all had such statement. The socol 3 of U.K. is a very helpful decision on (1) an on deck statement in bill of lading was sufficient to exclude application of the Hague/Visby Rules to the carriage of deck cargo, as a result, the clause 13(b) should not be null and void by the clause 3(8) of the Hague/Visby Rules (3) the clause 13(b) could not protect the owners from the loss and/or liability caused by negligence and/or breach of the obligation of seaworthiness on the part of the owners, their servants and agents. Therefore, the purpose of this study is to critically analyze the decision in the socol 3, and provide the decision's practical implications in order to prevent legal disputes as to the on deck carriage between the owners and the charterters.

  • Transportation in the logistics, many business organizations are engaged in monitoring and tracking the vehicles in order to improve logistics services, reduce expenses and secure security in cargo transportation. It is saving time and money by tracking and monitoring vehicles which transport cargo in supply chain of logistics. Therefore the main issue of delivery flow is to improve services, and ensure the safety in transportation system. This article suggests the tracking and monitoring model to keep safety transports on ICT network. It focuses on precise delivery control by monitoring and tracking vehicles to save time and costs. The status of product movement is analyzed for proper decision making. The vehicle embedded with RFID is automatically tracked in the movement process by tracking and monitoring model. The main role keeps safety tracking to reduce costs and to deliver products at proper time and location.

Evaluating Level of Quality for the Skyteam Cargo Services (스카이팀 카고의 서비스 품질에 대한 평가)

  • This research explores the relative importance of factors and service items that influence the air cargo service quality for provision services by the Skyteam Cargo in the Korean market. In general, the Skyteam Cargo provides a package of services which are different functions and operations of service such item as Equation Heavy (heavy and large express freight), Equation (small express freight), Variation (special freight), and Dimension (general freight). To carry out the research, the expert questionnaire survey, the Analytic Hierarchy Process (AHP) analysis had adopted to evaluate the level of quality for the provision air cargo operation services by the Skyteam Cargo at Incheon International Airport. Based on an expert survey and the AHP, five core service factors, namely, infrastructure as installed facilities, reliability, promptness, efficiency, and safety are defined.

On the New Design of Liquid Dome Chair in Membrane Type LNG Carrier (멤브레인형 LNG선박의 리퀴드 돔 체어 구조개발)

  • A membrane type LNG cargo tank is equipped with a pump tower and a liquid dome for loading and unloading of LNG. However, the membrane running continuously on the tank wall to prevent leakage of LNG is interrupted by the liquid dome, hence care should be taken in the design of liquid dome and its substructures. In case of GTT NO96 membrane type cargo containment system, chair structure is arranged along the periphery of the liquid dome targeting to support the membrane which is exposed to the both hull girder and thermal load. This paper proposes a new and simple chair structure, which outperforms traditional design from productivity point of view maintaining same level of structural safety. Strength assessment on the new design was performed to guarantee the structural safety of the new design, which includes strength, fatigue and crack propagation analysis.

  • As arctic energy resource is attracting public attention, arctic shipping market will also be growing in large as expected to increase in LNG trade from Arctic area to the western countries by shipping. During the voyages through such routes, collision with icebergs may be possible. In the present report, ice collision analyses are carried out from a practical point of view to verify the safety of hull structural strength of LNG carriers equipped with GTT $MKIII^{TM}$ membrane type cargo containment system. From the results of collision analyses and the operation-friendly design concept of no-repairing of cargo containment system, a safe operating envelope against ice collision is proposed for LNG carriers of membrane type cargo containment system. Based on the currently proposed safety criteria, it is concluded that LNG carriers with membrane tank type can operate safely with regard to the integrity of CCS in regions where collision between LNG carrier and iceberg is expected.

A Study on the Stability Criteria of Small Vessels (소형선박의 복원성기준 연구)

  • In order to ensure safety of small vessels, the amended Ship Safety Act will come into force on 4th. Nov. 2007. This study is performed to suggest the stability criteria of fishing vessels and cargo ships of 12m in length and over but less than 24m in length which will be new object of amended Ship Safety Act. We have analyze the dimensions of domestic small vessels and the casualty reports of capsizing accidents. According to the analyzed result, 58 ships that are in the range of the dimension are modeled and the stability calculation has been carried out. The Stability for the 58 ships has been analyzed by comparing the result that applied the selected standard in the national standard to the stability calculation. Based on the regression analysis of the model ship's allowable transverse metacentric-heights under several stability requirements, stability criteria for small fishing vessels and cargo ships are proposed.

  • With the recent increase in the volume of liquid cargo transportation, there is a need for STS( Ship To Ship) globally. In the case of the STS mooring, the safety assessment should be conducted according to other criteria because mooring is different from the general mooring at the quay, but there is no separate standard in Korea. Thus in this study, STS mooring simulation and sensitivity analysis using OPTIMOOR program, the numerical analysis program, was conducted to identify the characteristics of the STS mooring. The target sea modeled the Yeosu port anchorage in Korea and the target ship was selected as the case of VLCC (Very Large Crude Oil Carrier)-VLCC. Through the numerical simulation and sensitivity analysis, the characteristics of STS mooring were identified. Also based on these results, we focused on establishing the standard for STS mooring safety assessment. Numerical simulation results show that the STS mooring safety can be changed according to a ship's cargo loading condition, pre-tension of mooring line, sea depth, encounter angle with the weather, and the weather condition. Additionally, the risk matrix is prepared to establish the safe external force range in the corresponding sea area. This result can be used to understand the mooring characteristics of STS and contribute to the revision of mooring safety assessment criteria.

A Study on the Improvement of the Maritime Safety Supervisor System for the Reinforcement of Coastal Ship Safety Control (내항선 안전관리강화를 위한 해사안전감독관 제도 개선 연구)

  • The biggest change in the field of coastal ship safety control since the accident of passenger ship Sewol has been the introduction of the maritime safety supervisor system. With its introduction, the safety control system in coastal passenger ships was changed from consisting of operation managers and marine police to operation managers and a newly-introduced maritime safety supervisor. The safety control system for coastal cargo ships was also converted from relying on ship inspection officers to having a maritime safety supervisor and ship inspection officers. However some negative elements have surfaced due to confusion related to the scope of work in the coastal cargo shipping field. These have been caused by dividing the supervisory agency, a lack of work continuity given non-permanent public official status, low supervisor qualifications overlooking reality, and limitations of the order for improvement to secure seaworthiness. It is essential that the maritime safety supervisor system be solidified to reinforce coastal ship safety control. Therefore, systematic safety control in the coastal cargo shipping industry should be conducted by a single, integrated government agency, and the area covered by the order for improvement to secure seaworthiness should be extended. Also limitations of the supervisor recruitment system due to non-permanent public official status should be simultaneously improved. In addition, it is necessary to upgrade supervisor qualifications to require experience with surveyors of international class, ship captains, and chief engineers.
